The Mediation Directive (2008) obliged the Member States of the European Union to promote the use of mediation through their own means. A decade later, the results of several studies revealed that national efforts to foster mediation were not as effective as planned in most cases. Despite some scholars’ concerns about restricting mediation voluntariness as means for increasing its application, Italy introduced a mandatory mediation scheme which proved that forcing parties to mediate results in high numbers of mediation procedures with favorable success rates. This led other Member States to reconsider the role of the State in fostering mediation. This article tackles the prevalence of mandatory mediation in family disputes, as an area widely recognized as most suitable for it. The co-authors raised the research question of whether the introduction of mandatory mediation in family disputes is an emerging trend in the European Union. A short overview of the mandatory mediation concept and the existing doctrinal models was presented as a theoretical background of this research. Based on the review of the scientific literature, four prevailing models were identified and briefly described. Secondly, the map of mandatory mediation within the European Union was updated with the latest data collected from the most recent legislative amendments and testimonies of the corresponding national mediation experts. Thirdly, a brief examination of the current mandatory mediation models in the Member States was conducted. The in-depth analysis of the obtained results shows that introducing mandatory mediation in family disputes is a prevailing trend in fostering mediation in the European Union. Consequently, it was identified that the variety of implemented models went far beyond the existing doctrinal classification, which needs to be reconsidered by future research in this field.

The article discusses the legal and systemic issues of the creation of a modern mediation institution in Georgia. It discusses Georgia’s historic experience traditions of settlements of disputes by means of peaceful methods, part of which are still preserved in the high mountainous regions of the country. In 2013, the country was also introduced to the mediation for settlement of collective labour disputes, which is implemented by active involvement from the government. Already existing statistics demonstrate that mediation in the given sphere is effective and actually serves for the settlement of disputes between employers and groups of employees. In 2019, Georgia adopted the law on mediation, which regulates the issue of private mediation conduction andexecution of achieved agreements. Mediators training and professional development system were created. By the adoption of the given Law ended the almost eightyear phase of mediation legal and institutional regulation,which,  according to the opinion of the author of the article, was a process prolonged in time. Unified Law could have been adopted at the early stage of the reform which would have made the process of extensive usage of mediation in the country faster. As reason for introduction of mediation institution in Georgia is named the obligations of the country in the process of integration with the European Union, overloading of civil courts in the country and prolonged disputes.

Practically everywhere around the world we encounter some form of conflict. The different views, needs, values (whether individuals or the whole society) are causing contradicts in different areas of our lives. Clearly, the conflict is a vital component of the society's life, and each of us was most likely a part of a larger or lesser conflict during his/her life. Conflict is a natural part of our lives which will push us further. Sociology is the study of social relationships, social interaction and culture of everyday life and one of the basic principles says that a constant conflict is vital for society where in the end new balance in the life is found. Mediation is an effective tool for dealing with these conflicts which is mostly used in resolving litigation, but there are other areas of use for mediation, which will be further explained in this document. Although mediation has been placed in our legal relatively recently, it has a rich history and firm place in the life of society. The new history of mediation goes back to the eighteenth century, when this was used as a tool to prevent expensive and time-consuming litigations. The institutionalized form of mediation was introduced for the first time at the beginning of the last century in the United States. Although directive 2008/52/EC of the European Parliament and Council from 21 May 2008 on certain aspects of mediation in civil and commercial matters should ensure a certain unity of national arrangements it is clear, that individual countries have different approach to legislative matters. I believe that it will be interesting to compare our legislation with the other countries but given the scope of the article I will focus only on the few selected states.

Mediation is an institution that has been in demand in all modern legal systems for the last twenty years as a fast, reliable and inexpensive alternative method in the resolution of commercial law disputes. Turkey and Uzbekistan are in a continuous effort to ensure compliance with comparative law systems which are adopted by the EU and international legislation in the modern sense, including mediation. In Turkey’s case, specialization and institutionalization targets were envisaged regarding mediation. Codification frameworks devoid of systematic planning were carried out in order to achieve these targets. Contrary to the concept of mediation, the areas where mandatory mediation applies have been expanded. On the other hand, for Uzbekistan’s case, which accepted mediation six years after Turkey, in 2018, and did not adopt mandatory mediation, Turkey’s disappointing mediation experience can be regarded as a lesson. This experience is valid not only for Uzbekistan but also for all legal systems that include mediation.

Conflict-related and disputable situations have been present in our lives since ancient times, when people have become aware of the need to protect their rights and interests, sometimes at odds with the aspirations of others. The conflict that emerges between people disturbs their relationships and poses a threat to the proper functioning of people, bringing with them negative emotions. However, it can be an opportunity for development, be treated as a change in interpersonal relationships and can ultimately produce positive effects. Mediation offers a possibility of converting the negative aspects of the conflict into constructive solutions. Being voluntary, confidential, non-formal, out-of-court proceedings, it enables the parties to come to an agreement, offering them the opportunity to actively participate in shaping the legal and social situation and exercising their rights and interests in the spirit of consensus. In the mediation process, the parties use the support of a professional, impartial, neutral mediator. The authors of the article promote the idea of mediation with full conviction that it is a valuable and effective way for conflicted parties and third parties and their relatives to reach a consensus on various issues, including family matters.

The article discusses an alternative way to settle a tax dispute through mediation. For the Russian law enforcement practice, this format of interaction is new, since the current law on mediation only since 2019 has established the possibility of its implementation in the public sphere of activity. At the end of 2020, the first precedent for considering a tax dispute through mediation appeared, which gave a positive result. The author discusses the pros and cons of using mediation in public legal relations and gives his vision of this process.

Studies of understanding and identification of mediation objectives, strategies and techniques and the effectiveness of mediation proceedings are justified from the cognitive and practical perspectives. The aim of this paper is to present the report of an empirical study, devoted to the subject matter mentioned above, conducted by the author as part of the scientific activity financed by the Polish National Science Centre. The paper is complex in nature – it deals with the research, concept and methodological threads. The empirical study was conducted in Poland, with Polish mediators participating in it, providing mediation services mainly in one of the Mediation Centres operating at District Chambers of Legal Advisors, making up the National Network of Legal Advisor Mediation Centres. However, considering the universal and utilitarian nature of the issue in hand, the comparative potential, originality and cognitive value of the study findings may be of interest to both Polish and international scientists and practitioners of mediation as an amicable form of holistic legal dispute management. Given the scope and depth of the issues addressed, the article is divided into three parts. This text (part II) contains the findings of an empirical study, presented in the form of detailed data obtained by means of a survey questionnaire, followed by a brief discussion and the most important conclusions.
Prowadzenie badań nad rozumieniem i identyfikacją celów mediacji, wykorzystywanymi strategiami i technikami mediacyjnymi oraz efektywnością postępowań mediacyjnych posiada istotne uzasadnienie poznawcze i praktyczne. Celem artykułu jest przedstawienie sprawozdania z badań empirycznych poświęconych wymienionej problematyce, przeprowadzonych przez autora w ramach działania naukowego sfinansowanego przez Narodowe Centrum Nauki. Artykuł ma złożony charakter, podjęto w nim zarówno wątki naukowo-badawcze, koncepcyjne, jak i metodologiczne. Prezentowane badania empiryczne przeprowadzone zostały w Polsce, z udziałem polskich mediatorów, świadczących usługi mediacyjne przede wszystkim w ramach jednego z ośrodków mediacji funkcjonujących przy Okręgowych Izbach Radców Prawnych, tworzących tzw. Ogólnopolską Sieć Ośrodków Mediacji Radców Prawnych. Mając na uwadze uniwersalność i utylitarność podejmowanych zagadnień, ich potencjał komparatystyczny oraz oryginalność i wartość poznawczą uzyskanych wyników badań, mogą one zainteresować nie tylko krajowych, lecz także unijnych czy międzynarodowych przedstawicieli nauki i praktyki mediacji jako polubownej formy holistycznego opanowywania sporów prawnych. Zważywszy na zakres i stopień szczegółowości podjętych zagadnień artykuł składa się z trzech części. W niniejszym tekście (stanowiącym część II) zaprezentowane zostały rezultaty badań empirycznych w postaci szczegółowych danych uzyskanych na podstawie kwestionariusza ankiety, a następnie ich zwięzłe omówienie oraz najważniejsze wnioski.

The subject of this article is the analysis of the activity undertaken during mediation in the context of the characteristics of the mediation process and the normative conditions of the legal relationship and disputes resolved through this form of ADR. In order to implement the project, the content of the work will contain a list of functions performed by the mediator during mediation as ‘the environment for performing the role’ (which is not closed due to the dynamics of interaction in the negotiations). Their character and content determine the nature of the social and professional role of mediators in the Polish legal order, it also allows us to illustrate in detail the key issues for reflection on the professional role, including, for example, legal liability and conflict of roles. Mediation functions are diversified in terms of the frequency of their implementation depending, among other things, on the strategy of conducting mediation, the specificity of the dispute and the legal regulation of mediation. The discussion of the last of the indicated differentiating factors (i.e. the impact of universally binding law) will be reflected in the content of the paper.
Przedmiotem rozważań niniejszego artykułu jest analiza aktywności podejmowanej w trakcie mediacji w kontekście specyfiki procesu decyzyjnego mediacji oraz uwarunkowań normatywnych stosunku prawnego i sporów rozwiązywanych za pomocą tej formy ADR. W celu realizacji zamierzenia treść pracy będzie zawierać katalog funkcji pełnionych przez mediatora w trakcie mediacji jako „środowiska realizowania roli” (który ze względu na dynamikę interakcji w ramach rokowań nie posiada zamkniętego charakteru). Ich charakter oraz treść przesądzają o charakterze roli społecznej i zawodowej mediatorów w polskim porządku prawnym; pozwalają również w sposób szczegółowy zobrazować kluczowe zagadnienia dla rozważań nad rolą zawodową, w tym takie, jak np. odpowiedzialność prawna czy konflikt ról. Funkcje mediacyjne ulegają zróżnicowaniu w zakresie częstotliwości ich realizacji w zależności m.in. od strategii prowadzenia mediacji, specyfiki sporu oraz regulacji prawnej mediacji. Omówienie ostatniego ze wskazanych czynników różnicujących (tj. oddziaływania prawa powszechnie obowiązującego) znajdzie odzwierciedlenie w treści pracy.

Under the provisions of Act I of 2017 on the Code of Administrative Court Procedure, a brand new institution has been introduced in Hungary: as of 1 January 2018, in administrative court proceedings, the judge may, with the agreement of the parties, allow for a court mediation procedure in the cases in which the law does not preclude it. The primary method to approach the topic is the review of the relevant primary legal sources [actual law in the form of the constitution (Fundamental Law of Hungary), acts, governmental decrees, orders of the President of the National Office, court cases, etc.] and secondary legal sources (Hungarian and international scientific literature explaining the primary sources, the legal practice and also the specific circumstances determining the broader social environment) through which we may define relevant scientific problems, create our own definitions and prepare a catalogue of practical problems, specifically for Hungarian issues regarding the topic. Moreover, this article tries to build on the results of the interviews with judges, representatives of different defendants (administrative authorities) and others. Qualitative interviewing, including the interviewing of judges and other participants of such proceedings, is a relatively new method in the field of legal studies, at least in Hungary.

Aim. Peer mediation is a tool for the prevention of socio-pathological phenomena occurring in the school environment, is an opportunity to resolve conflicts through reconciliation. The paper focuses on the perception of the importance of peer mediation and on the presentation of the results of a questionnaire survey, the aim of which was to determine the respondents’ preferences after completion of the project process. Methods. The aim of the questionnaire survey was to determine how pupils and students perceive peer mediation. The survey sample consisted of selected pupils from 6 primary schools aged 10 to 15 years and students from 6 secondary schools aged 15 to 18 years. The questionnaire was completed at the beginning (year 2020 - N = 189, including 90 primary school pupils) and end of the project implementation (year 2021 - N = 124, including 56 primary school pupils). Results. The responses in the entry and exit questionnaires, the respondents declared after participating in the project process an increase in their experience with peer mediation, expressed an interest in becoming peer mediators and resolving personal and school conflicts through peer mediation. Conclusion. Peer mediation engages pupils in a common dialogue to resolve conflicts at school through reconciliation and is a suitable way to prevent undesirable social phenomena in the school environment. The results of the research showed that respondents preferred peer mediation and perceived it as an appropriate form of conflict resolution in the school environment.

Celem artykułu jest przedstawienie sprawozdania z badań empirycznych poświęconych wymienionej problematyce, przeprowadzonych przez autora w ramach działania naukowego sfinansowanego przez Narodowe Centrum Nauki. Artykuł ma złożony charakter, podjęto w nim zarówno wątki naukowo-badawcze, koncepcyjne, jak i metodologiczne. Prezentowane badania empiryczne przeprowadzone zostały w Polsce, z udziałem polskich mediatorów, świadczących usługi mediacyjne przede wszystkim w ramach jednego z ośrodków mediacji funkcjonujących przy Okręgowych Izbach Radców Prawnych, tworzących tzw. Ogólnopolską Sieć Ośrodków Mediacji Radców Prawnych. Mając na uwadze uniwersalność i utylitarność podejmowanych zagadnień, ich potencjał komparatystyczny oraz oryginalność i wartość poznawczą uzyskanych wyników badań, mogą one zainteresować nie tylko krajowych, lecz także unijnych czy międzynarodowych przedstawicieli nauki i praktyki mediacji jako polubownej formy holistycznego opanowywania sporów prawnych. Zważywszy na zakres i stopień szczegółowości podjętych zagadnień, artykuł składa się z trzech części. W niniejszym tekście (stanowiącym część III) zaprezentowane zostały istotne, wybrane dane, wynikające z przeprowadzonych z mediatorami pogłębionych wywiadów indywidualnych, a także ich zwięzłe omówienie i główne wnioski oraz podsumowanie całości działania naukowego.

Study participants are 46 women (age 23.48 ± 4.88 years) with Mayer-Rokitansky-Küster-Hauser (M-R-K-H) syndrome. Occurrence of the M-R-K-H syndrome is one in 4000-5000 female children. It was investigated (a) whether coping styles mediate the effect of neuroticism (N) on positive (PA) and negative (NA) affect, and (b) whether this mediation is moderated by the level of N as well as (c) whether this moderated mediation is moderated by length of awareness of illness. Methods: Neuroticism, coping style as well as positive and negative emotions were assessed using the Polish version of NOE-FFI, CISS and Scale of Emotional State. Results: Emotion coping style fully (for PA) or partly (for NA) mediated the relationship between neuroticism and emotions and these mediations were moderated by the level of N. Additionally, direct effect of neuroticism on NA was moderated by the time for which a patient has been aware of the disease. Conclusions: The level of neuroticism and the length of illness are important factors for the psychological functioning of women with M-R-K-H Syndrome. In women with medium and high neuroticism, (positive) effect of N on NA was indirect and also direct – but only in those who have been aware of the diagnosis for 6 years or more. Relations with positive emotions were different: the indirect effect (negative) was observed only in women with a moderate and low neuroticism.
