The welfare aspects of intra-European migration remain an important and controversial topic of academic and political debates. These discussions touch upon the classical ‘welfare magnet’ or ‘welfare tourism’ hypothesis. Transcending the politicised concept of ‘benefit tourism’, our paper examines how welfare-state considerations in relation to migration decisions vary across the life course. Relying on micro-level qualitative research focusing on Spanish intra-EU movers, the paper probes deeper into how individuals perceive welfare systems, analysing the subtle and nuanced meanings of different aspects of the welfare for their migration decisions. We focus more specifically on welfare provisions in terms of health care, compulsory education, child support and other care responsibilities, unemployment and pensions and retirement. Our research indicates that, in studies on the migration–welfare nexus, it is necessary to move beyond the current narrow focus on the welfare magnet hypothesis and to examine how diverse welfare arrangements continuously and dynamically set the context for migration decisions at various stages of an individual’s life. The results of our research show how features of the Spanish welfare system, in comparison to those of potential destination countries, might act as both a trigger and/or a barrier to migration. As such, we get a ‘thicker description’ of the role which welfare might play in shaping individuals’ eventual migratory aspirations and decisions.

The author advocates a flexible approach with respect to the interpretation of the term “Member State” as employed in the Succession Regulation, allowing the differentiation between “participating” and “non-participating” States. It does not mean that the term “Member State” should always be interpreted in a wide sense including the three non-participating States: Denmark, the Republic of Ireland, and the United Kingdom. Whether a wide or a narrow interpretation is appropriate depends on the context and the purpose of the single provision. Most provisions contained in the chapter on jurisdiction refer to participating Member States only. But some articles such as the Article 13 of the Regulation, provide a counter-example. A uniform interpretation of the concept of Member State in all provisions of the Succession Regulation seems far too sweeping. It reminds of Begriffsjurisprudenz and does not take account of the purpose of the single provisions. In particular, it disregards the need for the cross-border protection of individual rights in a Union with open frontiers.

Opis:
Privatisation of the Gdansk shipyard was to prevent its collapse. The act on privatisation of state-owned enterprises, adopted by the parliament in 1990, set the rules to govern the ownership transformation process. The article is to analyse the privatisation process of Stocznia Gdańska im. Lenina and the impact of state-owned institutions on the course of the privatisation in the period 1990-2007. A theses has been presented that Polish governments had no consistent concept for ownership transformation policy regarding the Gdansk shipyard. An attempt has been undertaken to answer the following research question: what factors affected the Gdansk shipyard privatisation process? The interdisciplinary approach to the analysed phenomenon enforced the application of research methods appropriate to political science, legal sciences, and sociology. The case of Gdansk shipyard testifies to absence of a privatisation policy on the part of the government, and wrong management by the shipyard authorities.
