One of the political goals of the EU in broad is the absorption of all European continent state in a sort of United States of Europe. Nowadays the EU counts 28 states and the perspective of enlargement is not stopped by the current economic crisis. The current situation after the just completed pro-EU revolution in Ukraine and the implementation of strong economic link with former USSR Transcaucasian Republics (Georgia, Armenia and Azerbaijan) may suggest the final number of state in the EU. Many people believe that the United States of Europe puzzle is nearly full defined … but a new kind of EU enlargement may change the situation. This paper will focus only in one question. “Is an EU Member state secessionist territory automatically in the EU after archiving its Independence or have to reapply?” To answer to this question I will analyses the possible past experiences in secessionist territory getting membership in international organization like UN. The Vienna Convention on Succession of States in Respect of Treaties is a good material to use in case of succession but the fact that is not in force and not signed by the greatest part of EU member state make it only advisory and not binding.

In the face of the European integration, the legal protection of national symbols enjoys momentous significance. The present turbulent times and numerous conflicts, the etiology of which is – e.g. social or political in nature – require an attempt to make a scientific overview of the situation. In this article I will examine the scope of standardization of the protection of national colors in the Polish law, the Italian law and the Community legislation. The study takes into account the historical and contemporary judicial decisions. I will try to answer the question whether the scope of protection of the Community colors in the Polish law is sufficient? The analysis of the examined normative acts has led me to the conclusion that the Polish legislator, after the restoration of independent statehood, attached a great importance to the normative grounds ensuring protection of colors of the national symbols. The Italian constitutional adjustment, compared to the Polish one in the scope of the national colors, is very sparse. Aside from the Community rules, each member state – as a result of historical development – has developed its own model of protection. The colors of the European Union are not expressly protected under the Polish normative regulations. However, de lege ferenda, I reckon that for the interests of legal certainty, the legal status in this field should be amended and relevant norms should be laid down.
W obliczu integracji europejskiej, doniosłego znaczenia nabiera prawna ochrona symboli narodowych. Współczesne czasy nie są spokojne. Liczne konflikty, których etiologia ma charakter społeczny, polityczny, nakazują próbę dokonania scjentystycznego oglądu sytuacji. W niniejszym artykule zbadam zakres normowania ochrony barw narodowych w prawie polskim i włoskim oraz wspólnotowym. W badaniach uwzględnię historyczne i współczesne orzecznictwo sądowe. Spróbuję udzielić odpowiedzi na pytanie o to, czy na gruncie prawa polskiego zakres ochrony barw wspólnotowych jest wystarczający? Analiza zbadanych aktów normatywnych doprowadziła mnie do wniosku o tym, że polski prawodawca po odzyskaniu niepodległego bytu państwowego przywiązywał dużą wagę do normatywnych podstaw mających zapewnić ochronę barwom jako symbolom narodowym. Włoska regulacja konstytucyjna, w porównaniu do polskiej, w zakresie barw narodowych jest bardzo skąpa. Pomimo regulacji wspólnotowej, każde z państw członkowskich – na skutek rozwoju historycznego – wykształciło własny model tej ochrony. Barwy Unii Europejskiej nie są expressis verbis chronione na gruncie polskich regulacji normatywnych. Moim zdaniem, de lege ferenda, dla pewności obrotu prawnego, należałoby stan prawny w tym zakresie zmienić i stosowne normy subrogować.

The purpose of this article is to set out the multiannual process for establishing the European Ombudsman's office and the reasons for its establishment. It presents the history of the first European Ombudsmen and the history of the European Communities from a legal perspective. The author goes back to the reasons for setting up the European Ombudsman's body, which were the lack of legitimacy in the European Union. The role of bodies such as the European Ombudsman is to ensure that citizens' rights are actually respected. The European Ombudsman strengthens the rule of law in the European Union and complements the role of the courts by providing a cheap, accessible individual remedy and, on the other hand, complements the representative function of the European Parliament by becoming the centre of independent critical assessment and improvement of the quality of European administration. The rule of law serves to maintain the EU system as a supranational system. It is the construction of the axis of integration. If there is a lack of trust in the community in this respect, it begins to be treated differently. It is therefore important that the European Ombudsman fulfils his Treaty obligations as a body of the European Union effectively.

The article discusses the issue of standards of the right to defence and takes into account the recent amendments of the Code of Criminal Procedure. The analysis is conducted against the background of minimum standards of the right to defence set out under European law. A reference introduced to the title of the Code includes the assertion that the legislator has implemented the provisions of Directive of 22 October 2013 on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty as well as Directive of 9 March 2016 on the strengthening of certain aspects of the presumption of innocence and of the right to be present at the trial in criminal proceedings. However, it should be emphasized in this context that as a result of changes made in the discussed scope in the years 2016-2019, the legislator not only failed to fully implement the aforementioned Directives, but even introduced modifications that led to lowering the standards of the right to defence and guarantees of its implementation, both in material as well as formal terms.

The creation of a single market in Europe, conceived as the application of the so-called four freedoms (goods, services, capital and manpower) of movement was in vogue in the 1990s. What has happened to this dream? At the time not only business communities but also consumer associations, and even labour unions were all in favour of opening their national economies to the winds of continental competition. Three decades after, some national communities seem to have turned their backs on the free movement of people. The case of Eastern European immigrants settling for work in the UK after 2004 comes to mind, something which arguably was one of the main reasons for the Brexit vote in 2016. The issue could again become the focus of populist governments or parties (e.g., in Italy, France, Sweden, Austria, Hungary or The Netherlands), should the danger of an EU-wide recession or an idiosyncratic crisis in one of the poorest member states (MSs) materialize. Actually, a new intensification of intra-EU migration flows could be one of the outcomes of the unravelling of supply chains as a result of the COVID epidemic and geopolitical considerations, such as the EU’s wish to diminish trade dependence from China and Russia. The ground is slowly eroding under the feet of those adamant to cling to the free movement of people as part of the acquis. The EU Commission should give thought, before it is too late, about the fourth freedom particularly in view of future EU enlargements.

This article analyses the priorities of European competition law in the air transport sector in the light of the ongoing process of the industry’s consolidation. The oligopolistic nature of the airline business results in a natural tendency towards its concentration. From the standpoint of regulatory oversight, the question is how to manage or counteract this tendency in order to achieve defined policy goals. In this vein, European competition law has departed from the model whereby the competitive process in itself is the priority and turned to an instrumental approach, with preference given to the welfare of customers. This analysis will highlight three policy areas relevant to the discussed subject. It begins with antitrust law, with special emphasis on the sector-specific phenomenon of airline alliances; then discusses merger control, especially in the context of pro-competitive remedies, and finally State aid, with particular focus on the effects of the compensatory scaling-down of operations which are imposed on recipients of a rescue and restructuring aid grant.

Freedom of contract and corrective justice are considered to be the basic principles governing contract law. However, many contemporary legal orders implement various policy goals into private law. The regulatory private law of the European Union is the most striking example of such a trend. This article aims at reconciling the corrective justice theory of private law and the principle of freedom of contract with the regulatory dimension of the EU law. The main argument is that the meaning of the concept of harm, one that is crucial to the principle of corrective justice, should be understood broadly so that it can transform the corrective justice theory from a monistic one into a pluralistic one.

The article considers the problem of adaptation of the law of Ukraine to EU private law. It analyzes the concept of “European Law” and “EU law” as elements of European civilization and their correlation is determined. On the basis of differentiation between the Western and the Eastern European civilizations a conclusion about the existence of corresponding traditions of private law is made. The idea that the concept of private law is grounded in western culture is based on the fact that there is a need for the adaptation of Ukrainian law to EU law. This approach is the basis for the conclusion that the success of the adaptation of the law of Ukraine to EU law depends primarily on the willingness of Ukrainian society to accept the fundamental values of European civilization, such as liberalism, human rights, the right of private property, freedom of contract etc.
Artykuł poświęcony jest zagadnieniom dotyczącym adaptacji prawa Ukrainy do prawa prywatnego Unii Europejskiej. Na podstawi analizy różnic pomiędzy Zachodnimi i Wschodnimi sub-cywilizacjami autorzy podjęli próbę podsumowania, przez pryzmat istnienia odpowiednich tradycji prawa prywatnego. Zwracają uwagę na to, ze koncepcja prawa prywatnego jest elementem Zachodnioeuropejskiej sub-cywilizacji i podstawą adaptacji prawa Ukrainy do prawa Unii Europejskiej. Adaptacja prawa Ukrainy do prawa Unii Europejskiej jest możliwa, przede wszystkim, w oparciu o takie wartości europejskie jak liberalizm, prawa osobiste, prawo własności prywatnej, swoboda umów i inne.

Currently, a holding company is one of the most popular form of organisation in the globalized Europe. The tax situation of such entities is a significant condition determining cross-border operations. Therefore, the objective of this article is to analyse the theories of taxation of holding companies conducting business activity on the territory of the EU. Analysis shows how great a variety of models (theories) of taxation, which are available in various EU Member States, a holding company may use. Individual tax theories are characterised by particular constructions that have both advantages and disadvantages.

The paper analysis the principle of proportionality, which is widely applied in the EU legal order and is therefore one of the fundamental principles of the system of the European Union. It is one of the legal principles that govern decision-making processes and common strategic objectives, and which are applicable when establishing European Union legislation and transposing it into national law, including in the area of criminal law, although the current analyses do not often focus on discussing this aspect. Due to its complexity and significance for the processes of establishing and applying the law, the principle of proportionality requires detailed and separate discussion, especially in the context of European criminal law.

The purpose of this paper is to present a theoretical assessment of the existing Law on Personal Data Protection in the Republic of Macedonia. The paper aims to analyse whether there is a need for additional legal tools in order to achieve a balance between maintaining data integrity in the digital age and the use of modern technology. The paper discusses the meaning of “information privacy” in the age of big data, cyber threats and the domestic and international response to these issues. Special focus is dedicated to privacy policy enforcement in European Union Law. Having regard to the development of new technologies, prevailing data protection legislation may no longer be able to provide effective protection for individuals’ personal information. Therefore, existing laws should be continuously adapted to respond to new challenges and situations deriving from different online activities and communications.
