The energy tax is a type of environmental tax. In addition to its ability to generate revenue for the central budget, it is important that it can have a major impact on the achievement of the European Union’s significant but not legally binding objectives in the field of energy policy and climate change. The role of the energy tax is gradually increasing, partly due to the growing importance of environmental considerations in certain policies, on the other hand, the EU attaches great importance to the harmonization of these tax rules, as almost 75% of environmental taxes in integration come from the energy sector, so the role of energy taxes in environmental taxation and policy is also important. The EU wants to reduce its greenhouse gas emissions by 55% by 2030 and achieve full climate neutrality by 2050, as set out in the Green Agreement Communication. Aiming to achieve these goals, the European Commission has adopted the so called ‘Fit for 55’ package of proposals on climate protection, which, in addition to several measures, states the need of the amendment of the Energy Tax Directive (hereinafter: Energy Tax Directive, the Directive). The reason for this is that, in its current form, it is not in line with climate protection goals, as it does not encourage the reduction of greenhouse gas emissions and energy efficiency.

Opis:
This paper discusses the performance and strategies of banks with foreign participation in the new EU Member States and their attitudes towards socalled ‘socially responsible finance’. The banking sector in the analyzed countries (Czech Republic, Poland and Slovakia) is dominated by foreign capital. The global financial crisis caused a decrease in new annual FDI inflows into the financial intermediation and banking sector of these countries. Some disinvestment occurred in Slovakia and Poland. The foreign-owned banks already operating in the analyzed countries undertook some organizational and financial adjustments to the global economic crisis that allowed them to secure their own position in recipient countries. They are involved in socially responsible activities in the field of culture, sport, environmental protection etc. As trust-based financial institutions. they also showed a kind of responsibility in the field of finance when the crisis occurred.

This paper tries to shed some light on factors influencing the positions of the new member states of the EU on Eastern Partnership in its initial phase. It utilises an analytical approach developed by Copsey and Haughton (2009) and argues that the two most important factors affecting positioning of newcomers towards the initiative are: perceived size and geography. While the new members were especially keen to support their immediate neighbours, they were using a common policy towards these countries to increase their presence and influence in the region since the initiative helped them to deal with neighbourhood issues they were not able to solve on their own. The paper suggests an amendment to the theoretical approach and proposes an assumption explaining positioning of the member states towards the third countries that better reflect the empirical evidence than the original framework. Moreover, the research showed that Poland differed from the rest of the new EU countries, was much more active and influential and rather resembled the old members. However, due to its not very positive image (caused by its assertive approach and strong effort to play a prominent role within the EU) its influence within the EU was limited and, therefore it proposed the Eastern Partnership together with Sweden that held a much better image.

The paper on European welfare regimes and policies presents common and shared features of the social development of the post-communist countries that are members of the EU today. This will provide a basis for an attempt to assess if there is a single regime for those countries that distinguishes them from the three classical (and later four) regimes of the Esping-Anderson classification, or if there is an affinity to one of those models en bloc, or if there is similarity to one of the regimes, but in a different way for each of the new EU members. This attempt will be made primarily on the example of Poland, but with salient references to other countries in the group. The basis of the thoughts presented here is that of a project on Diversity and Commonality in European Social Policies: The Forging of a European Social Model (Golinowska, Hengstenberg, Żukowski 2009). Considerations and analysis done in the paper lead into conclusions that social policy development in the new member states is characterized by a one social model distinguishing them differently than according to the Esping-Andersen classification, in spite of a some differences in the outcome of the social policy being pursued. Similarities are mainly of an institutional character, resulting from both the similar past and the similar challenges connected with the systemic transformation towards the democratic system and market economy. In the future this specificity may fade and integration within the EU will cause a Europeanization of social policy of member states, but now this process is not sufficiently advanced.

The author advocates a flexible approach with respect to the interpretation of the term “Member State” as employed in the Succession Regulation, allowing the differentiation between “participating” and “non-participating” States. It does not mean that the term “Member State” should always be interpreted in a wide sense including the three non-participating States: Denmark, the Republic of Ireland, and the United Kingdom. Whether a wide or a narrow interpretation is appropriate depends on the context and the purpose of the single provision. Most provisions contained in the chapter on jurisdiction refer to participating Member States only. But some articles such as the Article 13 of the Regulation, provide a counter-example. A uniform interpretation of the concept of Member State in all provisions of the Succession Regulation seems far too sweeping. It reminds of Begriffsjurisprudenz and does not take account of the purpose of the single provisions. In particular, it disregards the need for the cross-border protection of individual rights in a Union with open frontiers.

Nowadays, contemporary European states are undergoing dynamic transformations connected with the integration processes. Thus, national basic laws not only register to a wider extent, but also become open to integration processes, which is commonly called “Europeanization of constitutions”. Regional integration causes far-reaching constitutional consequences for the European states. It poses new challenges to the EU Member States in the process of adjusting their legal systems, including the contents of their basic laws, to the permanently changing political and legal reality. Objectives and functions performed by the contemporary European states, particularly their scope and ways of fulfilment, are also undergoing transformation. The key issue is also new understanding of the concept of sovereignty
Współczesne państwa europejskie ulegają dynamicznym przemianom związanym z procesami integracyjnymi. Stąd narodowe ustawy zasadnicze w coraz szerszym zakresie nie tylko rejestrują, ale także otwierają się na procesy integracji europejskiej, co powszechnie określa się mianem „europeizacji konstytucji”. Integracja regionalna powoduje daleko idące konsekwencje ustrojowe dla państw europejskich. Przed państwami członkowskimi UE stawia nowe wyzwania w procesie dostosowywania ich porządków prawnych, w tym treści ich ustaw zasadniczych, do wciąż zmieniającej się rzeczywistości politycznej i prawnej. Przemianom podlegają również cele i funkcje realizowane przez współczesne państwa europejskie, a w szczególności ich zakres i sposób wykonywania. Kluczowym pozostaje także problem nowego pojmowania suwerenności.

The author of the paper submits that EU foreign policy disputes can be attributed to the fact that Central and Eastern Europe was admitted into the European Union as a less developed part of Europe. As a result, particularly the Franco-German axis intended to run EU foreign policy in accordance with the rule “the West knows best”. This approach is based on the assumption that the new EU member states should be socialized into Western, superior values. EU foreign-policy problems were created mostly by the Franco-German axis when these two countries decided to support a multi-polar world trying to counter American dominance and forging close ties with the Russian Federation. This approach to EU foreign policy was not acceptable to the new member states for political, economic, military and historical reasons. In the context of the current economic and financial crisis, the new member states’ foreign-policy choices have been vindicated as it turned out that the European Union cannot distance itself from the United States due to its economic weakness and the organization was not able to change Russia by way of the policy of “Wandel durch Annäherung”.
Autor artykułu twierdzi, że spory w odniesieniu do polityki zagranicznej Unii Europejskiej są uwarunkowane traktowaniem nowych państw członkowskich jako mniej rozwiniętych państw, które powinny podlegać procesowi socjalizacji zgodnie z zasadą, że „Zachód wie najlepiej”. Z punktu widzenia nowych państw członkowskich niska efektywność polityki zagranicznej Unii Europejskiej wynika z faktu, iż ich interesy nie były dotychczas uwzględniane przez organizację w dostatecznym stopniu. Zainicjowana przez tandem francusko-niemiecki polityka zdystansowania się od Stanów Zjednoczonych i jednoczesnego zbliżenia z Rosją była niezgodna z interesami nowych państw członkowskich i zakończyła się fiaskiem. Rosji nie udało się zdemokratyzować poprzez politykę „Wandel durch Annäherung” a światowy kryzys gospodarczy obnażył słabość gospodarczą Unii Europejskiej oraz uświadomił państwom członkowskim konieczność współpracy ze Stanami Zjednoczonymi. W rezultacie cele polityki zagranicznej nowych państw członkowskich okazały się słuszne w skali całej organizacji.

Opis:
The purpose of this paper is to verify the hypothesis that a debt write-off implemented recently by Polish authorities in favour of public hospitals constitutes State aid within the meaning of Article 107(1) of the Treaty of the Functioning of the European Union. The paper contains a detailed description of the nature of the measure – its historical background, regulatory context, as well as its construction. It presents an in-depth analysis of the fulfilment by the measure of the conditions stipulated in Article 107(1) TFEU. As a preliminary issue, the analysis addresses the problem whether Polish public hospitals can be considered as undertakings within the meaning of EU competition law, particularly, as to their activity financed by the sickness fund organized under the principle of social solidarity. The answer to this question seems to be affirmative and in line with the landmark Hoefner and Elser judgments where the ECJ held that the way in which an entity is financed is irrelevant for its classification as an undertaking. The paper argues in favour of the thesis that the debt write-off must be considered as affecting trade between Member States and competition. Consequently, and contrary to the official position of the Polish government, the measure in question is classified as State aid.
Le but de cet article est de vérifier l’hypothèse selon laquelle l’amortissement total des dettes effectué récemment par les autorités polonaises en faveur des hôpitaux publiques constitue une aide publique au sens de l’Article 107(1) TFUE. L’article contient une description détaillée de la nature de cette mesure – son histoire, contexte législatif aussi que sa construction. Il présent une analyse profonde de l’accomplissement par cette mesure des conditions indiquées par l’Article 107(1) TFUE. Comme question préliminaire, l’analyse a pour objectif de vérifier si les hôpitaux publiques polonais peuvent être considérés comme entreprises au sens de la loi de concurrence de l’EU par rapport à son activité financée par le fonds de maladie organisé en accord avec le príncipe de la solidarité sociale.
