The ADR Act of 23 September 2016 addressing consumer dispute resolution implements the EP and EC ADR Directive of 21 May 2013 regulating consumer dispute resolution, and EU and EP Regulation 524/2013 of 21 May 2013 on Online Dispute Resolution in Consumer Disputes. The aim is to give consumers who engage in dispute resolution with business entities an option to apply to legal entities that offer independent, impartial, transparent and effective facilities of amicable dispute resolution. The aim is also to equip entrepreneurs with a necessary tool to avoid costly and prolonged court proceedings against consumers. This article discusses how the Act regulates the substance, commencement, conduct and conclusion of the proceedings in out-of-court settlement of consumer disputes.

The article discusses an alternative way to settle a tax dispute through mediation. For the Russian law enforcement practice, this format of interaction is new, since the current law on mediation only since 2019 has established the possibility of its implementation in the public sphere of activity. At the end of 2020, the first precedent for considering a tax dispute through mediation appeared, which gave a positive result. The author discusses the pros and cons of using mediation in public legal relations and gives his vision of this process.

The role of alternative dispute resolution (ADR) in the management of cases and disputes in Nigeria and across the globe cannot be overemphasized. The judicial arm of the government is the arm responsible for interpretation of laws in Nigeria and the judiciary’s role in preserving the rights of citizens across Nigeria also cannot be overemphasized. It ensures that the society is stable in the face of insta-bility and ensures that lawlessness is not maintained. The judiciary ensures that laws made by the legislature are obeyed by ensuring that those who violate the provisions of any established laws are punished. In doing all these, it has been established that the system of administering justice in our courts in Nigeria is extremely slow. Considering the foregoing, alternative dispute resolution as a means of settling disputes has been of tremendous help in easing the hardship of getting cases resolved through the court system. This paper examines ways through which alternative dispute resolution has assisted the Nigerian judicial system and the need to use alternative dispute resolution the more in order to ensure that number of cases handled by courts are drastically reduced. Recommendations are made at the end of the research.

The subject of this article is the use of ADR in sports disputes in association football under the Polish and Ukrainian law. Professional and amateur sport generates various types of disputes related to both disciplinary and civil cases, an example of which may be disputes arising during the execution of contracts binding players and football clubs. In the first part, the scope of disputes that are subject to ADR in association football is outlined. The next part presents legal solutions adopted under the Polish law in this respect, of which the activity of the Football Arbitration Court of the Polish Football Association is a particular example. The last chapter is devoted to the Ukrainian perspective on the resolution of disputes in association football.

Nowadays solutions are sought for public administration to involve citisens in decision-making as one of the ways of promoting the development of civil society and thus to foster democratic forms of government. Public administration is looking for efficient methods of resolving administrative disputes. Administrative mediation serving the purpose of ensuring proper communication between the parties to administrative proceedings is one of such methods. Mediation in public administration hinges upon the definition of communication rules. The aim of this paper is to define communication from the perspective of legal science and discuss its application in the administrative mediation proceedings. In this article, we discuss the essence, the subject matter and the object of mediation as well as the legal regulations governing the mediation procedure and consider the possibility of applying mediation to the administrative procedure, as exemplified by the related case law. The study has been conducted by means of the legal research methods, in particular the legal-dogmatic approach and the legal functionalism approach.

In the age of globalisation, alternative forms of dispute resolution (ADR) are gaining new importance. In Poland, an increasing number of mediations and arbitrations in international (cross-border) cases are being observed. However, the number and importance of international ADR in Poland is much lower than in other European countries. Polish advocates and legal advisers, experienced in conducting international arbitration and mediation, explain the Polish specificity, genesis, and perspectives of ADR in international disputes. The comparison of lawyers’ experiences with the collected data thoroughly describes the state of out-of-court forms of dispute resolution in these types of situations. The study, based on interviews with Polish jurists, statistical data analysis, and an analysis of nonreactive materials, demonstrates the far-reaching deficiencies and problems of the Polish system of alternative dispute resolution in transnational cases.

This paper examines some problems of educating people in alternative dispute resolution. The social, economic and political changes give rise to a greater level of conflict and inequality within any society that is undergoing transformation. We suggest that education in conflict management and resolution, and particularly with the respect to consensusbuilding techniques and collaborative interest-based approaches to conflict, can play an important role. Individuals who are used to alternative dispute resolution (ADR) better perceive their values and achieve their needs and are more active in decision making process. The better one can use consultation, negotiation and mediation the more society acquires the features of self-regulation and self-governance and the more efficient is counterweighing of social relations sharpened by modernization. Teaching and training the society in peaceful practice brings to people certitude that the best way of interacting with adversaries is to communicate and cooperate with them in solving problem which contradistinguished individuals or organisations. Modern conflict resolution development in Lithuania takes place in a wide legal, administrative, cultural and social environment. Actual conflict resolution curricula may be found in some university programs and postgraduate studies. The next stage will ensure the development of classes and programs in the fields of law, social psychology, political science, public administration, and sociology. Some corrections with elements of dispute resolution and peace education may be incorporated into the curricula of primary and secondary schools. Also certificate programs have to be designed for professionals solving commercial, social problems, dealing with extreme situations, and others, to meet their specific needs in conflict resolution skills. Long-term purposeful efforts while forming positive thinking, approach towards constructive activities and assertive behavior, that is the whole mental and cultural heritage, should be followed constantly in order to make negotiations, mediation and other alternative dispute resolution methods a part of public life and problem solution.

Mediation is an institution that has been in demand in all modern legal systems for the last twenty years as a fast, reliable and inexpensive alternative method in the resolution of commercial law disputes. Turkey and Uzbekistan are in a continuous effort to ensure compliance with comparative law systems which are adopted by the EU and international legislation in the modern sense, including mediation. In Turkey’s case, specialization and institutionalization targets were envisaged regarding mediation. Codification frameworks devoid of systematic planning were carried out in order to achieve these targets. Contrary to the concept of mediation, the areas where mandatory mediation applies have been expanded. On the other hand, for Uzbekistan’s case, which accepted mediation six years after Turkey, in 2018, and did not adopt mandatory mediation, Turkey’s disappointing mediation experience can be regarded as a lesson. This experience is valid not only for Uzbekistan but also for all legal systems that include mediation.

Aim. The main purpose of research presented in this article is to analyse mediation principles as an alternative way of dispute resolution and features of their application in the educational environment of Ukraine. For which purpose it was necessary to perform the following tasks: - the concept and role of mediation principles were studied; - certain types of mediation principles were defined; - the essence and significance of the most important mediation principles were revealed; - and the application of mediation principles in Ukraine was clarified. In Ukraine, civil society institutions have been trying on their own to introduce and promote mediation as a way of alternative dispute resolution. However, systemic problems of access to justice require finding other ways to resolve conflict situations. Mediation becomes especially relevant in the context of COVID-19 coronavirus pandemic, when access to the court system is limited. Methods. The study is based on the analysis of enacted regulations and their comparison in different countries, as well as information obtained from the study of literature, including works by authors of both legal and other social sciences where mediation is used as a means of compromise, including psychology, medicine, ecology, along with the use of tools and comments specific to the study of law. To study the prospects and effective application of mediation principles in the educational environment, sociological surveys of various participants of the educational process were conducted. Results. The results of study showed that certain types of mediation principles are applied in different countries taking into account the peculiarities of national legal systems. Notwithstanding, such principles as the rule of law, the principle of equality (equal rights) of the parties, the principle of voluntariness, confidentiality and mediator behaviour (independence and impartiality, trust and justice) are applied in most of the studied national models of mediation, consequently they can be called fundamental. The survey results have revealed the readiness of the educational environment to introduce mediation as a tool for resolving conflicts in the educational environment.  In Ukraine, the draft law “On Mediation” defines general principles of mediation; however, the problem is insufficiently clear criteria for disputes that cannot be transferred to mediation. In addition, the principle of the rule of law should be defined as one of the fundamental principles of mediation. Conclusions. The specifics of the implementation of mediation principles in Ukraine and their correlation with the principles of the judicial process require further research.

W artykule przedstawiono mediację jako podstawową metodę alternatywnego rozwiązywania sporów prawnych (ADR), służącą rozwiązywaniu konfliktów w różnych sferach życia społecznego. Dokonano analizy polskich uregulowań prawnych dotyczących mediacji w sprawach administracyjnych, sądowoadministracyjnych oraz cywilnych. Rozważania dotyczą dwóch zagadnień natury ogólnej. Po pierwsze, porównano zakres przedmiotowo-podmiotowy zastosowania mediacji w ww. sprawach. Po drugie, omówiono podstawowe zasady dotyczące przedmiotowej metody ADR uregulowane normatywnie, tj. zasadę dobrowolności, zasadę bezstronności mediatora, zasadę braku jawności oraz zasadę poufności. W podsumowaniu zwrócono uwagę na podobieństwa i różnice występujące w ww. kwestiach w poszczególnych rodzajach spraw.
This article shows mediation as a basic method of alternative dispute resolution (ADR) to resolve conflicts in various spheres of social life. The author analyses Polish legal regulations with regard to mediation in administrative, court-administrative and civil cases. The considerations apply to two issues of general nature. Firstly, the subject/object scope of mediation in the above mentioned cases is compared. Secondly, basic principles of ADR, such as the principle of voluntariness, the principle of the mediator’s objectivity, the principle of non-disclosure and the principle of confidentiality are discussed. In the conclusions, special attention is drawn to similarities and differences in the above mentioned issues to be found in particular cases.

The article is a result of a qualitative empirical study designed to reveal whether personal injury lawyers in the State of Michigan implement compassionate counseling practices. The study contributes to a well-established body of research pertinent to the development of soft skills in legal practice, whilst also attempting to proliferate and highlight the benefits of out-of-court settlements. The research was designed to study the nature of compassionate counseling practices and its effect on mediated settlements. Consequently, the research analyzed how lawyers evaluate intangible and non-monetary interests of clients and whether those play a role on the dispute resolution continuum. The paper also elaborates on what lawyers do and do not do well in assessing intangible interests of clients. The study posits that if lawyers attend to those intangible interests, it is a form of compassionate practice. Therefore, the study has both theoretical and practical implications for lawyers and mediators. Last, the study suggests that alternative dispute resolution mechanisms, such as mediation, attribute to a speedier resolution of personal injury disputes.
Artykuł jest wynikiem jakościowego badania empirycznego mającego na celu analizę, czy prawnicy zajmujący się sporami związanymi ze szkodą na osobie w stanie Michigan wdrażają praktyki poradnictwa prawnego opartego na współczuciu. Opracowanie stanowi wkład w dobrze ugruntowane badania dotyczące rozwoju umiejętności miękkich w praktyce prawniczej, a jednocześnie jest próbą rozpowszechnienia i podkreślenia korzyści płynących z pozasądowych metod rozwiązywania sporów. Celem było zbadanie charakteru tzw. współczujących praktyk i ich wpływu na ugody zawierane w drodze mediacji. W związku z tym przeanalizowano, w jaki sposób prawnicy oceniają niematerialne i niepieniężne interesy klientów oraz czy odgrywają one rolę na kontinuum rozwiązywania sporów. Ponadto omówiono zalety i wady praktyki prawniczej związanej z oceną niematerialnych interesów klientów. W badaniu założono, że prawnicy zwracający uwagę na niematerialne interesy klientów stosują formę współczującej praktyki. Dlatego opracowanie zawiera zarówno teoretyczne, jak i praktyczne implikacje dla prawników i mediatorów. Wreszcie wyniki badania sugerują, że alternatywne mechanizmy rozwiązywania sporów, takie jak mediacja, przyczyniają się do szybszego rozwiązywania sporów dotyczących szkód na osobie.

Purpose: The purpose of this study is to examine the relationship between the leadership styles and how economics and manager students vote to manage conflicts within their relationships and with other entities. Design/methodology/approach: an exhaustive review of the literature on leadership decision-making and conflict management has been carried out, focusing on trust, conflict management theories, models that have distinct influence in conflict management. In addition, a study of conflict management has been carried out in Óbuda University and in Pontifical University of Salamanca. Findings: In the course of work of the study was found the identified comparison of the most striking conflict management styles, that explain how students manage conflicts. Originality/value: The questions answered by future leaders provides that the paper is able to mediate new mark. The value of the paper that it reflects the direct answers of future leaders in 2022 and it is addressed to university students, teachers, leaders, for employers and employees, both in the private sector and in the public sector.

Ukraine has become a candidate country for the European Union membership, which brings challenges, including those of a legal nature. One of such challenges is the regulation of the institution of mediation, which is a subject of interest to European institutions (both within the Council of Europe and the European Union) that actively promote methods of alternative dispute resolution (ADR methods). The aim of the article is to compare the current development of mediation in Poland and Ukraine, as well as to determine to what extent there are similarities in successes and challenges and to what extent the Polish experience could be helpful for the development of mediation in Ukraine. The essence of the problem is whether Ukraine shall follow Polish solutions in this area.
Ukraina ma obecnie status państwa kandydującego do uzyskania członkostwa w Unii Europejskiej, co niesie za sobą wyzwania, w tym natury prawnej. Jednym z takich wyzwań jest uregulowanie instytucji mediacji, będącej przedmiotem zainteresowania instytucji europejskich (zarówno w ramach Rady Europy, jak i Unii Europejskiej) aktywnie promujących alternatywne metody rozwiązywania sporów (ADR). Celem artykułu jest porównanie obecnego rozwoju mediacji w Polsce i Ukrainie, a także określenie skali podobieństw w zakresie sukcesów i wyzwań oraz udzielenie odpowiedzi na pytanie, na ile doświadczenia polskie mogą być pomocne dla rozwoju mediacji w Ukrainie. Istotą problemu jest to, czy Ukraina będzie podążać za polskimi rozwiązaniami w tym zakresie.

Opis:
The article focuses on the novelties introduced by the Damages Directive in the field of consensual settlements of disputes concerning private enforcement. The Damages Directive obliges Member States to ensure that the limitation period for bringing an action for damages is suspended for the duration of any consensual dispute resolution process. The Directive also establishes the main principles that govern the effect of consensual settlements on subsequent actions for damages. Since the EU framework for consensual dispute resolution of private enforcement disputes is quite new, many issues must still be solved in Member States’ practice. While analysing consensual dispute resolution in private enforcement cases, particular interest should be paid to mediation and arbitration as a form of Alternative Dispute Resolution (ADR). Mediation is often used in competition law litigation. In a mediation process, parties are subject to fewer legal costs than in litigation and arbitration. It may thus be concluded that consensual dispute resolution is usually a faster way to receive compensation. However, voluntary arrangements and ADR in competition law still raise many problems concerning both procedural and substantial legal acts.
