Opis:
The article describes the results of Libet’s experiment and its resulting critique, as witnessed by the articles published between 2000 and 2012. As a result of his experiments, Libet concluded that conscious intentions of making a movement are preceded by brain activity registered as the readiness potentials (RP). In this interpretation, free will does not initiate the decision of making a move but is however capable of stopping this process. For this reason, Libet does not conclude that will is determined by biological processes. The resulting discussion in the literature concerns mainly methodology and conclusions drawn by Libet. The methodological points raised include an argument against the use of EEG as an accurate research tool and criticism of the method of timing the occurrence of the conscious intention of making a move. We note that subsequent modifications made to the original experiment, did however allow putting some of the methodological doubts to rest. On the other hand, the critique of Libet’s conclusions focuses on the problematic nature of correlation of physical movements with the readiness potentials. The most recent research also shows that the potentials might have a more complicated origin than previously thought. Libet’s interpretation is also criticised for its vagueness in defining intention and for not distinguishing it from wishes and desires. The last part of our article summarises the latest state of affairs as emerging from the analysis. We point out the difficulties in correlating potentials with movement, their interpretation and difficulties with the notion of veto, since it seems to require that contradictory intentions of making and refraining from a movement are present simultaneously. The article concludes that on the basis of the current research, the thesis about a biological determination of voluntary processes lacks a sound justification.

Numerous problems that emerge in the process of project management can be presented as multi-criteria issues and solved with the help of appropriate methods. The contracting authority, selecting one tender out of many available tenders, assesses them, taking into account various criteria, e.g. price, expected execution time and the contractor’s experience. The owner of a company intending to purchase the fixed assets requisite for the realization of the project behaves similarly, i.e. the most advantageous model of the device is chosen, taking into account not only its price but also production capacity, energy intensity, noise emission, service availability, etc. From among many concepts, the investor has to choose a solution which frequently constitutes a compromise between price, functional properties, durability and aesthetics of performance, as well as safety of the utilization and impact on the environment. The choice of an investment location depends not only on the market, financial and supply factors, but also on so called soft factors such as the perceived quality of institutions and the attitude of local communities. All such situations can be described in the same way: taking into account preferences of the decision maker, the best possible choice must be made out of a finite set of alternatives evaluated according to a finite set of criteria. There are many different methods that can be used to aid a decision maker in this choice, including, but not limited to, techniques based on the outranking relation, verbal decision analysis and the MACBETH method. In this article, they will be compared and their applicability to different types of decision making problems will be considered. Furthermore, the PROMETHEE II method with a veto threshold will be presented within the text. Because the application of project management in the wedding planning business has gained wide popularity, as an illustrative example an empirical study of selecting the best venue for a wedding reception will be elaborated.

Opis:
The system of protection of persons close to the deceased in contemporary succession law is one of the major dilemmas. This is because the rights of those close to the deceased interfere with one of the most valuable values developed in succession law over the years: the freedom to dispose of property upon death. Any new solution from a particular country that addresses this issue may prove interesting for the ongoing development of substantive law in individual countries. For this reason, the author presents the new Polish solutions, which have been in force since 22 May 2023 and which change the Polish legitim system fundamentally. The aim of the article is to first assess the changes introduced and to present them to the foreign reader.

Although the current Constitution of 1978 does not include the right to a legislative veto among royal prerogatives, this institution has a rich tradition in Spanish constitutionalism. In the 19th century, despite the clash between conservative and liberal ideas, the King almost continuously had the right to refuse to sanction law projects. Only the political changes of the 20th century finally deprived the monarch of the right to intervene in the legislative process. However, under the current Constitution, all laws must be sanctioned by the King, which often causes political and legal controversy.
Choć obecna Konstytucja z 1978 r. nie przewiduje wśród prerogatyw królewskich prawa do weta legislacyjnego, instytucja ta posiada bogatą tradycję w hiszpańskim konstytucjonalizmie. W XIX w. pomimo ścierania się ze sobą idei konserwatywnych i liberalnych, Król niemal nieprzerwanie posiadał prawo do odmowy sankcjonowania projektów ustaw. Dopiero zmiany ustrojowe XX w. pozbawiły ostatecznie monarchę prawa do ingerencji w proces legislacyjny. Jednakże pod rządami obecnej Konstytucji wszystkie ustawy muszą być obligatoryjnie sankcjonowane przez Króla, co nierzadko wywołuje polityczne i prawne kontrowersje.

When in 1719 Augustus II of Poland made an attempt to emancipate himself from the influence of the Russian emperor, the latter entered into alliance with the Prussian king, with the intent of preventing emancipation of the monarch and his country. The alliance concluded by Tsar Peter the Great with King Frederick William I of Prussia expressed the substantial interests of both monarchies. It was all about keeping watchful oversight of political and military weakness of the Polish-Lithuanian Commonwealth and rendering the country isolated in the international arena. The programme established by Petersburg and Berlin remained valid until the end of the eighteenth century and the final, third, partition of Poland. The monarchs guaranteed that they would do everything possible to prevent the Polish constitutional system from altering (keeping the king’s rights restrained against the liberties maintained – primarily the liberum veto and free election of monarch), and treasury and military reforms from implementing. The preponderance over the Commonwealth implied the participation of Russia in what is termed the concert of the European powers. For the country of the Hohenzollerns, the debilitation of the nobility-based republic was, in turn, an opportunity for increasing the its territory, which had been policy energetically pursued since the Great Elector Frederick William’s reign (1640–88). For these reasons, the whole series of Russo-Prussian alliance treaties (1726, 1729, 1740, 1743, 1764, 1769, and 1772) comprised provisions regarding Polish affairs. The range of the issues covered by these bipartite agreements was ever-broadening, extending to the dissenters’ affair, among other things. Other reasons stood behind the inclusion of clauses related to the Commonwealth in Russian-Austrian treaties. Of substantial importance was the antagonism prevalent in the Reich between Austria and Prussia, which from 1740 onwards turned into acrimonious hostility. The Viennese Burg, which solicited favour from Petersburg, endeavoured to persuade its Russian ally that it was ready and willing to replace the Prussian partner in Poland-related matters of importance to Russia (cf. the treaties of 1726, 1730, 1733, 1746). Discussed is also a never-ratified tripartite agreement of 1732 – the so-called Löwenwolde’s treaty – which was momentous for the designs of the contracting parties, as well as the partition treaties of 1772.

Opis:
When a company decides to enter overseas markets, it must take a number of strategic decisions, such as, for instance, a decision on the appropriate entry mode. The company has a wide array of choices: various forms of exporting, contractual modes such as licensing, franchising and management contracts, turnkey projects and subcontracting or equity-based modes including wholly-owned subsidiary or joint venture. The various entry modes differ greatly in resource commitment, degree of risk, level of control or profit potential. The appropriate choice of entry mode is a key element of the success of foreign operations and the future of the company. Hence, it is essential for the company to conduct a deliberate and conscious analysis of advantages and disadvantages of each entry mode from the point of view of internal and external factors that influence the choice of entry mode, taking into account the opinion of different participants of the decision- making process. The aim of this paper is to carry out the simulation of the entry mode selection, using MCDA methods and stochastic dominance (SD) rules, from the perspective of a dynamically developing company that manufactures and distributes hygiene, cosmetic and medical products for women, children and adults.
