Opis:
The study presents critical reflections on the course and results of Polish local self-government reforms from March 1990, when after 40 years of the system of territorial soviets (national councils), self-government was reintroduced into communes, until January 2018, when an attempt to improve the systemic institutions of self-government in communes, poviats and voivodships was once again revisited. The author points out significant discrepancies between the basic ethical and political values of local self-government, i.e. democracy, independence and efficiency, and the changing content of self-government systemic laws as well as the practice of local authorities’ operations, and formulates proposals aimed at repairing Polish local self-government by adjusting its organisation and functioning to the principles resulting from the Constitution of the Republic of Poland and the European Charter of Local Self-Government. He considers as the most important the elimination of pathological phenomena of simulated local democracy which include: a drastically low turnout in elections and referenda, the disappearance of democratic responsibility of local self-government bodies, and the autonomy of the directly elected executive body of the commune from the influence of the local representation. From this point of view, he positively assesses the new regulations, strengthening the guarantee of transparency of operations carried out by local self-government bodies and control rights of councillors, as well as expanding the catalogue of initiative, consultative and control powers of citizens. He points out, however, that ensuring real democracy in of the local authorities requires a deeper reconstruction of the principles of self-government, the election process, and strengthening the role of representation in creating and enforcing the responsibility of executive bodies.

Celem artykułu jest przedstawienie definicji informacji publicznej w polskim porządku prawnym, gwarancji zasady jawności w demokratycznym państwie prawnym, zakresu jawności działania jednostek samorządu terytorialnego oraz analiza przepisów w zakresie jawności działania jednostek samorządu terytorialnego w czasie pandemii COVID-19. Analizy zostaną przeprowadzone na podstawie stanowiska doktryny, orzecznictwa sądów administracyjnych i praktycznego działania administracji publicznej.
The paper aims to present a definition of public information in the Polish legal order, guarantees of openness under the democratic rule of law, and scope of openness in activities of local government organisations, and to analyse regulations concerning operation of local government units at the time of COVID-19 pandemic. The analysis is based on the doctrine, decisions of administrative courts, and practice of public administration.

Opis:
As of January 1, 2018, the provisions of the new Act on the financing of education tasks came into force, whereby the statutory legislator authorised the legislative bodies of local government units to, among others, determine the procedure for the granting and settlement of subsidies, as envisaged by Article 38 para. 1 of the act on the financing of educational tasks. These powers (convergent with the powers granted by the provisions of the subordinate act on the education system) give this body the possibility of technically regulating the scope of data which an application for subsidy must contain, but not to determine the principles and conditions as necessary conditions. The article presents selected judgements of administrative courts (based on previous regulations), which emphasize the abuse of power by the legislative bodies of local government units.

Opis:
The purpose of local self-government in Poland, which was reactivated in 1990, was to address the needs of the entire local community. Newly created commune authorities were also made competent to handle individual matters by means of administrative decisions. It became necessary to make the idea of the communes’ independence and sovereignty go in line with the underlying standard of administrative proceedings, which is the parties’ right to have their matter examined twice as to its substance. Simultaneously with local self-government, boards of appeal were created at selfgovernment parliaments, which were meant to safeguard real protection of entities whose matters were handled in an authoritarian, unilateral manner by the commune authorities. The boards of appeal were modified by subsequent legal regulations and have been operating until the present day, though in 1994 they were renamed as selfgovernment boards of appeal. In this paper the evolution of these bodies is presented and their linkage to local self-government is explained.
