Opis:: By provisions in collective agreements, the option can be excluded for regular dismissal of older em- ployees. Such so-called non-dismissal clauses are meant to protect older employees, who with gro- wing age often are faced with difficulties in finding a new job after a dismissal. This frequently results in precipitating longer-term unemployment.1 In response, clauses on special protection against dis- missal in collective agreements are devised with the aim and purpose of protecting older employees mainly against dismissal and any follow-up longer unemployment. The paper explores to what extent this may possibly succeed and what pertinent issues may arise.

Opis:: The main purpose of the article is to identify the contradictions and problems arising when both international labor standards and Russian labor law are applied and separate guarantees to workers are provided in the case of their dismissal. The object of the research is the employment relationship which arises between the employer and the employee when social guarantees are given to the workers when the employment relations are terminated. This article considers the regulations of Russian and foreign labor law which provide workers with certain guarantees if the employment contract is terminated at the initiative of the employer. For the first time, these guarantees are considered from a comparative legal perspective. Specific recommendations about improvement of the Russian labor law and its enforcement.

Opis:: This article is entirely devoted to the issue of discharge from ser-vice in the Police under Article 41(1)(1) of the Police Act. Exemption on this legal basis requires that a medical committee must issue a medical certifi cate to the police offi cer, which states that he/she is totally incapable of serving in the Police. This must be a fi nal decision. Issuing a fi nal ruling requires the superior in charge of personal matters to discharge the police offi cer from offi cial duties in the Police, before he/she is dismissed from service. During the period of dismissal from offi cial duties, the police offi cer retains the right to full salary despite not performing service duties.
