Bearing in mind that there exists no universally accepted definition of the rule of law, this paper sets out to identify its commonly agreed core, and to expand it by adding substantive elements. While the core is not controversial, the second part of the rule of law framework, comprising social welfare rights, essentially aims to revisit classical accounts of the rule of law. The analysis involves the frequently ignored social dimension of the rule of law, defending the necessity of its translation into a substantive element of the definition. Some general arguments are offered explaining why social rights protection should be included in the definition of the rule of law.

During the 26th ICOM General Conference in Prague in 2022 a new museum definition was adopted. However, debates on it are much older, and while reaching merely the previous 25th ICOM General Conference held in Kyoto in 2019 let us recall that it was there that an aborted attempt at introducing the new museum definition, much differing from the current one, took place. It is the normative and legal consequences of the adoption of the new ICOM museum definition that are the subject of the paper. It is possible for the normative ICOM output to be implemented in the domestic legal regulations. Interpretations and observations related to the question are contained in the paper, however they finally lead to the conclusion that the literal wording of the museum definition as such is not of major importance. As for the tendency, this shows the extension of the name’s range although not conducted entirely spontaneously and freely.

In 1980, in Poland, there were about 30 religious minorities. The socio-political transformation changed the religious landscape dramatically. In 1999, there were already 155. Not all new religions, however, were registered. In the case of The Church of Miracles, The Raelians, and The Order of Initiated Knighthood, registration was refused. The Ministry of the Interior and the Supreme Administrative Court decided that they did not fulfil the requirements of a “religion”. The purpose of this article is to examine, from a sociological perspective, the definitions of religion used by the court, by which the above new religious movements were not recognised as religions. The analysis shows that the court and administration ruled on the basis of substantial definitions of religion, reducing religion to believing in God or the sacred. Furthermore, the article presents the socio-cultural reasons behind the choice of such definitions, and reviews the scholarly debate on the issue.

The primary aim of this paper is to analyse the legal definition of piracy stipulated in Article 101 of the United Nations Convention on the Law of the Sea. As the title of the paper itself suggests, the phenomenon of maritime piracy is examined only from the perspective of international law of the sea, which means that state municipal laws remain beyond the scope of the analysis. The authors attempt to interpret and critically assess relevant legal provisions, rather than recount in detail facts related to cases of maritime piracy or present statistics describing the scale of this phenomenon. The article is divided into six relatively short sections. Key considerations are contained within sections 3–5, which cover the relevant provisions of the Montego Bay Convention. These sections deal, respectively, with the definition of piracy, the “private ends” requirement, and the “two-vessel” requirement. The remainder of the article is divided into introduction, historical background and conclusions.

Opis:
Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 2021 provides for the need to include initiatives such as “Smart Villages” in territorial development strategies. An explanation is needed for the purposes of constructing and implementing this element of the strategy. The research undertaken for this purpose started with a structural analysis, which showed, among other things, that the terms smart village and smart villages occur in about 100 legal acts and its preparatory documents of the European Union from the period between 2015 and 2021. A general definition of smart village as a concept that aims to develop services through digital technologies and better use of knowledge, for the benefit of inhabitants and businesses, is provided in a 2017 Commission document. Although a later opinion of the European Committee of the Regions, proposed replacing this term with smart rural areas; both phrases appear in the most recent documents. A contextual analysis of the 2020 and 2021 acts and documents shows expanded common elements of the smart village and smart city concepts compared to the original ones. This provides justification to the search for theoretical support in publications on smart cities, which, in addition to the opportunities and benefits, also points to the need to strengthen personal data protection and cybersecurity.
