The study presents critical reflections on the course and results of Polish local self-government reforms from March 1990, when after 40 years of the system of territorial soviets (national councils), self-government was reintroduced into communes, until January 2018, when an attempt to improve the systemic institutions of self-government in communes, poviats and voivodships was once again revisited. The author points out significant discrepancies between the basic ethical and political values of local self-government, i.e. democracy, independence and efficiency, and the changing content of self-government systemic laws as well as the practice of local authorities’ operations, and formulates proposals aimed at repairing Polish local self-government by adjusting its organisation and functioning to the principles resulting from the Constitution of the Republic of Poland and the European Charter of Local Self-Government. He considers as the most important the elimination of pathological phenomena of simulated local democracy which include: a drastically low turnout in elections and referenda, the disappearance of democratic responsibility of local self-government bodies, and the autonomy of the directly elected executive body of the commune from the influence of the local representation. From this point of view, he positively assesses the new regulations, strengthening the guarantee of transparency of operations carried out by local self-government bodies and control rights of councillors, as well as expanding the catalogue of initiative, consultative and control powers of citizens. He points out, however, that ensuring real democracy in of the local authorities requires a deeper reconstruction of the principles of self-government, the election process, and strengthening the role of representation in creating and enforcing the responsibility of executive bodies.

The article considers public security as a component of national security. Public security is one of the priorities of state policy in the field of national security. Successful public safety is the implementation of a set of measures in the field of landscaping: installation of traffic lights in appropriate public places, construction of underpasses, construction of indoor stops for citizens waiting for the arrival of public transport, etc. A well-thought-out system of planning and construction of settlements or public places, maintaining them in good condition, which promotes work and recreation of citizens, reduces the degree of threat to public safety from the occurrence of unexpected and dangerous situations. And neglect of public amenities can lead to favorable conditions for those who commit offenses and encroach on public safety. A special place is occupied by local governments, they are the closest power to the population, have the necessary powers and resources to attract citizens to maintain public order, increase their social activity in creating decent living conditions in a given area. The state defines local self-government as an independent level of government to which the people are entitled. First of all, it presupposes the organizational separation and independence of local self-government from state power, its independence in resolving issues of local importance, but independence within its own powers, as provided by the constitution. The main powers of local governments to ensure public safety and public order include: monitoring compliance with the law in the territory; application of measures of state coercion (usually, it is a question of bringing to administrative responsibility for the offenses connected with local government); protection of public order, carried out mainly by the police; ensuring the safety of citizens. Accordingly, local governments may be endowed with additional powers in the field of public order and protection of citizens’ rights. Protecting the rights of citizens is an important component of ensuring security both at the individual level and at the level of the entire state. The sense of security that is transmitted inside and outside the country can be considered part of the attractiveness of the image of the country abroad.

The right for electing the representatives of authority bodies is one of the fundamentals of democracy. This right entitles citizens for active public participation through expressing their support (votes) for candidates, which will respectively represent their voters in certain institutions. Polish electoral law, which regulates the local self–government elections is very controversial. The existing legal rules were changed many times since 2011. Among the subjects being discussed one can mention electoral campaigns, candidate registration rules and organization of elections. Frequent changes in the electoral law result in misunderstandings and unwillingness to participate in elections. Their effect is low voter turnout and a large number of invalid votes. To sum up considerations over a political model of large cities, it is worth to indicate that during the last 25 years of operation of Polish local government none of political models of big cities was adopted.

Local self-government, as a structure within which civil society can thrive, where the digital competencies of the local and regional community come to life, must have the right tools to ensure adequate cybersecurity. These days, e-government, also at the local self-government level, is a common form of performing public tasks, and as a result, its activities in cyberspace must be properly secured. Many tasks are performed using ICT systems that are exposed to external attacks, and therefore, they should meet the appropriate security standards. The article refers to the legal solutions in the field of cybersecurity operating within local self-government in Poland and Hungary.

After the collapse of the Union of Soviet Socialist Republics (USSR), Kazakhstan’s policymakers recognized that the existing model of state governance had proved ineffective and needed to be changed. One of the necessary solutions was to carry out decentralization. The primary purpose of the following article is to outline the barriers that Kazakhstan needs to remove if it is serious about building local self-government independence. Confronting these with the President’s vision of the transformation of local self-government led to the following research questions: What organizational and legal issues remain unresolved or constitute a barrier to the construction of independent local government structures in the Republic of Kazakhstan after the collapse of the Soviet Union?; to what extent do the changes proposed by President Kasym Tokayev meet the real challenges in the context of expanding the autonomy of local power structures? Answering the questions posed was possible by analyzing legal acts and finding literature and press materials.

The sustainable development of the local self-government institute in modern democracies, the introduction of the principles of subsidiarity, regionalization and decentralization show a clear need for implementing the systemic reforms aimed at strengthening local initiatives in Ukraine. Therefore, there is a need to increase the role of self-governing structures, to grapple for the ways of adaptating governance at the regional level to the long-standing European traditions of democratic governance, and to address the procedural issues of the power distribution, transfer and delegation, in particular the formation and distribution of local budgets. One of the most effective tools to enhance local communities is a participatory budget, the implementation of which in Ukraine is gaining momentum and needs to be analyzed, and to be supported upon its successful realization. This article focuses on the analysis of the implementation of participatory budget as an instrument of the local community development in Ukraine in the case of the city of Sumy

Communes in Poland are entities that act on market, have defined resources at their disposal, are independent, which is legally guaranteed, and are also responsible for their decisions. Moreover, they compete with each other for various forms of capital. Their effectiveness in management and rationality of undertaken actions are essential as they can reach a specific (desired) market position. In this paper, the assumption was made that relationships of entities interested in activities of commune can have a diversified nature (not necessarily favorable from the point of view of their goals and interests), and the power of their influence may significantly facilitate or impede management in a commune and thereby influence the effectiveness of its activity. In the present conditions of commune functioning, the ability to recognize the interests of particular entities related by market relationships with the commune may guarantee and, in the case of a lack of this ability, may limit the accomplishment of interests of a commune as a collective. The reflections presented in this paper include broadly understood interests of local self-governments. This area is multi-dimensional and poorly recognized, which inspires us to make an attempt to create the system of notions. This attempt has been undertaken in further part of the paper. This constitutes an introduction to direct studies on the problems of interests of local self-government on the example of tourism economics.

The following paper employs a normative approach and focuses on the problem of the current state of the local self-government in the South Caucasus countries: Georgia, Armenia, and Azerbaijan. Since all these countries are members of the Council of Europe, a reference point for decentralisation is the European Charter of Local Self-Government. The paper's main thesis is that despite showing some similarities, the countries have introduced different models of decentralisation that do not fully meet the Council of Europe’s criteria. Such variation is in line with the different political systems of these states and their level of democratisation. The more democratic the state is, the stronger the decentralisation it has adopted. Thus, decentralisation in Georgia follows the European model of public policy, while Azerbaijan is preserving the former Soviet model of weak self-government, with central authorities playing the leading role in public services. The current changes in Armenia’s model resemble the Georgian track of reforms. The findings of this paper may be applicable both in further theoretical research and in implementing reforms of local self-government in various post-Soviet states.

The aim of this paper is to highlight specific features related to the performance of public duties by local self-governments, focusing on their autonomy. Hence, it is essential that the conceptual boundaries of such notions as ‘public duties’ and duties associated with ‘public services’ are established at the outset. The current lack of clarity contributes to the complexity of the issue, and this is further complicated by a lack of clear legal regulations which would explicitly define the acceptable way in which public duties assigned to local self-governments are to be implemented. These issues suffice to explain the choice of the topic tackled in this study. Admittedly, it will not provide answers to all the problems associated with the public utility services which fall within the scope of the public duties discharged by particular local self-government units: gmina (municipality/commune), powiat (county), or województwo (voivodeship). However, it may form the basis for further research to be conducted in this field. Therefore, within the framework of this paper, issues related to local self-governments, their autonomy, and the concepts of ‘public duties’ and ‘duties in the field of public utility’ will be discussed. These issues are important, as they are inextricable from the decentralization of public authority, which consists in assigning numerous public duties to be fulfilled by local self-governments.

This paper presents changes that have occurred at the local level in Poland and new German federal states during the process of the post-communist system transformation. The stages of rebuilding the local self-government and its structures are analyzed. The experiences of Poland and Eastern Germany – two states where the system transformation took different courses – were compared. At the same time, both countries have different constitutional orders of the unitary state and federal state, and this context are interesting fields for a comparative analysis. This paper also confronts the two methods of institution building – the importing of well-established institutions and developing them in the evolutionary way, where in both cases path a dependency can be well observed. In Germany this is considered a special case (Sonderfall) of institutional transformation, in which the key role was played by the transference of institutions, personnel and financial means. This was also done much quicker and in a more structured and comprehensive way than in Poland. In the case of Poland, the creation of local self-government structures or shaping the political actors was a grassroots and evolutionary process. This article points out the most important factors that had a crucial significance in the course and results of the transformation and explains different ways of developing the system of democratic local self-government.

This study examines the role of institutional mechanisms in local government accountability by undertaking a comparative assessment of the Nigerian institutional provisions against the European Charter of Local Self-Government. The specific objectives of the study are to examine the institutional mechanisms for local government accountability in Nigeria, evaluate the Nigerian mechanisms, using the provisions of the European Charter of Local Self-Government and subsequently determine how the effective deployment of institutional mechanisms may enhance the prospects of local government accountability. The study adopts as methodology a comparative analytical framework, under which it uses the provisions of the European Charter of Local Self-Government to evaluate the Nigerian institutional mechanisms. Findings of the study led to a conclusion that for emerging political systems, which Nigeria typifies, institutionalized mechanisms of (political) accountability in the local government system, are truly less effective than the non-institutionalized or informal mechanisms. For the effective deployment of institutional mechanisms to enhance the prospects of local government accountability, the study concludes that a judiciary component of the local structures of governance is an unconditional necessity, as in the absence of such conditions; the incidence at the local level, totally ceases to be describable as government.

The article analyses models of administrative supervision of local self-government in the Baltic States (Latvia, Lithuania, Estonia) highlighting the advantages and disadvantages of these models. The research done in this article defines the theoretical concept of administrative supervision of local self-government; gives an overview of the legislative framework underpining the key administrative supervision bodies of local self-government in the Baltic States; discusses the issue of legal regulation and the present state of administrative supervision over local self-government units in the Baltic States; gives some theoretical and practical suggestions to develop this field in the Baltic States. The research methods employed in preparation of this article are theoretical methods of analysis of scientific literature and sources, legal acts and documents as well as comparative and logical analysis, induction and generalisation. Three Baltic States similar in their area, number of inhabitants, and governmental peculiarities have been chosen for the analysis.

Slovenian communities were eager to re-establish autonomous local governments after the introduction of democracy. These newly established municipalities corresponded territorially to the previous regime’s local communities; however, only 194 municipalities were formed from over 1,200 communities. Some municipalities comprised a cluster of communities, some of which later became proponents of splits, due to the sense that they were being neglected by the rest of the municipality and in the hope of receiving more funds as separate municipalities. Although stricter criteria for establishing municipalities were imposed and the scope of formal initiators was narrowed to limit the splits, the proponents found loopholes in the form of political patrons (deputies) and, as a last resort, sought justice from the constitutional court. The splits occurred in both underdeveloped and developed municipalities. The breakaway municipalities were not more developed than the mother municipality; about a third were less developed. There were no clear financial advantages in creating separate municipalities.

The municipality, acting in the sphere of dominium, independently decides on the use and manner of use of individual assets. However, the trade in real estate constituting the subject of ownership of this local self-government unit requires compliance with a number of legal regulations, the most significant of which is the Act of August 21, 1997 on Real Estate Management (consolidated text Journal of Laws of 2021 item 1899, as amended). However, none of the provisions of the law refers explicitly to the freedom and limits of shaping by the municipality of the terms and conditions for the disposal of real estate, which in the case of a non-tender route are determined in negotiations conducted with the buyer, while in the case of a tender they are announced in the contract notice. The content established in this manner is then included in the protocol, which forms the basis for the conclusion of the contract, and thus directly affects the shape of the contractual legal relationship. The purpose of the publication will therefore firstly be to set out the legal framework for the municipality’s determination towards the future buyer of the real estate of the specific manner, in which the investment is to be carried out, as well as to answer the question as to the real possibility of the former owner (municipality) co-shaping the investment proces on the sold real estate after the buyer has signed the contract. The importance of the issue under consideration is expressed in the decision as to whether the creation by the municipality of its own lex contractus by means of the terms and conditions for the disposal of the real estate relating to specific deadlines for the commencement and completion of the investment process, the manner of use and development of the real estate, as well as the liability of the new owner towards the previous owner for their violation, is legally effective and can actually be enforced by the municipality.
