The aim of this paper is to present the legal nature of the Convention for the Protection of Human Rights and Fundamental Freedoms as a special treaty under international human rights law. Second, it presents the Convention as the source of fundamental individual human rights. The article also discusses the role of ECtHR case law in the context of fundamental individual human rights.

The scale of immigration problems in Europe today is well-known and broadly dis-cussed. The article identifies how this issue is reflected in two Human Rights Council mechanisms: Special Procedures and the Universal Periodic Review. The Special Rap-porteur on the human rights of migrants, François Crépeau, undertook a regional study on the management of the external borders of the European Union and its impact on the human rights of migrants. The analysis of the annual and country visits’ reports allows the main immigration problems facing the EU countries and threats for the protection of human rights to be identified. The recommendations made by the Special Rapporteur are confronted with those taken up in the UPR process. Special attention is given to the EU countries’ position on the problem of immigrants. Their reluctance to raise this issue in the UPR weakens the credibility of EU Member States and puts the objectivity of the mechanism into question.

The aim of this article is to present the liability of Russia and Ukraine regarding Crimea under the European Convention on the Protection of Human Rights. The author analyzes pending and possible prospective cases originating from the conflict around Crimea between Ukraine and Russia. Due to the inconsistency in case law of the EC-tHR it is difficult to clearly determine what state will be considered responsible for the violation of the rights of residents of Crimea resulting from the Convention. In author’s opinion the ECtHR could determine that the Russian Federation may be held respon-sible, as well as Ukraine. However, as it seems, the liability of Ukraine will be limited to the positive obligations under the ECHR.

The aim of this article is to present the European Committee of Social Rights as a moni-toring treaty body in the system of the European Social Charter. The author pays par-ticular attention to the mechanism of collective complaints, which was introduced to the Charter’s supervisory system on the basis of the 1995 Additional Protocol. In the author’s opinion, on the basis of the competence of the European Committee of Social Rights to hear collective complaints, it is arguable that this important treaty body in the system of the European Social Charter performs the function of a quasi-judicial organ in the monitoring process, which distinguishes it from other treaty bodies in the field of the international protection of human rights

Among the member states of the Council of Europe, there is a consensus on the importance of vaccination as a successful and effective preventive health intervention. Every state aims to achieve herd immunity, i.e., a high vaccination rate of the population that will prevent the circulation of contagious diseases in the population and thus protect those who cannot be vaccinated due to age or poor health. However, despite the general recognition of the importance of vaccination, there is no consensus on a “single model” of how best to achieve the goals of mass immunization. Countries have different public health policies, so while the vaccination policy of some members of the Council of Europe is limited to a recommendation, others have made vaccination compulsory. Today, there are many opponents of vaccination and those who are hesitant. This paper will focus on those who refuse to be vaccinated based on a moral understanding of how to act in certain circumstances. The paper will explore whether countries imposing mandatory vaccination, with financial or other sanctions imposed in the case of non-compliance, should recognize the right to conscientious objection. This includes the right of adults to refuse vaccination, and respecting the religious and philosophical beliefs of parents who refuse to vaccinate their children. The article consists of two main parts. The first part will explore the legal-theoretical and legal-philosophical dimensions of the relationship between justice and conscience, with special emphasis on the interpretation of this relationship provided by the American political philosopher John Rawls. The second part of the paper will examine the issue of compulsory vaccination and conscientious objection through the prism of the rights provided for in the Convention for the Protection of Human Rights and Fundamental Freedoms.

Opis:
The new Albanian Family Code provides an additional measure reading the protection of the child, namely, the “loss of parental responsibility.” Differently from the measure of “removal of the parental responsibility” that is provided in the civil code provisions, this new measure has been introduced for the first time in the Albanian legal framework and is taken by court through a penal process. Thus, according to article 223 of the Family Code, “the parents of a child may loose the parental responsibility through a penal court decision that has found them guilty of committing themselves or assisting in the commitment of a criminal offense against their child. They may also loose it if they have been convicted for any of the reasons regarding the abandonment of the family and have not fulfilled the related obligations.” This paper aims to analyse and interpret the introduction of this new measure which has caused difficulties regarding its practical application by courts. The authors of the paper analyse the legal features of the measure and the controversies of the doctrine in relation to such a measure. They also suggest the categorization of the new measure as a punishment of a penal nature, i.e as a supplementary punishment. The paper also analyses the cases where the measure is likely to be applied and the terms applicable to the individual that will be subjected to this measure. The paper reviews also the time frame of the application of the new measure. The current legal framework does not contain a specific provision regarding this issue. In light of the evolution of the concept of the parental responsibility as well as the perspective of human rights protection the authors support the idea of the regulation of the time limits of the measure. The authors argue that in the determination of the time limits of the application of the measure (including the possible return of the parental rights), it is important the courts maintain a fair balance between the loss of parental responsibility and the respect of rights of the biological parent, in the highest interest of the child, to be raised and educated in the family of origin. At the end of the paper the authors also suggest the need to improve de lege ferenda the current provisions in order to ensure that the application of the new measure meets its purposes, i.e the removal of the parental rights is applied only in those cases where the parents are considered unfitted to exercise this right over their children.

Along with the development of the SARS-CoV-2 pandemic, the Polish legislator, by introducing restrictions on the principle of openness in administrative court proceedings, finally decided to exclude the possibility of conducting hearings in court buildings. Currently, it is only possible to proceed in closed session or in the form of a remote hearing – i.e. with the use of technical devices enabling simultaneous direct transmission of vision and sound. The aim of the article is to assess the “Covid regulations” introduced into the Polish legal system, limiting the right of the parties to open hearing of a case pending before administrative courts in terms of the regulations on the right to a fair trial contained in the Convention for the Protection of Human Rights and Fundamental Freedoms.

The article is devoted to the study of the correct application of the evaluative concepts contained in the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms. Attention is drawn to certain difficulties in the application of the evaluative norms in the Convention: despite their objective necessity and usefulness, they create a room for the law enforcement entity’s own discretion up to subjectivism in resolving specific cases; they serve as an objective obstacle to the unification of the case law of the ECtHR and this creates preconditions for unequal implementation of ECtHR judgments in the national legal order; they cause the risk of errors in the application of the provisions of the Convention by the competent authorities of the Contracting States. It is established that the application of legal norms containing evaluative concepts is challenging not only owing to the specific properties of the evaluative concepts themselves, but also due to the peculiarities of adjudication by the ECtHR when applying the evaluative norms. The relevant case law of the ECtHR as well as examples of national legislation are analysed in support of these theoretical conclusions. Since the lack of uniform application of the evaluative norms of the Convention causes divergent use of the ECtHR’s judgments in the domestic judicial system, it is advised to follow a number of rules for reasoning of decisions by the domestic court. These rules will serve as a certain guarantee against ambiguous implementation of ECtHR judgments at the national level.

At the beginning 2020, the vast majority of countries worldwide were forced to confront and face the SARS-CoV-2 pandemic. The rapid spread of this new disease resulted in radical changes in the basic principles of the functioning and organization of states and entire societies. The novel circumstances which both nation states and the international community are facing induce reflection on the need of redefining the right to privacy. This paper aims to answer, whether the current situation will lead to lasting changes in the way privacy is now perceived in Europe and what threats may be associated with the possible changes.
Początek 2020 r. zmusił zdecydowaną większość państw świata do skonfrontowania się z pandemią wirusa SARS-CoV-2. Tempo rozprzestrzeniania się nowej choroby wymusiło szybkie i radykalne zmiany w zasadach funkcjonowania i organizacji państw oraz całych społeczeństw. Nowe okoliczności skłaniają ku refleksji nad redefinicją prawa do prywatności zarówno na gruncie rozwiązań krajowych, jak i w ramach prawa międzynarodowego. Celem niniejszego artykułu jest próba odpowiedzi na pytanie, czy obecna sytuacja doprowadzi do trwałych zmian w dotychczasowym postrzeganiu prawa do prywatności w Europie oraz jakie zagrożenia mogą zaistnieć w efekcie ich wystąpienia.

This paper analyzes how the approach of the European Union to the protection of fundamental rights evolved. It focuses on primary legislation, which ranks highest in the hierarchy of EU sources of law. For this purpose, the author examines the Founding Treaties, the Reform Treaties, and the Charter of Fundamental Rights. The paper focuses on modifying the Treaties due to the complexity of the subject matter. The considerations discussed in this paper set the ground for the outline of the formation of a multi-level system of human rights protection in the European Union, as well as for the presentation of the current state of the law, which undoubtedly constitutes an important contribution to the regulation of the issue discussed.
Niniejszy artykuł stanowi analizę ewolucji podejścia Unii Europejskiej do kwestii ochrony praw podstawowych. Opracowanie skupia się na aktach prawa pierwotnego stojących najwyżej w hierarchii unijnych źródeł prawa. W tym zakresie przeanalizowano pod tym kątem traktaty założycielskie jak i traktaty rewizyjne a także Kartę Praw Podstawowych. Z uwagi na złożoność zagadnienia i ograniczenia objętościowe niniejszej publikacji skonkretyzowano się na kwestiach dotyczących modyfikacji treści Traktatów. Na podstawie dokonanych rozważań zakreślono proces kształtowania się wielopoziomowego systemu ochrony praw człowieka w Unii Europejskiej a także aktualny stan prawny, który stanowi niewątpliwie istotny wkład w uregulowaniu tego aspektu.

Zagadnienia związane z ochroną przed torturami lub innym nieludzkim czy poniżającym traktowaniem uregulowane są w systemie europejskim nie tylko w Europejskiej Konwencji Praw Człowieka, ale również w Europejskiej Konwencji Przeciw Torturom, którą Komitet Ministrów Rady Europy przyjął 26 czerwca 1987 r., ratyfikowanej obecnie przez wszystkie 47 państw Rady Europy. Jest ona ważnym uzupełnieniem przede wszystkim w zakresie mechanizmu kontroli. Uznano, że system ochrony oparty na skargach indywidualnych i skargach między państwami należy wzmocnić środkami o charakterze prewencyjnym. Wiele sytuacji, w których na państwie ciążą poważne obowiązki, aby nie doszło do naruszenia art. 3 Konwencji, ma miejsce w związku z postępowaniem karnym prowadzonym przez organy uprawnione do realizowania zasady legalizmu. W tym miejscu podnieść niestety należy, iż pomimo ratyfikowania przez nasz kraj powyżej wskazanych aktów prawnych, właśnie w trakcie prowadzonych postępowań przygotowawczych w sprawach karnych najczęściej dochodzi do naruszeń praw człowieka w kontekście nakazu godnego i humanitarnego traktowania osób podejrzanych, czy już oskarżonych. Państwo musi zapewnić, aby postępowania te odbywały się w warunkach wskazujących na poszanowanie ludzkiej godności, a procedury i metody pozyskiwania dowodów obciążających podejrzanych nie powodowały u świadków czy też podejrzanych udręki lub cierpienia, których skala i intensywność przekraczałyby potrzeby procesowe osobistego zabezpieczenia osoby podejrzanego dla celów postępowania karnego, przy zachowaniu wymogów procedury karnej dotyczącej zatrzymania oraz stosowania środka zapobiegawczego w postaci tymczasowego aresztowania.
Issues connected with protection against tortures or other forms of inhuman or degrading treatment are regulated in the European law not only in The Convention for the Protection of Human Rights and Fundamental Freedoms, but also in The Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which was adopted by The Committee of Ministers of the Council of Europe on June 26, 1987 and later ratified by all 47 countries of The Council of Europe. It is a key element in amending the control system. It has been agreed that the system based on individual and international pleas should be supported by preventive measures. Various situations in which the state has serious obligations so as to protect art. 3 of the Convention, take place following criminal proceedings by organs entitled to act according to legislation. It ought to be mentioned that despite our country’s ratification of the above mentioned legal acts, while conducting pre-trial proceedings in criminal cases, the violation of basic human rights and inhumane treatment of the suspects or the accused happen the most often. The state is responsible for securing proper conditions that would grant respect for one’s dignity and the procedures and methods of obtaining incriminating evidence are not to cause suffering whose scale and intensity would surpass needs of personal security of the accused or suspects during the proceedings in criminal trials, with respect to the legal procedures regulating the arrest and the use of preventative measures in form of a detention order.

The aim of the study is to discuss the protection of the rights of persons with disabilities un¬der the system of law of the Council of Europe. In particular, the focus is on the rights of per¬sons with disabilities to independence, social integration, and participation in the life of the community under the European Social Charter (ESC). This paper covers both an analysis of the Charter, with special attention paid to Article 15, and an examination of the decisions of the European Committee of Social Rights (ECSR) with respect to this provision. Besides the regulation of these rights at the European level, this paper also discusses different examples of state regulations’ conformity or non-conformity with Article 15 ESC.
