Opis:
In the paper, the author, revolving around the Supreme Court’s ruling linking close human relations in the workplace to the deterioration of management practices, critically analyses the dominant viewpoint espousing the need to strike out intimate behaviours from organizations. The author points to the significant impact of management theories, feminist trends and managerialization of law on the escalating de-sexualization of the workplace. In the article, it is evidenced that the overbearing conviction about the negative impact of intimate and sexual bonds on the working relations demands reinterpretation. It is alsoshown that consideration of sexual and intimate behaviours in organizations, irrespective of sex structures in these organizations, may paradoxically contribute to sex discrimination. The author offers the idea to modify the rules of employers’ liability depending on the sex structure and the number of women holding positions of authority and responsibility.
W tekście autor, wychodząc od poglądu Sądu Najwyższego o negatywnym wpływie bliskich relacji w zakładzie pracy na zarządzenie przedsiębiorstwem, poddaje krytycznej analizie dominujące stanowisko głoszące potrzebę eliminowania w środowisku pracy zachowań intymnych. Artykuł wskazuje na wpływ nauk o zarządzaniu, ruchów feministycznych oraz tzw. menedżeryzacji prawa na postępującą deseksualizację organizacji. Autor udowadnia, że dominujący pogląd o negatywnym wpływie relacji intymnych i seksualnych na stosunki w miejscu pracy wymaga zrewidowania oraz wykazuje, że traktowanie zachowań o naturzeseksualnej i intymnej w oderwaniu od struktury płci w stosunkach zatrudnienia może paradoksalnie przyczyniać się do dyskryminacji ze względu na płeć. W pracy proponuje się zmianę reżimów odpowiedzialności odszkodowawczej pracodawcy w zależności od struktury płci oraz od tego, czy kobiety obsadzane są na stanowiskach związanych w władzą i odpowiedzialnością.

The article considers the issue of what is sex and sexual orientation discrimination and  should under the federal statute 2000 Esexual orientation be encompassed under the term sex. The statute has long been intrepreted as directed to physical sex and not read as including sex orientation as an aspect of sex. The article however traces and identifies a clear trend in the federal court system of the United States to interpreting  and  includng sexual orientation or homosexuality and lesbianism within this statute’s prohibition against traditional sex discrimimation. The author holds the view  that homosexuality and sexual orientation should be given the same and equal protection as sex discrimimation in the federal courts of the United States and in time this statute will rightly be interpreted not only to include sex discriminataion as directed in its tradidtional understanding but be analayzed and interpreted to include protection against sexual orientation discrimination.

In the conditions of the full-scale invasion of the Russian Federation on the territory of Ukraine, the issues of gender-based violence, discrimination based on gender and domestic violence are more acute than ever before the Ukrainian society. The war became the catalyst that caused not only an increase in cases of such violence, but also complicated the process of identifying and recording them. Despite the military actions, Ukraine continues to take decisive steps to overcome this problem, following the Euro-Atlantic and NATO course. Ukraine supports the policy of gender equality aimed at overcoming all forms of discrimination based on gender. Ukraine has recognized gender equality as one of the global standards – one of the basic principles of a democratic society, and strives to achieve real, factual equality between women and men. Evidence of this is the active implementation of international and European legislation and the implementation of its provisions in the practical activities of state bodies and institutions of all levels. In order to overcome gender stereotypes, education is actively developing, the institutional capacities of state bodies and institutions, and local self-government bodies are being strengthened. Alongside this, statistical research findings suggest that women still have limited access to decision-making in armed conflict, despite their disproportionate contribution to humanitarian aid, and that women remain under-represented in the security and defense sectors , in particular at the level of decision-making, including in military and civilian positions in the Armed Forces of Ukraine, the National Police, in international operations to maintain peace and security. In view of the above, the issue of gender equality in the security and defense sector of Ukraine, in particular, in the bodies of the National Police, deserves special attention and remains relevant.

In the conditions of the full-scale invasion of the Russian Federation on the territory of Ukraine, the issues of equal rights of women and men, prevention and counteraction of any manifestations of discrimination, including on the basis of gender, require a comprehensive approach for their effective solution and consolidation of the efforts of all state and public institutions. Ukraine continues to take decisive steps to overcome this problem, following the Euro- Atlantic and NATO course. Ukraine supports the policy of gender equality aimed at overcoming all forms of discrimination based on gender. Ukraine has embraced gender equality as a fundamental global standard, a cornerstone of democratic societies. The nation is actively working towards attaining authentic and factual equality between women and men, underscoring its commitment to fostering a society where equal opportunities and rights are afforded to individuals of all genders. Evidence of this is the active implementation of international and European legislation and the implementation of its provisions in the practical activities of state bodies and institutions of all levels. In order to overcome gender stereotypes, education is actively developing, the institutional capacities of state bodies and institutions, local self-government bodies are being strengthened. Furthermore, statistical research indicates that women continue to face restricted access to resolutions in armed conflicts, despite their significant contributions to humanitarian efforts. Women remain underrepresented in key sectors like security and defense, particularly at decision-making levels. This includes both military and civilian roles within the Armed Forces of Ukraine, the National Police, and international peacekeeping operations, highlighting an ongoing imbalance in gender representation within these critical areas. In view of the above, the issue of gender equality in the security and defense sector of Ukraine, in particular, in the bodies of the National Police, deserves special attention and remains relevant. The responsibility for implementing a cohesive state gender policy within the units of the National Police of Ukraine lies with the Human Rights Office of the General Inspection and Human Rights Department of the National Police of Ukraine (hereinafter referred to as the Human Rights Office). Despite the considerable volume of the legal framework outlining a diverse range of competences for the Human Rights Office as a subject of administrative and legal relations, it can be confidently stated that there has been no thorough examination of the regulatory and legal aspects governing the activities of the Human Rights Office in the field of implementing the unified state gender policy. This lack of comprehensive study contributes to the presence of numerous gaps in the legislative foundation of the Human Rights Office’s activities. All this actualizes the topic of the corresponding scientific research, testifies to its scientific and practical usefulness, taking into account the recent significant intensification of domestic law-making processes aimed at defining the legal foundations of gender equality and nondiscrimination, the integration of European and international legislation into domestic legislation.

The article focuses on an artist and activist collective Guerrilla Girls, created in 1985 in order to fight discrimination in the art field. It presents the group’s strategies, using selected actions as examples. The article is also a critical analysis of the collective’s achievements in the context of feminist theories, especially one concerning the relations between feminism and issues of race and ethnicity. The author is also interested in the connections between members of the group and the art system, as well as questions on sexism in the contemporary art field, after 30 years of Guerrilla Girls’ existence.

The paper first deals with the conditions and prerequisites of adopting European law before the former „real-socialist” countries joined the EU. The key role of European Courts is described by showing that they worked as de facto virtual legislators even before accession. It is emphasized that European Courts have provided the courts and antitrust authorities of new Member States with an inestimable value-based orientation. The EU judicial practice enhanced national legal standards and legal culture in the respective countries. The second part of the contribution contrasts with this positive tone. An example of a serious inconsistency in values between the Court of Justice of the EU and the European Commission is shown concerning their divergent views on “uni-sex insurance” and the draft directive on women’s representation in board member positions. There is substantial disagreement in this matter, which weakens and endangers the integrative role of the CJEU and its habitual value-confirming impact. This disparity could to some extent depreciate the role of European Courts as „motors of integration”.
Le document traite d'abord sur les conditions et les préalables de l'adoption de la législation européenne avant que les anciens pays «vraiment» socialistes aient rejoint l'UE. Un grand rôle des juridictions européennes est décrit d’une manière suivante: ils travaillaient en réalité comme des législateurs virtuelles même avant l'adhésion. Il est souligné que les tribunaux et les autorités de la concurrence des nouveaux Etats membres de l'UE ont été fournis d’une orientation axée sur la valeur inestimable par les juridictions européennes. La pratique judiciaire de l'UE renforçait des normes juridiques nationales et de la culture juridique dans les pays respectifs. La deuxième partie de la contribution contraste avec ce ton positif. Un exemple d'une grave incohérence de valeur entre la Cour de justice de l'Union européenne (CJUE) et la Commission européenne, concernant la divergence entre la CJUE et la Commission européenne dans une affaire qu'on appelle «l'assurance uni - sexe» et le projet d'une directive sur la représentation des femmes aux postes de membres du conseil d'administration est présenté. Il y a un désaccord important dans cette matière qui affaiblit et met en danger le rôle intégratif de la CJUE et son impact habituel de confirmation de valeur; il pourrait, en quelque sorte, déprécier le rôle des tribunaux européens étant des «moteurs de l'intégration».
