Opis:
The USA as a multinational country of immigrants is nevertheless a fertile ground for competing nationalist ideologies and the consequently competing myth-building that surrounds the construction of national identity. The myth of the 1776 Declaration of Independence as an important founding document for domestic politics in the United States continues to spread through popular culture and academic textbooks. The claim of the Jefferson’s Declaration as an aspirational founding document helped establish a myth supporting creedal nationalism, but obscures the arc of the ideological debate over national identity.

On 11 March 2014 Crimea declared independence. Ukraine and international society has not recognised that act. However Crimea’s independence was recognised by Russia and on 18 March 2014 an agreement on the accession of the Republic of Crimea to the Russian Federation was signed. Many countries and international organisations have condemned that step, viewing it as illegal annexation. Regardless of how this situation is treated however, it is at present a fait accompli. Such a situation evokes legal consequences both in the internal law of Ukraine and Russia as well as on the plane of international law. The residents of Crimea appear to be in the worst situation. Legal certainty is a fiction for them now. There are also problems on the international plane. Despite the fact that in the opinion of international society Crimea remains an integral part of Ukraine, in practice there are many conflicting problems of a legal nature that cannot be solved, at least for the time being. This article analyses the legality and certain legal consequences of the “accession” of Crimea to Russia and the effect of this accession on the legal situation for residents of Crimea. The article concludes that legal situation of Crimeans will not improve anytime soon, and that the legal problems which have arisen on the international plane will not be resolved soon either.

Opis:
The purpose of this article is twofold. First, to look at the Identity of Israel as both Jewish and democratic State in its Declaration of Independence and the status it acquired over the years within the Constitutional and law system. The second, to examine, through the evolution of the enounced principle of equality in the situation of economic, gender, religious and national minorities, how it was implemented and what has changed after 70 years. From the outset, the Declaration was not given a constitutional status but later the Supreme Court gave it an interpretive quality. With the two Basic Laws on Human Rights, limited as they were, it gave the Supreme Court much more advantage to intervene and impose the Identity of the State as Jewish and democratic in its interpretations of laws in spite of strong criticism and even to influence and criticize the Knesset legislation. However, Israel is still not a true liberal Democracy since the rights within it are determined more according to the ethnic-national religious belonging of the person that according to its citizenship and the principle of equality is only partially adopted in practice with different degrees as regards the various minorities. In some aspects, it even moves away from the original intended Identity of an exemplary liberal Democratic Nation State.

The international community anxiously awaited delivery of the advisory opinion of the International Court of Justice (ICJ) on Kosovo’s declaration of independence, hoping it would clarify the controversial right of self-determination and the right of secession. Although it was hailed by many as a confirmation of both rights, the advisory opinion was disappointing regarding that part of the analysis which was based on general international law. The ICJ interpreted the question posed in a very narrow and formalistic way. It concluded that declarations of independence (not their consequences) are not in violation of international law, but it did not rule that they are in accordance with international law, as was requested in the posed question. The ICJ refused to examine whether there is a positive entitlement to secession under international law. Although Kosovo and its supporters claimed that the case of Kosovo is unique and will not set a precedent, Russia used the case of Kosovo and the advisory opinion to justify the so-called referendum in Crimea and the subsequent incorporation of Crimea into Russia. However, the situation in Crimea is only superficially comparable to Kosovo and the advisory opinion gives little or no support in the case of Crimea.

The focus of this article is to examine the notion of freedom, and more precisely freedom of speech, in the light of The People vs. Larry Flynt. The analysis will pay close attention to what has always been a central concern of American society constituting one of the basic principles on which the new nation was founded. What is more, the article will try to indicate that freedom of speech has been as essential as controversial in many respects, which is proven by numerous examples from American history. As a baseline of this study I have chosen Larry Flynt, whose life and legal battles form the central theme of the selected biopic. The article will scrutinize the plot of the movie, as it provides interesting insights into the life of this controversial advocate of freedom of speech. Flynt made himself well-known, if not notorious, by being the focal point of countless debates that concerned moral issues, public taste, and two basic rights guaranteed by the Declaration of Independence and the First Amendment. Ultimately, the article will try to challenge the concept of a society based on the notion of freedom of speech by asking and trying to answer three questions: What precisely is freedom of speech? Is freedom of speech absolute? Are there any limits of expression and if so, then where to draw the line?
