The paper analyses access to documents in cartel-based damages cases from the EU and Croatian perspective. It considers all relevant EU and Croatian legislation and case-law primarily focusing on the expected impact of the newly enacted Damages Directive. It is argued that the new rules on access to documents provided by the Directive will not necessarily have a significant impact on damages proceedings following cartel decisions issued by the Commission. This is due to the introduction of an absolute ban on the disclosure of leniency statements and settlement submissions via a ‘maximum harmonization’ rule. This conclusion is drawn from statistic figures showing that EU cartel enforcement rests solely on the leniency and settlement procedures. With that in mind, it is concluded that the Directive’s general, permissive rules on access to documents (other than leniency and settlement procedures) will not be applicable in most damages cases following the cartel infringement decision issued by the Commission. However, it is also observed that the Damages Directive’s new rules on access to documents may have the opposite impact on private enforcement in cases following infringement decisions issued by National Competition Authorities (NCAs) which do not rely as much on leniency in their fight against cartels as the Commission. The Directive’s general rule on access to documents will apply in jurisdictions such as Croatia, where all of its cartel decisions so far have been reached within the regular procedure. It is argued that the general access rule, coupled with other rules strengthening the position of claimants in antitrust damages proceedings, might actually be beneficial for both public and private enforcement in such jurisdictions.

Financial inclusion has been one of the key pillars of Colombia’s development strategy for a number of years. Financial inclusion policies have aimed at channeling microcredit to poor, spreading formal banking system usage, fostering electronic payment acceptance, and making financial services more affordable. Using simulations from a general equilibrium model it is possible to identify the most binding financial sector frictions that preclude financial inclusion of enterprises, and study the effects on growth and inequality of efforts to remove these frictions. The study finds that lowering contraints on collateral promises higher growth while inequality is better tackled through measures that lower the financial participation cost

The Ombudsman’s Office of public bodies constitutes a strategic and democratic space for communication between the citizen and this Government Institution, aiming at strengthening the mechanisms of social participation. It is essential for its consolidation that the citizen has a space to request information, register suggestions, praise, complaints and denunciations, obtaining an agile and resolute response to his manifestation. For that, it is necessary to improve an Ombudsman with the concept of participative management and democratization of information, which provides an effective service, capable of seeking the solution of the manifestations. In addition, these manifestations must be organized in management reports aimed at informing and subsidizing the managers of public agencies, serving as an instrument for positive changes in the course of the Audits. This article aims to implement proactive actions in order to foster Social Control, through the participation of society and encouraging the exercise of citizenship. In order to carry out this investigation, it was necessary to apply the dogmatic method, as the hermeneutics of the normative texts recommends, but also the need for doctrine and transversality was necessary, since it is an interdisciplinary theme with a high political and sociological content, everything basked by a tradition of egalitarian rationalist thinking and based on international human rights hermeneutics. In conclusion, we identified that the Ombudsman’s Office aims to improve the exercise of Social Control and be another effective tool for institutional management and transformation. Its main task is to promote a dialogue between the public institution and society. For this to happen, citizen participation is essential, representing a strong allied body for the realization of significant changes in Public Administration, which fundamentally cares for the public interest.

Based on social network theory, the study explained the digital transformation process of startups in Vietnam during the outbreak of the COVID-19 pandemic. The study examined the relationship between social capital, human capital, access to resources, and digital transformation of startups in Vietnam. The study used Partial Least Squares - Structural Equation Modelling (PLS-SEM) with a sample size of 230 startups managers. The results show that there are positive and statistically significant relationships between social capital, human capital, access to resources, and digital transformation. The results also reveal the partial mediating roles of access to resources and human capital in the relationship between social capital and digital transformation. The results proposed some managerial implications for startups managers in building relationship networks with stakeholders such as government agencies and business partners (customers, competitors, suppliers, and providers of digital platform services). Through managers' social capital, accessible resources and the improvement of human capital have accelerated digital transformation for startups to escape the crisis of the COVID-19 pandemic. Finally, the study presented some limitations and directions for further research.

The preconditions for the provision of educational and social services that ensure equal access to education for pupils of grades II – IV G are also discussed.

This study investigated the gender analysis of access to formal credit by both male and female small-scale farmers in the Greater Letaba Municipality. The study precisely identified and described the socio-economic characteristics of female and male small-scale farmers, analysed and compared factors influencing access to formal credit by both female and male small-scale farmers and determined the perceptions of female small-scale farmers towards the credit system. In collecting the primary data, structured questionnaires were administered on 140 respondents (70 females and 70 males) using stratified random technique. The study employed descriptive statistics, principal component analysis and probit model to analyse collected data. The probit regression model discovered that farm size, land ownership, gender, age, collateral and extension services had a significant positive influence on small-scale farmers` formal credit access. Based on the study findings, a set of recommendations for achieving equitable formal credit access by female and male small-scale farmers was put forward.

The objective of the study is the analysis of the relations between the distribution of non-financial resources of health care protection at a regional level (voivodeships) and the state of health of the female and male population. The study refers, therefore, to a geographical concept, and the potential access to health service benefits. The following research hypotheses were formulated: (H1) non-financial resources are unevenly distributed among the regions; (H2) access to the health care services affects the state of health of females and males; (H3) there are time delays between the observed levels of accessibility and the state of health of the population. The fundaments for sustainable development are constitute by spatial management policies expressed in the study of conditions and directions of spatial management as well as in the local spatial management plan. Polish agricultural lands are more often reclassified as non-agricultural areas. For example, this is confirmed by statistical data from the Polish Central Statistical Office. Also, there is an increasing number of non-agricultural and non-forest areas in spatial management studies. Ensuring access to technical infrastructure is an important argument in favour for development of investment areas. This article analyses, land zoning patterns in the community of Tomice, with particular consideration to investment areas. This paper also takes a close look at local spatial management policies and discusses the location of investment areas in the context of their access to utilities network. The article applies geoprocessing methods, including geometric and spatial analysis of selected basic evaluation fields.

From a sample of 75,854 Slovenian firms in the period 1995-2011, we examine the effects of a firm's access to bank credit on its growth. The results suggest that as the external financing constraint relaxes and firm gets access to credit, the reliance on internal funds to finance growth decreases. By exploring the role of available collateral in gaining access to bank credit, we find that collateral only helps larger firms to obtain credit more easily. On the other hand, collateral does not reduce micro firms' dependence on internal funds to finance growth, which suggests that even if they have collateral, banks are still unprepared to finance them, possibly due to the level of risk. It could also be that in approving credit to micro firms, other factors such as liquidity or cash flow are more highly considered by banks than the value of collateral.

Railway infrastructure access rates, as an important element of the costs affecting the services offered to railway clients, are an object of interest in the context of transport sustainability and the promotion of railway transport. The pandemic caused by the SARS-CoV-2 coronavirus has spawned a crisis that has affected the railway sector in a significant way. In October 2020, the European Commission published a Regulation establishing measures for a sustainable rail market in view of the COVID-19 pandemic. The European Commission’s initiative of introducing a Regulation allowing for derogations from existing laws, as well as satisfying the urgent needs of the railway sector for the duration of the effects of the pandemic, may be a significant step towards a permanent leveling of the playing field for all of the branches competing in the transport sector. This article presents information in terms of the legal regulations concerning the charges for infrastructure use and outlines the assumptions of Regulation 2020/1429 (EU) of the European Parliament and of the Council.

The paper uses survey data to analyse the financing conditions of firms in transition countries. The results show that small firms have considerably more problems with access to and cost of finance than larger firms. Small firms also display markedly different financing patterns than large firms, relying to a much greater extent on internal financing sources and less on bank credit or other sources of formal finance than large firms. To examine the determinants of access to and cost of finance the survey data are combined with macro and financial variables in an ordered logit model. The results indicate that a heavy reliance on foreign and state-owned banks has adverse effects on the average firm’s financing condition.

Ukraine headed for European integration in 1998 when the Partnership and Cooperation Agreement between the European Union and Ukraine came into force. In the following years the Ukrainian society has been preparing to the state’s prospective accession to the EU. However, on 21 November the course of Ukraine drastically changed and the Ukrainian society exploded. The lack of efficient communication policy, specifically close cooperation between the state authorities and the public, absolute disregard for Ukrainians’ interests and requirements became the catalyst of mass protests. The aim of the article is to study the evolution of the development of communication interaction between the authorities and the civil society, to research the reasons of challenges Ukraine has faced in the past years. The article focuses on the legal grounds and the mechanisms of development of Ukraine’s communication policy directions.
