The purpose of a grammatical theory is to specify the mechanisms and principles that can characterize the relations of acceptable sentences in particular languages to the meanings that they express. It is sometimes proposed that the simplest and most explanatory way of arranging the formal mechanisms of grammatical description is to allow them to produce unacceptable representations or derivations for some meanings and then to appeal to a global principle of economy to control this overgeneration. Thus there is an intuition common to many syntactic theories that a given meaning should be expressed in the most economical way, that smaller representations or shorter derivations should be chosen over larger ones. In this paper we explore the conceptual and formal issues of Economy as it has been discussed within the theory of Lexical Functional Grammar. In LFG the metric of Economy is typically formulated in terms of the size of one component of syntactic representation – the surface constituent structure tree – but it is often left unstated which trees for a given meaning are to be compared and how they are to be measured. We present a framework within which alternative explicit definitions of Economy can be formulated, and examine some phenomena for which Economy has been offered as an explanation. However, we observe that descriptive devices already available and independently motivated within the traditional LFG formalism can also account for these phenomena directly, without relying on cross-derivational comparisons to compensate for overgeneration. This leads us to question whether Economy is necessary or even useful as a separate principle of grammatical explanation.

Opis:
Study towards the notion of liberty remains relevant at any time since the idea of freedom remains a basis of the contemporary democracies and other modern liberal political regimes. This article traces the differences between the two theoretical approaches towards the liberty: of the ancient Greek philosopher, Plato and the British economist and politician of the XIX century, John Stuart Mill. The research reveals common features of the concepts: while Plato can be considered to be a representative of the ancient philosophy with the peculiar comprehending of liberty notion, John Stuart Mill, adhering liberalist views, proposes the classical understanding of the concept. Moreover, the article will contribute to the distinguishing between the contemporary perception towards the freedom and the ideas of philosophers of the past. In addition, the research is based on the comparative analysis of the following criteria: the authors' attitude to the concept of liberty in general, views on the freedom of speech, freedom of expression, freedom of the will, approaches to the political regimes, like tyranny and democracy, opinions about the necessity of customs, as well as about the issues of individuality, personal development, and the system of citizens' control.

Works of art often refer to privacy or the freedom of conscience and religion. The goal of the study is to contribute to the discussion on resolving conflict situations arising from the way of reception of art and to point out circumstances worth taking into consideration while choosing measures intended to prevent conflicts or at least minimize the effects of conflict situations that have already occurred. That is why it appears indispensable to consider difficulties in defining art-related concepts basing on social science, and to present artistic creation as a form of expression, as well as to analyze the determinants of the freedom of artistic creation as a law-protected interest in the political-legal system in the situation of conflict with other human rights.
Dzieła sztuki często nawiązują do prywatności lub wolności sumienia i religii. Celem opracowania jest przyczynienie się do rozwoju dyskusji na temat rozwiązywania konfliktowych sytuacji wynikających ze sposobu odbioru sztuki oraz wskazanie okoliczności wartych uwzględnienia podczas wyboru działań mających zapobiegać konfliktom lub przynajmniej minimalizować skutki już zaistniałych sytuacji konfliktowych. Dlatego jako niezbędne jawi się rozważenie trudności w definiowaniu na gruncie nauk społecznych pojęć związanych ze sztuką oraz przedstawienie twórczości artystycznej jako formy wypowiedzi, a także przeprowadzenie analizy uwarunkowań wolności twórczości artystycznej jako dobra chronionego w systemie polityczno- -prawnym w sytuacji konfliktu z innymi prawami człowieka.

The phrase ‘libel tourism’ appeared for the first time in 1990, when a Hollywood star ArnoldSchwarzenegger sued American author Wendy Leigh for his unauthorized biography in an English court[Rayner 2010; Sanchez 2011]. A number of recent cases included wealthy libel tourists such as NicoleKidman, David Hasselhoff, Roman Polański, Jennifer Lopez, Marc Anthony, Britney Spears, Tiger Woodsand Cameron Diaz. Since 2005, the number of libel actions in the High Court has doubled, and in 2009, therewere 219 defamation cases issued; 34 of them were identified as having a “foreign connection” [Ministryof Justice, Report of the Libel Working Group]. In a short time, the widespread opinion has appeared thatLondon has become the “Libel Capital of the World” [London “The Times”, Be Reasonable; Carvajal,Britain, a Destination for ‘Libel Tourism’]. Through an extensive review of relevant case law and studiesI would like to draw attention to the problem of libel tourism which creates a chilling effect on press freedom.

Throughout history, mankind has been inclined to use an increasingly advanced technology to enhance communication skills between them. Communication already represents a need as essential as it is considered one of the funda-mental human rights. This right of communication today translates, among others, as the right to freedom of expression, as well as the right to infor-mation. These rights are provided in the highest acts such as the Universal Declaration of Human Rights, the European Convention on Human Rights, the Constitution of the Republic of Albania as well as other laws or bylaws issued on the basis and implementation of the Constitution. The human right to express oneself, to be informed and at the same time to preserve privacy, is developing along with the great boom that has taken place in the development of communication technology, in an increasingly connected world, so much so that to look like a global village, where information spreads very quickly. The evolution that has taken place with the development of information technology and related digital communications in recent years has changed the communication practices around the world. But in addition to this, the legislation that regulates this field has undergone constant changes, due to the fact of direct implication for human rights.

The phenomenon of media pluralism and content diversity has been unceasingly a central issue of the European policy making. Media pluralism is usually linked to the democratic perform- ances of society. The concept of pluralism can be defined both in terms of its function and in terms of its objective. Concerning television, media pluralism can be assessed through the number and types of channels, the number and structure of their owners, the editorial content of the broadcasts, and the access of different societal groups to the programming. Th e text investigates how well the traditional television system with its main social pillars, such as plurality and diversity, fits into the newly devel- oped digitized media environment.

Unlike the author’s economic rights, the authorship of a work as well as other moral rights should not necessarily be classified as a kind of intellectual property. If literature presents the problems of copyright as an element of intellectual property, this is done in reference to economic rights. The issues connected with moral rights appear then as the background condition for economic rights to arise. However, according to the will of the legislator, the nature of these rights was formed in a different way. While economic rights are a kind of intellectual property, the authorship of a work should rather be viewed as a phenomenon at the intersection of the right to privacy (particularly at the stage of an already established but not yet completed work) and the right to freedom of expression (from the moment of the exercise of other moral rights and the moment of taking a decision to make a work public under the author’s own name). The right to withhold authorship cannot be interpreted as the right to change the author by agreement of the interested parties.

Both the Covid-19 pandemic as well as the political and social discussions it forced upon liberal Western democracies on limitations of fundamental rights provide me with the framework for this paper’s topic. I will address it through the question of how German artists – in this case mostly TV actors – with the social Media campaign #allesdichtmachen drew attention to their situation in times of widespread lockdown and contact restrictions in spring 2021. The question will be whether the constraints of free expression felt by these artists, or the public reactions to their voicing a sense of being unheard, can be captured by the vocabulary of censorship in the narrower or broader sense.

The Article 168a of Code of Criminal Procedure introduces the rule of the permissibility in criminal proceedings evidence obtained under the violation of criminal procedure regulations or as the result of indictable offence defined in Article 1 of Criminal Code. The Article 168a of CCP is highly controversial, especially due to the lack of linguistic precision of its provision and collision with Constitution. The regulation mentioned above is in conflict with the system of evidence-related prohibitions in criminal proceedings. In this context, the freedom expression rule during the interrogation is essential. Its violation results in the prohibition of the use of evidence. Used in the provision of Art. 168a of CCP, word „exclusively” is claimed to be a key for proper resolution of this problem. If interpreted differently, the provision would flagrantly deny the essence and nature of the freedom expression rule during the interrogation

The article explores the concept of the positive and negative obligations of the state in securing human rights, recognized in human rights literature, and in the judgments of the European Court of Human Rights. The concept is then applied to show the importance of securing freedom of expression in regulating Internet access services and enforcing pertinent regulations in EU Member States. The author is of the opinion that economic arguments should not overshadow the need to secure the freedom of expression of the end-users of Internet access services.
L’article explore le concept des obligations positives et négatives de l’État en matière de défense des droits humains, reconnu dans la littérature sur les droits humains et dans les arrêts de la Cour européenne des droits de l’homme. Le concept est ensuite appliqué pour montrer l’importance de garantir la liberté d’expression dans la réglementation des services d’accès à Internet et dans l’application des réglementations pertinentes dans les États membres de l’UE. L’auteur est d’avis que les arguments économiques ne doivent pas occulter la nécessité de garantir la liberté d’expression des utilisateurs finals des services d’accès à Internet.

The purpose of the paper is to discuss the mechanism of censorship before and after 1990 when the mission of the communist Chief Control Bureau for Press, Publications and Performances (GUKPPiW) was terminated. Communist censorship was not, as we have grown to perceive it, a case-based preventive control of the flow of ideas but a complex and continuous system of relations which shaped desired social actions. Institutional censorship only ensured the coherence of messages produced by self-censoring culture outlets: representatives of the media, scholars, writers, and artists. In my opinion the abolition of GUKPPiW was not some radical rupture, it seems that some of the mechanisms of censorship have a rather permanent nature, regardless of the political system. Moreover, even though institutional control over the discursive sphere was lifted, many informal relations of power have remained untouched. These dispersed power relations have been shaping Polish society’s view of the world for centuries deciding what is good or bad, nice or ugly, decent or indecent, Polish or non-Polish, and last but not least – expressible or inexpressible.

The SARS-CoV-2 pandemic has undoubtedly become a challenge for all lawmakers around the world - implying, among others, the need to introduce restrictions on freedom of expression due to health protection. Different countries dealt with this challenge in various ways, which was influenced not only by the systems in force in these states, but also by the specific characteristics and conditions of these countries. Hence, the purpose of this study is to answer how did the pandemic affect the legal situation in the Republic of Poland, with particular attention being paid to: 1) statements whose purpose or effect was to make it difficult or impossible for the state to perform the obligations implied by "health protection"; 2) statements substantively contesting the official information policy of the state on pandemic issues; 3) statements of representatives of the authorities, which are a reaction to the expression referred to above in points 1 and 2. Of course, this study - due to the modest volume - does not pretend to be exhaustive. Its purpose is only to outline the title topic and related issues.

In the most general terms, the Logical Connection Argument (LCA) states that theory and practice are two inseparable aspects of the same thing. Every action (or practice), linguistic or otherwise, is an indivisible unity of content and the means by which it is expressed. Alternatively, we may talk of the inseparability of content and form, meaning and act of expression, goal and method or means of its realization, and so forth. The argument was meant to prove that intentions cannot be treated as causes in social scientific explanation, but it did it at the cost of making any meta-analysis, and hence, critique, highly problematic. My position is that the LCA is indeed logical, and hence irrefutable. Nonetheless, we can distinguish between “raw” and “refined” versions of the argument. The refined version maintains that while ultimately and ideally, the content and means of expression presuppose one another in the sense that a content is inconceivable without a form, and vice versa, in reality there is never a perfect match between aims and methods. In typical circumstances, we do not have a precise sense of what we are doing; the meaning of our actions is gradually discovered in the course of exploratory behaviors, of which (immanent) critique is an indispensable part. In this contribution, I venture to examine the problem from a neuropsychological perspective with the view to showing in exactly what sense and to what extent explorative behaviors and associated motivations preside over other activities. I argue that content is always underdetermined with respect to its form (and vice versa), and hence the alleged internal connection between them is not a given, but rather amounts to a regulative principle which motivates mutual adjustments.

The present article aims to analyze selected aspects of the conflict between two basic values: freedom of expression and freedom of religion. Based on the co-called Aiisa’s case (see the judgement of the European Court of Human Rights of 22 July 2021, Ana Gachechiladze v. Georgia, App. No. 2591/19), the paper proposes general criteria for assessing insults to religious feelings. It is argued that national courts must not act as guardians of concrete religious groups or conventional morals, as this leads to negative results and destruction of the national law system. As a rule, it cannot be excluded that sacred images and figures are used in commercials or other ways of expression. When adjudicating on a case, every court should primarily consider the context, content and form, and prohibition of expression should be the last and final resort.
Celem niniejszego artykułu jest analiza wybranych aspektów konfliktu między dwoma podstawowymi wartościami: wolnością ekspresji i wolnością religii. W oparciu o tak zwaną sprawę Aiisy (zob. wyrok Europejskiego Trybunału Praw Człowieka z dnia 22 lipca 2021 r., Ana Gachechiladze v. Georgia, skarga nr 2591/19) autor proponuje generalne kryteria oceny obrazy uczuć religijnych. Dochodzi do wniosku, że sądy krajowe nie mogą działać jako protektorzy konkretnych grup religijnych i akceptowanych społecznie zasad moralnych, ponieważ to wywoływałoby negatywne skutki i destrukcję krajowego systemu prawnego. Co do zasady, nie można wykluczyć, że obrazy i figury otaczane czcią religijną zostaną użyte w reklamie czy innych formach ekspresji. Oceniając tego typu sprawy, sądy powinny wziąć pod uwagę przede wszystkim kontekst, treść i formę, a zakazy dotyczące określonych form ekspresji powinny być traktowane jako środki o charakterze ostatecznym.

The focus of this article is to examine the notion of freedom, and more precisely freedom of speech, in the light of The People vs. Larry Flynt. The analysis will pay close attention to what has always been a central concern of American society constituting one of the basic principles on which the new nation was founded. What is more, the article will try to indicate that freedom of speech has been as essential as controversial in many respects, which is proven by numerous examples from American history. As a baseline of this study I have chosen Larry Flynt, whose life and legal battles form the central theme of the selected biopic.
