Opis:
Article 32 of the EU General Data Protection Regulation imposes the obligation to implement appropriate safeguards to protect personal data. It states that the application of adequate measures is to be preceded by a risk analysis and evaluation. In the current paper, as the main risk factors, probability and consequences were assumed that take into account the basic attributes of information, i.e. confidentiality, integrity and availability. Next, a risk analysis methodology based on the risk matrix is proposed. The issue discussed in the publication is currently valid and still requires careful analysis in order to develop universal standards aimed at establishing certification mechanisms as well as quality labels and markings in terms of personal data protection.

Purpose – The purpose of the article is to present the essence of innovation and possible innovative activities affecting the increase in the efficiency of personal data management in medical entities. The article concerns the cross-border processing of personal data carried out by the Catholic Church entities in the context of the emigration of the faithful. Processing of the data of believers takes place, for example, in the formalities related to preparation for entering marriage. From the point of view of canon law the article deals with such issues as: the legality of the process of cross-border data processing, the obligations of the data controller carrying out such a process and the role of the supervisory authority.

The aim of this article is to familiarize the Reader with the outline of the General Data Protection Regulation 2016/679 with a special emphasis put on its part that will be the most troublesome for the entities processing the personal data- monetary and nonmonetary sanctions. It is undoubted that never before have we faced a piece of legislation that can be of such a big importance not only because of the scope of its regulation but also because of its potential detrimental effects for the functioning of the market seen from the point of view of penalties threatening those processing the personal data. Due to the commonness of the employment relationships I decided to make them the basis for my reflections concerning the topic. It is even more relevant as the revolutionary character of the General Data Protection Regulation also results from the change in the attitude towards instructions and guidelines specifying the minimal scope of the protection of the processed personal data.
Celem niniejszego artykułu jest zapoznanie Czytelnika z zarysem Rozporządzenia o Ochronie Danych Osobowych 2016/679, ze szczególnym naciskiem na tę jego część, która będzie najbardziej problematyczna dla podmiotów przetwarzających dane osobowe – sankcji pieniężnych i niepieniężnych. Niewątpliwie nigdy wcześniej nie mieliśmy do czynienia z regulacją, która może mieć tak duże znaczenie nie tylko z powodu zakresu swojego normowania, ale także z powodu potencjalnych negatywnych skutków dla funkcjonowania rynku rozpatrywanych z punktu widzenia kar grożących podmiotom przetwarzającym dane osobowe. Z powodu powszechności stosunków zatrudnienia zdecydowałem się, by oprzeć na nich moje rozważania dotyczące tematu. Zabieg ten jest jeszcze bardziej aktualny z uwagi na fakt, iż rewolucyjny charakter Rozporządzenia o Ochronie Danych Osobowych wynika również ze zmiany podejścia do instytucji instrukcji i wytycznych określających minimalny zakres ochrony przetwarzanych danych.

Opis:
The right to the protection of personal data, which is part of the right to privacy, is a fundamental human right. Thus, its guarantees were included in the high-level regulations of the European Union as well as the legal norms of the EU Member States. The first Polish law regulating the protection of personal data was adopted in 1997 as the implementation of EU Directive 95/46. The law imposed a number of obligations on public and private entities which process personal data in order to protect the rights of data subjects and, in particular, to guarantee them the ability to control the correctness of processing of their personal data. Therefore, the law obliged data controllers to process data only on the basis of the premises indicated in the legislation, to adequately secure data, and to comply with the disclosure obligation concerning data subjects, including their right to correct false or outdated data or to request removal of data processed in violation of the law. However, as complaints directed by citizens to the supervisory body-the Inspector General for Personal Data Protection-showed, personal data controllers, especially those operating in the private sector, did not comply with the law, acting in a manner that violated their customers’ rights. In the hitherto existing unfair business practices of entrepreneurs, the violations of the data protection provisions that were the most burdensome for customers were related to preventing them from exercising their rights, including the right to control the processing of data, as well as the failure to provide the controller’s business address, which made it impossible for subjects whose data were used in violation of the law or for the inspecting authorities to contact the company, a lack of data security and a failure to follow the procedures required by law, the failure to secure documents containing personal data or their abandonment, a lack of updating customer data, the use of unverified data sets and sending marketing offers to deceased people or incorrect target recipients, and excessive amounts of data requested by controllers. The violations of the rights of data subjects recorded in Poland and other EU Member States-among other arguments-provided inspiration for the preparation of a new legal act in the form of the EU General Data Protection Regulation (GDPR) (which entered into force on 25 May 2018). The extension of the rights of people whose data are processed was combined in the GDPR with the introduction of new legal instruments disciplining data controllers. Instruments in the form of administrative fines and the strongly emphasised possibility to demand compensation for a violation of the right to data protection were directed in particular against economic entities violating the law.

The police process huge amounts of personal data without which they would not be able to carry out their basic tasks. The data processed by the police have a very different nature and scope. Data processing in such large quantities and in such a wide range is associated with great responsibility for its safety. Maintaining a high level of security becomes a challenge when, at the same time, it is necessary to take care of the rights of data subjects. The article contains an overview of administrative decisions issued by the Inspector General for Personal Data Protection (currently: the President of the Personal Data Protection Offi ce) relating to police activities. The issues of the implementation of the rights of data subjects are discussed in three areas, i.e.: sharing information from police resources, deleting data from the National Police Information System, and verifi cation of identity documents.

Purpose – The purpose of this article is to identify and indicate the basic issues of employee moni-toring that arise in the field of economic and legal sciences from the perspective of employers, such as the factors motivating employers to use various forms of employee monitoring, current conditions of such activities resulting from state law and the European Union law, as well as potential threats to employers using broadly understood monitoring. Research method – Dogmatic and statistical methods, the analysis of legal acts and research results, as well as literature studies and observations of practice were used to prepare the article.Results – The possibility of using modern technologies to monitor employees is an important tool in the pursuit of effective organization of working time, although there is a lack of studies showing whether the monitoring methods offered on the market actually increase work efficiency. The actual needs of employers with regard to various forms of monitoring are not reflected in the provisions of the Labor Code. Employers should approach employee monitoring with caution, because inapprop-riate actions in this area may have negative effects.Originality / value / implications / recommendations – The article concerns issues of significant impor-tance from the perspective of not only Poland, but also other European Union countries, current in the realities of the pandemic and based on the latest legal regulations.

In the European Union, in the first half of 2018, the General Data Protection Regulation came into force, which established the new rules for processing users’ personal data for IT companies. The operating systems (OS) are the dominant software that is responsible for collecting and processing data in computer systems. The most common OS is the Windows OS family. The authors identified Windows 10 operating systems, that collect and accumulate user's personal data; developed and tested practically an algorithm, the application of which localizes and blocks the transfer of user's personal data to official servers of the Microsoft company.
W Unii Europejskiej w pierwszej połowie 2018 r. weszło w życie ogólne rozporządzenie o ochronie danych, które ustanowiło nowe zasady przetwarzania danych osobowych użytkowników dla firm informatycznych. Systemy operacyjne są dominującym oprogramowaniem odpowiedzialnym za zbieranie i przetwarzanie danych w systemach komputerowych. Najpopularniejsza obecnie jest rodzina systemów operacyjnych Windows. W artykule autorzy zidentyfikowali systemy operacyjne Windows 10, jako zbierające i gromadzące dane osobowe użytkowników; opracowali i przetestowali w praktyce algorytm, którego zastosowanie lokuje i blokuje transfer danych osobowych użytkownika na oficjalne serwery firmy Microsoft.

The purpose of this paper is to explore whether the processing of personal data under Regulation 2017/226 is compatible with the principle of proportionality in the light of Charter of Fundamental Rights of the EU and the case-law of the Court of Justice of the European Union (CJEU). The Regulation 2017/2226 provides the EES system which is the only system that collects the entry/exit data of all third-country nationals entering the Schengen area for a short stay, whether via a land, sea or air border. The EES replaces the current system of manual stamping of passports.
