Opis:
This article analyses the admissibility of evidence gathered by the Polish procedural authorities as a  result of issuing an European Investigation Order, on the basis of provisions implemented due to the adoption on the 3th of April 2014 of the Directive of the European Parliament and of the Council regarding the European Investigation Order in criminal matters. This Directive created a mechanism that allows for transfer of evidence between EU Member States. In this text the question will be answered how to deal with results of investigative measures that have been legally obtained in the executing state but despite acting in accordance with the legality principle by both states, happen to be illegal in the issuing Member State. Another discussed problem is how the rules of admissibility of evidence obtained from the result of issuing an EIO work in Poland – or at least how they should operate. The second discussed issue thus will refer to the current provisions in force in Poland regulating the method of dealing with evidence obtained abroad – that is also with evidence transferred from other Member States. It will be shown that they are unclear and may lead to undesirable results. In addition,  suggested changes in Polish law will be proposed.

Opis:
To sum up, it should be stated that the concept of efficiency should be understood as a quick, effective and rational operation of the participants in the proceedings, taking into account the principles of efficiency and savings of financial resources. The length of proceedings is one of the most acute problems not only of criminal law, but also of the administration of justice in general. The first and foremost reason for such a classification is that the excessive length of proceedings prevents a fair hearing, since it does not respect the constitutional right to have a case heard without undue delay. Secondly, long proceedings generate high costs, an issue particularly important when these costs are borne by the State Treasury and thus not by the convict whose culpable behavior has caused them to arise. The issues of efficiency of criminal proceedings and their costs are inextricably linked. Furthermore, it establishes that the efficiency of criminal proceedings determines the level of generated costs. The research shows that the quality of the proceeded cases depends on the financial outlays and that the costs indicated by the procedural authorities do not correspond with those actually incurred. In conclusion, it should be pointed out that financial aspects fall within the scope of the regulatory impact assessment and constitute a priority when implementing new legal provisions, in direct relation to the economic analysis of law and the efficiency and costs of ongoing proceedings.

Stairways are, in general, a thoroughly studied subject, but there is almost no scientific data available about spiral stairs. They are, however, widely used in homes, industrial sites and public buildings. The purpose of this study was to determine preferred handrail heights for a spiral stairway. The most preferred handrail height for descent was 105 cm. On the other hand, 95% of the participants regarded handrail heights between 95 and 100 cm satisfactory for descending. Participants’ anthropometric data was combined with the handrail height preference to develop a draft of a model to predict preferred handrail height for other user populations.

It is quite paradoxical that such a negative social phenomenon as the ever-present threat of the SARS-CoV-2 virus and its mutations has contributed to the exceptional acceleration of the widespread adoption of the institution of remote hearings in the area of civil trials in our country. Traditional hearings are no longer the only possible format of public hearing in the form of a trial. We are now witnessing a new quality in the way in which civil cases are heard. Most importantly, the nature of the court’s communication with the parties and other participants of such proceedings has changed significantly in the broad sense due to the remote nature of the hearings. At present, the venue where a court gets to hear the parties to proceedings is not only the courtroom in a court building, but also cyberspace. Thus, the landscape and the structure of civil trials have changed considerably.

Opis:
It is commonly known that the Anne Boleyn’s execution (May 1536) was a consequence of a violation of humanitarian norms governing criminal procedure in 16th century. By undermining the evidentiary side of the proceedings, the rules which English penal procedure was known for and which were applicable to state trials, including in the case of the Queen’s English process, are usually omitted. Although it is unquestionable that the law when it comes to crimes qualified as political, became a tool thanks to which the authority accomplished its goals. It can not be overlooked that the process of Anne Boleyn constructively remains identical with other similar proceedings that took place in the 16th century. Therefore, one should look at the events that led to the conviction of Anne Boleyn, not from the point of view of the current legal and axiological rules, but taking into account the historical and legal context.

Trypanosomiasis is one of the severe pathogenic infections, caused by several Trypanosoma species, affecting both animals and humans, causing substantial economic losses and severe illness. The objective of this study was to determine the molecular diagnosis and the risk factors associated with trypanosomiasis in District Jhang, Punjab, Pakistan. For this purpose, blood samples were randomly collected from 200 horses. A predesigned questionnaire was used to collect data on risk factors before the sample collection. The microscopy examination through Giemsa staining, formol gel test and PCR techniques were used to find the prevalence. The prevalence was recorded as 22.5% with microscopy examination, 21% through formol gel test and 15.5% with PCR based results. Analysis of risk factors associated with Trypanosoma brucei evansi occurrence was carried out using Chi-square test. It showed the prevalence of Trypanosoma brucei evansi was significantly (p<0.05) associated with sex, age, rearing purpose and body condition whereas non-significantly (p>0.05) with insects control practices. This study supports the idea that PCR is a sensitive, robust and more reliable technique to diagnose trypanosomiasis. It was concluded that Trypanosoma brucei evansi is widely prevalent in Jhang (Pakistan), highlighting a dire need to develop control strategies and education programmes to control this disease in developing countries.

The use of information technology is an essential part of law enforcement activity. Cloud technology is widely widespread in our life. Unfortunately, it should be noted that this technology is not widespread in the activities of investigators during the pre-trial investigation of criminal offenses. Therefore, in this article the author focuses on the possibilities of using cloud technologies in law enforcement, as well as on the distinctive features of this technology. In addition, the author has conducted a study in the context of the possibility of obtaining information from the Internet using cloud technologies during pre-trial investigation of criminal offenses. Ways of obtaining information from the Internet using cloud technologies during the pre-trial investigation are studied and criminal procedural means of obtaining such information during the pre-trial investigation are identified. The problems of using cloud technology by the investigator are described in the article. The positive aspects of replacing traditional personal computers with cloud services are identified. The history of the development of cloud technologies is described. The models of cloud technologies and their importance in the activities of the investigator are analysed. The author has investigated the features of using virtual computers in Amazon Web Services during the pre-trial investigation. The possibility of using software product such as Microsoft Office 365 by the investigator is described.

Opis:
Introduction and aim. There is evidence in the literature about a change in the effectiveness of inhibitors of the renin-angiotensin system (iRAS) in people with COVID-19. Considering different mechanisms of pressure reduction by different iRAS groups, one can expect differences in people with COVID-19 receiving these drugs. The aim of angiotensin-converting enzyme inhibitors (ACEi), angiotensin II receptor blockers (ARB) and direct renin inhibitors (DRi) usage in COVID-19 (BIRCOV study) was to pinpoint clinical and laboratory differences in people with hypertension who received iRAS and suffered coronavirus infection. Material and methods. An open prospective trial of 108 patients was performed in subjects suffering from COVID-19 who have been receiving iRAS: ACEi, ARB or DRi as basic antihypertensive therapy. The disease follow-up was 12 and 24 weeks. A blood pressure (BP) measurement was performed the week before COVID-19 and up to 24 weeks from the disease onset. Subanalysis in patients with chronic kidney disease (CKD) was performed. Results. In patients with COVID-19, a change in the effectiveness of antihypertensive therapy depending on the type of drug in the iRAS group has been documented in the first 4 weeks from the onset of the disease. The use of ACEi had significantly increased the risk of severe hypotension, unlike ARBs that do not cause hypotension. The synchronous decline of estimated glomerular filtration rate (eGFR) and systolic BP was more pronounced in CKD patients followed by albuminuria incidence. The greatest decrease in eGFR was in people taking ACEi. Conclusion. People with grade 1-2 hypertension who are constantly receiving RAS inhibitors suffering from COVID-19 may develop hypotension with ACEi. COVID-19 leads to transient albuminuria and decreased glomerular filtration rate, which is especially dangerous for people with CKD 4-5.

Opis:
Israeli culture in the 1940s and 1950s was dominated by ideological considerations. Zionist films, as other aspects of Eretz-Israel and Israeli culture, distinctively propagated Zionist ideas. As a consequence of their sociopolitical focus, these films neglected the complexities of the relationship between Holocaust survivors and the native Jews in Eretz Israel. Instead, Holocaust survivors were reduced to a homogeneous entity that bore distinct negative connotations. Films depicted female Holocaust survivors as mentally unstable, unfit mothers, and often played up negative sexual stereotypes. In these films, the women were “cured” or went through a process of “purification” thanks to the Zionist establishment. Historical research often cites the trial of Adolf Eichmann (1961) as being a turning point in the Israeli public’s perception of the Holocaust, and its representation in Israeli culture. This article will focus on an analysis of the film The Hero’s Wife (Peter Frye, 1963) that was produced in the aftermath of the trial. It will discuss the innovative representations of this unresearched film and will seek to answer the questions of why, and in what way, its narrative comprises a subversive antithesis to the narrative shaped by Zionist fiction films made prior to the Eichmann trial.

The study presents the contents of the letters from the private archive of Major Jerzy Sosnowski, a Polish military intelligence officer operating in Berlin in 1926-1934. The letters are addressed to his father and come from 1937 and 1938. The text presents Major Sosnowski's profile. Then the circumstances in which the letters were written and their meaning are discussed. Their content was analyzed against the background of the criminal trial before the Military District Court No. I in Warsaw and regarding the current state of knowledge about Major Sosnowski’s fate from crossing the German-Polish border in April 1936 until the sentence in June 1939. The content of the letters proves their author’s personal harm and violations of the law preceding criminal proceedings before the Polish military court, and to some extent, also provide insight into the trial for which the primary sources (court records) have not been preserved.
