This paper refers to the accurate usage of the word “Eurasian”, which is tightly connected with Russian Eurasianism, an intellectual movement that existed in the Interwar period, in the years 1921–1939. Nowadays, the concept of “Legal Culture” is rendered banal by comparative legal thinkers, who reduce it to legal tradition or even the legal system as a social system. In contrast to these theories, the Eurasianist jural project was mostly culture-oriented. For instance, the Eurasianist idea of Language Union, provided by Nikolai Trubetzkoy and the famous linguist Roman Jakobson, could be useful for developing a new concept of Legal Union instead of the idea of legal family. Piotr Savitzky’s notion of “Mestorazvitie”, Jakobson’s “method of linking”, and Nickolai Alekseev’s idea of “Right-Duty” could be very fruitful concepts for establishing cultural jurisprudence.

This article shows the basic European Union and national regulations with regard to international shipments of waste, such as the Resolution No. 1013/2006 and the Act of 2007 on international shipments of waste in Poland. Procedures which may decrease the negative infl uence of waste on the environment, especially during shipments of hazardous waste, play an important role in this area. For the observance of these procedures, the penal sanction system is useful because it prevents illegal activities in this area. However, an analysis of the statistics of the Supreme Chamber of Control and Police shows that the effectiveness of criminal instruments is not very high. This is evidenced by the low percentage of proceedings under Article 183 of the Penal Code as well as by the poor detection of offenders, and despite the increase in the number of convictions imposed by courts of general jurisdiction, criminal penalties are too lenient.

Argument Principle of irremovability of judges is a norm of judicial independence not only in the EU framework but also in the international level.Judges of the Supreme Courts or the Constitutional Court are still removed even in the modern and developed countries. It is deeply related to the lack of independence of the judiciary in Europe and beyond Europe too.  Results and Conclusion The results of the work can be applied in some countries that have not linked  each other with regional integration policy ( like Myamar and ASEAN Countreies). The functions of the Constitutional Court are needed to be updated to protect the fundamental rights effectively in national level and the judiciary should be free from the influence of the legislature and the executive. Cognitive value To learn the best solution for the reconcilement among the three great branches of the government, especially to respect the independence of the judiciary and the principle of irremovability of judges widely accepted as not only international standards but also EU noem.

The aim of this article is to discuss the dilemmas over the integration of accounting in EU member states. The dilemma could be divided into the following main groups. Dilemma of the user of financial statements. This dilemma consists in determining for whom the integration of accounting in EU is crucial, and who is the intended beneficiary of integration. Dilemma arising from the lack of theoretical framework for drafting directives and standards: the accounting paradigm assuming that accounting is strictly quantitative. Accounting is a social science, whereas the accounting practice has greater influence on social, rather than purely economic, reality. Dilemma over legal regulations and the legitimization of standard setters could be attributed to accounting regulations as legal norms. A classic example of this might be the transition from rule-based to principle-based IFRSs. The dilemma over the legitimization of standard setters has its roots in the legal aspect of accountancy. In order to solve it, it is necessary to answer the question: ‘who controls the processes of accounting integration?’ since the participants of this process often present divergent viewpoints, and sometimes even opposite priorities. Dilemma over the politicization of accountancy. The more globalized and complex the economic environment is, the more of political intervention there is expected to be in the standard setting process, affected by global geopolitical trends.

Pandemic-induced economic shocks saw the European Commission and national competition authorities adopt so-called comfort letters to provide guidance, assurance, and legal certainty to undertakings in order to help mitigate the detrimental effects of the crisis. Whereas it is true that desperate times may call for desperate measures, the fact that the Commission continues to issue comfort letters for initiatives with little relevance to the ongoing emergency raises questions. This article analyzes the re-emergence of comfort letters from the viewpoints of legal basis and certainty. It finds that the foundations upon which the letters are constructed are shaky, which translates into the fostering of uncertainty. In that regard, explored are alternatives for Union enforcers to deploy a robust bespoke guidance regime for the future.
Les chocs économiques induits par la pandémie ont amené la Commission européenne et les autorités nationales de la concurrence à adopter des lettres dites de confort pour fournir des orientations, des assurances et une sécurité juridique aux entreprises afin de contribuer à atténuer les effets néfastes de la crise. S’il est vrai que les temps désespérés appellent des mesures désespérées, le fait que la Commission continue à émettre des lettres de confort pour des initiatives peu pertinentes par rapport à l’urgence actuelle soulève des questions. Cet article analyse la réapparition des lettres de confort au regard de la base juridique et de la certitude. Il constate que les fondements sur lesquels ces lettres sont construites sont fragiles, ce qui se traduit par un encouragement à l’incertitude. À cet égard, cet article explore les alternatives pour les autorités chargées de l’application de la législation de l’Union de mettre en place un solide régime d’orientation sur mesure pour l’avenir.

An approach to the translation of deontic modality in legal texts. The case of the Polish and English versions of the Charter of Fundamental Rights of the European UnionThe co-existence of twenty-four legal languages in the European Union is guaranteed by the basic principles of EU language policy, stated in its founding treaty. Indeed, every EU citizen has the right to communicate with the EU in the official language of their choice, and to receive a reply in the same language. Such a situation is reflected in legal multilingualism, which presents challenges for both linguists and translators.One of these challenges is the translation of deontic modality. This article focuses on how deontic modality is expressed in the Polish and English versions of the Charter of Fundamental Rights of the European Union. The form and usage of modal forms which express deontic possibility (i.e. permission) and deontic necessity (i.e. obligation) are highlighted, as well as the similarities and differences between the two parallel texts. The differences between the modal forms in the two versions of the text have consequences regarding the degree of both the subject’s and addressee’s commitment to norms and regulations.This article aspires to contribute to the study of deontic modal language, which is considered to be one of the central linguistic phenomena most in need of explanation. Tłumaczenie modalności deontycznej w tekstach prawnych na przykładzie polsko- i anglojęzycznej wersji Karty praw podstawowych Unii EuropejskiejWspółistnienie dwudziestu czterech języków oficjalnych Unii Europejskiej gwarantowane jest przez podstawowe zasady przyjętej przez nią polityki językowej, których podstawy zawarte są w traktatach założycielskich. W ich wyniku każdy obywatel UE ma prawo nie tylko do komunikowania się z organami UE w wybranym przez siebie języku urzędowym oraz do otrzymania odpowiedzi w tymże języku, ale również do tego, aby całe prawo Unii Europejskiej tworzone było we wszystkich 24 językach urzędowych. Wspomniane założenia stanowią jednak ogromne wyzwanie zarówno dla tłumaczy, jak i lingwistów.Teksty prawne składające się na system prawa Unii Europejskiej, sporządzone w 24 językach urzędowych UE, zawierają w sobie wypowiedzi, których immanentną cechą jest modalność. Jednakowe wyrażenie wspomnianego elementu modalnego wydaje się jednak szczególnie trudne w procesie redagowania wielojęzycznych tekstów prawnych.Niniejszy artykuł poświęcony jest zagadnieniu sposobu wyrażania modalności deontycznej w polskiej i angielskiej wersji Karty Praw Podstawowych Unii Europejskiej. Przeprowadzone badanie pozwoliło na wyodrębnienie poszczególnych form językowych będących nośnikiem odpowiednio możliwości (dozwolenie) oraz konieczności (nakaz i zakaz) deontycznej. Wykazane zostały ponadto zaobserwowane różnice i podobieństwa pomiędzy dwoma równoległymi wersjami językowymi wspomnianego dokumentu. Na uwagę zasługują zwłaszcza te ostatnie ze względu na ich potencjalne konsekwencje wynikające z różnego stopnia zobowiązania się zarówno podmiotu, jak i adresata dokumentu do przestrzegania wynikających z niego norm.Celem artykułu jest przyczynienie się do rozszerzenia badań nad środkami wyrażania modalności deontycznej, stanowiącymi jedno z głównych zagadnień lingwistycznych wymagających głębszej analizy i opisu.

The aim of the article is to attempt to identify the state of, and prospects for, the development of the common policy of the European Union regarding legal migration from third countries. The subject of interest is, above all, legal economic migration, which is crucial from the perspective of certain demographic processes taking place in the EU, the changes and needs of the Community's labour market, and the challenges posed by the digital transformation. The adopted hypothesis assumes that, within the framework of EU migration and asylum policy, policy as regards legal economic migration is still an underdeveloped area and remains in the hands of individual Member States. Initiatives undertaken in this area remain overshadowed by the main focus of the common migration and asylum policy, namely the development of a common asylum system and the prevention of irregular migration. Policy regarding legal economic migration in the near future will mainly be created by Member States and play out on the domestic stage due to the lack of direct motivation for its development at the Community level. In this case, the strength of particular stakeholders' interests is not balanced out by any direct and easily identifiable benefits to be gained from the adopted common solutions.

The world is shaken by many new developments. In this turbulence, the EU should provide an area of stability and security. It can only be so in case its internal cohesion is strengthened. The EU is a community based on values. Members have committed themselves to respect European values. But in case of a breach of the contract the Union has only two means to enforce respect for its values. Some have a legal character, others a financial one. The legal method is not very effective in this respect. This paper deals with the financial method. It argues that the conditionality of the budget needs to be increased; non-respect of values by Member States should entail loss of allocations. The recent proposals of the European Commission in this matter fall short of this.

The article tackles the political and legal environment within the borders of the European Union (EU) member states. Determinants of the political and legal environment of the European market were identified on two levels: (1) the framework, i.e. supranational European political and legal conditions; (2) the classical political and legal environment of the EU member states. Afterwards, an analysis of individual factors of the political and legal environment in the aforementioned levels was performed. Four legal areas in the EU states were demonstrated: Roman, Anglo-Saxon, Germanic and mixed; three jurisdictional systems were identified: case law, continental and Scandinavian law; and the legal framework of the Union was found to consist of primary legislation, secondary legislation and adjudications of the Court of Justice of the EU. The problem of excessive duration of the administrative procedures, untimeliness and incomplete transposition of directives into the national law of the member states was discussed. It was also brought to attention that the diversity of laws and taxes is still a significant barrier to foreign operations of businesses in the EU internal market. It was also indicated that the integration of European law enables economic entities to perform marketing activities in the European market in the form of a representative office or a foreign branch without legal entity. Finally, it was stated that the factors of the political and legal environment are significantly unified in the supranational environment, while in the classical environment, there are some differences among the EU countries, but they allow for the use of unified marketing concepts, e.g. the concept of euromarketing.

As Britain has voiced her opinion on the continued membership in the European Union and expressed her wish to leave its structures, it seems essential to provide an understanding of the impact of its exit in the legal and constitutional context. The following paper aims at presenting the background to the ‘in or out’ referendum on the UK’s membership in the Union, the complexity of the exiting route, the most immediate legal and constitutional consequences of the decision as well as the possible future implications in the internal UK’s relationship between the devolved nations. The article bases on a body of papers and analyses provided by several British and foreign institutions and authors published both before the June (2016) referendum was held and afterwards and attempts to examine the kingdom’s rights in revising its deal with the European Union, the outcome of the popular vote as well as its possible implications of the new situation.
W sytuacji, gdy Wielka Brytania wyraziła swoją opinię odnośnie dalszego członkostwa w Unii Europejskiej i zdecydowała się na opuszczenie jej struktur, wydaje się niezbędne, aby wyjaśnić, jakie są konsekwencje tej decyzji w kontekście prawnym i konstytucyjnym. Niniejszy artykuł ma na celu przedstawienie tła referendum w sprawie członkostwa Wielkiej Brytanii w Unii, złożoności procedury wyjścia, najbardziej widocznych konsekwencji prawnych i konstytucyjnych, jak również ewentualnych przyszłych implikacji tej decyzji w zdecentralizowanym królestwie. Artykuł bazuje na szeregu dokumentów i analiz autorstwa brytyjskich oraz zagranicznymi instytucji i autorów opublikowanych zarówno przed czerwcem (2016), kiedy odbyło się referendum, jak i po. Przedstawia przyczyny dokonania rewizji kontraktu z Unią Europejską, wynik powszechnego głosowania i możliwe konsekwencje nowej sytuacji.

At present, the main legal act concerning placing plant protection products on the market and ensuring the safety of plant protection products use is the Directive 91/414. It will soon be replaced. The following legal acts aiming to increase safety of the use of plant protection products have already been adopted or will be adopted in future in the European Union: - The Thematic Strategy on the Sustainable Use of Pesticides; - Directive of the European Parliament and the Council establishing a framework for Community action to achieve a sustainable use of pesticides; - The Regulation of the European Parliament and of the Council concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC; - Directive of the European Parliament and the Council laying down essential environmental protection requirements for the placing on the market of new pesticide application equipment and accessories. The provisions of new legal documents are presented in the paper and the possibility of their implementation in Poland is discussed briefly.

Drawing upon the methods of qualitative source analysis and process tracing, the study addresses the following research questions: How was the national legislation of consolidated democracies positioned to neo-militant democracy measures during the recovery from the great financial crisis (2007–2009)? To what extent was democracy prone to authoritarian abuse depending on a neo-militant democracy rule implementation? It advances arguments to reject Carlo Invernizzi Accetti’s and Ian Zuckerman’s hypothesis that if the freedom of political actors is restricted through militant democracy measures, democracy becomes more prone to authoritarian abuse in the long run. In the founding states of the EU, neo-militant democracy measures functioned in the legal structures long before the outbreak of the great financial crisis, during the crisis (2007–2009), and in the period of recovery. The states restricted democratic freedoms of speech, the press, association, and assembly. Belgium, Luxembourg, and Germany also limited organization in political parties. Moreover, during the recovery from the crisis, that is, a period of particular vulnerability of democracy to authoritarian abuse, the lists of relevant precautions were extended in France, Italy, and Germany. In these states, strengthening neo-militant democracy measures was neither a factor undermining democracy nor making it prone to drift towards a hybrid or authoritarian regime.

This article focuses on the phenomenon of Transnational Company Agreements (TCAs) concluded between the employees’ representatives and the employer. This legal embodiment of industrial relations has been gaining noticeable popularity since the 1980s. After that decade, many agreements, both of international and European dimension, have been concluded. The European social dialogue doctrine has adopted TCAs as an instrument promoting collective bargaining. Agreements signed in the absence of legal framework comprise a variety of content and might be signed by several actors. Sometimes agreements undergo a follow-up implementation and then they strongly resemble the national collective agreements. But, in general, TCAs exert variable legal effects depending mostly on their character. Many agreements have been attributed solely with a political character, whereas others do convey strong obligations for the parties.
