The following article is intended to analyse potential economic benefits in professional competitive sport. Professional sport is not to be perceived only from the perspective of emotions evoked by sportsmen competing in various disciplines. Currently, sport has become a great business that generates noticeable revenues and provides employment to many individuals. Hence, the scientific discipline referred to as the sports law has been receiving more and more interest as it not only tackles upon the legal status of sports federations, sportsmen or clubs but also has to deal with the issues of sports economy, sponsorship agreements in sports, the image of contestants as well as numerous other problems. Therefore it seems justifiable to commence a scientific debate on economic benefits in sport and their forms on the basis of legal regulations regarding sport.

This article highlights selected characteristics of Swiss international arbitration law focussing on interim measures in sports-related disputes. The key academic concern of the article is to indentify whether under Swiss law the parties may waive the state courts’ jurisdiction to grant interim relief in international arbitral proceedings and declare the arbitral tribunal as exclusively competent. The view held in this article favours the admissibility of the waiver based on mainly two arguments: the parties’ autonomy and the lack of statutory limitations to the waiver. Further, this article deems that in ad hoc arbitral proceedings the waiver is not enforceable (but not null and void) as long as the tribunal has not been yet established. In such a case, the parties may exceptionally request interim relief with state courts. Seeking for a arbitral alternative to the said solution the article scrutinises whether in sports-related disputes the Court of Arbitration for Sport in Lausanne could be competent until the constitution of the ad hoc tribunal. Finally, the article examines the formal requirements for the waiver.

Legal liability has various forms, including the various distin-guishable forms of liability related to the world of sport and disciplinary li-ability in sports in particular, which can also be discussed by comparing it with aspects of criminal law and labour law. Disciplinary liability in sports emerges in the case of accountable, delinquent infringement of the related regulations. The burden of production of evidence lies with the sports federa-tion. Every sports federation is authorised to conduct disciplinary proceed-ings against an athlete, sports specialist and sports organisation involved in the competition system of the given sports federation.The disciplinary regulations defi ne what disciplinary offence the athlete, sports specialist or sports organisation is likely to have committed, for theinvestigation of which the proceedings will start. Both the legal standards of the country concerned and the rules of national sports federations include detailed regulations necessary for disciplinary proceedings to be conducted properly. The knowledge of thereof is essential in terms of practical applica-bility, as presented by this study in detail.

The application of the work-life balance conception has become increasingly popular in recent years. This conception draws not only from legal solutions, but from psychological sciences and those related to human resources management. In the field of labour law, the instruments used may be, inter alia, rights related to parenthood (maternity, paternity, parental and extended parental leave), the use of fixed-term contracts or part-time employment, the use of individual working time schedules, the use of task-based schedules, equivalent or intermittent working time, telework regulations, variable work start and end times. However, employment in professional sports is atypical. The very essence of providing sports work is different from the essence of performing both office and industrial work. It consists in the provision of a special type of work of a multiple nature aimed at maximising the performance of athletes, carried out for profit. The athlete’s ability to achieve success results from the effect of actions taken as part of the employment relationship with the club as well as from leisure activities. Such activities include preparing appropriate meals, keeping a balanced diet, refraining from an unhealthy lifestyle and from the use of unauthorised substances, not using drugs that could be considered doping, taking care of proper regeneration and rest, and refraining from betting on matches in the practiced sport discipline. Herein, firstly, the characteristics of sports work was presented and, secondly, the possibilities of using work-life balance tools in shaping everyday sports work were analysed. The paper analyses the phenomenon of blurring personal and professional lives among athletes. The main conclusion of the paper is the inability to effectively guarantee a work-life balance among athletes, and that athletes can effectively use legal tools of WLB only if they simultaneously perform services or work elsewhere. The paper uses a dogmatic and legal method (analysis of the literature on the subject, analysis of normative acts) and the results of research carried out by the author, i.e. a survey addressed at professional athletes

The subject of this article is the use of ADR in sports disputes in association football under the Polish and Ukrainian law. Professional and amateur sport generates various types of disputes related to both disciplinary and civil cases, an example of which may be disputes arising during the execution of contracts binding players and football clubs. In the first part, the scope of disputes that are subject to ADR in association football is outlined. The next part presents legal solutions adopted under the Polish law in this respect, of which the activity of the Football Arbitration Court of the Polish Football Association is a particular example. The last chapter is devoted to the Ukrainian perspective on the resolution of disputes in association football.

The article analyzes the possibilities of conducting mediation in sports disputes. The author cites solutions relating to various types of disputes, including financial, disciplinary, strictly sports-related, administrative and inter-institutional. As part of the conclusions, the author lists practical and theoretical aspects of conducting mediation in disputes, in which the use of mediation is required or promoted by the procedural law, and in disputes, where the use of mediation results or may result from internal regulations of sports associations.
W artykule dokonano analizy możliwości prowadzenia mediacji w sporach sportowych. Autor przytoczył rozwiązania odnoszące się do różnych rodzajów sporów, w tym majątkowych, dyscyplinarnych, stricte sportowych, administracyjnych i międzyinstytucjonalnych. W ramach wniosków wskazano na praktyczne i teoretyczne aspekty prowadzenia mediacji w sporach, w których stosowanie mediacji wynika z przepisów ustaw regulujących tryb postępowania oraz w sporach, gdzie stosowanie mediacji wynika lub może wynikać z regulacji wewnątrzzwiązkowych.

Background: The aim of the article is to highlight the importance of mediation in resolving disputes in sports, which is, in the consideration of the Author, underestimated. bMaterials and Methods: The text is based on literature and articles that consider this method of ending conflicts, internet recognition, and the presentation of a hypothetical (based on the Nonviolent communication mediation model) case study. Conclusions: Mediation is not widely used in the process of resolving disputes in sports. There is no example of using a mediation model based on NVC in the Polish internet space. Mediations based on NVC can be treated as a possible and successful means of ending conflicts in sports. This area (mediation and mediation based on NVC) is worth more advanced research.

Opis:
Organising football matches in Poland is currently a very important issue for the institutions and services responsible for security. The author, on the basis of his professional and scientific experience, has presented a concept of safety in this area. The article analyses in detail the organisational and legal solutions in force in Poland and selected European countries and assesses their effectiveness. The proposed concept provides for the development of organisational and functional requirements that would increase the level of safety during this type of sports events. Implementing the proposed solutions into the current law would enable a harmonised security system to be organised.
