In modern democracies the liberty of the individual is ensured and protected by the state or the government. But it is well-known that restrictions on liberty are institutionalized and the individual is responsible for obeying them. The liberty of the individual and its protection is provided through restrictions. On the other hand, the legal system and the government are the institutions that threaten the liberty of the individual. Mill’s thesis on individual liberty implies the primacy of it and sets out the social conditions in which it will be possible to realize and protect individual liberty. The main theme of his treatise On Liberty is the nature and boundaries of individual liberty, the scope of legitimate interference with individual liberty. In other words, the principle establishes a sufficient basis for the legitimate protection of the individual liberty, i.e. what is a restriction of a right, on the one hand, is at the same time a protection of it. An individual must be free from all forms of violence, if his/her actions do not harm others [Riley 2001, 46]. The purpose of the paper On Liberty is to provide one very simple principle. Main point of it is that the method of societies’ relations with the individual should not be coercion and control. No matter is it a case of physical violence as a form of punishment or as a form of moral coercion by society. Power over a member of a civilized community can only be exercised for the sole purpose of preventing harm to others. Thus, the liberty principle establishes a necessary condition for legitimate violence against any individual: his/her liberty of action must be restricted by law or opinion if there is a reasonable expectation that it will harm others.
We współczesnych demokracjach wolność jednostki jest zapewniana i chroniona przez państwo lub rząd. Jednak powszechnie wiadomo, że ograniczenia wolności są zinstytucjonalizowane i jednostka jest odpowiedzialna za ich przestrzeganie. Wolność jednostki i jej ochrona jest zapewniona poprzez ograniczenia. Z drugiej strony system prawny i rząd to instytucje zagrażające wolności jednostki. Teza Milla o wolności indywidualnej implikuje jej prymat i określa warunki społeczne, w których możliwa będzie realizacja i ochrona wolności indywidualnej. Głównym tematem jego traktatu O wolności jest natura i granice wolności jednostki oraz zakres uzasadnionej ingerencji w wolność jednostki. Innymi słowy, zasada ta stwarza wystarczającą podstawę dla uzasadnionej ochrony wolności jednostki, czyli to, co jest ograniczeniem prawa, jest jednocześnie jego ochroną. Jednostka musi być wolna od wszelkich form przemocy, jeśli jej działania nie szkodzą innym. Celem dzieła O wolności jest przedstawienie jednej bardzo prostej zasady. Najważniejsze jest to, że metodą relacji społeczeństw z jednostką nie powinien być przymus i kontrola. Nie ma znaczenia, czy jest to przemoc fizyczna jako forma kary czy forma przymusu moralnego ze strony społeczeństwa. Władza nad członkiem cywilizowanej społeczności może być sprawowana wyłącznie w celu zapobiegania krzywdzie innych. Zatem zasada wolności ustanawia warunek konieczny uzasadnionej przemocy wobec jakiejkolwiek osoby: jej wolność działania musi być ograniczona przez prawo lub opinię, jeśli istnieje uzasadnione oczekiwanie, że zaszkodzi to innym.

My argument in this paper is that Charles Taylor’s view of liberty and ethics unites Isaiah Berlin’s liberal pluralism with Elizabeth Anscombe’s virtue ethics. Berlin identifies, in “Two Concepts of Liberty,” a tradition of negative liberty advocated by figures like Locke and Mill. He maintains that this concept of liberty is unique to modernity, and it is the form of liberty best suited to the political sphere. The much older concept of positive liberty, which is found in ancient philosophers like Plato and Aristotle, as well as modern thinkers like Hegel, Berlin regards as ill-suited to the political sphere. Anscombe, in “Modern Moral Philosophy,” specifically identifies and criticizes the Anglo-Saxon tradition of moral philosophy. Utilitarian thinkers like Mill are, for Anscombe, consequentialists. The virtue ethics of Aristotle gives a basis for the intrinsic goodness and badness of actions not in sentiment but reason. Charles Taylor draws upon the views of both thinkers. He advocates a liberal pluralism in a manner comparable to Berlin. However, Taylor strongly emphasizes, with Anscombe, that the most complete conception of ethical and political life must be rooted in virtue ethics and positive liberty. Thus, Taylor’s views constitute a synthesis of the approaches of his two mentors.

RESEARCH OBJECTIVE: In this article the research objectives are the rights of children deprived of liberty and suspected of having committed crimes in international and regional agreements as well as in Swedish legislations and intended to preserve the child’s dignity. THE RESEARCH PROBLEM AND METHODS: The method applied to study their dignity is, on one hand, in the context of international and regional agreements; on the other hand, in the context of Swedish legislations, which are relevant to these children. THE PROCESS OF ARGUMENTATION: The argument is whether in Sweden children under the age of 15 years deprived of liberty and suspected of having committed crimes are treated in a manner consistent with promoting the child’s sense of dignity during the investigation of the crime. These children are of particular interest as they are more vulnerable than adults in the same situation; the spirit of dignity should therefore be more explicitly expressed for them. RESEARCH RESULTS: The research result confirms that dignity is fundamental for the rights of children as expressed in the studied international and regional agreements and, more specifically, in the CRC Articles 37 and 40. CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: Swedish legislations still need improvements to preserve the dignity of children, particularly regarding the rights of children under the age of 15 deprived of liberty and suspected of having committed crimes.

The various aspects of Christian Liberty and of the life of the Christian in the world are linked in a singular way in Paul’s pronouncements on marriage, as is found in 1 Cor 7:1–7 ff. Our choice of St. Augustine in the numerous contemporary scholarly attempted hermeneutics of 1 Cor 7:1–7 is that he adopts and elaborated an already existing tradition on sex and marriage. Moreover, this text in the New Testament is the only one that speaks explicitly of the significance of conjugal intercourse. The interpretation of this text or passage has to an extent determined the development of the church’s tradition. Thus, the importance of the passage has to be considered. In Cor 7:1, Paul starts answering the questions the Corinthians put to him. Verse 1 reads: “Now concerning the matters about which you wrote”. The first of these questions concerns marriage. According to the superscription of this work, Augustine’s interpretation of 1 Cor 7:1–7 has implications for Christians in the contemporary world. In as much as it raises numerous problems to our contemporary understanding of marriage and sexuality, the problem of sexuality characterized our society today.

The age of intellectual debates in France between the Revolution in 1789 and the Dreyfus Affair at the turn of the centuries is one of the key sources that enable the understanding of the modern political culture. It concerns, in particular, the modern concept of liberty that became one of the defining values shaping the European political discourse. Thus, the post-revolutionary France remains an extremely valuable source of inspiration when revisiting the essence of many contemporary debates in political philosophy and public discourse. Most of the ideas and arguments in circulation today echo the debates over the liberty, reason, and society that dominated the intellectual climate of that period in the French political history or, at least, heavily depend on the foundational ideas formulated then and there. Thus, they are worth reconsidering.

The mid-1980s saw a decisive shift in the approach to religious liberty in American educational system. The shift was the fruit of a concerted effort of numerous infl uential bodies – both political and religious – which subsequently led to the emergence of the new consensus on teaching about religion and religious liberty in public schools. One of the ways used to facilitate the implementation of the new consensus ideals in public education was the nationwide dissemination of informative materials (guides). Addressed primarily to school offi cials, teachers and parents, the guides outlined the constitutional and educational role of religion in the public school. The article analyzes a number of selected guides with respect to their religious liberty content. It also discusses the impact they exerted on the U.S. system of education at the primary and secondary school levels.

A common interpreting perception of Machiavelli’s thought is based on the paradox that state feasibility uses not only knowledge but also any form of immoral act in order to preserve power. Against this position that draws its origin in Meinecke, this paper aims to study the ways that the notion of liberty is interpreted by Machiavelli as well as the impact of this contribution to contemporary policy making. Furthermore, through this study, the diversification between the real Machiavellian contribution to modern thinking and Machiavellianism, will be thoroughly analyzed. The main research question of the paper is to test if the new arte dello stato (art of the state), in contrast with the notion of Machiavellianism, is based on the new form of rationality which has its roots in naturalism and history, as a precondition for the ruler’s unobstructed action. The methods used include main literature review on Machiavelli as well as content analysis of Machiavelli's treatise The Prince in order to address the research hypothesis that Machiavelli is based on rationality, naturalism and history in order to create a framework of stability, continuity, liberty and prosperity of the people. The main conclusion of the paper is that Machiavelli’s The Prince seems to posit a notion of the state operating around the ruler against fortune within a political regime of homogenization, in which the ruler represents the pole of stability and capable rationality by rolling out a long-term conservation strategy in accordance with the social reality that surrounds him. Thus, his thinking inaugurates the democratic pragmatism of modernity which was later deepened by the philosophy of the Enlightenment.

Freedom is one of the most fervently fought for values and, at the same time, the very idea of freedom belongs to concepts that are essentially contested. This situation is a part of human brokenness, and in Christian formation, it has to be seriously dealt with. According to the popular view, ‘holiness’ is a life-negating and judgmental attitude towards everything ‘normal.’ In biblical usage, it connotes belonging to God as a gift in Christ. Spiritual formation begins with a biblical explanation of freedom and holiness. A Christian worldview has to be the background to Christian formation, functioning as a correction of the commonly- accepted naturalistic worldview. A personal experiential relationship with God is the key to successful growth towards realistic and practical holiness in daily life. ‘Dos and don’ts’ that usually arise at the beginning of religious education shall be experienced as liberating instructions, if they are offered as guidance to a fully persuaded mind and a devotedly loving heart.

Study towards the notion of liberty remains relevant at any time since the idea of freedom remains a basis of the contemporary democracies and other modern liberal political regimes. This article traces the differences between the two theoretical approaches towards the liberty: of the ancient Greek philosopher, Plato and the British economist and politician of the XIX century, John Stuart Mill. The research reveals common features of the concepts: while Plato can be considered to be a representative of the ancient philosophy with the peculiar comprehending of liberty notion, John Stuart Mill, adhering liberalist views, proposes the classical understanding of the concept. Moreover, the article will contribute to the distinguishing between the contemporary perception towards the freedom and the ideas of philosophers of the past. In addition, the research is based on the comparative analysis of the following criteria: the authors' attitude to the concept of liberty in general, views on the freedom of speech, freedom of expression, freedom of the will, approaches to the political regimes, like tyranny and democracy, opinions about the necessity of customs, as well as about the issues of individuality, personal development, and the system of citizens' control.

The article analyzes the transformation of concepts like liberty, equality, and democracy depending on the political, historical, and socio-cultural context. The author proposes to trace the significant difference in understanding “universal” socio-political values by using the classical liberal theories of B. Constant and A. de Tocqueville compared to modern international political processes. The author uses comparative and historical analysis methods, and a cultural and axiological approach to studying the ideology and politics. The argument is that the ancient understanding of liberty was irrelevant for the society of the XIX century, just as B. Constant’s classical understanding of liberty no longer meets the changing socio-political needs of people living in the XXI century. It does not consider a fundamentally new sphere of human activity like freedom and privacy in the digital world. Recognizing the value of democracy, the author observes that today, A. de Tocqueville’s approach is more than adequate for understanding political processes. For example, the post-election information warfare in the United States in 2020 shows the relevance of the specific understanding of Tocqueville’s democracy as a profound process of total equality spread. The main conclusion is that the political values familiar to modern discourse often are interpreted inadequately to reality since scientific understanding is rigid and lags behind the rapid development of information technologies, globalization, and virtualization.
Artykuł prezentuje analizę znaczącej transformacji wartości wolności, równości i demokracji w zależności od kontekstu politycznego, historycznego i społeczno-kulturowego. Autorka rekonstruuje różnice interpretacji „uniwersalnych” wartości społeczno-politycznych przez klasycznych teoretyków liberalizmu – B. Constanta i A. de Tocqueville’a – w kontekście nowoczesnych międzynarodowych procesów politycznych. Do badania wykorzystuje metody analizy porównawczej i historycznej, a także kulturowe i aksjologiczne podejście do badania sfery ideologicznej i politycznej. W efekcie pokazuje, że starożytne rozumienie wolności nie miało znaczenia dla społeczeństwa XIX wieku. Podobnie jest w przypadku wciąż żywotnej klasycznej interpretacji wolności B. Constanta, która jednak nie jest już adekwatna do potrzeb społeczno-politycznych osób żyjących w XXI wieku. Dzieje się tak, ponieważ całkowicie nie uwzględnia ona nowej sfery ludzkiej działalności – wolności i prywatności w cyfrowym świecie. Uznając wartość demokracji, autorka zwraca uwagę, że dziś bardziej adekwatne do zrozumienia procesów politycznych jest podejście A. de Tocqueville’a. Na przykład powyborcza wojna informacyjna w Stanach Zjednoczonych w 2020 roku pokazuje znaczenie specyficznego rozumienia demokracji Tocqueville’a jako głębokiego procesu całkowitego rozprzestrzeniania się równości. Stwierdza się, że wartości polityczne znane współczesnemu dyskursowi często są interpretowane nieadekwatnie do rzeczywistości, ponieważ zrozumienie naukowe jest relatywnie stałe i z tego powodu niedotrzymujące tempa szybkiemu rozwojowi technologii informacyjnych, globalizacji i wirtualizacji.

The above article illustrates the argument between Herbert Lionel Adolphus Hart and the issue of liberty as it was depicted by John Rawls. Rawls in his Theory of Justice claims that justice requires that every person enjoys the greatest possible liberty which is possible to reconcile with the liberty of other people. Following such a principle it may be assumed that liberty can only be limited in the name of the liberty of others. H.L.A. Hart does not share such a standpoint. He points out that liberty can be limited not only because of itself, but also due to some social and economic progress. Moreover Hart claims that the idea of liberty presented by Rawls differs from his point of view concerning the possible limitation of the law of property. In fact Rawls admitted that his deliberations in his subsequent work, namely The Political Liberalism, arise from the critical view of Hart presented in his work Rawls on Liberty and its Priority.

The aim of the research is to confirm whether “God’s Not Dead” (2016) production is an adequate portrayal of religious liberty of school officials in present-day K-12 schools in the United States. The author limited the discussion to the essential problem questions inspired by the production, such as teachers’ right to express their religious views both in the formal setting of a class discussion, and out-of-class informal exchange with students and fellow faculty members. The problem was discussed against the backdrop of selected legal and legislative acts that determine the scope of teachers’ religious expression, such as selected courts’ decisions, official federal guidelines issued by the Department of Education as well as the guides published by non-government organizations. The results of the Bible Literacy Project as well as interviews with several school officials were utilized to further verify the basic concepts of the research. The source texts were analyzed using a close reading method. The study seems to prove that due to the complexity of the legal system as well as the discrepancy between the lines of decisions reached in lower courts it difficult to unambiguously assess the probability of the scenario featured in the movie. However, observable trends in case law and governmental control over teachers’ in-class speech appear to imply that the script is definitely accurate in its portrayal of a legal liability of teachers, and possibly less so in respect of the favorable outcome of the dispute.

The main goal of this paper is to reconstruct David Hume’s theory of action from the perspective of the second book Of the Passion in his work A Treatise of Human Nature. My paper will proceed in three steps. In the first part I present the main assumptions of Hume’s views on action together with a general outline of his theory. I show that for Hume action has a uniform character and that there is a constant relation between action and the motive which can be understood as desire or aversion. Next, in the second part, the main elements involved in the process of human activity will be outlined, such as: passions, will, liberty, and reason. Although Hume emphasizes that the passions are the main motive of action, since they have the power to initiate and withhold action, reason also plays an important role. In order to come to a better understanding, I will consider the functions which these elements are playing in human action and some of the problematic issues which are connected with them such as, whether each of the passions can motivate a person to action, what the relationship between passions and will is, and what kind of relation between passions and reason can be found. Finally, in the third and last part of my paper, I will conclude with a schematic outline of human action and the relation between different components engaged in the process of action.

The article presents history of liberty in the past and contemporary liberal thought. This article grounds that creators of liberalism passed by a long way to define precisely the phenomenon of liberty. When creators were closer to the present day, they tried to separate liberty from metaphysics and morality with reference to the ideals of democracy. However, they confused the cult of equality with the liberty to show that the truth always must be at liberty’s service. But the liberty should be understood like a competence to realize person’s rights. Not till then, liberalism will conceal the historic and present–time demons.

Drawing on Aristotle this paper contrasts two conceptions of liberty – one, as ‘ruling and being ruled in turn’, the other as ‘doing what one likes’. It claims thatAmericacan be said to have had two foundings. The first was that of the Puritan settlers who adopted the notion of self-government and self-restraint; the second, ‘official’ founding heavily influenced by the social contract philosophy of Locke who understood government as existing only to secure our rights and advance our individual freedom.  Unlike the first understanding it does not seek to foster conditions in which our souls are educated in self-government. The author concludes that the future of American democracy will depend on which of these two conflicting conceptions becomes the dominant understanding ofAmerica’s liberty.
