Both the 1961 European Social Charter and its revised version of 1996 constitute international social and economic rights treaties ratified by the Member States of the Council of Europe. Together with the European Treaty for the Protection of Human Rights and Fundamental Freedoms, they are the cornerstones of the contractual system for the protection of human rights in the member countries of the Council of Europe. Moreover, these contracts have contributed significantly to the development of European human rights standards in the areas of personal management, labour law and social security law. Nevertheless, it receives minimal attention from legal theorists. This leads to problems in its interpretation in practice. Through scientific and doctrinal interpretation, authors examine the various provisions of the European Social Charter. They seek answers to practical application problems through scientific literature as well as the case-law of the European Court of Justice. The aim and result of the authors’ work is to examine individual documents, to compare them and analyse the differences. The aim of the authors' work is also to evaluate the impact of the case law of the European Court of Justice in connection with the implementation of the Charter into the legal order as well as application practice. The benefit of this article is also the analysis of the impact of the Charter on the rights of working women.

This research aims to reveal the peculiarities of standardization and organizational principles behind the functioning of Orthodox brotherhoods on the territory of Right-Bank Ukraine from the 1850s to the 1900s. Methods. Methodologically, the authors of the work rely on the principles of novelty, objectivity, and historicism and employ general scientific methods (internal criticism of the sources, analysis, synthesis, generalization). Results. The study revealed that during the second half of the 19th century, the activity of Orthodox brotherhoods on the territories controlled by the Russian Empire was regulated by the law “Basic Rules for the Establishment of the Orthodox Church Brotherhoods” which regulated the prioritized tasks, membership and main vectors of their work. At the beginning of the 20th century, some changes occurred in the social-political life of the Russian Empire, which also affected the position of the Orthodox brotherhoods of Right-Bank Ukraine. Conclusion. The church authorities devoted considerable efforts to revitalizing and restoring the activity of the Orthodox brotherhoods at the beginning of the 20th century. In order to find new solutions to the situation, they discussed the further functioning of the fraternities at the congresses in which participated the representatives of the Orthodox brotherhoods of the western provinces of the Russian Empire. Thus, the church management controlled brotherhoods and channelled them into the required course of action.

The Wallachian monasteries are very well documented in the 16th century, but the life of nuns or monks after joining the monastery is a lesser-known aspect. Various details can be found in the life of a noblewoman (taking the name of Mușa), who decided to become a nun (Magdalina) during the first years of the 16th century. Mușa’s life before entering the monastery is not very well known. Although many researchers tried to link her to the Craiovescu family, one of the most influential families in Wallachia at that time, this paper argues against this opinion. The historical sources describe her as a relative of a Wallachian nobleman, Cârjeu, and as the wife of Hamza, another important nobleman from the first decades of the 16th century. Mușa took vows in the monastery, which she built, and even after she became a nun, she preserved some of her former habits. Thus, the nun Magdalina kept in her possession villages and Roma families, which she donated to different monasteries, a widespread situation in the Byzantine monasticism. Although the sources did not describe her everyday life as a nun, they documented her relations with the political and ecclesiastical elites.

This article deals with the interpretation of Security Council powers under the UN Charter, and analyses available interpretive options. The various approaches, inspired by the textual, teleological, “subsequent practice”, and “systemic” methods of interpretation, as well as the complementary means of interpretation supplied by the preparatory works of San Francisco Conference, are successively considered and their relative advantages and shortcomings comparatively assessed. The article argues that recourse to one or the other from among the available interpretive methods can be influenced in individual cases by political and judicial contingencies, and that as a whole the interpretation of Security Council powers under the Charter is an evolving process, the variations of which may depend on the changing needs of collective security and of the international legal order at large.

Article 51 of the UN Charter, in affirming the inherent right of self-defence of each UN Member State 'against which an armed attack has occurred', clearly indicates that the concept of armed attack plays a key role in delineating the right of self-defence. The concept in question was not, however, defined in the UN Charter, and no universally acceptable definition has yet emerged either in practice or in doctrine. One of the fundamental questions to be addressed in this context is who must engage in armed activity for it to qualify as an armed attack. This question is of particular relevance today because of the threat of international terrorism and the expansion of the concept of armed attack through the inclusion of an act of terrorism. The article discusses in some detail the emerging legal framework for attribution of actions undertaken by non-state actors to states.

Opis:
Higher education must respond to dynamically changing job market needs and this has become the third mission of higher education institutions. Traditional methods of sharing knowledge and developing students’ skills are not satisfactory. For this reason, it is necessary to seek teaching alternatives, such as PBL (Problem-Based Learning) and PjBL (Project-Based Learning). This paper presents the idea of applying the above-mentioned methods to the BA in Linguistics for Business at the University of Lodz, an innovative and interdisciplinary BA programme combining linguistics with management. The participants combine skills and knowledge gained throughout their studies, i.e. linguistics, intercultural communication, accounting and finance, or selected aspects of running a business. Moreover, creating group BA projects reflects real-life situations students may encounter in the workplace.

This text presents the application of the Charter of Fundamental Rights by Polish courts since the entry into force of the Charter in December 2009. As the Charter is an element of the ‘external’ constitution for the Republic of Poland, similar to the European Convention on Human Rights, the practice of the Polish Constitutional Tribunal is of particular importance in this analysis. Hence the referral to the Charter by common and administrative courts is rather briefl y described and the main focus of the text is on the broader analysis of the way of and reasons for using the Charter by the Constitutional Tribunal. While the Charter is not treated as a model for the hierarchical analysis of norms in cases of constitutional complaints, it can however be offered as such a model in cases of abstract control and legal questions fi led by the courts. The use of the Charter might be further clarifi ed by an answer of the Court of Justice of the European Union to the fi rst request for preliminary ruling made by the Polish Constitutional Tribunal in case C-390/15 RPO.

The right of employees and, at the same time, the obligation of employers in employment matters was regulated by the European Social Charter modified on 3 May 1996. Employees employed in Member States of the Council of Europe were granted, among others, the right to information and consultation in the establishments where they were employed. With a view to ensuring the effective use of the above rights in enterprises by employees, the modified Social Charter obliges entrepreneurs to inform and consult employees and their representatives – trade union organizations – about all financial and economic matters of the workplace employing them and about draft decisions taken by employers, that may affect the interests of employees. The author, a member and vice-president of the European Committee of Social Rights, analyzes and discusses in this scientific study the implementation and effects of actions taken by member states of the Council of Europe necessary – in the understanding of employees – to achieve the above goal.

Charter Party agreements underpin the relationship between ship owners and charterers. The agreement guarantees the performance of a vessel in terms of speed and fuel consumption. On this basis the charterers plan the arrival of their cargo and their profit margin. However, ship performance is degraded by age, periods between maintenance and many vessels fail to perform as expected. Moreover the performance is only warranted during the specific conditions stated in the charter party which are not always clear. These usually refer to Beaufort Force (BF) and the Douglas Sea and Swell (DSS) scale which is archaic in the age of Numerical Weather Prediction. Given these conditions, the stage is set for conflict and there are often disputes over the weather conditions experienced. Moreover ships’ often do not arrive on time because the charterer has assumed that the ship will make good its warranted speed and not taken account of the forecast weather conditions. The authors propose a new way of approaching charter agreements with the emphasis on consultation rather than confrontation facilitated by a new web based software platform.

This study examines the role of institutional mechanisms in local government accountability by undertaking a comparative assessment of the Nigerian institutional provisions against the European Charter of Local Self-Government. The specific objectives of the study are to examine the institutional mechanisms for local government accountability in Nigeria, evaluate the Nigerian mechanisms, using the provisions of the European Charter of Local Self-Government and subsequently determine how the effective deployment of institutional mechanisms may enhance the prospects of local government accountability. The study adopts as methodology a comparative analytical framework, under which it uses the provisions of the European Charter of Local Self-Government to evaluate the Nigerian institutional mechanisms. Findings of the study led to a conclusion that for emerging political systems, which Nigeria typifies, institutionalized mechanisms of (political) accountability in the local government system, are truly less effective than the non-institutionalized or informal mechanisms. For the effective deployment of institutional mechanisms to enhance the prospects of local government accountability, the study concludes that a judiciary component of the local structures of governance is an unconditional necessity, as in the absence of such conditions; the incidence at the local level, totally ceases to be describable as government.

The paper is a case study investigating the nominal and adjectival morphology in the English text of bounds to S 179, a post-Conquest forgery. The aim of the study is to determine what linguistic means of authentication were applied by an eleventh-century forger who devised a text which was supposed to look 200 years old at the time of its production, as well as to search for modern features which give the forgery away, at the same time allowing an insight into early Middle English. The study represents research into “transitional”, post-Conquest English (Faulkner 2012) and the status of English under the Norman rule.

The paper addresses the issue of the origins of the town of Poznań founded in mid-13th century under German law. The birth of the charter town on the left bank of the Warta river is illustrated first and foremost by sources: documents from the mid-13th century, particularly a location charter of 1253, and narrative sources, e.g. The Wielkopolska Chronicle and yearly records written in Wielkopolska. The town was the work of Przemysł I, the duke of Wielkopolska, who sorted out property issues on the left bank of the Warta, made grants and granted privileges, erected his new castle next to the new town, and together with his brother Bolesław issued a location charter in 1253. The duke’s action resulted in the rise of one of the most important urban centers in medieval Poland.

In EU law a lot of attention has recently been paid to personal data protection standards. In parallel to the development of the general EU rules on data protection, the Members States also develop cooperation between law enforcement agencies and create new information exchange possibilities, including the processing of personal data of participants in criminal proceedings. The aim of this article is to analyse whether the personal data of victims of crime are safeguarded according to the standards of the Charter of Fundamental Rights. For this purpose, the author analyses two directives: 2012/29/EU, which regulates minimum standards of victims of crime; and 2016/680/EU (also known as the Law Enforcement Directive), which regulates personal data processing for the purpose of combating crime. Based on the example of the Polish legislation implementing both directives, the author comes to the conclusion that the EU legislation is not fully coherent and leaves too much margin of appreciation to the national legislator. This results in a failure to achieve the basic goals of both directives. The author expects the necessary reflection not only from the national legislator, but also from the European Commission, which should check the correctness of the implementation of the directives, as well as from national courts, which should use all possible measures to ensure that the national law is interpreted in the light of the objectives of the directives.

Opis:
Social rights protection in the European Union has undergone significant development. Currently their protection is regulated by relevant treaty provisions and the Charter of Fundamental Rights (Charter), both of a primary law nature, as well as by the non-binding European Pillar of Social Rights (Pillar). The aim of the paper is the assessment of the social rights protection in the EU, and whether all social rights provided in the CFR have their counterparts in the EPSR, hence whether and in what way the EPSR assists the actual exercise of social rights provided by the CFR. Comparing the content of the above-mentioned legal instruments makes it possible to answer the question whether all social rights provided in the Charter have their counterparts in the Pillar. This can help determine whether the latter affects the implementation of the former. If the answer is in the affirmative, it can further allow for determining in what way the principles of the Pillar assist in the actual exercise of social rights provided by the Charter. This is very important taking into account the need for an ongoing response to unforeseen threats, like for example COVID-19. The social aspects of EU integration thus are and will remain a subject of interest in the nearest future.
