Opis:
This article addresses an issue that is highly debatable both in the theory of civil procedural law and in the practice of jurisprudence, namely the entrepreneur’s right to a court and, consequently, the possibility of respecting the principle of material truth in a separate proceeding in commercial cases in the context of evidentiary limitations introduced by the legislator under the Act of 4 July 2019 amending the Code of Civil Procedure. Due to the fact that eponymous matters are complex and multifaceted, the present article shall describe and signal selected specific issues, which seem to raise the most doubts among representatives of the world of science and practitioners who apply civil law daily.

The purpose of this article is to discuss selected problems related to conducting evidentiary hearings in civil proceedings, with a special emphasis on the essence of a motion for evidence and on the option to file it. The performed analysis covered both primary and secondary legislation concerning the formal matters related to filing motions for evidence, the possibilities of admitting evidence, the procedure of taking evidence, and the deliberations on the outcome of the evidentiary hearings. The regulations as they are in force at present offer no possibility to present evidence at the discretion of the parties and participants of the proceedings. It is therefore very important to use the evidence in accordance with the legislator’s suggestions so as not to be deprived of the chance to receive a favourable court decision only because the court finds the motion for evidence as having been filed too late.

The Article 168a of Code of Criminal Procedure introduces the rule of the permissibility in criminal proceedings evidence obtained under the violation of criminal procedure regulations or as the result of indictable offence defined in Article 1 of Criminal Code. The Article 168a of CCP is highly controversial, especially due to the lack of linguistic precision of its provision and collision with Constitution. The regulation mentioned above is in conflict with the system of evidence-related prohibitions in criminal proceedings. In this context, the freedom expression rule during the interrogation is essential. Its violation results in the prohibition of the use of evidence. Used in the provision of Art. 168a of CCP, word „exclusively” is claimed to be a key for proper resolution of this problem. If interpreted differently, the provision would flagrantly deny the essence and nature of the freedom expression rule during the interrogation

The subject matter of considerations undertaken in the paper is the issue of obtaining evidence entailing banking secrecy under the European Investigation Order at the stage of the preparatory proceedings from the Polish perspective. The examination of the described evidence activity is often necessary to make key findings, for example, in the field of the data on bank accounts or bank transactions. Actions taken in this regard may concern the monitoring of banking operations and may also be used for establishing financial links between entities operating in different European Union Member States. The procedure for applying the European Investigation Order generates many problems in the analysed scope, in particular at the stage of the preparatory proceedings, starting from determining the authority competent to issue the European Investigation Order, to the need to consider legitimacy of obtaining the consent by the prosecutor to exempt from banking secrecy in order to further request for the required information. Against the background of the issues presented in the article, an attempt was made to analyse the normative institution of the European Investigation Order, used for obtaining evidence covered by banking secrecy, and to show the model that determines its optimal functioning in the face of existing problems in the application challenges related to the European cooperation in this area.

In one of the court proceedings concerning a cassation appeal, brought against the decision of the President of the Office of Competition and Consumer Protection (UOKiK), the Polish Supreme Court expressed in its judgment of 29 July 2020 (I NSK 8/19) a view on the role of expert evidence in the definition of the relevant market, and more specifically, in the determination of product substitutability. By dismissing the corporate applicant’s cassation appeal, the Court stated that admission of expert evidence was not necessary, given that the substitutability of products is decided mainly by customer adoption and not their chemical composition. This article aims to present the arguments cited to this end by the Supreme Court and to analyze them through the prism of defining the relevant market and the specificity of expert evidence in determining the boundaries of the relevant market for the purposes of applying competition law.
Substituabilité des produits dans la détermination du marché pertinent et preuves d’expertise – commentaires sur la base de l’arrêt de la Cour suprême du 29 juillet 2020. (I NSK 8/19). Dans l’une des procédures concernant un pourvoi en cassation formé dans une affaire contre une décision du président de l’Office polonais de la concurrence et de la protection des consommateurs, la Cour suprême, dans son arrêt du 29 juillet 2020 (I NSK 8/19) a exprimé son point de vue sur le rôle des preuves d’experts dans la définition du marché pertinent, et plus particulièrement dans la détermination de la substituabilité des produits. Rejetant le pourvoi en cassation du commerçant, il a déclaré qu’il n’était pas nécessaire de procéder à l’expertise demandée dans le cadre d’une procédure judiciaire, car l’élément décisif pour déterminer la substituabilité des produits est leur perception par les acheteurs et non leur composition chimique. L’objectif de cet article est de présenter l’argumentation de la Cour suprême et de l’analyser sous l’angle de la définition du marché pertinent et de la spécificité des preuves d’experts dans le contexte de la détermination du marché pertinent pour l’application de la loi antitrust.

Opis:
Prohibition of using evidence obtained contrary to the law is defined in the views of legal scholars and commentators and in the literature as the doctrine of the fruits of the poisonous tree. The aim of the paper is to discuss the subject matter of limiting the freedom of proof both on the ground of criminal procedure, especially through the lens of Article 168a CCrP (Act of 6 June 1997 The Code of Criminal Procedure, consolidated text, Dz. U. (Journal of Laws) of 2018 item 1987 as amended) and administrative procedure. The author stays convinced that the above-mentioned theory should be applied in both these types of procedures, primarily due to the constitutional right afforded to everyone to a public, fair and lawful examination of a given case by public and investigative authorities.
