    Opis:
    Free Movement of People offers new opportunities for European Union citizens migrating into the single market. This does however, bring controversy and public debates. This paper’s focus is placed on the “Polish plumber” case – a symbol of social dumping. We study the European Union effects on the self-employment practices through the experience of Polish immigrants employed in low-skilled occupation in France. First, the reasons for setting up in France and the differences between labour conditions before and after the opening of the French labour market to Polish Immigrants are examined. The paper then discusses the self-employment career trajectories of Polish workers in France. Finally, we examine the impact that the Free Movement of Workers has on low-skilled occupations and the immigrants’ adaptation and integration into host society.

    On July 22, 2011, Spain suspended the application of freedom of movement for workers within the European Union with regard to certain categories of Romanian workers in all sectors and regions, grounding its decision in the difficult economic situation, high level of unemployment and approaching season in the agricultural sector, therein Romanian citizens were undertaking an employment. European Commission in the decision of August 11, 2011, did not consider the decision of Spain as unjustified. As a result of the decision, the discriminatory treatment of the Romanian citizens was maintained till the end of 2013. The correctness of the decision was not deeply examined on the ground of both the Polish and international legal writing. The aim of the paper is to examine the correctness of the decision of the European Commission of 11 August 2011, No. 2011/503 and to cover the gap in the legal discourse provided both on the international and domestic level. In the paper Author presents the essence of the free movement of workers and describes exceptions to this rule, with particular emphasis on exceptions established directly in the treaties of accession, having regard the exception in which the decision of Spain was grounded. In such a context Author casts doubts on the correctness of the decision of European Commission, which did not consider the restrictions as being contrary to the European law and formulates a thesis on excessive and unjustified character of restrictions implemented by the Government of Spain. Adopted methodology consists in the analysis of the case law of the European Court of Justice, legal acts, reports of the European Commission, international and domestic literature, with particular reference to the international scientific journals.

    The article is based on the legal report on the application of free movement of workers and social security coordination rules by national courts, prepared by MoveS (network of legal experts) in 2019 for the European Commission. It is the first European publication on issues dealt with by national courts in the field of freedom of movement of workers and coordination of social security. The report highlights common definition and conceptual problems, but also takes into account the diversity of these issues in EU Member States.
    Artykuł został przygotowany na podstawie raportu prawnego dotyczącego stosowania zasad swobodnego przepływu pracowników i koordynacji systemów zabezpieczenia społecznego przez sądy krajowe w krajach członkowski Unii Europejskiej, opracowanego w projekcie MoveS w 2019 r. dla Komisji Europejskiej (Legal report 2019. The application of free movement of workers and social security coordination rules by national courts). Jest to pierwsza publikacja dotycząca tego, jakie zagadnienia z zakresu swobody przepływu pracowników i koordynacji systemów zabezpieczenia społecznego stają do orzekania przed sądami krajowymi na tle stosowania przepisów unijnych. Zagadnienia te pokazują wiele wspólnych problemów definicyjnych i pojęciowych, ale także uwzględniają różnorodność tych spraw w poszczególnych państwach członkowskich UE.

    Opis:
    The purpose of the article is to indicate the need to popularize knowledge in Poland about the coordination of retirement pensions in the EU and to present good practices for disseminating knowledge about coordination in selected countries covered by the coordination regulation. The following research hypothesis has been presented: the level of Poles’ knowledge about the coordination of retirement pensions in the European Union is low. The author’s own research was carried out based on the quantitative CAWI (Computer-Assisted Web Interviewing) method. The research included a survey sample with a total of 1,000 respondents. The nationwide survey was carried out among the Polish working population. The author's own research focuses precisely on the international aspect of pensions coordination. The research confirmed the low level of Poles' knowledge about coordination. Poles do not know whether Polish workers migrating within the European labour market can benefit from EU regulations that make it easier to receive a pension and retirement benefits, or whether the social insurance contribution periods for work performed abroad count when determining the right to receive Polish retirement benefits. The article presents good practices for disseminating knowledge about coordination in selected EU countries – Austria, Belgium, Bulgaria, Denmark, Finland, Spain, Ireland, Germany, Switzerland and the United Kingdom, as a basis for creating recommendations for Poland.
    Celem artykułu jest wskazanie na potrzebę popularyzacji wiedzy w Polsce na temat koordynacji emerytur w UE oraz przedstawienie dobrych praktyk upowszechniania wiedzy o koordynacji w wybranych państwach objętych rozporządzeniem koordynacyjnym. Postawiono następującą hipotezę badawczą: Poziom wiedzy Polacy na temat koordynacji emerytur w Unii Europejskiej jest niski. Badanie własne zrealizowano, wykorzystując ilościową metodę CAWI (Computer-Assisted Web Interviewing). Badaniem została objęta próba badawcza licząca łącznie 1000 respondentów. Pomiar realizowany był wśród ogólnopolskiej populacji osób pracujących. Badania własne autorki koncentrują się na międzynarodowym aspekcie emerytur – koordynacji. Badanie pozwoliło na potwierdzenie niskiego poziomu wiedzy Polaków na temat koordynacji. Polacy nie wiedzą, czy polscy pracownicy migrujący wewnątrz europejskiego rynku pracy mogą korzystać z regulacji unijnych, które ułatwiają uzyskanie emerytury oraz czy okresy składowe z tytułu pracy wykonywanej za granicą liczą się przy ustalaniu prawa do polskiego świadczenia. W artykule przedstawiono również dobre praktyki popularyzacji wiedzy o koordynacji w wybranych państwach UE – Austrii, Belgii, Bułgarii, Dani, Finlandii, Hiszpanii, Irlandii, Niemczech, Szwajcarii i Wielkiej Brytanii, tworząc tym samym rekomendacje dla Polski.
