The author analyzes and compares various meanings of the concept of equity such as they were conceived by prominent personalities of the history of the juridical, ethical and philosophical ideas in order to deduct their common contents. Having ethical and juridical connotations, the vision on equity and on applying its principles into the law-making process, into achieved the act of justice and in all kind of public authorities decision-taking process are differently designed at micro-groups level compared to the macro-social layer. The practical achievement of equity and justice is the privilege of the just person. The rightful person’s personality in the contemporary democratic societies may be considered as an ideal prototype which should be found in a larger extent, in the effective functioning of the institutions under the rule of law – at the level of human resources, with as much possible appropriate compliance with this prototype.

This article is devoted to current practices concerning the application of general principles of law in the light of their function in the international legal system. As a means of the application and interpretation of both treaty and customary law, general principles of law perform a crucial function in the system of international law, which is understood as set of interrelated rules and principles – norms. Te role played by general principles of law in the international legal order has been discussed by academia for years now. Initially they were used to ensure the completeness of the system of international law. However, at the current stage of development of international law, when many of them have been codified, they are usually invoked by international courts for the interpretation of treaties and customary law and/or the determination of their scope. This means that despite their ongoing codifcation they do not lose their character as general principles and are still applied by international courts in the process of judicial argumentation and the interpretation of other norms to which they are pertinent. References by international courts to general principles of law perform the allimportant function of maintaining the coherence of the international legal order, which is faced with the twin challenges of fragmentation and the proliferation of international courts.

In democratic legal systems there is a wide variety of instruments which profoundly affect the composition of future parliaments. They can cause significant changes in final results of both the parliamentary and municipal election. Due to them political parties can improve their position in emerging legislatures (gmina councils, poviat councils or sejmiks of the voivodeship), or even, I mean smaller formations in the first place, can guarantee any representatives in the chamber (council, sejmik). Politicians make use of these instruments most frequently in the face of the oncoming election. These mechanisms allow, on the grounds of binding law, to cause a result much worse than expected for the opposition or formations competing for power. In countries with deeply rooted democracy, it is most often a good political habit that makes any changes in the Electoral law take place long from the election. In our political reality, however, it is a rule that the election campaign is accompanied by auctions on legal grounds. Namely, changes in the borders of election districts take place, vote calculation methods are modernised so that they would be naturally beneficial for those who carry out such normative transformations.

In the literature, the sources of law are considered to be “a formalised act of state authority containing legal provisions”.1 In order to assess the nature of a designated act of state authority as a source of law, its form and the appropriate procedure are important. Therefore, the basic objective of the article is to demonstrate the sources of making tax law, with a particular emphasis on their classification in the tax law system. In fact, the position of particular types of sources of law in the system depends on three types of factors, such as: the position in the system of public authorities from which the source of law comes, its contents and the mode of its creation. Only a cumulative analysis of these three factors allows the prioritization of the legal acts constituting the sources of tax law. Despite notable achievements in the body of relevant literature, an attempt was made to re-analyse it in order to systematize the concepts and principles related to the subject matter in question. Furthermore, the jurisprudence was examined to emphasize that the sources of tax law also constitute a matter of argument in the judicature. Analysis of legal regulations in force and empirical methods were used as the basis for the study.

International law reflects systemic conditions compatible with its essence, which means that a space must exist inside the borders of that order for the presence of the phenomenon of general principles. The assumption that international law is a legal system ipso facto means that general principles must exist within its borders. A general principle of law is a necessary element of every legal order. It is a form and a tool in which the efforts of the individual seeking to comprehend a given phenomenon are materialized through imposing order on it rather than by breaking it down into unconnected and independent elements. Since law is an expression of order, law therefore applies general principles. The systematicity of law, and therefore of international law as well, creates the primary source of the binding force of any norm. Considerations of natural law or positive law justifications for the presence of general principles in international law are of little consequence, as the source of general principles is the systemic nature of the law. Order and hierarchy are part of the rationalized system in which norms of law present themselves. This dependency applies also to norms of international law. The role of the judge is to fill in the appropriate normative content (general principles) in fields constituting at one and the same time both a necessary element and a consequence of the systemic character of the international legal order. Within this context the principle of good faith constitutes one of the bases for considerations concerning the extent of the international legal order. The extent of international law reaches as far as the extent to which evidence of good faith are present among the subjects of international law. The impossibility of describing relations between two states by the use of the determinants of good faith, translated in turn into a normative general principle, determinates the limits of international law.

The purpose of this article is to a%empt to provide a more precise answer to the question of Paul Vladimiri’s (Latin: Paulus Vladimiri; Polish: Paweł Włodkowic) account of the concept of permissive natural law. This purpose is realized in two steps. First, a brief history of permissive natural laws in the tradition of medieval philosophy is discussed, and the historical context, in which Paul Vladimiri developed his theory of natural law, is outlined. Next, some excerpts from Vladimir’s writings are analysed, in which he uses phrases indicating the presence of the concept of permissive law in his philosophy.

Establishing good law has been an old dream of humanity. Back in ancient times leaders such as Hammurabi, Solon, and especially Justinian the Great, and many others, while attempting to codify and reform the law, were driven by the ideal of “good law”. ! is same idea inspired Montesquieu in his De l’esprit des lois (“! e Spirit of the Laws”). Monumental legal acts in Napoleon’s times or the time of German unifi cation, as well as copying these acts into the legal systems of the countries of the Far East, for example, Japan, serve as additional examples on how tempted leaders have been able to implement the idea of “good law”, which, quite frequently, is directly stated in the preamble to leading legal acts.
