    The Act on Higher Education and Science of 2018 considerably restricts the internal autonomy of universities. Management is vested in rectors and university boards while neglecting the role of faculties, which, if established in the first place, have been reduced to entities of no significance. The rector, as the exclusive managerial body of an institution, and the university board, representing mainly external stakeholders, as a body supervising its economy, have been vested with such an ex-tensive authority that this may result in hindering the development of multiple academic disciplines, especially those in the area of the humanities, but also in the field of social studies in many cases.

    This text summarises the results of extensive research into the relationship between the state and universities in 1849–1939, i.e. between the so-called ‘Thun reform’ and the closure of Czech universities by the Nazis. The focus is on the state’s respect for the privileged position of universities and the monitoring of tensions arising from the clash between legislation and the universities’ day-to-day operations, resulting mainly from satisfying the economic needs of universities on the one hand, and the interpretation of the responsibility and discipline of their academic staff towards the state and society on the other. The research shows the advancing erosion of the so-called Prussian (Humboldt’s) concept of an autonomous national-oriented university and the difficult search for a democratic alternative in interwar Central Europe’s unstable political and economic conditions.

    Within the context of logic-systemic analyses of philosophical discourse of “university ideas and missions” H. Gadamer, I. Haydegger, V. Humboldt, J. Derrida, M. Quek, W. Lepenies, J. Newman, J. Ortega y Gasset, J. Habermas, F. Schleiermaher, K. Jaspers) the way of university autonomy and academic liberties formation and development has been substantiated. Their gist becomes evident in the open intellectual environment, personal self-expression, immunity against political dictatorship, the possibility of regulating relations between the state and the market, the existence of a self-regulating corporation of students and professors, subjective interaction between “instructor – student”, student-centered principle of educational and scientific process, that in the long run ensures university the appropriate status, its corporate culture, causes the free search of scientific truth.
    W kontekście logiczno-systemowych analiz filozoficznego dyskursu „idei i misji uniwersyteckich” (H. Gadamer, I. Haydegger, V. Humboldt, J. Derrida, M. Kuek, W. Lepenies, J. Newman, J. Ortega y Gasset, J. Habermas, F. Schleiermaher, K. Jaspers) przedstawiono sposób powstawania i rozwoju autonomii uniwersytetów i swobód akademickich. Ich istota uwidacznia się w otwartym środowisku intelektualnym, osobistej ekspresji, odporności na dyktaturę polityczną, możliwości regulacji stosunków między państwem a rynkiem, istnienia samoregulującej się korporacji studentów i profesorów, subiektywnej interakcji „mistrz– uczeń”, koncentrowanej na zasadzie procesu edukacyjnego i naukowego, która w perspektywie długoterminowej zapewnia uczelni odpowiedni status, kulturę korporacyjną i umożliwia swobodne poszukiwanie prawdy naukowej.

    The article discusses the issue of the possibility of regulating matters concerning higher education and its institutions in executive and internal acts. It presents the acceptable limits of delegating matters relating to higher education to regulations, as well as internal acts of higher education institutions. These limits are described taking into account the principle of autonomy of higher education institutions, as well as the rules on the creation of law, in particular the rules for issuing regulations. It was also pointed out that the incorrect division of matter between act of parliament (statute) and a regulation violates constitutional rules of law creation. It is also contrary to the protection of entities’ trust in the state and law and the principle of division and balance of power. Faulty formation of the higher education system is not good to the quality of education and conducting scientific research. It hinders the implementation of the freedom of science.

    Jednym z przejawów autonomii szkół wyższych jest działalność uchwałodawcza organów kolegialnych uczelni. Akty (uchwały) tych organów nie figurują jednak w konstytucyjnym systemie źródeł prawa, natomiast stanowią źródło wewnętrznego prawa administracyjnego. Ich konstrukcja oparta jest na zasadach techniki prawodawczej, przez co powinny być one właściwie zredagowane oraz nie wykazywać sprzeczności z aktami o charakterze powszechnie obowiązującym. Adresatami uchwał organów kolegialnych szkoły wyższej są przede wszystkim użytkownicy zakładu administracyjnego (uczelni), zatem uchwały te są jedną z form realizacji władztwa zakładowego. Podlegają nadzorowi weryfikacyjnemu ze skutkiem w postaci stwierdzenia ich nieważności. Zastosowanie takiej sankcji jest następstwem naruszenia prawa bądź statutu szkoły wyższej przez uchwałę rady wydziału lub senatu uczelni. Nie jest to jednak sankcja definitywna, albowiem akt nadzoru nad działalnością uchwałodawczą organów kolegialnych szkół wyższych podlega kontroli sądu administracyjnego w trybie skargi. Skarga taka stanowi emanację autonomii szkoły wyższej. W ostateczności więc, to sąd administracyjny może decydować zarówno o legalności uchwały organu kolegialnego uczelni, jak i o legalności aktu nadzoru nad tą uchwałą. 
    One of the manifestations of the autonomy of an academy is the activity of issuing resolutions by proper academy collegial bodies. Although acts (resolutions) of these bodies are not included in the constitutional system of sources of law, they are a source of internal administrative law. Their construction is based on the principles of legislative technique, hence should be properly edited and conform with the acts of general application. Academy is the primarily recipient of these resolutions qua users of an administrative facility and, therefore, resolutions posit a form of an implementation of the rulership. This sort of legislation comes under supervision with the possible effect of the annulment thereof. The use of such a penalty is a result of violations of the law or the statute of the university by a resolution of the faculty council or the senate. Yet this is not a definite penalty because the supervision of legislation comes under the control of the administrative court by means of complaint. Such a complaint is derived from the autonomy of an academy. Eventually, it is the administrative court that can decide both about the legality of the resolution of a collegial body and the supervision of the legality of that resolution.     Autonomia szkół wyższych, zwłaszcza w jej wymiarze terytorialnym, w pewnym zakresie ogranicza interwencje służb odpowiedzialnych za zapewnianie bezpieczeństwa i porządku publicznego. Wynika to z przepisów Prawa o szkolnictwie wyższym, które ograniczają taką ich aktywność. Stoi to w pewnej opozycji do realnych potrzeb działalności analizowanych służb, a w konsekwencji regulacje prawne w tym zakresie powinny być zmienione, aby bez wpływania na autonomię uczelni, zwiększyć pole wymaganych interwencji.
    The autonomy of institutions of higher education, especially in its territorial aspect, to some extent limits intervention of services responsible for ensuring security and public order. This results from the provisions of the Law on higher education which limit the services’ activity. It is in conflict with the real need for such activities performed by those services and, as a consequence, legal regulations in this area should be changed so that, without affecting university autonomy, it would be possible to extend the sphere of required intervention.

    In this article we present a comparative case study of two master courses in mathematics organised respectively by a university in the UK and in Germany. The two cases are analysed in terms of the aspects of Autonomy, Mastery and Purpose which are related to the self-determination theory of Deci and Ryan and its concept of autonomous motivation. We reveal the differences between the two universities and consider their influence on the students behaviour and performance. Stronger features of Autonomy, Mastery and Purpose coincide with positive effects, which is in accordance with the predictions of self-determination theory. We propose Autonomy, Mastery and Purpose as a basis for establishing good practice in university teaching and make some suggestions for practical implementation.
