The following paper concentrates on the analysis of the criticism of the Area of Freedom, Security and Justice of the European Union. The Author focuses on the nature of this criticism, its subject – the process of securitization of the EU and also on the sources of such criticism. This paper addresses fundamental questions related to the issues of both general criticism of the AFSJ (its technocratic character and lack of parliamentary and judiciary control) and the criticism of particular activities of the EU agencies, such as Europol and Frontex.
Niniejsza praca skupia się na analizie krytyki Przestrzeni Wolności, Bezpieczeństwa i Sprawiedliwości Unii Europejskiej. Autor skupia się na naturze tej krytyki, jej przedmiocie – procesie sekurytyzacji Unii Europejskiej, a także na źródłach tej krytyki. Praca porusza fundamentalne kwestie związane zarówno z ogólną krytyką Przestrzeni Wolności, Bezpieczeństwa i Sprawiedliwości, jak i z krytyką poszczególnych działań podejmowanych przez unijne agencje, takie jak Europol i Frontex.

In view of the recent reform of the area of freedom, security and justice in the European Union as it is codifed in the Treaty of Lisbon, passed on 13 December 2007, this paper analyzes the changes put forward by the new legislation. Beginning with the system of the Treaty regulations, it goes on to provide a general outline of the changes in the six policies within this area: visas, asylum, immigration, judicial cooperation in civil matters, judicial cooperation in criminal matters and police cooperation.

The Amsterdam Treaty has established the Area of Freedom, Security and Justice (AFSJ). Since then, it is an example of a policy-making area creating its way quickly and comprehensively. However, in this paper the main dilemma is to what extent the Schengen development has modified the framework of AFSJ and how it adapts in this policy while being an example of enhanced cooperation and differentiated integration model. Developments in this area are part of a realisation that European states need to act together to better face new challenges to peace and internal security, while ensuring respect for democracy and human rights. It is important to add, that cooperation in the Area of Freedom Security and Justice has been driven by forces different from that seen in other policy areas.

The paper concerns the principle of mutual trust and its interpretation by the Court of Justice of the European Union as well as two other important European courts: the European Court of Human Rights and the German Constitutional Court. The paper presents the important change of direction in interpretation of the principle of mutual trust by the CJEU. Initially, the belief in the existence of mutual trust between member states was firm. Over time, however, it has turned out that even in the EU – which follows from a number of judgments of the ECtHR – violations of human rights sometimes happen. This dramatically undermines trust in foreign judicial systems. This led the CJEU to the conclusion that the principle of mutual trust is rebuttable and that in some circumstances limitations to the principles of mutual recognition and mutual trust can be made. This conclusion can be treated as an answer in the specific ‘judicial dialogue’ of the CJEU with the ECtHR and the German Constitutional Court – the two latter courts seemed to notice earlier that mutual trust between member states cannot be blind and unconditional.

The paper discusses the problem of the ne bis in idem principle stipulated in the Convention Implementing the Schengen Agreement (CISA) and the Charter of Fundamental Rights of the European Union. Article 54 of the CISA makes the application of the principle ne bis in idem subject to the condition of execution of the penalty. An analogous condition is not provided for in the Charter. These differences caused doubts regardingthe application of the ne bis in idem principle and were subject of the question for preliminary ruling in the Spasic case (C-129/14 PPU). The paper contains a critical review of the reasoning of the Court of Justice of the European Union in this judgment. In addition, the article also contains an analysis of the CJEU’s decision in Case C-398/12 M. in which the CJEU has analysed the meaning of “final disposal” of the judgment in the context of the ne bis in idem principle. Based on the above judgments, the article presents arguments indicating that the reasoning of the CJEU on the conditions for the application of the ne bis in idem principle in judicial cooperation in criminal matters in the EU is not consistent.

Opis:
Cardinal Wyszyński was a defender of every individual, family, nation and Church during the time of communist enslavement of Poland. He was an ardent defender of the truth with regard to human being and its dignity, he constantly emphasized the significance of respecting basic rights and obligations of men, and strongly demanded the observance of these rights when the state violated them. Furthermore, he was radical defender of the freedom of human persons, families, nation and the Church, indicating that only in freedom can they truly develop and fulfill their vocation and goals. He constantly reminded us of the need for justice made in the spirit of love with regard to every individual, family and nation. He clearly defined the tasks and duties of the state and the Church in relation to every human person that should be regarded as the highest value in the world, as well as towards families that are to be considered the cradle of the nation, and towards the nation that he regarded as a family of families sui generis. Additionaly he emphasized that the Church has a unique role to perform in relation to these communities, bringing into their existence not only the supernatural dimension, sanctifying God’s grace, salvation, but also the natural dimension consisting in the care of the Church for the national raison d’etat. Last but not least, in his view, the Church must be free and independent in its activities to be able to perform its religious and social role properly. The Primate indicated the need for cooperation between the state and the Church for the benefit of man, family and nation. When the communist state did not fulfill its role and acted against the rights of citizens, especially believers, against families and nation, he radically opposed these actions, demanding respect for dignity, rights, truth, freedom and justice with regard to every human person, family and family of families – that is the nation.
