The aim of the publication is to present the role and tasks of the police in criminal proceedings in a legal and comparative approach. Over the years, there could have been noticed an evolution in the area of police powers. The rationale for addressing such an important issue is, first of all, to look at the achievements of the authors of reforms in the post-annexation period and to recognise their contribution to the process of shaping high standards of functioning of police authorities. Studies and analysis of legal texts from the period when Poland regained independence is an important element of learning about history and tradition, as well as the possibility of following patterns of lawmaking adequate to the challenges of lawmaking. The original spelling of source texts and sometimes their archaic language layer, quoted in the text of the publication, is a measure to respect the principle of faithfulness to the sources and, at the same time, to illustrate the development of individual legal institutions. The article focuses on the analysis of selected regulations of the Regulation of the President of the Republic of 19 March 1928 — Code of Criminal Procedure (Journal of Laws of 1928, No. 33, item 313) in relation to the current solutions of the procedural act.

The article analyzes the concepts of «coercion», «measures of criminal procedural coercion», «measures to ensure criminal proceedings» and their relationship. The measures of procedural coercion, which the court can most often apply to the participants in court proceedings in a criminal case, as well as the procedure for postponing the trial in connection with their (measures of procedural coercion) are studied. Proposals for improving the criminal procedure legislation of Ukraine in this direction have been formulated. Measures of criminalprocedural coercion are procedural means of state-legal coercion defined by the criminal-procedural law, applied by the authorized bodies conducting criminal proceedings, in the order clearly defined by the law concerning persons, for the purpose of achievement of efficiency of criminal proceedings. The concept of “measures to ensure criminal proceedings” in its own right the content and scope do not cover the category of precautionary measures and other mea sures procedural coercion. In our opinion, the concept of «criminal measures procedural coercion “and” measures to ensure criminal proceedings «are not identical: under the current CPC of Ukraine measures procedural coercion is a component of criminal security measures proceedings, and, consequently, to some extent, a narrower concept. They are correlated between themselves as a whole and part. However, before proceeding to the analysis of each of the measures of coercion we have identified, let us pay attention to the important procedural provisions that the judge is obliged to remember when applying this or that measure. The court may impose measures of procedural coercion on the person, which in turn will postpone the trial.

The article concerns the issue of verification activities which precede the institution of criminal proceedings and are aimed at determining legitimacy or admissibility of the criminal proceedings. The author focuses on the presentation of this problem from the viewpoint of the legal nature of the time limit for the said proceedings. The article adopts a dogmatic and legal method. The existing regulation has been analysed, its defects identified and amendments proposed. The general goal of the discussion is to postulate the development of solutions that would result from proper balancing of protected interests of the administration of justice and the necessity to respect human rights.
Artykuł jest poświęcony zagadnieniu czynności sprawdzających poprzedzających wszczęcie postępowania karnego, służących ustaleniu zasadności lub dopuszczalności wszczęcia procesu. Autor analizuje tę problematykę z punktu widzenia kwestii dotyczącej charakteru prawnego terminu prowadzenia wspomnianych czynności. W opracowaniu przyjęto metodę dogmatyczno-prawną. Dokonano oceny obowiązującej regulacji normatywnej i sformułowano propozycje zmian. Całość rozważań ujętych w artykule jest podporządkowana postulatowi kreowania takich rozwiązań, które stanowią rezultat odpowiedniego zbilansowania ochrony dobra wymiaru sprawiedliwości oraz potrzeby poszanowania praw człowieka.

According to Albert Mehrabian - one of the first researchers of the body language - only 7% are affected by the words, 38% by the voice signals (the voice tone, the modulation) and 55% by the non-verbal signals. In view of the above fact it follows that the skills of the effective occurrence pay off so are the considerations in this context justified?

The subject of the article is the issue of the obligation to notify about a crime in relation to medical confi dentiality. Medical workers may obtain information indicating the commission of a criminal act while performing medical services. An important issue is whether, in such a situation, they can or should notify law enforcement authorities. In order to resolve these issues, the legislator defi nes the legal and social obligation to denounce. The legal obligation of a medical worker to notify about a crime relates to the offences specifi ed in Art. 240 (1) of the Act of June 6, 1997 — Penal Code. Among the enumerated types of generic acts covered by denunciation, particularly important due to the issues raised, are the crime of murder (Article 148 of the Penal Code) and deprivation of liberty (Article 189 of the Penal Code). A medical worker having obtained reliable information about the commission of a criminal act is obliged to notify law enforcement authorities. It is irrelevant whether they learned about it while carrying out professional activities or without a connection with their performance. The criminal sanction for failure to comply with the obligation under Article 240 (1) of the Criminal Code is a prison sentence of up to 3 years. However, the social obligation to denounce is introduced by Art. 304 (1) of the Act of June 6, 1997 — Code of Criminal Procedure. Failure to fulfi l obligations of this nature does not result in any criminal consequences. The social obligation to denounce does not include offences prosecuted on private accusation or on request of the victim. It is worth noting that this obligation does not repeal any of the laws regulating medical secrets. In this case, a medical worker who has learned of a crime in connection with the exercise of their profession has no obligation to denounce. It should be emphasised that a medical worker may fulfi l the obligation to denounce only if the patient or their legal representative has consented to it, or if there are premises for presuming the consent.

The aim of the study is to discuss the elements of the assault on a public official, as defined in Article 223 of the Penal Code. This provision is an expression of the criminal-law protection of public officials in Poland understood as all legal provisions specifying criminal sanctions and the rules of their application to perpetrators of prohibited acts under the threat of these sanctions, aimed at protecting public officials against such acts. Article 223 of the Penal Code defines active assault on a public official in the basic type [Article 223(1)] and the aggravated type [Article 223(2)]. Regarding the elements of the crime in question, there are many issues that raise doubts among both legal theorists and practitioners. These include, in particular, the issue of classifying the car as a category of items similarly dangerous as firearms or knives, and the justification for determining the degree of danger of the means of restraint used by the perpetrator. The text also points out that the penalisation of an active attack on a public official does not result from the increased protection of the goods of public officials, but from the need for the legislator to ensure the proper functioning of state mechanisms.

The subject matter of considerations undertaken in the paper is the issue of obtaining evidence entailing banking secrecy under the European Investigation Order at the stage of the preparatory proceedings from the Polish perspective. The examination of the described evidence activity is often necessary to make key findings, for example, in the field of the data on bank accounts or bank transactions. Actions taken in this regard may concern the monitoring of banking operations and may also be used for establishing financial links between entities operating in different European Union Member States. The procedure for applying the European Investigation Order generates many problems in the analysed scope, in particular at the stage of the preparatory proceedings, starting from determining the authority competent to issue the European Investigation Order, to the need to consider legitimacy of obtaining the consent by the prosecutor to exempt from banking secrecy in order to further request for the required information. Against the background of the issues presented in the article, an attempt was made to analyse the normative institution of the European Investigation Order, used for obtaining evidence covered by banking secrecy, and to show the model that determines its optimal functioning in the face of existing problems in the application challenges related to the European cooperation in this area.

Reforms undertaken after 90’s have brought progress in legislation changes and compliance with international standards. This goal is also supported from the membership of our country in several international organizations and ratification of international legal acts. Legal reforms have brought many positive aspects in terms of guaranteeing the procedural position of juveniles and respect their rights at all stages of criminal proceedings. One of the most important aspects of the process is the one related to the freedom deprivation in terms of which are sanctioned a number of principles and procedural rules. Despite positive steps, the Procedural Penal Code should be subject to further amendments and improvements regarding procedural provisions for the treatment of juveniles during criminal proceedings. This article seeks to analyze the specific guarantees and particularly procedural rules related to deprivation of personal freedom as well as issues associated with the treatment of juveniles at this stage. The paper will focus primarily on: - The issues on special protection of juveniles in criminal proceedings and cases of freedom deprivation in the framework of the international standards. - Reflecting the concrete situation and the judicial practice issues, in the framework of the Jurisprudence of the Criminal College of the Supreme Court. - Drawing concrete conclusions and recommendations in regard to the current stage of reflection of the international standards on minors freedom deprivation in the penal legislation and its implementation in practice, as well as the concrete needs for improvement through legal interventions and institutional arrangements.

The paper addresses legal solutions concerning the model of witness interviewing. The discussion is of comparative nature, as it refers both to the regulations contained in the Code of Criminal Procedure of 1928, as well as to the provisions of the current criminal procedure. It aims at a synthetic analysis of key changes in the model of interviewing a witness taking into consideration historical factors, as well as their impact on the current shape of the provisions in the Criminal Procedure Regulation. While reviewing legal solutions, the author pays special attention to the process of questioning at a distance supported by devices enabling simultaneous image and sound transmission. This issue is discussed in many aspects, taking into account the views of the doctrine and the analysis of case law. Apart from the assessment of the current legal status in genere, the paper also presents the proposals of solutions in the subject matter.

Artykuł zajmuje się ważnym problemem czeskiego sądownictwa w sprawach karnych, polegającym na przewlekłości postępowania. Występowanie tego problemu stało się podstawą działań legislacyjnych zmierzających do wprowadzenia nowych form skróconych procedur. Poprawki do Kodeksu Postępowania Karnego Republiki Czeskiej (Akt Nr 141/1961 Coll.) zostały wprowadzone zarówno z powodu nowych rodzajów postępowań karnych przewidzianych w czeskim prawie karnym (np. warunkowe umorzenie postępowania związane z zakazem działalności), jak też z powodu środka nazwanego porozumieniem co do winy i kary w formie tzw. ugody obrończej (plea bargaining). Artykuł analizuje zalety i wady nowych rozwiązań (np. zgodność z podstawowymi zasadami czeskiego postępowania karnego), jak również problemy z ich regulacjami prawnymi i perspektywami zastosowania w praktyce. Czeskie doświadczenia z nowymi formami skrócenia procedur karnych mogą być użyteczne jako inspiracja oraz porównanie dla specjalistów zagranicznych

Operational control is one of the most important powers of the state police services, including, since 2018, the State Protection Service (Służba Ochrony Państwa – SOP). The analysis of the title issue presented in the article leads to the conclusion that the shape of the operational control, which is a novum in the security service, which is the SOP, does not differ from the solutions used in regulating the operational powers of other Polish services, both in terms of the principles and procedure of applying control operational, and the (technical) ways of using this power in practice.

The Article 168a of Code of Criminal Procedure introduces the rule of the permissibility in criminal proceedings evidence obtained under the violation of criminal procedure regulations or as the result of indictable offence defined in Article 1 of Criminal Code. The Article 168a of CCP is highly controversial, especially due to the lack of linguistic precision of its provision and collision with Constitution. The regulation mentioned above is in conflict with the system of evidence-related prohibitions in criminal proceedings. In this context, the freedom expression rule during the interrogation is essential. Its violation results in the prohibition of the use of evidence. Used in the provision of Art. 168a of CCP, word „exclusively” is claimed to be a key for proper resolution of this problem. If interpreted differently, the provision would flagrantly deny the essence and nature of the freedom expression rule during the interrogation

This article discusses external openness of criminal proceedings in respect of legal security. The realization of such openness is done through the statutory permission to record and broadcast a hearing which is granted to representatives of the mass media. The article also attempts to assess amendments to article 357 of the Code of Criminal Procedure (2016) in terms its realization of the idea of legal security. The author gives a positive assessment of the direction of changes in the Polish law; however, she also tries to identify the legislation which could undermine legal certainty, and thereby negatively affect the possibility of realising the concept of legal security in the context of criminal law.

The forfeiture of an animal is a specific measure regulated by the Act of 21 August 1997 on the Protection of Animals. The rules for imposing the forfeiture of an animal are not questionable in the case of convictions for the offence of animal abuse. The adjudication of forfeiture is obligatory in such a situation. However, the legitimacy and legal basis for imposing forfeiture of an animal in cases of conditional discontinuance or discontinuance of criminal proceedings requires consideration. The authors believe that under current legislation, the courts can make use of this legal instrument. The analysis conducted in this article reveals that the legal basis for adjudicating the forfeiture of an animal in cases of conditional discontinuance or discontinuance of criminal proceedings is Article 45a of the Act of 6 June 1997 – Penal Code.
