PL (product liability) response system is an enterprise-wide system that prevents company’s financial loss due to PL-related accidents. Existing researches on PL response system are mainly focused on preventive and/or defense strategies for the companies. Also, it is obvious that each industry has their original characteristics related on PL issues. It means industryspecific characteristics should be considered to adopt PL response strategies. Thus, this paper aims to discuss industry-specific PL response system and their components. Based on prior researches, we tried to reveal the possibility of its application to manufacturing companies of existing PL response strategies using Delphi method with PL experts. Based on first round results, we tried to classify existing PL strategies of manufacturing companies into several categories. To validate our suggestion for essential components of PL response system, second round Delphi method are applied. Analytic hierarchy process (AHP) technique will be applied to identify a prioritized list of each components and strategies. Existing PL response strategies could be categorized with six components - strategy, technology, investment, training, awareness, and organization. Among six components, Technology - it represents the technology needed for improving the safety of all products – is the most important components to prepare PL accidents. The limitation of this paper is on the size of survey and variety of examples. However, the future study will enhance the potential of the proposed method. Regardless of rich research efforts to identify PL response strategies, there is no effort to categorize these strategies and prioritized them. Well-coordinated and actionable PL response strategies and their priorities could help small-and-medium sized enterprise (SME) to develop their own PL response system with their limited resources.

Opis:
Maritime law is being faced with developments in design and production of autonomous vessels. With the rise of new technologies different risks emerge while traditional cease to exist. This paper suggests possible scenarios in relation to development of law relating to unmanned vessels. Second part of the paper is dedicated to analysis of the IMO civil liability convention and its application to autonomous ships on the example of the CLC.
Prawo morskie stoi wobec nowych wyzwań spowodowanych pojawieniem się statków autonomicznych, zwanych również bezzałogowymi. Wraz z rozwojem nowoczesnych technologii pojawiają się nowe ryzyka, podczas gdy dawne ulegają marginalizacji. Poniższy artykuł proponuje możliwe scenariusze rozwoju regulacji prawnej dotyczącej statków autonomicznych. Jego druga część poświęcona jest analizie postanowień konwencji IMO o odpowiedzialności cywilnej i ich zastosowania do statków bezzałogowych na przykładzie CLC.

Polish regulations provide a variety of mechanisms of liability for damages caused by medicinal products and medical devices, including a fundamentally significant mechanism – civil liability. Such a liability may assumed by different categories of entities, including their producers, trading entities or entities conducting medicinal activities and using medicinal products/ medical devices under the subject’s activities. The civil liability regime of entities conducting medicinal activities is conditional upon the formal and legal status of the entity conducting medicinal activities and the relationship binding them with a patient on the basis of tortious and contractual principles. Statutory obligations to apply such liability regimes may frequently prevent (or even inhibit) the rectification of damage caused by medicinal products and medical devices, which gives rise to proposals to modify the general principles of liability and seeks solutions to provide an optimal system of compensation for such damages.

The subject of the considerations presented in the article are issues related to the liability for placing unsafe innovative food on the market. They are aimed at answering the question of whether the tort liability regime based on the risk principle meets the requirements of the modern agri-food sector and provides effective protection of consumer’s health and life against threats that may result from product innovations. The adoption of legal solutions providing for producer’s strict liability for an unsafe product must be assessed positively. They facilitate the consumer’s ability to seek redress for damage caused by an unsafe product. Unfortunately, these regulations do not take into account fully the specific nature of food, especially innovative food, limiting the possibility of redressing damage caused by this type of food.
L’articolo si propone di dibattere il problema di responsabilità per aver introdotto sul mercato alimenti innovativi pericolosi. L’obiettivo è quello di stabilire se il regime di responsabilità delittuosa, basato sul principio di rischio, soddisfi i requisiti richiesti dal settore agroalimentare odierno e protegga con efficacia la salute e la vita dei consumatori di fronte alle minacce che possono derivare dall'applicare innovazioni nei prodotti. La definizione di soluzioni giuridiche che prevedano la responsabilità del produttore in termini di rischio per un prodotto pericoloso va valutata positivamente in quanto, per il consumatore, diventa più facile richiedere i danni causati da questo tipo di prodotto. Purtroppo, però, le regolazioni in questione non tengono pienamente conto della specificità degli alimenti, soprattutto degli alimenti innovativi, limitando così la possibilità di riparare i danni causati.
