‘Legitimacy’, ‘reputation’ or ‘institutional trust’ inspired by judicial institutions constitutes an important aspect of the rule of law. Consequently, scholars developed survey-based methods to quantify ‘legitimacy’ as understood in the Weberian sense. Thereby, the survey response quality can meaningfully impact the obtained results. Moreover, one can expect, that sharpening political polarization observed in various countries could amplify such measurement problems. The goal of this paper is to examine the assessments of the Polish Constitutional Tribunal (CT) using two distinct surveys carried out in March 2022 by CBOS (Public Opinion Research Center). Both asked about the overall assessment of the CT performance, as well as electoral preferences (voting intent and preferred political party), frequency of religious practices, self-assessment of economic conditions and included a battery of standard demographic controls. Both overall assessment levels as well as individual-level determinants of the CT assessment (using probit models) had been compared. The findings document that, regardless of the survey data collection mode, controlled for demographic factors, the assessment of CT depends upon variables representing political polarization. This finding can be interpreted as an indication of its political de-legitimization. Moreover, five years after the constitutional crisis, and nearly one and a half years since the abortion verdict, over 40 per cent of respondents of the Allerhand Institute Survey admitted they ‘don’t know precisely’ the task of the CT or even ‘haven’t heard’ about it, indicating a substantial lack of knowledge. The second group of findings documents differences between CAPI and CAWI polls. According to the authors’ knowledge, it is the first attempt to examine respondent-level determinants of CT assessment, and test their sensitivity to the survey data collection mode, thereby contributing to our understanding of the Polish CT legitimacy five years after the constitutional crisis, and methodological aspects of such measurements in general.

The article identifies the discursive characteristics of news media texts covering Poland’s ‘constitutional crisis’. Following the conception of discourse presented in Laclau and Mouffe (1985), i.e. as an articulatory practice that conveys meaning through a structured system of positions and differences, the article highlights some features of English-language news media texts (e.g. from the Guardian, Telegraph, Economist, Financial Times, New York Times, Washington Post) that can be described as typical. The following features are identified: a lecturing tone, the use of structural oppositions, immediate rebuttals, misrepresentation, appeals to expertise, and the sovereignty taboo. These features are diagnosed as contributing to the narrow discursive range covered by news articles. To broaden the considerations, the article presents three conflicting positions from Polish legal theory that address the issues of constitutional courts, the rule of law and national sovereignty: Ryszard Piotrowki’s legal constitutionalism, Paweł Bała and Adam Wielomski’s Schmitt-inspired position, and Adam Sulikowski’s reading of the constitutional courts as an instrument of hegemonic discourse. In the conclusion it is suggested that news media discourse would benefit from demonstrating a greater awareness of other discourses, and from developing a more generous, balanced approach to presenting and addressing their claims.

This paper aims to present how logic may undermine a parliamentary assault on democratic institutions (representing legal guarantees of the rule of law and political freedom) based on the analysis conducted with reference to the so-called Polish constitutional crisis. I analyse whether a law can be reviewed on the basis of this law itself. The Polish Constitutional Tribunal faced such a problem while passing the verdict of 9th March, 2016, regarding the constitutionality of the amendment to the Statute on the Constitutional Tribunal from 22nd December, 2015. This problem, called a ‘verdict paradox’, was claimed to be a type of the Liar paradox. I argue that, contrary to the common view, the problem of the verdict paradox is not based on the Liar paradox; for this purpose, a logical analysis is applied to four variants of a reasoning with regard to the constitutionality of the said amendment. The distinction between two levels of analysis concerning emerging reasonings, namely an abstract (logical) level and a concrete level placed in the context of the legal system, is also introduced. This paper demonstrates that although only two variants of the reasoning concerning a law’s judicial review based on the law itself involve logical contradiction, the possibility of employing reasonings from other variants must be excluded, albeit due to alternative reasons. Therefore, the Constitutional Tribunal’s decision to avoid the verdict paradox by passing over the reviewed provisions in the review process was correct and might be perceived as an example of how logic and reason can defend the institutional guarantees of political freedom.

During the last four years the situation in Poland has been a matter of interest to the worldwide legal community mostly due to the constitutional crisis. Yet, the years 2015–2019 were also a time of a revival of transitional justice measures, such as cleansing the public sphere of communist symbols, remodelling of lustration law, and further reduction of pensions of communist secret service employees and officers. In this paper I argue that these spheres are interconnected and that Poland’s constitutional crisis has a transitional justice dimension. I start with an overview of retrospective instruments dealing with the communist past introduced in the last four years. Next, I turn to the constitutional crisis itself, discussing its possible explanations and transitional justice aspects. In the end I claim that the dramatic constitutional backsliding that Poland has recently experienced can be explained not only as a power grab, but also as a result of the tension between the rule of law and the principle of individual responsibility on one hand – and the resort to collective accountability in an attempt to get what the government sees as justice on the other.
W ciągu ostatnich czterech lat sytuacja w Polsce stała się przedmiotem zainteresowania międzynarodowych gremiów prawniczych przede wszystkich ze względu na kryzys konstytucyjny. Lata 2015-2019 były jednak także okresem powrotu do narzędzi rozliczeń z przeszłością, wśród których wymienić można usuwanie symboli komunistycznych z przestrzeni publicznej, zmianę modelu lustracji oraz dalsze obniżenie emerytur funkcjonariuszy i pracowników organów bezpieczeństwa państwa PRL. W artykule stawiam tezę, że sfery te są ze sobą wzajemnie powiązane, kryzys konstytucyjny ma zaś wymiar retrospektywny. Tekst zaczynam od przedstawienia mechanizmów sprawiedliwości tranzycyjnej dotyczących okresu komunistycznego wprowadzonych w Polsce w ostatnich czterech latach. Następne omawiam możliwe wyjaśnienia kryzysu konstytucyjnego i jego aspektów związanych z rozliczeniami z przeszłością. Analiza prowadzi mnie do wniosku, że dramatyczne zmiany ustrojowe, które współcześnie dotknęły Polskę, mogą być wyjaśnione zarówno w kategorii walki o władzę, jak i jako rezultat konfliktu pomiędzy zasadą rządów prawa i zasadą indywidualnej odpowiedzialności – a odwołaniem się do odpowiedzialności zbiorowej w celu zaspokojenia tego, co rządzący uznają za sprawiedliwość.
