The basis of European communities’ integration is diversified. Some of its aspects are particularly emphasized, like the dynamics of economic development, which creates new quality of life for millions of Europeans. Much attention is devoted to the common historical past and the common democratic political values. The attention is focused, to a lesser extent, on what constitutes the real basis of cultural identity for European societies, namely law and the attitude to it. It is law and values attributed to it as well as legal institutions, which have been the strongest links of cultural chain connecting Europeans. Except for a basic issue, that is the Roman law tradition, one can point at a great common achievement with essential practical qualities. Lex mercatoria in the field of commercial law. Traditions of European constitutionalism, including the second, in the terms of the time of creation, modern constitution which was Polish constitution of 1791. Modern civil law becoming widespread due to the French Napoleonic Civil Code, which at the beginning of the 19th century was binding on the eastern European territory within such borders, which are now the European Union’s borders. The exchange of ideas and legal doctrine from the Middle Ages at European Universities. Promoting in these discussions, starting from the 16th century, modern solutions in the area of law, like the postulate of departing from capital punishment and equal rights. A systematic development of subjective rights, human rights, equal rights for women, rights of minorities and rights of the disabled. Introducing these rights to the positive law and ensuring their international and institutional protection.

In the paper there are analysed five British and German incongruent civil law terms. German terms appear in the German act of law called Bürgerlicher Gesetzbuch. British terms name the terms characteristic of each of the three separate legal systems: of England and Wales, Scotland or Northern Ireland. All terms constitute legal terms according to the definition by Morawski. The research problem is to verify whether the published typology of translation methods used in the Polish-English translation of succession and family law terms (which are civil law terms) encompasses translation methods applied when translating civil terms from German into English. The term translation method is defined according to Hejwowski. In order to determine the translation methods applied while producing equivalents, the definitions of the source terms and the equivalents in question are analysed. Furthermore, the appearance of the suggested equivalents in the sources of the British law as well as the corpora of the English language is verified. Finally, having examined the translation methods employed, it is concluded that the equivalents suggested have been formed with the application of as many as 4 different methods listed in the abovementioned classification. Moreover, the Ukrainian terms denoting the legal institutions discussed have been analysed compared to the Polish terms. With regard to the translation of the terms under analysis from Ukrainian into English two different methods have been employed.

The paper discusses the extent to which it is possible to find the right Polish equivalents of such English concepts as acquisitive prescription (in property law), entitlements of the dependents (in the law of inheritance) and commercial impracticability (in the area of obligations). Although the general idea of the discussed concepts may easily be grasped and smuggled into such Polish institutions as zachowek, zasiedzenie (legitim), and rebus sic stantibus, deeper insight into the description of these concepts in the two legal systems discloses many differences in detail.

The introduction of the principle unity of civil law into the Polish civil law with the entry into force of the Civil Code in 1965 did not involve ensuring internal consistency of normative acts forming the core of civil law, i.e.: the Civil Code, regulations regarding commercial companies contained in the 1934 Commercial Code, the Family and Guardianship Code, and the law on land and mortgage registers. The Code of Commercial Companies of 2000, to some extent, but not completely, pursued the postulate of ensuring the consistency of the provisions of the Civil Code and the law of commercial companies. In the legal literature, attention is paid increasingly to the necessity to complete the process of adjusting the Commercial Companies Code to the Civil Code as well as the introduction of relevant modifications and corrections to the Commercial Companies Code ensuring the necessary coherence of the legal regulations of these codes. In the first place, this is required by the following issues: Firstly, concerning the nature, manner and scope of applying the freedom of contract principle in the area of legal regulation of commercial companies. Secondly, the relation between the provisions of the Civil Code concerning acts in law, in particular contracts, and articles of association in commercial companies as well as the so called invalidity of articles of association (Article 21 CCC). Thirdly, the issues concerning the concept of an act in law and resolutions of a capital company body, invalidity of an act in law and challengeability of a resolution of the general meeting or of the general assembly of a capital company, as well as the explanation of the so called non-existent resolutions. Fourthly, the legal and financial status of the spouses where at least one of them is a participant in a commercial company. Fifthly, synchronization of the provisions of the Act on the National Court Register concerning registration procedure with structural provisions of the Commercial Companies Code concerning the functioning of commercial companies. The application of adequate provisions of the Code of Civil Procedure is to be considered in this respect.

In last 20 years Slovenian civil law has experienced a revival and it tried to get rid of the former influences of socialism and communism. Slovenia does not have a uniform civil code. Civil law is governed by the four headline acts: Code of Obligation (from 2001 with changes), Property Code (from 2002 with changes), Marriage and Family Relations Act (from 1976, but with last official consolidated text from 2004 and later changes) and Succession Act (from 1976 with changes). Especially noticeable changes were made in the area of property law, which in last 20 years has undergone several substantive changes. The new Code of Obligations has largely succeeded former Yugoslav obligation law, but in some areas it has brought new radical changes (e.g. contract of donation, life care contract, loan agreement). Succession and family law are still governed by the law from year 1976, but family law was subjected important changes, especially regarding the children and foster care. In 2005 an Act on Same sex registered partnership. A new Family Code was also adopted, but the Slovenes in the referendum in March 2012 decided against the new Family code, so that it is now in the process of change. In 2012, a first draft of the Succession Act was also created. It was subjected least changes since 1991.

The paper deals with the specific organization of the shared custody regime in Spanish Law. This requires a separate analysis of two aspects: how the physical organization will be and how the time will be distributed among the parents. With regard to the first question, there are two possible alternatives for the physical organization of the shared custody regime: that the children remain in the same home and the parents rotate, or that the children rotate between their parents' homes. Both possibilities are analyzed, considering the advantages and disadvantages of each, as well as their practical repercussions, through the study of the judgements of our courts. With regard to the second aspect to be analyzed – the distribution of time between parents, as we know, shared custody does not necessarily imply an equal distribution of time, although it does seem to be similar, as this is the main data that allows it to be differentiated from an exclusive custody regime that involves a wide regime of visits for the non-custodial parent. The paper attempts to determine the necessary time requirement to be able to speak of shared custody and addresses the issue of the specific duration of periods of alternation – which may be long and extended in time or, on the contrary, short and frequent. For this, once again, the jurisprudence emanating from our courts is taken into account, as well as the doctrine of the authors who have worked on this issue.

The author is contrasting the legal status of landlords from the times before servitude of transmission was established and after its implementation. The author is of the opinion that taking into consideration the vast range of powers the landlords have today, servitude of transmission may be treated as, at least, a favorable adjustment.

This article tries to return to the essence of civil law which, with a little more than ten key contractual institutions, allows all disputes created from newly founded institutions to be examined and interpreted. If law is science it must be ableto be reduced to a set of basic concepts that have been coined and concluded from daily contractual practice and, almost in their entirety, have been in force over time. Hence the study of Roman law and Roman legal tradition remain a constantreference to our continental law. However, this does not prevent them from being open to gradual enrichment.

Orientation sentences for the remark 1. In the case of non-fully harmonised EU law, the fundamental rights of the Basic Law constitute the primary standard of assessment. Within the diversity of fundamental rights provided for by European law, the presumption is that the fundamental rights of the Charter of Fundamental Rights of the European Union (GrCh) are co-guaranteed by those of the GG(German Constitution). That presumption can only be rebutted if there is concrete and sufficient evidence to support it. 2. Threats from the dissemination of personal reports and information as part of public communication affect the scope of protection of the expressions of general personality law, not that of the right to informational self-determination. 3. The general right of personality does not give way to filtering and restricting publicly available information about one’s own person according to his own ideas. The unlimited public confrontation with previous positions, statements and actions, on the other hand, is not appropriate. 4. On the contrary, it is necessary to strike a balance with the interests of the content provider, with specific emphasis on the temporal aspect, availability and context of the information in relation to the communication conditions of the Internet.

The Consumer Credit Act of 12 May 2011 introduced, with effect from 11 March 2016, Article 36 a 1, which specifies the maximum amount of non-interest credit costs. The maximum amount of these costs is calculated according to a formula (Article 36a (1)), and additionally, these costs over the entire duration of the credit may not be higher than the total amount of credit (paragraph 2). On the other hand, with effect from 30 May 2010, Article 304 CC was amended to include new paragraphs 2 and 3-2, aimed at protecting the consumer from excessive benefits in loan agreements. According to the author of the article, the provisions aimed at protecting the consumer against unfair practices of lending entrepreneurs are insufficient and, despite the implementation of Directive 93/13/EEC, do not provide sufficient consumer protection. Therefore, the court deciding the case should always ex officio examine whether contractual provisions constitute prohibited clauses.

The Hungarian labour law reform is a good example of how the idea of flexicurity is enforced in the 21st century in a post-socialist country. Flexible employment relationships overshadow the social side what is necessary in order to develop effectiveness and competitiveness. This process is completed by the relationship between labour and civil law and it is traced back to the special tradition of legal history. The present study surveys the main connection between labour and civil law and gives some remarks on the special private law-nature of labour law. This paper deals with one of the central questions of the Hungarian labour law reform, that is, the changing relationship between labour and civil law. This legal problem can be observed in Hungarian law for a long time. The study focuses on the civil law-type of the employment relationships and the differences between them. This study examines the regulation before 1st July of 2012 with the aim that development will be seen clearly in connection with the regulation in force. The study emphasizes what kind of fundamental changes the direct usage of civil law can perform in the strict structure of employment relationships.

Separating Roman law from the theory of applicable private law inspires - from the beginning of 20th century – the questions pertaining to the meaning, aims, and methods of researching Roman law. This article analyses these issues in the context of the changes of the evaluation of research resulted from the Polish higher education and science act enacted in 2018. The core of this analysis is the comparison of the traditional understanding of the internationalization of the study of Roman law by Polish researchers and the understanding of world-class research according to the new Polish law. The tension between traditional approach of Romanists and bibliometric criteria of evaluation has significant implication for whether and how the Roman law should be studied and taught on the Polish faculties of law. The paper stresses the role of the impact of Polish researches of Roman law on the European debate about basic problems of private law and legal method today. The future of Roman law in Polish legal education interacts with today’s fundamental dispute about what is Western civilization and how it is to be understood.
