The article deals with the practice of invoking philosophers in the reasons for judgments of the Polish courts. A quantitative and qualitative analysis of the case law of the common courts, administrative courts, the Supreme Court and the Constitutional Tribunal allowed for the formulation of several main conclusions. First, although judgments containing references to philosophers constitute only a small fraction of all the case law, at the same time, when measured in absolute numbers, cases of quoting philosophers are not marginal. Second, in the two last decades there has been a clear intensification in the use of philosophical references in judgments. Third, references to philosophers exercise a number of different functions falling within the clarification and persuasive purposes of grounds of judgments. Fourth, there is no one attitude among courts and the parties towards the presence of philosophical arguments in the judicial process. The titular issue is not the further stage of the legal scholarship’s discourse on “judges as philosophers” in the likeness of Dworkin’s “Judge Hercules”. The practice of referring to philosophers by the courts is primarily an issue of the style of reasons for judgment and the role of non-legal sources in the rationalisation of judicial decisions – and not so much in the making of them. In the author’s view, the case law study reveals the utilitarian potential of philosophy for judicial argumentation.

Exploring the idea of a more practical relationship between the agent and his own mental life leaves room for reconsidering the relevance of the familiar analogy between reasons for belief and reasons for action. Even if their difference is usually admitted, they are also treated as equivalent, in the sense that the connection between reasons to believe and the arising belief would be analogous to the connection between reasons for action and the arising action. If such an analogy might be relevant to a certain extent in the frame of a theoretical stance towards oneself, I'll argue that it cannot be maintained once we have put the agent at the heart of self-knowledge.

W swojej znakomitej książce One Body Alexander Pruss opiera się na przekonaniu, że istnieje wymóg powszechnej miłości: wszyscy jesteśmy zobowiązani do wzajemnej miłości. Zawarte w niniejszej pracy tezy Pruss w dużej mierze uzasadnia, odwołując się do prawdy objawionej, mimo to wymóg powszechnej miłości wzmacnia argumentacją filozoficzną. Ten sposób argumentacji nazywam „argumentem z wrażliwości na wartość”. Jego podstawą jest przekonanie, że wszyscy ludzie posiadają pewien rodzaj wsobnej wartości, która to wartość dostarcza wszystkim innym podmiotom racji, aby odpowiedzieć na nią pozytywnie, stąd każdy człowiek jest zobowiązany do miłości drugiego człowieka. W niniejszym artykule dyskutuję z tym argumentem, zwracając uwagę na jego dwie istotne słabości: pierwsza z nich dotyczy tego, jakiego rodzaju racji dostarcza wartość osoby, a druga tego, na ile odpowiedź na ową wartość musi być odpowiedzią miłości.
Throughout his excellent book One Body, Alex Pruss relies upon the view that there is a requirement of universal love: each and every one of us is required to love each and every one of us. Although he often appeals to revealed truth in making arguments for his various theses, he supports the requirement of universal love primarily through a philosophical argument, an argument that I call the “argument from responsiveness to value.” The idea is that all persons bear a sort of nonrelational value, and because this value gives every agent reasons to respond to it positively, each and every person is bound to love each and every person. The aim of this paper is to criticize this argument. Pruss’s argument has two important gaps, one concerning the sort of reasons that the value of persons gives and one concerning whether the required response is the response of love.

Introduction: The problem of alienation and delinquency among juveniles still exists. This is not only a social problem, but also a health problem. Through participation in antisocial behaviour, juveniles may experience various diffi culties later in adult life. The aim of this paper is to investigate reasons for alienation and delinquency among juveniles and their influence on said health and functioning in society. Materials and methods: The research dealt with here was carried out in 2015 among children and teenagers from The Silesian Centre for Rehabilitation and Health in RabkaZdrój by means of a questionnaire designed by the author. Conclusions: The participants defined alienated anti-social behaviour, or alienation leading to anti-social and delinquent behaviour. Children aged 16–18 showed symptoms of anti-social alienation mostly by using bad language, drinking alcohol, smoking and vandalism. The respondents were affected by the antisocial behaviour of parents, family framework and the Internet.
Wprowadzenie: Problem demoralizacji i przestępczości wśród nieletnich nadal występuje. Ma on wymiar nie tylko społeczny, ale i zdrowotny. Nieletni naruszając swe zdrowie zarówno biologiczne jak i psychiczne, w dorosłym życiu mogą mieć wiele dysfunkcji. Celem pracy było poznanie opinii dzieci i młodzieży na temat przyczyn przestępczości i demoralizacji w ich środowisku, wpływu wykroczeń na zdrowie i funkcjonowanie w społeczeństwie. Materiał i metody: Badania przeprowadzono w 2015 roku wśród dzieci i młodzieży w Śląskim Centrum Rehabilitacyjno-Uzdrowiskowym w Rabce-Zdrój, z użyciem autorskiego kwestionariusza pytań. Wyniki i wnioski: Badani definiowali demoralizację jako odchodzenie od obowiązujących norm w społeczeństwie. Najczęściej dzieci wykazywały przejawy demoralizacji, w grupie 16–18 lat, i było to wulgarne słownictwo, spożywanie alkoholu, palenie papierosów, wandalizm. Wpływ na postępowanie badanych miały aspołeczne zachowania rodziców, zachwiana struktura rodzinna oraz Internet.

The goal of my paper is to consider how one chooses one’s own action. First, I will try to understand how both his past and his environment can condition someone's action. According to Sartre, we can act without being determined by our past which is always separated from us. It will be important to understand how such a process is possible. Is man completely free to act? Then I will raise the question of our reasons for acting in order to show that reasons do not pre-exist in the world. Motives are always motives for an agent who gives them meaning. They never condition the action completely. By his project, the agent reveals some reasons to act and these reasons have a value only in relation to the project adopted by the agent. Therefore, we can say that everyone is condemned to be free.

The objective of this paper is to compare the reasons for choosing a degree in geography by students starting their studies in two academic centres: Warsaw and Kielce. The first is a big city with rich traditions and one of the best academic centres in Poland, while the second is regional, much smaller but developing. In the research, special attention was paid to the reasons for choosing geography as a major, a variety of ideas considering future job and professional prospects open to geography graduates as well as attitudes toward the profession of a geography teacher. The research involved interviews with first and second-year students in both centres.

The article aims to present the meaning of the share repurchase (also called as buy backor buy-back) programmes and to identify the reasons announced and potential results of sharerepurchase made by firms listed on the Warsaw Stock Exchange (WSE) in Poland. The mainhypothesis to be verified states that there are more reasons to repurchase shares than just cashtransfer to shareholders and there are different results than just diminishing cash holding.The problem is significant enough because share repurchase in the literature is deemed asa substitute for dividends and as another way for cash transfer to shareholdersOn carrying out the research for the selected listed companies, I found that shares might berepurchased for many different reasons and not only to signal the excessive amounts of cash heldin the corporation. Viewing by the numbers it is possible to state that transferring cash is the leastimportant reason while repurchasing shares.

The duty to give reasons is generally thought of as an indispensable procedural guarantee that is offered to citizens in all modern European administrative law systems. The comparative analysis carried out in this article, however, reveals that important differences continue to exist between the way in which various legal systems within Europe conceive of that duty. The article furthermore argues that the duty to give reasons has an important role to play in the furtherance of transparency and accountability as principles of good governance. However, it also has its limitations as an instrument for keeping the administration accountable. Up until today, the duty to give reasons primarily has a role to play in the relationship between the administration and those individuals that are subject to its specic (mostly individual) decisions. In that context, the question arises whether the status of the duty to give reasons is evolving towards that of an individual human right

Introduction: Under Polish law there is a criminal offence, called incest, where close relatives perform an act of sexual intercourse with each other. Its penalization has a long tradition under Polish law. However, its criminalization remains controversial.Purpose: To examine whether incest should still be penalized.Materials and methods: The provisions of the Polish Penal Code and the relevant regulations of selected European states have been analysed. The judgement of the European Court for Human Rights and the criminal law literature have been examined as well.Results: There are both reasons for the depenalization of incest and arguments in favour of its continued penalization.Conclusions: The issue of incest may be seen both in the light of criminal law and from the point of view of morality. Looking at the problem solely from a legal perspective, the penalization of incest is not necessary and thus Article 201 of the Penal Code is redundant. Looking at the problem from a moral perspective, the opposite conclusion should be made.

ObjectivesThis study aimed to assess country-specific evidence of physical and non-physical acts of workplace violence towards nurses working in the health sector in 5 European countries, and then to identify reasons for not reporting violence experienced at work.Material and MethodsThis retrospective cross-sectional study was conducted in 5 participating countries (Poland, the Czech Republic, the Slovak Republic, Turkey, and Spain). All registered nurses working in selected healthcare settings for at least 1 year were invited to participate in the study. A questionnaire adapted from the Workplace Violence in the Health Sector Country Case Study – Questionnaire, developed jointly by the International Labour Office, the International Council of Nurses, the World Health Organization and Public Services International, was used. The selection of healthcare settings and the distribution of the questionnaire were conducted according to the recommendations of the questionnaire authors.ResultsIn total, 1089 nurses submitted completed questionnaires which could be included in the study. Of these, 54% stated that they had been exposed to non-physical violence and 20% had been exposed to physical violent acts. A total of 15% of the surveyed nurses experienced both forms of workplace violence. In addition, 18% of the respondents confirmed having witnessed physical violence in their workplace. The most common perpetrators were patients and patients’ relatives. In about 70% of these cases, no actions were taken after the act of violence to investigate its causes. About half of the study group did not report workplace violence as they believed it was useless or not important. The most common consequences of workplace violence included being “superalert” or watchful and on guard.ConclusionsNurses internationally are both victims of and witnesses to workplace violence. Workplace violence is often seen by nurses as an occupational hazard and, as such, it remains not reported. The first step in preventing workplace violence is not only to acknowledge its existence but also to ensure the appropriate reporting of violent acts.

Introduction. External causes of death are the third most common causes of death, after cardiovascular diseases and malignant neoplasms, in inhabitants of Poland. External causes of death pose the greatest threat to people aged 5–44, which results in a great number of years of life lost. Objective. The aim of the study is the analysis of years of life lost due to external causes of death among rural inhabitants in Poland, particularly due to traffic accidents and suicides. Material and methods. The study material included a database created on the basis of 2,100,785 certificates of rural inhabitants in Poland in the period 1999–2012. The SEYLLp (Standard Expected Years of Life Lost per living person) and the SEYLLd (per death) indices were used to determine years of life lost due to external causes of death. Joinpoint models were used to analyze time trends. Results. In the period 1999–2012, 151,037 rural inhabitants died due to external causes, including 27.2% due to traffic accidents and 25.2% due to suicides. In 2012, the SEYLLp was 1,817 per 100,000 males and 298 per 100,000 females. Among males, suicides (SEYLLp = 633 years per 100,000) and traffic accidents (SEYLLp = 473 years per 100,000) contributed to the largest number of years of life lost. Among females, SEYLLp values were: 109 years due to traffic accidents and 69 years due to suicides (per 100,000). Among males, SEYLLp values started to decrease in 2008 at the average annual rate of 3.2%. In the group of females in the period 1999–2012, SEYLLp values were decreasing by 2.4% per year. Conclusions. The decreasing trend of the number of lost years of life due to external causes among rural inhabitants does not apply to suicides among men. The SEYLLp due to this group of causes has been steadily increasing since 1999. Analysis of the years of life lost focuses on the social and economic aspects of premature mortality due to external causes.
