Opis:
Disinformation regarding the COVID-19 pandemic is a global phenomenon. It constitutes a threat to the values protected under the law, health in particular. The primary issue tackled in “Disinformation regarding COVID-19 in the light of priorities of the European Commission and the legal regulations binding and currently drafted in Poland” paper is an attempt at answering the following question: Is eliminating COVID-19 disinformation from public space possible in light of the priorities of the European Commission and the legal regulations already effective and currently being drafted in Poland? The analyses conducted under the paper lead to the conclusions that the provisions currently regulating freedom of expression theoretically constitute a basis for eliminating disinformation from public space but are, in practice, not very effective. This leads to the need for searching for other, more effective legal instruments in this field, both on the level of European Union law making and domestic legislation. Although we may speak of a consensus concerning assessment of the very phenomenon of disinformation the legislative and practical actions taken, both on the domestic level and the European Union level, enable us to indicate substantial and frequently disturbing differences regarding shifting the aspects emphasized by legislation. As compared to the proposed solutions drafted by the European Commission and the drafts of domestic acts, the vastly different approach to the idea of controlling disinformation is clearly visible. Therefore, it must be stated that such circumstances will lead to development of varied legal effects of the drafted regulations that will decide, among other issues, the practical effectiveness or lack thereof in the case of the drafted solutions. In the course of the analysis of the issue constituting the subject of this paper we should concurrently bear in mind that freedom of expression is one of the principles in a democratic state governed by the rule of law.

Opis:
The SARS-CoV-2 virus outbreak came suddenly, devastating the health systems of other countries regardless of the financial condition of individual countries. And although at the end of 2019 it seemed that it would remain a problem in the Far East, the mechanisms related to globalization and human mobility meant that within a few weeks the strength and capabilities of almost the entire globe were exposed to a huge challenge—similar for every country. All of this took place at a time when analysts boldly predicted another financial crisis—at a time of raging economic processes. These, in turn, are closely related to the necessity to incur foreign debts—especially in the case of developing countries. Therefore, it seems reasonable to analyze the current information in this regard, based on the published data and the position of analysts in this problematic area. At the same time, it will be an introduction to further analyses in-depth with comprehensive data for the coming months.
Epidemia wirusa SARS-CoV-2 przyszła nagle, druzgocąc systemy zdrowotne kolejnych państw bez względu na ich kondycję finansową. I choć jeszcze pod koniec 2019 roku wydawało się, że pozostanie ona problemem Dalekiego Wschodu, mechanizmy związane z globalizacją i z ludzką mobilnością sprawiły, że w ciągu kilku tygodni siły i możliwości całego niemal globu zostały wystawione na potężną próbę – podobną dla każdego kraju. Wszystko to miało miejsce w momencie, kiedy coraz śmielej analitycy przepowiadali kolejny kryzys finansowy – czyli w momencie rozszalałych procesów gospodarczych. Te z kolei ściśle wiążą się z koniecznością zaciągania długów zagranicznych – zwłaszcza w przypadku krajów rozwijających się. Zasadne wydaje się więc dokonanie analizy aktualnych informacji w tym zakresie na podstawie publikowanych danych i stanowiska analityków tego obszaru problematycznego. Będzie to jednocześnie wstęp do dalszych analiz, pogłębionych o całościowe dane z kolejnych miesięcy

The spread of the epidemic of the SARS-CoV-2 coronavirus and the announcement of the state of epidemic emergency determined the necessity of the changes in the functioning of the social welfare units. This article is an analysis of the literature sources related to the functioning of the social workers during natural disasters, that have served as the basis for conclusions. In addition, twelve pilot interviews with social workers were conducted. Previously the institutions were not prepared for such a threat, did not have procedures nor regulations and means of self-protection. In the times of the epidemic the feminization of the profession of a social worker and the fact of the necessity of taking care of the children of the age of up to 8 years, resulted in the staff shortages. The new reality created the necessity to reorganize the work system of the social assistance units especially in the area of the safety regulations that is to say teleworking, rotational work and shift work, limitations in dealing with the clients and fieldwork, conducting community interviews by phone. Working at residential care facilities, which were closed to protect their residents from infection, has become of particular nature. Due to the epidemic situation, normative acts regarding benefits for persons threatened by the infection of SARS-CoV-2 virus, implementation of assistance for persons experiencing violence or support for people in crisis of homelessness are constantly changing. The text discusses in detail five factors hindering the performance of professional activities for employees of social assistance units: organizational and legal, physical, interpersonal, ethical and psychological. Finally, it is essential to start working by applying the method of organizing local communities (and using social capital), as its absence will be a barrier to the development of Polish municipalities after the epidemic.

Opis:
The article submits to a scientific discussion on the issue of the auction of a dwelling or a plot of land developed with a residential building, serving to satisfy the debtor’s housing needs during the SARS-CoV-2 virus epidemic. The key importance should be attached to the new Article 9521 § 5 of the Civil Procedure Code, which states that an auction of a dwelling or a plot of land developed with a residential building, which is to meet the housing needs of the debtor, is not carried out during the state of epidemic threat or epidemic state and 90 days after its end. The new legal solution highlights the general problems with the organization of the work of the courts (related to judicial enforcement proceedings) during the SARS-CoV-2 virus epidemic and the division of duties between the district court and the court bailiff. The presented considerations postulate the introduction of innovative solutions applicable not only in the state of epidemics. Firstly, an introduction, through legislative intervention, of an electronic auction in the course of enforcement of real estate, following the example of an electronic auction of movable property. Secondly, breaking the rule according to which the auction of real estate requires direct supervision by a judge (court clerk). The article takes into account the legal status as of 1 January 2021.
W niniejszym artykule poddano pod naukową dyskusję problematykę licytacji lokalu mieszkalnego lub nieruchomości gruntowej zabudowanej budynkiem mieszkalnym służących zaspokojeniu potrzeb mieszkaniowych dłużnika w czasie epidemii wirusa SARS-CoV-2. Kluczowe znaczenie należy przypisać nowemu art. 9521 § 5 Kodeksu postępowania cywilnego, według którego licytacji lokalu mieszkalnego lub nieruchomości gruntowej zabudowanej budynkiem mieszkalnym, które służą zaspokojeniu potrzeb mieszkaniowych dłużnika, nie przeprowadza się w czasie obowiązywania stanu zagrożenia epidemicznego lub stanu epidemii oraz 90 dni po jego zakończeniu. Nowe rozwiązanie prawne zwraca uwagę na podstawowe problemy z organizacją pracy sądów (związane z sądowym postępowaniem egzekucyjnym) w okresie epidemii wirusa SARS-CoV-2 oraz z podziałem obowiązków pomiędzy sądem rejonowym a komornikiem sądowym. W zaprezentowanych rozważaniach postuluje się wprowadzenie nowatorskich rozwiązań, obowiązujących nie tylko w stanie epidemii. Po pierwsze, wprowadzenie w drodze interwencji ustawodawczej licytacji elektronicznej w toku egzekucji z nieruchomości, na wzór licytacji elektronicznej z ruchomości. Po drugie, przełamanie zasady, według której licytacja nieruchomości wymaga bezpośredniego nadzoru sędziego (referendarza sądowego). Artykuł uwzględnia stan prawny na dzień 1 stycznia 2021 r.

Introduction. The article describes the process of converting a large multi-specialized hospital into one dedicated to COVID-19 patients, and present established standards of work organization in all the wards and training system of the medical and supporting staff. The several weeks pandemic of the COVID-19 disease has forced the healthcare systems of numerous countries to adjust their resources to the care of the growing number of COVID-19 patients. Managers were presented with the challenge of protecting the healthcare workers from transmission of the disease within medical institutions, and issues concerning the physical and psychological depletion of personnel. Materials and method. Based on analyses of the structure and work processes in Central Clinical Hospital (CCH) reconstructive strategic plan was developed. It included: division of existing wards into observation and isolation wards; installing locks; weekly plan for supplying personal protection equipment (PPE); designating new access to the hospital and communication routes; training of medical and supporting staff. The plan was implemented from the first days of conversion of the hospital. Results. The wards of the CCH were converted for observation and isolation, and each one was fitted with sanitary locks. There was a big improvement in the supply of PPE for the medical staff. Separation of the ‘dirty’ and ‘clean’ parts of the CCH were attained, and widespread intensive training not only protected personnel against infections, but also diminished unrest which was discernable at the beginning of conversion. Conclusions. The transformation efforts will ultimately be appraised at the end of the epidemic, but the data looks encouraging. Two weeks after conversion, the testing of hospital Staff was started and by the end of April, 459 tests were had been conducted, of which only 11 were positive.

In the last several weeks we have been witnessing the exponentially progressing pandemic SARS-CoV-2 coronavirus. As the number of people infected with SARS-CoV2 escalates, the problem of surgical management of patients requiring urgent surgery is increasing. Patients infected with SARS-CoV2 virus but with negative test results will appear in general hospitals and may pose a risk to other patients and hospital staff. Health care workers constitutes nearly 17% of infected population in Poland, therefore early identification of infected people becomes a priority to protect human resources and to ensure continuity of the access to a surgical care. Both surgical operations, and endoscopic procedures are considered as interventions with an increased risk of infection. Therefore, determining the algorithm becomes crucial for qualifying patients for surgical treatment, but also to stratify the risk of personnel being infected during surgery and to adequately protect staff. Each hospital should be logistically prepared for the need to perform urgent surgery on a patient with suspected or confirmed infection, including personal protective equipment. Limited availability of the equipment, working under pressure and staff shortages in addition to a highly contagious pathogen necessitate a pragmatic management of human resources in health care. Instant synchronized action is needed, and clear uniform guidelines are essential for the healthcare system to provide citizens with the necessary surgical care while protecting both patients, and staff. This document presents current recommendations regarding surgery during the COVID-19 pandemic in Poland.
