A recent view about disagreement (Karczewska 2021) takes it to consist in the tension arising from proposals and refusals of these proposals to impose certain commitments on the interlocutors in a conversation. This view has been proposed with the aim of solving the problem that “faultless disagreement” – a situation in which two interlocutors are intuited to be both in disagreement and not at fault – poses for contextualism about predicates of taste.In this paper, I consider whether this view applies equally well to disagreements involving aesthetic adjectives. I show, first, that it applies quite straightforwardly to predicates like “beautiful,” which presumably generate faultless disagreement. However, aesthetic adjectives like “beautiful” don’t exhaust the aesthetic sphere. A term like “balanced,” for example, while still perspectival, is said to have a more “objective” feel and usually doesn’t generate faultless disagreement: when the novice and the expert disagree on using such a term, we take it that the expert is right and the novice is wrong. I argue that Karczewska’s view has trouble explaining this difference in the profile of the two types of aesthetic predicates vis-à-vis the generation of disagreement. I also consider possible ways of coping with this problem, but I then reject them and propose a different one that is suitable for most views in the debate.

What is the relationship between general legal theories and legal narratives? In this paper we aim to problematise this relationship in the context of different legal disagreements. As we see it, the Dworkinean category of “theoretical disagreement”, which basically refers to the phenomenon of disagreement “about the grounds of law” (between different general legal theories) is not sufficient to cover all substantial disagreements that appear in legal practice. Thus, we propose a category of “narrative disagreement” which has a wider scope. Eventually, we discuss the thesis of a possible equality of legal theories, as well as legal narratives, which we understand as an inevitable consequence of the relationship between legal theories/narratives and a special type of evidence on which they both rely: truisms about the law that laymen and/or legal professionals generally share.
Celem tekstu jest zbadanie relacji między teoriami prawa i narracjami prawnymi oraz roli jaką pełnią one w sporach prawniczych. W pierwszej kolejności wyeksponowane zostaje zjawisko sporów teoretycznych w prawoznawstwie, które rozumiane są jako spory między rywalizującymi teoriami prawa. Wskazane zostają przy tym dwa podejścia do rozumienia „teorii”: węższe (tradycyjne, m.in. pozytywistyczne) oraz szersze (paradygmatycznym przykładem jest teoria Dworkina). Szersze rozumienie „teorii” pozostaje – gł. z uwagi na podstawę w pragmatyczno-holistycznej metodologii – w bliższych związkach z ideą „narracji” (metafora pisania powieści). Wydaje się jednak, że wciąż pewne istotne różnice między „teorią prawa” a „narracją prawną” pozostają, stąd dalsza część artykułu poświęcona zostaje ich problematyzacji. Na samym końcu dochodzi do porównania idei „sporów teoretycznych” z ideą „sporów narracyjnych” (w związku z zaproponowanym rozumieniem narracji prawnej).

In a series of publications Burgess, Plunkett and Sundell have developed a metalinguistic negotiation view that they call ‘Conceptual Ethics.’ I argue that their position adequately captures our intuition that some cases of value disputes are metalinguistic, but that they reverse the direction of justification when they state that speakers ‘negotiate’ the best use of a term or concept on the basis of its prior social role. Borrowing ideas from Putnam (1975b), I instead suggest distinguishing two meanings of general terms and value predicates. Core meaning represents the lowest common denominator between speakers and is primarily based on our needs to coordinate behavior. In contrast to this, the noumenal meaning of a general term or value predicate is intended to capture an aspect of reality and represents what a term really means. Like many other disputes about theoretical terms, terms for abstract objects, and predicates, metalinguistic value disputes are about noumenal meaning on the basis of a shared core meaning. This direction towards reality is what sets the account apart from mere metalinguistic negotiation.

This article is concerned with an analysis of semantics and the normativity of evaluative judgments, in which “aesthetic concepts” and “predicates of personal taste” are used in the context of the evaluation of selected cultural forms (foods and beverages). Qualitative data obtained through semi-structured interviews with representatives in four categories of actors in the cultural field (non-experts, fans, makers, and professional critics) are analyzed. In the light of the findings, theories of aesthetic judgment are critically assessed, which on the one hand, postulate the categorical semantic and normative difference between aesthetic concepts and predicates of personal taste and, on the other hand, conceive aesthetic disputes from an epistemological point of view and do not sufficiently take into account their pragmatic context. In conclusion, a functional analysis of the semantics and normativity of evaluative judgments is presented, in which the speakers use terms from the field of aesthetics.

The article focuses on the explicit teaching of language used to express agreement and disagreement in the popular English language coursebooks English File and Navigate. It reviews the current research on teaching various aspects of polite language and politeness-sensitive speech acts and analyses and compares the explicitly taught phrases of agreement and disagreement in the two selected coursebook series, as well as the methods of their presentation and the amount of background theoretical information provided to students and teachers to facilitate their proper usage. Differences were identified not in the inventories and language representation of the explicitly taught phrases, but mainly in the background support available for students and teachers on their usage.

The possibility of construction disputes can be reduced, but they cannot be avoided due to the uncertain and risky nature of the building industry. Conflicts between construction parties often have very unfavourable effects, such as cost increases, poor construction quality and time extension in the schedule. Lots of studies have been carried out in order to try and avoid these disagreements. However, there are no common resolution tools or techniques due to the improving conditions and scope of contracted works. Advanced methods and dispute reasons should be fully monitored and updated for the applicable solutions. This paper discusses the current major constructional dispute reasons in Turkey. The questionnaire method was applied within the scope of this study. The questionnaire documents were randomly distributed to 80 contractors to analyse major dispute reasons in Turkey. Analysis of the questionnaire results indicates that the major current dispute causes are poor quality of performed works, delays in progress payments, inefficient site management, poorly written contracts and design mistakes.
Prawdopodobieństwo sporów budowlanych może zostać obniżone, jednakże nie można ich uniknąć, ze względu na niepewną i ryzykowną naturę przemysłu budowlanego. Konflikty pomiędzy stronami inwestycji często mają bardzo niekorzystny wpływ, taki jak wzrost kosztów, słaba jakość konstrukcji oraz wydłużenia czasowe w harmonogramie. W celu uniknięcia tych nieporozumień, przeprowadzono wiele badań. Jednakże, nie ma wspólnych narzędzi lub technik rozwiązywania tych problemów, ze względu na poprawiające się warunki oraz zakres prac budowlanych. Metody zaawansowane oraz powody sporów powinny być w pełni monitorowane i aktualizowane pod kątem stosownych rozwiązań. Niniejsza praca omawia obecne, główne powody sporów budowlanych w Turcji. W zakresie niniejszej pracy zastosowano metodę ankietowania.

The Braess paradox in road planning presents a case, where adding a new connection in a road network may lead to delayed arrival because of violation of the balance in the traffic flow. The paper discusses a generalization of this paradox. The initial, the asymmetrical, and the Pareto optimal domain are identified. Administrative solution with the participation of a controller is introduced, which aims to minimize the time of arrival, and thus has an environmental aspect. The preferences of the groups of passengers in the vehicles are modeled by an analytical arctan-approximated utility. Nash arbitration is employed to find an optimal solution that maximizes the Nash utility criterion. It is performed over the optimal Pareto domain that is outlined in four stages. A numerical example with 40 vehicles and five types of preferences of the passengers demonstrates the ideas.

The paper aims to weaken a widespread argument against indexical contextualism regarding matters of personal taste. According to indexical contextualism, an utterance of “T is tasty” (where T is an object of taste) expresses the proposition that T is tasty for J (where J is a judge). This argument suggests that indexical contextualism cannot do justice to our disagreement intuitions regarding typical disputes about personal taste because it has to treat conversations in which one speaker utters “T is tasty” and another responds with “T is not tasty” (referred to as ‘judge-non-specific conversations’ in this paper) as being on a par with conversations in which one speaker utters “T is tasty to me” and another responds with “T is not tasty to me” (referred to as ‘judge-specific conversations’). The argument has it that judge-specific conversations, unlike judge-non-specific conversations, do not contain disagreement between speakers. To defend indexical contextualism, some philosophers have proposed accounts (here referred to as ‘dual-propositiontheories’) according to which utterances of “T is tasty” are used to communicate both the above kinds of semantically expressed proposition and some other kinds of proposition (like superiority propositions or metalinguistic propositions) that could be used to explain disagreements about taste. The paper defends two claims: First, it is argued that judge-specific conversations, or at least some of them, do contain disagreement between speakers, contrary to what the anti-indexical-contextualist argument supposes. Second, it is argued that dual-proposition indexical-contextualist theories fail to explain judge-specific conversations that are intuitively interpreted as containing disagreement.
