Are Augustine’s views of creation still relevant today, after the scientific revolution, and especially post-Darwin? Surely, much of his interpretation cannot withstand the onslaught of modernity and its concomitant increase in scientific knowledge. Perhaps not, but we can still learn from Augustine. It is a modern myth that the scientific revolution alone began—or forced—the church to come up with interpretations that were amenable to the science of their time. Augustine is a prime example of this “wrestling with the Divine”. However, we cannot go to Augustine with the hopes of settling the debate on origins and scriptural interpretation. Augustine erred mightily when he sought to use the bible as a proverbial science textbook. In this essay, we will encounter a presentation of Augustine’s theolog(ies) of creation through examining his views of “seminal seeds”, simultaneous creation, and his interpretive acrobatics with regard to Genesis 1–3. Whereas his initial persuasion on this matter was sound, Augustine nevertheless contradicted it in his own writings, to our corporate detriment.

This paper considers the foundations of legal interpretation against the background of the theory of embodied cognition and mental simulation. It is argued that interpretation has a double, concrete-abstract nature. The understanding of concrete language is made possible by the mechanism of mental simulation. In turn, the interpretation of abstract language (and hence of most of legal language) requires to apply the procedures of exemplification, paraphrase and embedding. The relationship between these two modes of language comprehension is analyzed and the thesis is defended that they represent two extremes of a continuous spectrum rather than isolated mechanisms. Finally, the significance of such a conception of interpretation for legal methodology is considered. It is argued that the conception provides a unifying, foundational framework for any theory of legal interpretation, as well as generates fresh insights into the nature of understanding legal statutes. cancelcancel

The main assumption behind this study is that the relationship between language and international law is particularly interesting due to the complexity and special nature of this relationship when compared to national law. The author focuses on some selected issues connected with the fact that from the legal point of view the multiplicity of languages in international law is an important factor affecting its interpretation. Due to this, apart from the issue of the dominant position of the English language in international law, the major focus of the study is on the specific problems associated with the interpretation of international treaties. The study suggests that there are certain intrinsic tensions and contradictions involved in the relationship between language and international law. The dominant position of English language in international law is at odds with the principle of sovereign equality laid down in the UN Charter, which entails equal opportunities for all nations to participate in the global legal discourse. Moreover, the interpretation of plurilingual treaties involves significant problems when it comes to the interpretation of authentic texts made in various languages, which need to be reconciled. In turn, the tensions between the meaning of terms used in international legal norms and their corresponding meaning in national legislation are addressed through the use of the autonomous method of interpretation. Moreover, considering the growing importance of the legitimacy of international law, the role of the language of international law in this context is also considered. The problems related to the problems of language in the context of international law outlined in this study confirm the need for further continuous and in-depth research in this field.

The article presents an opinion in the discussion on the limits of judicial activism. The active attitude of judges in the law-making process according to the so-called concept of ‘pro-constitutional interpretation of the law’ can be observed more and more often. While we may agree with the view that the role of a judge is to pronounce a fair verdict based on the applicable law and judges may give meaning to statutory provisions supplemented with an axiology of the Constitution, the problem appears with particular sharpness when such a pro-constitutional interpretation leads to a specific application of the provisions contra legem.

Opis:
The article discusses the phenomenon of “disappearance” in the supervision process. The authors show that the phenomenon of “disappearance” is a result of the peculiarities of the flow of group dynamics at the initial stage of the group’s development. The manifestation of all the phenomena of the initial stage of group dynamics is characteristic for a supervision multimodal group. The condition provoking the development of the phenomenon of “disappearance” is the activation of deep layers of the unconscious, typical for situations of group therapy and supervision. The motivational basis of this phenomenon is the avoidance of the narcissistic trauma of the specialist exposing the case to supervision. The article offers examples of how this phenomenon manifests, and discusses its variations. The article draws from the theoretical traditions in psychology such as  psychoanalysis, group analysis and professional multimodal model of supervision.
Niniejsza praca stanowi omówienie zjawisk określanych mianem „zniknięć” w procesie superwizji. Autorzy wykazują, iż zjawisko to jest wynikiem specyficznych warunków charakterystycznych dla dynamiki grupowej w grupie superwizyjnej na jej wstępnym etapie rozwoju. W multimodalnej grupie superwizyjnej można zaobserwować przejawy wszystkich zjawisk charakterystycznych dla początkowego etapu dynamiki grupowej. Różnorodne zjawiska „zniknięć” wywoływane są aktywacją głębokich warstw nieświadomości, typowo zachodzącą w warunkach terapii grupowej oraz superwizji. Podłożem motywacyjnym procesów określanych tą nazwą jest unikanie traumy narcystycznej przez specjalistę zgłaszającego przypadek mający podlegać superwizji. W artykule podano przykłady, w jaki sposób zjawiska „zniknięć” mogą się przejawiać, oraz  opisano ich możliwe warianty. Ramy teoretyczne dla niniejszej pracy stanowią takie tradycje w psychologii, jak psychoanaliza, analiza grupowa oraz multimodalny model superwizji.

This contribution to the discussion on truth in music shows two ways of thinking most often chosen by representatives of the contemporary English-speaking world’s analytic philosophy. The first way assumes seeking truth or falsehood in the actual musical work and its structures, while the other is related to truth in experiencing music, and thus to the sincerity, authenticity of a performance (and especially performers’ faithfulness to the score and to themselves). The text concludes with a literary example of the debate on truth in music. For aestheticists, it can be a source of reflection on metacritical issues of music performance, and for critics – encouragement to verify their own interpretative strategies.

The problem of transformations of the definition “Interpretation in international law” is analyzed in the article. Particularly acute and ambiguous is the question of differentiation of the concepts “interpretation” and “explanation”, which are used n the domestic theory of international law. In Western literature, mostly, the term “interpretation” is used (from the Latin interpretatio). It is determined that two concepts, which Ukrainian lawyers often see as identical or synonymous, the national experts in international law often consider to be rather problematic. From the point of view of the Ukrainian legislation, the concept of “interpretation” is legal, and lawyers use in legal practice and theory such terms as interpretation of the law, interpretation of the legal act, legal interpretation, interpretation of the rules of law, interpretation of the norms of international law. The author notes that this not only does not introduce categorical unambiguity and clarity, but rather complicates the integration of Ukrainian legal science and the science of the theory of international law in the European scientific system.

The aim of this article is to ascertain whether in the Polish legal culture in which precedent is not a legislative fact, it can become an argument in the process of judicial interpretation. The article posits that an analysis of precedent as an argument in judicial interpretation must be carried out in relation to a particular concept (or theory) of legal interpretation. Hence, it adopts the Maciej Zieliński’s (derivative) concept of legal interpretation as a point of reference for understanding “legal interpretation”. The choice is based on the following reasons: 1) this concept offers a complex approach to legal interpretation (which assumes that interpretation can be concluded if three directives have been applied by an interpreter: linguistic, systemic and functional); 2) this concept considers the realistic elements of legal interpretation in the form of directives linked to the interpretative findings achieved in judicial practice; 3) this concept stipulates that legal interpretation has certain roles, which allow establishing whether the outcome of legal reasoning is within the scope of the interpretation or whether it constitutes a “normative novelty”. As a result of this analysis, it can be concluded that depending on the content of the directives of interpretation adopted in a given legal culture, the proceedings of the entity applying a law will have either an interpretative or a legislative character and will consequently determine how invoking earlier court judgments in legal interpretation will be classified.
Celem artykułu jest ustalenie, czy w polskiej kulturze prawnej, w której precedens nie jest faktem prawotwórczym, może być on argumentem w procesie interpretacji prawniczej. W artykule przyjęto, że ustalenia na temat precedensu jako argumentu w interpretacji prawniczej należy zrelatywizować do konkretnej koncepcji wykładni prawa. Dlatego jako punkt odniesienia dla pojmowania „wykładni prawa” przyjęto derywacyjną koncepcję wykładni prawa. Wybór ten podyktowany był tym, że jest to: 1) koncepcja prezentująca kompleksowe podejście do wykładni prawa (zakładającej, że wykładnia kończy się po zastosowaniu trzech typów dyrektyw interpretacyjnych: językowych, systemowych i funkcjonalnych); 2) uwzgledniająca elementy realistyczne wykładni w postaci dyrektyw związanych wprost z ustaleniami interpretacyjnymi sądowej praktyki prawniczej; 3) przyjmująca, że wykładnia odgrywa określone role, ze względu na które można ustalić czy wynik przeprowadzonego rozumowania prawniczego mieści się w zakresie wykładni, czy też stanowi „nowość normatywną”. W wyniku przeprowadzonych rozważań ustalono, że w zależności od treści dyrektyw interpretacyjnych przyjętych w danej kulturze prawnej zależy, czy postępowanie organu stosującego prawo będzie miało charakter interpretacji czy prawotwórstwa, a w konsekwencji przesądzi o tym, jak kwalifikowane będzie powołanie się w procesie wykładni na wcześniejsze orzeczenia sądowe.

Throughout his work, Uniłowski drew heavily on historical materialism, constantly balancing his instinctive focus on the political – and, specifically, on class – with his equally instinctive conviction as to the irreplaceability of literary form. While we might not have agreed on every single issue – as is always the case on the Left – we in “Praktyka Teoretyczna” are proud to have called him not just an inspiration, but a comrade. Uniłowski passed away while putting finishing touches to the essay we’re presenting below. Unfortunately, he never managed to send us the finished abstract/summary for this article, so it falls to us to try and summarise its main theses. The issues raised in this erudite and formally complex piece include such fundamental questions as: in what sense do the fictional worlds resemble the non-fictional one, and how do we inhabit them? What’s the relationship between immersion and interpretation? What real-life figures can help us imagine or visualise our intimate yet inherently social relationship with the fictional (are we guests, dwellers, passersby...)? Uniłowski looks for answers in contemporary Marxist criticism (Eagleton, Jameson, Berardi), sci-fi and fantasy writing (Lem, Sapkowski, Martin), as well as modern continental philosophy (Gadamer, Heidegger) and – in the last part of the essay – contemporary game studies. We’re happy to be able to present Uniłowski’s piece in two versions, the original Polish as well as its English translation (by Jakob Ziguras). In order to preserve the unmistakable flow of Uniłowski’s thought in English, small changes were introduced – with the author’s full approval – in the English version. We trust that our Polish-speaking readers will fin the comparison of the two versions interesting and instructive, as they seem to give a unique insight into Uniłowski’s writing process.

The article confronts key notions framing our understanding of modernity, such as rationality, knowledge, freedom and democracy, opening the space of a critical interpretation undermining the superficial take on modernity as an embodiment of integrity, putting together the noble principles of knowledge and liberty. Drawing on the thought of Max Weber, exploring the symbolism of his metaphor of “iron cage of rationality”, the article emphasizes a paradoxical sense of the experience of modernity. In concluding statements it defies and calls into question a standard reading of democracy, viewed as an embodiment of freedom and rational self-definition.

The theme of the paper is observing and revealing non-pragmatic language that, when dealing with deliberately chosen texts about acts of violence, leads to productive aesthetic disturbance. In its substance, this language refers to the gulf between intensity of representation and ideological intention towards a reader declared in a complicated manner. The paper discusses five texts with the theme of the Holocaust. Three of them deal with the Holocaust as with a recent experience, namely Curzio Malaparte’s Caput (1944), Žofia Nalkowska’s Medallions (1945), and Leopold Lahola’s Last Thing (1949–1956, published in a book in 1968); whereas two other ones deal with the Holocaust after some time in a form of belles-lettres memoirs or testimony, namely Juraj Špitzer’s I Did Not Want to Be a Jew (1994) and Jerzy Kosiński’s Painted Bird (in English in 1965, Czech translation was published in 2011). All interpreted texts are marked by specific language situated beyond the border of traditional literary representation. This language is either extremely subjective, expressive and periphrastic – in this case it borders on with absurd Realism or nonsense (in case of C. Malaparte, J. Kosiński, and L. Lahola) – or, in its neutral representation (in case of Ž. Nalkowska, and J. Špitzer), it borders on with a melancholic self-referential document on limits of cultural humanism or of normal, common humanity.

This paper tackles the issue of the lack of a substantially new approach to classifying the interpreters’ notes. In my paper, I highlight the fact that the researchers in the field are yet to agree on the contents of interpreters’ notes, and that is, in my opinion, the problem that is numerously stumbled upon in consecutive interpretation research in general and note-taking research in particular. Not only do researchers invent new classifications within an excising paradigm, sometimes they contradict each other presenting different definitions for the same concepts. This paper attempts to solve the issue by introducing a new perspective on the contents of interpreters’ notes by adapting the human-centered approach and turning to the “writers” of the notes, the interpreters. The interpreter trainees who participated in this research were interviewed to obtain an in-depth understanding of what is included in interpreters’ notes. Under the semiotic perspective, which assumes both linguistic and non-linguistic notes as a system of signs, I classified the interpreters’ notes based on the subject’s comments to the notes they had written. This retrospective approach unveiled how interpreter trainees perceive their notes which prompt meaning-making and facilitate the memory when delivering interpretation.

Opis:
The use of references to foreign law and jurisprudence by the constitutional courts around the world currently gains more and more attention from scholars. The admis-sibility and usefulness of conducting such a horizontal dialogue between various juris-dictions raises controversies in other countries, but not in Poland, where no significant academic discussion on the legal basis and justification for using comparative arguments in constitutional jurisprudence has been conducted. The reasons for this lack of contro-versy seem to lie in the roots of the 1997 Constitution, and the way in which the Polish legal system is constructed. The Polish Constitutional Tribunal is quite prone to using comparative references in its reasoning. However, it rarely clearly indicated their role or significance for the resolution of the case before it. The analysis of the case-law of the Tribunal indicates that references to foreign law concern constitutional provisions, legislation, and the judgments of other constitutional courts. The purpose of the refer-ences stresses the universality of particular constitutional norms and deciphering their meaning, as well as gathering data significant for the assessment of the proportionality of a national law, as well as at drawing inspiration from the decisions taken by foreign courts. However, the persuasive use of a comparative argument demands that the meth-odological problems which can be noticed in the case-law should be addressed. They in-volve in particular: the need to justify the choice of comparative material that is analysed, the fragmented nature of the analysis, and the lack of a clear indication what role these kind of arguments have in constitutional argumentation.
