Opis:
A characteristic feature of post-modernity is the atomization of society while at the same time far-reaching globalization processes takes place. In this context, one of the most important human rights is the need to define and protect its identity. The atomization of society is a consequence of the break-up of the family as well as traditional social structures such as the state, religious communities and trade unions. This phenomenon is accompanied by frequent changes of location. The concept of small homelands disappears. Globalization provides a person with a range of technical and electronic instruments that on the one hand make life easier and on the other hand pose a threat to people. Social media facilitate communication, but at the same time increase the threat to the protection privacy and sensitive data. The subject of the study will be the assessment of the legal framework for the protection of human identity against atomization and globalization processes in the European Union and the presentation of possible new solutions in this field.

The European Communities, later the European Union, for a long time did not  pay attention to the protection of European cultural heritage, as well as to issues o f cultural policy, leaving the area more or less consciously the Council o f Europe. The cultural policy o f the European Union treats the ambiguous term “culture” as an area that belongs to the sphere of national sovereignty. Undefined terms from the area of culture, such as the European cultural space, a common cultural heritage, etc. appear in the documents o f the European Union. Only Art. 151 o f the Treaty establishing the European Community, currently Art. 167 of the Treaty on the functioning o f the European Union is more specifically devoted to the issue of culture and more closely to the issue of heritage. The cultural policy on this ground includes the protection o f European cultural heritage, undertaking projects involving the development of a culture and the promotion of European culture. In that respect, the attention should be paid to a number of bilateral agreements, international programs, and finally conventions.

Opis:
An effective implementation of mutual recognition in the Area of Freedom, Security, and Justice requires mutual trust between the Member State. Mutual trust has been eroded in some Member States due to the rule of law crisis. However, it is not only the rule of law crisis, but also the departure of the Member States from the shared values of respect for fundamental rights, as well as the differences in the prosecutorial systems of individual Member States, that have caused changes in the perception of the principle of mutual recognition. This paper will examine the evolving approach to the principle of mutual recognition based on the recent Court of Justice of the European Union rulings on the European arrest warrant. The analysis concludes that the CJEU attaches more importance to the protection of the principle of mutual recognition, the prosecution of perpetrators of crime, and the unwavering presumption of respect for fundamental rights by the Member states than to the effective protection of fundamental rights.

This article discusses the harmonisation of laws within the EU focusing on the specific ways of achieving an approximation of the Polish legal system with European competition law. It identifies and gives an overview of three specific ways of harmonising national laws with EU antitrust provisions: (1) spontaneous (or bottom-up) harmonisation; (2) judicial harmonisation and; (3) legislative harmonisation by means of EU Directives. With respect to the last category, particular attention is drawn to the legislative competences of the EU, allowing it to harmonise antitrust issues either on the basis of Articles 103 and 114 TFUE, or perhaps even on the basis of Article 82 TFEU
Le présent article explique la notion d'harmonisation du droit dans l'UE et se concentre sur les moyens particuliers de réalisation du rapprochement du droit polonais au droit de la concurrence de l'UE. Il identifie et offre un aperçu des trois façons de l'harmonisation du droit national avec le droit antitrust de l'UE: (1) l'harmonisation spontanée (ou bottom-up); (2) l’harmonisation juridique et (3) l'harmonisation législative par voie de directives. Dans ce dernier cas, une attention particulière est accordée aux compétences législatives de l'UE, ce qui lui permet d'harmoniser les questions du droit de la concurrence de l'UE, soit sur la base des articles 103 et 114 du TFUE, soit même, peut-être, sur la base de l'article 82 TFUE.

The aim of this article is to present marriage and family protection in the light of Polish constitutional law. The Constitution of the Republic of Poland provides for this protection through a constitutional guarantee. The publication shall present aspects of marriage and family not only on the basis of the regulations of the Basic Law, but also in accordance with the Family and Guardianship Code. The discussion in this article focuses mainly on protection of the institution of marriage and family as the fundamental social unit. Furthermore, a comparative analysis of constitutional legislation including the Basic Law of the Republic of Italy and Spain in the field of marriage and family protection has been performed.

Due to amalgamation of Polish and EU systems, the shape of many public policies in the country is the consequence of decisions taken within the EU – but what is more important – with participation of Poles. Complexity of the challenges ahead demands making decisions that the society shall feel are acceptable, or even proceeded with their co-authorship. Relevantly high degree of cooperation, co-decision making and shared responsibility – between executive and legislative power and non-public entities, within political decision making, is important in order to get as properly stable as possible standpoint of Poland, and for efficient implementation. Because of that, the aim of this analysis is the search for the answer to the question whether within challenges that await the EU, we may find those, that will lay especially in the field of interest of Polish non-public entities. In addition – is it justified (and to what extend) to include in such cases those entities into processes of working out standpoints of Polish officials. With such a research objective a thesis is being advanced, that in Poland awareness of EU functioning mechanisms, but also the level of inclusion of non-public entities into political decision making, is little and in face of challenges awaiting the union it is necessary to raise it.
