Opis:
Criminal investigation in Mexico is performed by the investigation triad, which is made up of police and experts in different areas such as medicine and prosecutors. They all use interview and interrogation techniques to do their work. Unfortunately, in Mexico, there is no culture of training in governmental institutions responsible for investigating crimes, and results in ignorance of techniques for obtaining objective and reliable information that guarantees the protection of fundamental rights. This chapter illustrates the scope and limits of interview and interrogation techniques and their objectives, with emphasis on the cognitive interview (CI). The CI, which has been validated scientifi cally, is one of the best tools to obtain useful information, that is, results of a CI that have been conducted in the field can be used in a court of law. This technique can be used with victims, witnesses, or suspects. The current chapter also describes the most utilized techniques, cognitive interview, mnemonic techniques, Strategic Use of Evidence, and Verifiability Approach.

William (Billy) Shaffir taught about what it means to be a true empiricist, a sociologist committed to naturalistic observation as the most incisive method in our scientific toolbox. His inspiration still resonates, two decades later, in the work of new emerging scholars with the same commitment to ethnography—or what Billy more modestly and wisely calls “hanging around.” This paper is a tribute to his legacy that highlights the contributions of the next generation of graduate students that the lead author has been privileged to mentor at the University of Guelph. It builds on work by Hathaway and Atkinson on tactics of active interviewing to establish a more nuanced understanding of the benefits and challenges of being recognized as either an “insider” or “outsider,” and the implications of attempting to be both.

Throughout history, different methods and instrumental designs have been used to identify and obtain the truth. Some of the methods described in this work are based on myths that have remained over time, but due to this legacy are unlikely to be applied, such as the Osiris judgment. In this study, we analyzed the characteristics of these methods, such as the period in which they were used, their scientific validation, and their passive or active approach according to the literature. Some approaches have established the theoretical foundations for the development of more precise technologies that are currently used, such as the Bisha Bedouin Court System (ordeal by fire), which is based on arousal theory (response). This work also includes innovative applications such as the use of interview techniques to detect deception, which stands out for their wide spectrum of use in different contexts. Finally, we mention elements of investigative interview models and highlight the benefits of using verbal approaches to detect deception.

Reflexive accounts of research are important, but they should include attention to a wider range of relations than those between researcher and participant. The researcher’s position in relation to the participants does merit discussion, especially when there is an element of autoethnography involved. However, assistants in the research such as transcribers, can play a role in accounting for the research. The relationships participants have with loved ones also shape how they reflexively account for themselves and their experiences, in this case – of being in a distance relationship.

Opis:
The life-grid has previously been used as a tool for improving the reliability of retrospective data in epidemiology. Recent research has suggested that the life-grid may also prove a useful tool for qualitative sociological interviewing, by facilitating the asking of difficult questions and acting as an aide memoire. This paper describes a pilot study which examines the influences the life-grid has upon qualitative interviews with married couples. It finds that use of the life-grid limits interviewees’ willingness to revisit topics, tends to create “event-centred”, non-reflexive, data and does not facilitate the asking of difficult questions. This paper does find that the life-grid acts to stimulate recall, but in a limited, factual fashion. It concludes that the life-grid is unlikely to prove an appropriate tool for qualitative researchers in its present form.

Under the provisions of Act I of 2017 on the Code of Administrative Court Procedure, a brand new institution has been introduced in Hungary: as of 1 January 2018, in administrative court proceedings, the judge may, with the agreement of the parties, allow for a court mediation procedure in the cases in which the law does not preclude it. The primary method to approach the topic is the review of the relevant primary legal sources [actual law in the form of the constitution (Fundamental Law of Hungary), acts, governmental decrees, orders of the President of the National Office, court cases, etc.] and secondary legal sources (Hungarian and international scientific literature explaining the primary sources, the legal practice and also the specific circumstances determining the broader social environment) through which we may define relevant scientific problems, create our own definitions and prepare a catalogue of practical problems, specifically for Hungarian issues regarding the topic. Moreover, this article tries to build on the results of the interviews with judges, representatives of different defendants (administrative authorities) and others. Qualitative interviewing, including the interviewing of judges and other participants of such proceedings, is a relatively new method in the field of legal studies, at least in Hungary.

Opis:
In Latin America, the investigative interview is still in its beginnings. Currently, most public and private investigators use interview and interrogation techniques aimed at obtaining admission or confession, instead of applying Investigative Interview techniques focused on information gathering. This document provides an overview of the Conversation Management Approach. This is an investigative interview technique used to interview uncooperative criminal suspects, such as those accused of feminicide. An example of how to apply the technique in a case of feminicide is shown, to serve as a guide to good practices. This technique consists of three phases that must be considered when administering and applying the interview. In the first, the behavior before the interview is reviewed, in which the planning and preparation of the interview was carried out. The second phase is the interview to elicit information, which consists of a variety of questioning style techniques, explanation of procedures and instructions to follow, rapport building, and clarifi cation of information. The third phase is called the post-interview phase, which consists of closing and evaluating the entire interview process. The objective of this work is to provide Latin American interviewers with information on the best practices in investigative interviews used in other countries, to raise their aware of the need for training in this area. The correct application of investigative interview techniques is essential to investigate crime, and training of interviewers in this type of technique is necessary to improve the results obtained through interviews.

The paper addresses legal solutions concerning the model of witness interviewing. The discussion is of comparative nature, as it refers both to the regulations contained in the Code of Criminal Procedure of 1928, as well as to the provisions of the current criminal procedure. It aims at a synthetic analysis of key changes in the model of interviewing a witness taking into consideration historical factors, as well as their impact on the current shape of the provisions in the Criminal Procedure Regulation. While reviewing legal solutions, the author pays special attention to the process of questioning at a distance supported by devices enabling simultaneous image and sound transmission. This issue is discussed in many aspects, taking into account the views of the doctrine and the analysis of case law. Apart from the assessment of the current legal status in genere, the paper also presents the proposals of solutions in the subject matter.

Opis:
Over the past decades, Neo-Pentecostalism has spread across the nations, mainly because of its strong emphasis on the so-called prosperity gospel and the promotion of supernatural phenomena. John Wimber, the founder of what came to be known as power evangelism, stressed the importance of signs and wonders, whereas Charles Peter Wagner, the father of New Apostolic Reformation (NAR), developed the concept of leadership and strengthened the position of the highly-efficient, entrepreneurial ministers working independently. These two figures contributed enormously to the contemporary religious marketplace; therefore, their ideas have successfully shaped the intra-community reality of various religious groups representing Charismatic Christianity. The principal objective of this study is to investigate the role the Neo-Pentecostal language combined with non-linguistic elements plays in one’s personal revival and transformation. The research concerns both Neo-Pentecostals and Pentecostal Catholics from Poland and Italy. The analysis is based on participant observation, in-depth interviews, and surveys.

Opis:
In response to the assumptions of new public management models and public or good governance, practical aspects of research in the area of public administration and the development possibilities of qualitative research methods are presented in the article. Due to the fact that qualitative research has become increasingly popular in the above disciplines, data archiving and transparency is discussed (Moravcsik), (Yom et al.) and guidelines and principles are established (American Political Science Association). However, there is a lot of controversy among scholars (Monroe), and some examples are missing. This paper presents the challenge of ‘openness’ in the empirical activities (or empirical practice) of researchers. Its purpose is to present the archiving data potential from in-depth interviews on the example of a small set of qualitative data from research in the field of public administration. Firstly, the basic assumptions of new models of functioning of public administration and related consequences for researchers are described. In the second part, the challenges related to openness in contemporary public administration models are briefly mentioned. Next, the method of creating an archive from existing data, individual stages, documents, and data is outlined; it is based on the author’s best practice on Qualidata (American Political Science Association; Van den Eynden et al.) and DA-RT principles.1 The summary includes examples of probable opportunities and challenges related to usage of data archiving for the research in public administration and political science development.

Opis:
The article is a result of the discussion between the sociologists and professional psychotherapist. The authors’ aim is to consider therapeutic functions of biographical interviewing with reference to professional psychological treatment assumptions. Therapeutic aspects of the narrator– scientist encounter are especially important in the research on traumatic collective and individual experiences (such as wars, exile, disability, poverty, etc.), when informants recall painful memories or talk about the distressing present. In the article, the issues of scientific and psychological treatment aims are discussed, as well as problems regarding the relationship between narrator–patient and researcher–therapist, and professional skills in the area of biographical interviewing and psychotherapy. Also, the authors consider potential advisability of “therapeutic” interventions undertaken by a researcher in the sociological interview course in the context of ethical principles and their presumable impact on narrators’ biographical and identity work resulting from the participation in the interview. The in-depth biographical interviews and narrative interviews collected in the project “Institutionalized identity? The processes of identity development on the basis of biographies rendered by adults raised in residential care,” Lodz, Poland 2011-2013” will provide the empirical background for our considerations.
Artykuł stanowi rezultat dyskusji między socjolożką a zawodowym psychoterapeutą. Celem autorów jest rozważenie terapeutycznych funkcji wywiadu biograficznego w odniesieniu do założeń profesjonalnej terapii psychologicznej. Terapeutyczne aspekty spotkania badacz–narrator mają szczególne znaczenie w przypadku przedsięwzięć badawczych, niejako „z założenia” uruchamiających traumatyczne wspomnienia lub refleksję nad aktualnym doświadczeniem badanych (np. biografie wojenne, uchodźców, osób wykluczonych i zagrożonych wykluczeniem społecznym, osób ciężko chorych i niepełnosprawnych).

Następnie zaprezentowany jest przykład badania przeprowadzonego w wyżej wymienionych okolicznościach, by wskazać zalety homogenicznej kompozycji grup fokusowych podczas rekonstruowania zbiorowych postaw przedstawicieli poszczególnych szczebli administracji publicznej.
The paper approaches the topic of sampling in the qualitative research design. Particular attention is paid to the composition of the focus groups in two important aspects: the homogeneity of the participants in terms of their positions in socio-occupational hierarchy and the pre-existing relations among the participants in the single group. The latter issue is closely and directly intertwined with the former, in the case when the informants are approached in their institutional setting, and the research is conducted in a relatively small community. These problems are discussed in reference to the body of available methodological studies. The example of the research undertaken in aforementioned circumstances is subsequently presented to advocate the homogeneous composition of the focus groups while reconstructing the collective viewpoints of representatives of a particular level of public administrations. Avoidance of power relations within the groups proved profitable and effective. Substantial differences between the groups were easily identifiable in spite of the pre-existing relations among participants, which were unavoidable in this very case.
