Opis:
The resolution with gloss concerns the rules for interpreting a will. The Supreme Court stated in it that an interpretation of a will should be performed taking into account all circumstances, including those external to the will and using all means of evidence. The Supreme Court decided that it is the court adjudicating in the case for inheritance acquisition, assessing the evidence gathered in a specific case, that should assess whether it is actually possible to establish the will of the testator. The author of the gloss accepts the thesis of the resolution, but argues with the position of the Supreme Court contained in its justification that only the rules for evidence assessment constitute an instrument allowing one to establish the testator’s will. In the opinion of the author of the gloss the functional interpretation of Art. 948 of the Polish Civil Code (k.c.) indicates limits to the interpretation of the will. After all this is a process that renders it possible to determine the testator’s will in a manner that does not raise any doubts. Therefore, if the interpretation of the will of such fails to secure such a degree of certainty, even despite a positive assessment of the evidence gathered in the case, the court should state that the inheritance has been acquired under the Act.

Opis:
This article deals with the problem of making a will during an epidemic and simplifications in the testamentary formalities that are necessary to facilitate a testator to validly express his or her wishes in such difficult and specific circumstances. It analyses testamentum tempore pectis conditum in Roman law and its modern equivalents in Spanish, Italian and Polish law. Preconditions of applicability of the special forms of a will in those systems and the simplifications introduced therein are compared. The article presents the specific provisions in which this form of a will is regulated and their interpretation in civil law doctrine and case law. The central questions are: under which circumstances this form of a will is allowed, what the purpose of the special regulations is, what the relaxation from the ordinary testamentary formalities consists in and what requirements should be fulfilled after the will is made to preserve its validity. Some basic comparisons with the ordinary forms of a will are made to establish the peculiarities of the will drawn up during the epidemic. The differences between the analysed provisions and their importance in practice are pointed out.

The article deals with the obligation to present the last will in order to officially read the will, to acquaint the beneficiaries with its content and to enable them to obtain a copy. This action was, apart from convening witnesses, one of the two actions preceding the formal opening of the inheritance. The obligation to do so rested with holders elected by the testator or actual ones, after establishing the fact of the testator’s death. Their unjustified resistance led to the application of an interdict de tabulis exhibendis. It applied to the testamentary beneficiaries, both before and after the official opening of the inheritance.
Artykuł dotyczy obowiązku prezentacji testamentu w celu dokonania jego urzędowego otwarcia, zapoznania się z treścią i umożliwienia uzyskania kopii jego beneficjentom. Czynność ta była, obok zwołania świadków, jedną z dwóch, które poprzedzały formalną procedurę otwarcia testamentu. Obowiązek jej dokonania spoczywał na wybranych przez testatora lub faktycznych dzierżycielach testamentu, po ustaleniu faktu śmierci testatora. Nieuzasadniony opór z ich strony pociągał za sobą zastosowanie interdyktu de tabulis exhibendis. Przysługiwał on beneficjentom testamentowym zarówno przed urzędowym otwarciem testamentu, jak i po nim.

Expressing wishes as to how a person’s property was to be distributed at death was permitted by Old-Russian common law. At first, oral disposals had been practiced, whereas written wills became widespread only in the 14th century. Disposals of an estate were principally made by liege lords and church authorities, hardly ever by peasants. This article presents a study of 8 unique peasants’ wills from registers of the Solovetskiy Monastery of the 16th century. A pope was obligatorily in attendance when such documents were prepared. All analyzed wills referred to Christian ethics and values. The dispositions of personal property alternated with requests to pray for the testator’s salvation. It seems that the main purpose of the examined last wills was not to transfer of real estates and personal property to successors but to contain a testator’s understanding of dying and death, and to form a proper attitude towards them. Preparation of someone’s last will and getting rid of material goods constituted an act of contrition that closed the testator’s worldly existence and conditioned his eternal life after death.

The article describes the results of Libet’s experiment and its resulting critique, as witnessed by the articles published between 2000 and 2012. As a result of his experiments, Libet concluded that conscious intentions of making a movement are preceded by brain activity registered as the readiness potentials (RP). In this interpretation, free will does not initiate the decision of making a move but is however capable of stopping this process. For this reason, Libet does not conclude that will is determined by biological processes. The resulting discussion in the literature concerns mainly methodology and conclusions drawn by Libet. The methodological points raised include an argument against the use of EEG as an accurate research tool and criticism of the method of timing the occurrence of the conscious intention of making a move. We note that subsequent modifications made to the original experiment, did however allow putting some of the methodological doubts to rest. On the other hand, the critique of Libet’s conclusions focuses on the problematic nature of correlation of physical movements with the readiness potentials. The most recent research also shows that the potentials might have a more complicated origin than previously thought. Libet’s interpretation is also criticised for its vagueness in defining intention and for not distinguishing it from wishes and desires. The last part of our article summarises the latest state of affairs as emerging from the analysis. We point out the difficulties in correlating potentials with movement, their interpretation and difficulties with the notion of veto, since it seems to require that contradictory intentions of making and refraining from a movement are present simultaneously. The article concludes that on the basis of the current research, the thesis about a biological determination of voluntary processes lacks a sound justification.

The gloss addresses the decision of 16 October 2014, III CSK 301/13, in which the Supreme Court adopted the position that a member of the governing body of a legal entity may, in principle, be a witness to making a testament in which a benefit is provided for that legal person. Similarly, in the Supreme Court’s opinion, a witness to the making of a will may, in principle, be a member of a corporate legal person for which a benefit is provided in that will. The author offers a critical assessment of that position. He considers as appropriate the view according to which a last will in which a benefit is envisaged for a legal person cannot, in principle, be witnessed by either an officer of such a legal entity, or by any member (shareholder) of a corporate legal person.

The present analysis is focused on the issue of interactions of individuals with mathematics in films and strives to show why the question of the accuracy of mathematical formulas is not crucial to films and, therefore, what their main functions in the creation of the diegetic and the outer world are. In order to achieve the set aim, I ground my reflection in the idea suggested in Math Goes to the Movies, i.e. that mathematics is not presented in films only as an abstract theory, but it also carries a creative potential. Good Will Hunting (1997), A Beautiful Mind (2001) and Pi (1998) are the films in which mathematics is a substantial driving force, influencing both the gradual development and consolidation of characters. In this work, the films serve as the research material.
Niniejsza analiza koncentruje się na problematyce interakcji jednostek z matematyką w filmach i stara się pokazać, dlaczego kwestia ścisłości formuł matematycznych nie jest kluczowa dla filmów oraz jakie są ich główne funkcje w tworzeniu świata diegetycznego i zewnętrznego. Aby osiągnąć wyznaczony cel, autorka opiera swoje refleksje na tezie zaproponowanej w Math Goes to the Movies, czyli na tym, że matematyka nie jest prezentowana w filmach tylko jako abstrakcyjna teoria, ale ma też potencjał twórczy. Buntownik z wyboru (1997), Piękny umysł (2001) i Pi (1998) to filmy, jakimi autorka posługuje się jako materiałem badawczym a w których matematyka jest istotną siłą napędową, wpływającą zarówno na stopniowy rozwój, jak i na umocnienie postaci.
