Historic title is just one of many legal instruments which may be raised by parties and used by judges to decide a territorial dispute. If a claim of historic title in given circumstances may be deemed to have been extinguished as a result of its relative weakness, the elements advanced in support of its construction, for example uti possidetis or effective occupation, may be used to support other types of legal claims. Taking into account its construction and its systemic conditional criteria, historic title gains maximum effectiveness when conditions exist which would support a finding of its incremental consolidation. This involves a multi-dimensional interpretation in reliance on particular elements which, taken together, create a complicated factual state in a particular territorial dispute. On the other hand, consolidation of historic title is not an argument which can be used by the indigenous native inhabitants of a territory, since their arguments are not based on claims of sovereignty.

Migration in relation to democracy and sovereignty is considered one of the great challenges of this century. At the local, national, and global levels, migration is causing tensions in the development of democracy and security, which often calls the sovereignty of a given state into question (International IDEA, 2017). The challenges about migration in relation to democracy and sovereignty will increase even further since, according to relevant data, it has been warned that the next exodus is likely to occur as a result of climate change. In accordance with the assertion of the UN Climate Panel, it is said that this coming exodus will occur in the distant future as it is calculated that somewhere around the year 2100 there will be a climate-related warming of the planet of 2 to 3 degrees. The emergence of violent conflicts, climate change, persecution based on ethnic and religious affiliations, and various forms of violence are also en-dangering state sovereignty. These reasons why migrants leave their own countries, along with migrant perspectives, are topics that need to be addressed. It is important to examine migration as the main topic, especially migration in relation to democracy and state sovereignty. Seen in its totality, migration is taking on global dimensions and will be the hottest point of political topics with regard to finding the formula for its management in accordance with democratic values and their compatibility with state borders. Therefore, a debate should be subject to the following questions: how are we to preserve democratic values and the stability of sovereignty, and, should sovereignty be democratised?

During the 2019 campaign to the European Parliament, it was often argued that the situation in which EU institutions can make decisions that de facto legally affect public authorities of a given state in shaping policies on its territory violates this state’s sovereignty. Another argument was that such a situation would seriously limit the possibility of satisfying the needs of citizens of the state in question. The above logic assumes that maintaining the principles of nation state with regard to a state’s political system would guarantee the citizens greater control over public decisions and ensure that their needs are met. This type of argumentation has been present for a long time in the discourse on Poland’s membership in the European Union.The objective of the presented research is to elucidate what exactly it would mean for an average citizen (considering their potential influence on shaping public policies) to introduce a political system based on the so often evoked concept of a nation state in its original, literal sense. To meet the above objective, the text presents the original meaning of the category of a nation state and its constituent parts, followed by an analysis whether and possibly why the understanding of these elements has evolved. Finally, the entire cognitive process leads to a firm conclusion that a return to political relations based on the classical approach to the category of a nation state would lead to contemporarily unacceptable effects on the position of individuals in democratic political systems. This also means that the categories of a nation state and sovereignty can evolve and a discussion on the changing scope of their meaning is fully acceptable.

The dynamic character of changes we are observing in the contemporary world makes us ponder on the condition of the state – one of the most firmly established institutions, which has been a central unit in the international system so far. We got used to the unquestionably dominant role of the state as the main architect and arbitrator in both internal affairs and international relations. The superior position of the state has been undermined neither by World Wars nor the global economic crisis. At present, the world order based on the system of national states, commonly known as the Westphalian system, seems to be becoming a thing of the past due to huge international transformations, the most important of which is globalization. The multi-level character of changes affects basic spheres of international cooperation and is exerting an increasing influence upon the state, which is gradually losing its omnipotent position. The article presents how the abovementioned processes of change create new conditions of the functioning of the state and erode the foundations of its national identity: territoriality of state authority, sovereignty of the country and its generally secular character. All of them have been quite difficult to implement over the past twenty five years. As a result, the postmodern state is becoming less and less autonomous in its operations and is vulnerable to difficulties it encounters in the conditions of a turbulent environment and uncertain future. Not only the complexity of the international system, but also the fragmentation of the national society in the times of growing threats lead to the instability of traditional support usually offered to the state by a more homogenous national background. In these circumstances, the issue of the future of the national state becomes a subject of scientific research.
Dynamiczny charakter procesów przemian jaki obserwujemy we współczesnym świecie skłaniać musi do refleksji nad kondycją jednej z najtrwalszych instytucji jaką jest państwo, które stanowiło dotąd centralną jednostkę w systemie międzynarodowym. Przywykliśmy do niekwestionowania, dominującej roli państwa jako głównego architekta i arbitra w sprawach zarówno wewnętrznych jak i międzynarodowych. Dominującej pozycji państwa nie zniszczyły ani wojny światowe ani światowy kryzys gospodarczy. Obecnie porządek międzynarodowy oparty na systemie państw narodowych zwany powszechnie jako westfalski zdaje się jednak odchodzić w przeszłość za sprawą potężnych transformacji międzynarodowych utożsamianych w pierwszym rzędzie z globalizacją. Wielopłaszczyznowy charakter przemian dotyka podstawowych sfer współdziałania międzynarodowego i odbija się w coraz większym stopniu na państwie, które traci stopniowo swoją omnipotentną pozycję. Artykuł ukazuje jak pod wpływem wspomnianych procesów przemian kształtują się nowe warunki funkcjonowania państwa i ulegają erozji fundamentalne podstawy jego bytu narodowego, które tradycyjnie sprowadzały się do przestrzeganych w stosunkach międzypaństwowych zasad: terytorialności władzy państwowej, suwerenności państwa i jego zasadniczo laickiego charakteru. Wszystkie one pod wpływem przemian ostatniego ćwierćwiecza napotykają znaczne przeszkody w realizacji. Państwo ponowoczesne jest w związku z tym coraz mniej autonomiczne w swoich działaniach i wystawione na trudności związane z funkcjonowaniem w warunkach zmieniającego otoczenia i niepewnej przyszłości. Nie tylko złożony charakter komplikującego się systemu międzynarodowego ale także fragmentaryzacja społeczeństwa narodowego sprawiają, że w czasach rosnących zagrożeń zmniejsza się stabilność tradycyjnego oparcia jakie państwo miało zazwyczaj w bardziej homogenicznym zapleczu narodowym. W tej sytuacji pytanie o przyszłość państwa narodowego staje się podstawą dla dociekań naukowych.

This article aims at defining the specific tenets of the doctrine of “military occupation” and assessing how it deals with the issue of “sovereignty,” looking at the problem from a historical perspective. Accordingly, after tracing the evolution of belligerent occupation as a legal institution of international law, attention is turned to the concepts of “effectiveness” and “temporariness” and the interplay between de jure and de facto sovereignty in the light of the “occupation zone model”, as it has been applied in the course of international practice. Against this background the article discusses the hypothesis that the codification of the “laws of war” and evolution of the doctrine of military occupation as a temporary and limited regime, whose final aim is to restore legitimate sovereignty over the occupied territory, constitutes a paradigm which could and should apply to various unlawful territorial situations today which have arisen as a result of a misapplication of the law of military occupation.

Globalization entails the increasing volume, velocity and importance of flows within and across borders of people, ideas, goods, money, and much else, thus challenging one of sovereignty’s basic principles: the ability to control what crosses borders in either direction. Sovereign States increasingly measure their vulnerability not to one another, but to forces beyond their control. Necessity may also lead to reducing or even eliminating sovereignty when a government, whether from a lack of capacity or conscious policy, is unable to provide for the basic needs of its citizens. This reflects a view that state failure and genocide can lead to destabilizing refugee flows and create openings for terrorists to take root. Globalization is frequently discussed as a counterpoint to national sovereignty. It is commonly asserted that globalization has eroded national sovereignty or that it has rendered borders obsolete. In particular, it is asserted that, in a globalized world economy, governments have no alternative but to adopt neoliberal economic policies of privatization, deregulation and reductions in public expenditure. However, in the contest between social democracy and neoliberal globalization, the nation—state per se is only marginally relevant. The crucial issue is whether policy will respond to the wishes of a democratic electorate, or be tightly constrained by the ‘Golden Straightjacket’ of international financial markets.

The author in this study tests the applicability of basic categories of Leon Petrażycki’s (1865–1931) socio-psychological theory of law, pointing at ambiguity of the concept of ‘indigenous law’, ‘natives’ law’ and ‘customary law’. First, however, the right to one’s own law is followed through the history of colonization. It is essential for the plight of the indigenous people that already in 1537 Popes recognized that ‘original inhabitants’ had ‘rights’ and thus ‘legitimate claims’. If, on the one hand, there are ‘rights’ and ‘rightful claims’ then, on the other, there are duties that include not only the negative refraining from appropriation but also the positive duty to protect in exchange for the impairing the indigenous sovereignty. But whenever the nexus iuris is recognized, i.e. the link of correlative rights and duties, there is a law (Petrażycki) and ‘inherent – even if impaired, or as some say, abused – sovereignty of the indigenous people’ (Justice Marshall). The pluralist notion of ‘law’, the distinction between the ‘normative positive’ reference and the ‘normative intuition’ and the distinction between the ‘normative’ and the ‘factual’ should allow one to organize systematically the multiple issues that one encounters when approaching the area of ‘indigenous law’. From discussion of the official nonindigenous indigenous law exemplified by the federal Native American law of the United States the paper moves on to discuss the Navajo case of the official tribal law. It comes out that the native procedures and law are full of religious meaning so the ‘cultural’ sovereignty is much more fundamental and value-loaded than the secular philosophy of human rights incommensurable with the right to one’s own law. This is not considered when borrowing from native law into secular Western law (Greenland’s Criminal Code; mediation procedures in North America). The meaning of cultural sovereignty is the right to develop one’s law so that it fits one’s needs and aims. But the full success story is when the antithesis of the ‘indigenous’ and ‘dominant’ law is settled through the feedback from the former to the latter, like when the law – not only of a country but also on the global level – becomes syncretic and embraces deeper universalization of the human rights.

The launch of the Soviet Sputnik in 1957 resulted in the emergence of two legal concepts concerning spaceflight. The first of them concerned harmless passage through airspace subjected to the sovereignty of states, the second - recognition that at the height of the trajectory of a passage, space is no longer subject to the sovereignty of states (res omnium communis). In both cases, we are dealing with limiting the sovereignty of states. These issues have not been resolved to this day. The practice of spaceflight has confirmed the freedom of spaceflight, although it has not resolved the issue of the upper limit of airspace. It is worth emphasising, however, that the decisive factor for the development of space law was the customary law that arose in 1957, because states did not protest and tacitly accepted the principle of a harmless flight.

Irregular immigration is a phenomenon with a substantial impact for the majority of the countries. The paper analyses whether there is an adequate human rights framework for protection of irregular immigrants or whether the irregular status exempts the migrants from the protection of international human rights law. If this is the case, then the human rights universality has failed. The paper takes into consideration the developments in the International and EU Law, as well as in the jurisprudence of the international tribunals regarding protection of irregular immigrants. It is divided into three main sections. The first section informs briefly on the dynamics of irregular immigrants; the second section analyses the legislation on irregular immigration from the perspective of the state sovereignty, the third section analyses the human rights law and the protection it affords to irregular immigrants, pursuant to the interpretation of International tribunals.

Sovereignty is now a key concept in geographic scholarship. However, sustained geographic investigation of sovereignty commenced only in the 1990s, after the collapse of the Cold War order. Early, important contributions to the interrogation of sovereignty were historical, providing rigor in understanding the dialectical relationship between space and politics in the development of the state system. By the close of the twentieth century, however, historical complementarity in important geographic tracts on sovereignty, conditioned by new geopolitics of post-communism, gave way to diverging prognostications among academic geographers on the contemporary and future nature and salience of state sovereignty.

The article concerns the constitutional position and political role of the President of the Republic of Poland. Though the Author concentrates on the current constitution of Poland, that entered info force in 1997, he also reviews all the constitutions (and important amendments to these constitutions) that were adopted over the last century, so after Poland had restored its sovereignty in 1918. The analysis is concentrated not only on the constitutional position and political role of the Polish president, but also on the way he was (and is) elected. This paper deals with the conflict between Ukraine and the Russian Federation, focusing on both cold and hot phases since 1991, including the conflict drivers beyond military operations. We use a multidisciplinary approach based on conflict transformation theory. We include local research data from Ukraine received in 2013-2022, applying both qualitative and quantitative methods. Official narratives from both sides and Russian quantitative sociology data are also considered. The possible paths of further conflict transformation are discussed.

An attempt to shake the established world order of Western society, based on International Law, by the waging of war, has reached its peak. This is evidenced not only by Russia’s war in Ukraine, but also by Russia’s political attempts to destabilise Moldova’s approach to Western values, along with the recent unrest in Georgia, where there is a risk of restricting individual freedom of expression, and the constant threats against the Baltic States. Conflicts of values have existed throughout world history, but the events we are witnessing now are not an accident, but a systematic reiteration of Russia’s influence, with the aim of maintaining its influence and, perhaps, increasing its power in the region. The aim of this article is to show the clash of contemporary values in the current socio-political situation from the perspectives of theory and practice. Russian political leaders had long used alarming language in their rhetoric, up to and including the moment of the Russian invasion of Ukraine. In Europe and throughout the Western world there was a belief in universal values with peaceful/stable global institutions, a belief which has proved to be misguided. On the other hand, military aggression against a free and independent country can be interpreted as a direct and clear attempt to destabilise the values of Western civilisation, without which no democratic society can exist. The timing of the military aggression was chosen after a decline in civic confidence from the perspective of the COVID-19 crisis; European countries were experiencing a reduction in political activity among their citizens, dissatisfaction with the political elite, and a certain decline in confidence in the EU institutions. The course of the pandemic reflected the lack of critical thinking in societies, as individuals were also at risk of manipulation in the information sphere. The Russian invasion of Ukraine caused some indignation in the Western world and a failure to react quickly to the rapid turn of events. After the first year of the war, the EU Member States managed not only to change their position but also to give unwavering and unequivocal support to the victim of the war, namely, Ukraine. So far, the EU slogan “United in Diversity” has become “United in Solidarity”, helping Ukraine to hold on and possibly win the war against the aggressor state, because no war, especially a war of values, ends on the front lines. As a result of current events, EU and transatlantic cooperation has undergone a major transformation involving extensive cooperation, a clear position on international law, and a desire to preserve and strengthen Western values.
