This paper is devoted to clarifying Hannah Arendt’s concept of political freedom (which, at certain points, is markedly obscure) by the means of analysing its structure. My analysis proceeds in three steps. Firstly, I distinguish a pre-political concept of freedom as exercising spontaneity, which is at the root of Arendt’s understanding of political freedom. Secondly, I analyse her account of freedom as exercising action and indicate its relationship to the elementary freedom of spontaneity. Arendt endowed action with a distinguished importance, since she assumed that it is the only activity within the vita activa (the other two being labour and work), which has a special anthropological and axiological significance. According to Arendt, only action allows one to truly experience the fundamental aspect of the human condition, which is the fact of human plurality; it is also the only activity which allows one to exercise specifically public principles, such as solidarity, equality, or justice. Thirdly, I indicate how these two accounts of freedom translate into Arendt’s concept of political freedom. This analysis reveals that the Arendtian concept of political freedom is markedly original. She did not define it in a usual manner, i.e. through indicating bundles of legal and political rights which determine the accepted scope of participation in the public affairs. The inherent part of her concept of political freedom is a specific account of how it must be exercised (i.e. through action). Political freedom understood as the participation in governance exercised through action is not merely an activity of instrumental, but also anthropological and axiological importance, which is due to the special anthropological and axiological meaning of action. In the final section, I discuss the practical dimension of Arendt’s theory. She doubted whether the traditional representative democracy is capable of accommodating her ‘rich’ ideal of political freedom, therefore she proposed an alternative account of political system based on councils. I formulate objections against this proposition and demonstrate that councils would presumably fail to accommodate Arendt’s exacting account of political freedom

This paper critically examines Latvian media policy from the point of view of public value theory, regarding the management of public service media. Since 1992, Latvian Television (LTV, 1954) and Latvian Radio (LR, 1925) officially, i.e. according to law, are independent public service media organisations, and consequently two legal entities. In fact LTV and LR are two state enterprises with one supervising council (five members) elected by parliament according to political proportionality – National Electronic Mass Media Council (the NEPLP). Since 2011, the Latvian government has been slowly deciding plans for the reform and creation of a unified PSM corporation, not just a PSB, i.e. including not only radio and TV broadcasting but a multimedia approach, especially on the Internet platform, due to media convergence. Political decisions of government and parliament for the above-mentioned intent are still wanted. Also, an initiative by LTV and NEPLP to establish a Russian language TV channel was not taken further by decision makers.

This essay proposes that time preference is an essential component of analysis of collective behavior and provision of public goods. It addresses the validity of the assumption that time preference, as a parameter in individual utility functions, is exogenous and fi xed. While individual time discounting is used to predict many social phenomena, it is quite often applied in a fi xed form where the possibility of change is rarely discussed. The mechanism of change in individual time discounting is explored in different social contexts, using student, inmate and drug addict populations. This study establishes that certain parameters, such as the length of exposure to new environment and new social connections, are of extreme importance in determining the degree of change in time discounting.

This article is an attempt to synthetically present and test the main conclusions of the State-as-Leviathan model. In the first part, the main assumptions of the model are described. In the second, the model is developed further in order to present main research hypotheses. In the third part, the critique and remarks on the model are reviewed. The fourth part is devoted to developing an empirical model and presenting the main findings of the analysis. The summary concludes the text with some suggestions for future research. The conducted analysis allows us to draw conclusions pointing to the less-than-perfect ability of the Leviathan model to describe real events in the areas of fiscal policy and taxation and, in some instances, seems to corroborate the conclusions ascribed to the "orthodox" theory of public finance criticized by Buchanan and Brennan. A regression model built upon a database on selected EU countries derived from the Eurostat, European Commission and European Social Survey points to the fact that indeed the broadness of the taxable base can positively influence public revenue. And it also negatively affects the way people perceive the national government (in linę with model assumptions). But when we turn to the influence of the broadness of the base on its perceived quality of life, we can find out that, in the countries with a relatively broad base, people's perceived life satisfaction is significantly higher (in line with "orthodox" theories). At the same time, the analysis corroborates to some extent Leviathan-model suggestions that progressive taxation is beneficial for the citizens in comparison to proportional, as some recent research shows.

The article deals with the issue of administrative procedural law and civil court proceedings. The author describes a special right of the parties to administrative proceedings, which is the right to bring an action against an administrative decision, and attempts to analyse the action in relation to the administrative decision against the control of common courts against individual acts of public administration. This analysis is carried out in the light of the provisions of the Code of Civil Procedure, as well as on the legal grounds for bringing actions against administrative decisions. The article was enriched with a number of judgments of common and administrative courts. At the end of the article, the author formulates de lege ferenda conclusions.

Performance of resistance in Croatia: A chronotopic review from the 1990s onwardsI follow the performance of resistance in performance art in Croatia from the 1990s – i.e. from the disintegration of Yugoslavia – in correlation with the visibility of the performance of resistance in public spaces, with an emphasis on the individual guerrilla action by Igor Grubić (1998), which is considered the first action and provocation in Croatia of the 1990s that was triggered by civic self-initiative. Due to socialist legacy and the war, it was only in 1998 that an action could occur in Croatia that would be as powerful action in terms of media influence as had been the case in the revolutionary year of 1968 in Yugoslavia with the action Red Peristyle, upon the aura of which Grubić’s Black Peristyle was built. I conclude this review of the performance of resistance in Croatia from the 1990s onwards with the story of Black Nylon Peristyle as the civic performative reaction on the occasion of the accession of Croatia to the EU. Thereby I follow chronotopically the performance of resistance in Croatia between 1998 and 2013 (and partly further, up to and including 2017) with regard to the performative centres, placing the starting and endpoint in Split i.e. Peristyle as the art forum of the performance of resistance in Croatia. Performans oporu w Chorwacji. Przegląd chronotopiczny od lat 90.W artykule prześledzono performans oporu w sztuce performansu w Chorwacji od lat dziewięćdziesiątych, tj. od rozpadu Jugosławii – w odniesieniu do kwestii widzialności performansu oporu w sferze publicznej. Akcent został położony na indywidualnej akcji partyzanckiej Igora Grubicia (1998), uważanej za pierwszą akcję i pierwszą prowokację jako przejaw inicjatywy obywatelskiej w Chorwacji w latach dziewięćdziesiątych. W związku z panującą wojną i trwającym okresem postsocjalizmu dopiero w 1998 roku w Chorwacji miało miejsce działanie, które pod względem medialnym było porównywalne do rewolucyjnego roku 1968 w Jugosławii, kiedy to odbyła się interwencja Czerwony Perystyl, do której odnosiło się przedsięwzięcie Grubicia – Czarny Perystyl. Przegląd performansów oporu w Chorwacji od lat dziewięćdziesiątych zamykam opowieścią o Czarnym Nylonowym Perystylu jako obywatelskiej reakcji performatywnej na przystąpienie Chorwacji do Unii Europejskiej. Tym samym śledzę w sposób chronotopiczny performans oporu w Chorwacji w latach 1998–2013 (i częściowo dalej, aż do roku 2017) z uwzględnieniem centrów performatywnych, umieszczając punkt początkowy i końcowy w Splicie, a dokładnie na Perystylu jako artystycznym forum performansu oporu w Chorwacji.

This article deals with the issue of civil activeness in a system of free market democracy. Participation in social and civil dialogue is a sign of citizens’ engagement and is considered here in the context of Jürgen Habermas’s theory of communicative action. The manifestations and consequences of the extant institutional arrangements are shown, as are the means of describing and explaining them in the Polish socio-political and economic context. The reflections presented here illustrate the weakness of the existing measures. Both the institutional structure and the theoretical tools used in Poland are imitative in nature and do not fulfil the practical expectations of either participants or researchers of civil dialogue.

The paper explores the changes the EU Directive on harmonizing certain rules governing actions for damages under national law for infringements of the competition law provisions will bring about in Hungary, with a special focus placed on damages liability rules, the interaction of public and private enforcement of these rules, and the importance of class actions. Amendments of the Competition Act introduced in 2005 and 2009 had created new rules to promote the idea of private enforcement even before the Directive was adopted. Some of these rules remain unique even now, notably the legal presumption of a 10% price increase for cartel cases. However, subsequent cases decided by Hungarian courts did not reflect the sophistication of existing substantive and procedural rules. There has only ever been one judgment awarding damages, while most stand-alone cases involved minor competition law issues relating to contractual disputes. The paper looks at the most important substantial rules of tort law (damage, causality, joint and several liability), the co-operation of competition authorities and civil courts, as well as at (the lack of) class action procedures from the perspective of the interaction of public and private enforcement of competition law.
Le document analyse les changements apportés par la directive européenne relative aux certaines règles régissant les actions en dommages et intérêts en droit national pour les infractions aux dispositions du droit de la concurrence en Hongrie, en particulier concernant les règles sur la responsabilité civile en matière de dommages, l’interaction de l’application publique et privée du droit de la concurrence et l'importance des recours collectifs. Les modifications à loi de la concurrence introduites en 2005 et 2009 ont créé de nouvelles règles pour promouvoir l'idée d'une application privée du droit de la concurrence même avant que la directive a été adoptée. Certaines de ces dispositions sont toujours uniques, notamment la présomption légale d'une augmentation de prix de 10% par les ententes. Néanmoins, les jugements ultérieurs rendus par les tribunaux ne reflétaient pas les règles de fond et de procédures sophistiquées. Il n’y avait juste le jugement qui a accordé des dommages et intérêts, alors que la plupart des actions autonomes (« stand-alone actions ») portaient sur des problèmes secondaires du droit de la concurrence liés aux conflits contractuels. L’article examine des règles les plus importantes du droit de la responsabilité civile (le dommage, la causalité, la responsabilité solidaire), la coopération entre les autorités de la concurrence et les tribunaux civils, ainsi que l’absence de mécanisme de recours collectifs et de la perspective de l’application publique et privée du droit de la concurrence.

This article presents a case study of the Polish American Economic Forum as an example of public transnational behavior in intertwining economic and political spheres. The organization was formed in 1989, primarily by Solidarity refugees and other contemporary migrants, along with a small number of Polish Americans and WWII émigrés who played salient roles. The migrants utilized cross-national networks and bi-cultural knowledge to create a nonprofit organization to promote investment in Poland’s emerging private sector economy, which they also defined as political support for the new government. The transnational networks of these contemporary Polish migrants in the U.S. were simultaneously embedded in both the home and host countries.

The aim of the paper is to reconsider Habermas’ discourse approach in terms of its usefulness in the realm of public healthcare where, on a microscale, intersubjective communicative situations arise between defined participants, i.e., patients and healthcare providers, patients’ family members, and further eligible contributors to patient-related decision making. A need for more “communicative interaction,” and explicative and practical discourse, is illustrated by two empirical examples of medical decision making which reveal both communicative and discursive deficits (Section I). To empower and enable the patient as a rational and autonomous speaker and discourse participant, a Habermasian emancipatory argument and ‘the power of the better argument’ is recalled (Section III). The possibility of equal communicative and discursive rights in the light of real inequalities is discussed in the context of a ‘competence gap’ between participants (Section IV). Further sections focus on the importance of informed consent on the side of the patient and the communicative competences as an important factor of healthcare system.

Opis:
The article focuses on inactivity of the public administration in the Slovak Republic. It analyses this malfunction of the public administration from the point of view of the legal theory, international legal regulation as well as national legal regulation. The emphasis is on the national legal regulation that should provide effective legal remedies on how to eliminate inactivity of the public administration – namely the Constitution of the Slovak Republic, the Act on Administrative Proceeding and the Act on Administrative Justice Procedure. The article analyses the new legal regulation on a judicial review of inactivity stipulated in the Act on Administrative Justice Procedure and compares it with the previous legal regulation. The aim is to conclude which legal regulation is more effective and describe why it is so.

The relationship between religious faith and public reason has occupied an increasingly central role in  Jürgen Habermas’s mature work. Yet this recent engagement with questions of  religious meaning also illuminates a  significant area of development in Habermas’s thought. While his earlier writings emphasized a  need to  subordinate religious beliefs to  rational critique and to translate religious truth claims into publicly accessible forms of reasoning, his later writings signal a shift to a more cooperative understanding of religious faith and critical reason that highlights the ongoing potential of religion to advance rational discourse and social criticism in the public sphere. This essay traces this growing recognition of the irreducibility of religious meaning in Habermas’s writings, and it attends to the non-translatable dimension of religious faith as a source of its ongoing contemporary significance.

As of 28 April 2017, amended provisions of the Public Finance Act are in force regarding the granting of relief in repayment of monetary receivables of a civil-law nature falling to government administration bodies, state budgetary units and state customs funds (e.g., fees from the lease or rental of real estate, costs of court proceedings), and non-tax budgetary receivables of a public-law nature (fines imposed by way of a penalty ticket, fines, administrative fees). The amended provisions of the Public Finance Act: with respect to civil law debts, they clearly specify when debts may be written off ex officio and when at the debtor’s request (Article 57), and they unify the premises for granting preferences in repayment of debts, which are general clauses: “important interest of the debtor” and “public interest.” The Act provides for the possibility to write off part of a debt, postpone repayment dates of all or part of a debt, or spread payment of all or part of a debt in installments – if justified by social or economic reasons, particularly the debtor’s ability to pay. Since the application of these reliefs will have a more lenient effect on the State Treasury, the body granting the relief will be able to rely on grounds other than full write-off, such as social or economic reasons, e.g. the debtor’s limited ability to pay.  
Od 28 kwietnia 2017 r. obowiązują zmienione przepisy ustawy o finansach publicznych, dotyczące udzielania ulg w spłacie należności pieniężnych mających charakter cywilnoprawny, przypadających organom administracji rządowej, państwowym jednostkom budżetowym i państwowym funduszom celowym (np. opłaty z tytułu najmu lub dzierżawy nieruchomości, koszty postępowań sądowych), oraz niepodatkowych należności budżetowych o charakterze publicznoprawnym (np. grzywny nakładane w drodze mandatu karnego, kary pieniężne, opłaty administracyjne). Zmienione przepisy ustawy o finansach publicznych: w zakresie należności o charakterze cywilnoprawnym wyraźnie określają, kiedy należności mogą być umarzane z urzędu, a kiedy na wniosek dłużnika (art. 57), oraz ujednolicają dla przesłanki udzielania preferencji w spłacie należności, stanowiące klauzule generalne: „ważny interes dłużnika” oraz „interes publiczny”. Ustawa przewiduje możliwość umorzenia należności w części, odroczenia terminów spłaty całości albo części należności lub rozłożenia na raty płatności całości albo części należności – gdy jest to uzasadnione względami społecznymi lub gospodarczymi, w szczególności możliwościami płatniczymi dłużnika. Ze względu na fakt, że zastosowanie tych ulg będzie wywoływać łagodniejsze skutki dla Skarbu Państwa, organ udzielający ulgi będzie mógł kierować się innymi niż przy całkowitym umorzeniu należności przesłankami, takimi jak względy społeczne lub gospodarcze, np. ograniczone możliwości płatnicze dłużnika.

Opis:
The article reviews the jurisprudence of Lithuanian courts on private enforcement of competition law and identifies the main obstacles for the development of this practice. The analysis of the jurisprudence makes it possible to summarise that: most rulings of the Lithuanian courts relate to cases on the abuse of dominance; usually, dominant undertakings were allegedly applying discriminatory conditions towards the injured party and; most of the claims were presented as follow-on actions after a decision of the Competition Council. The courts held that damages caused by a breach of competition law have to be recovered in accordance with Lithuania’s main principles of civil responsibility. At the same time, the courts made it clear that their jurisprudence is based on the rulings of European Courts and the main principles of EU competition law. The main obstacles for the successful development of antitrust damages claims in Lithuania are, inter alia: complexity of competition cases; difficulty in obtaining substantive evidence; proving a consequential relationship and; high legal costs. The article also analyses substantial and procedural provisions of Lithuanian legislation that regulate the submission of antitrust damage claims.
