Opis:
The integration of legal systems in European is one of the most important issues. This process has started by the fact that there are significant differences between the civil law and common law system and between the legal families in it. A law (at domestic or international level) should not be viewed against the backdrop of the historical, political, cultural, social and economic context in which they function. In order to shed further light for our readers, we analyze by emphasizing the significant differences between the civil law and common law system on one side and the legal families that are part of the same legal system, either “Civil” or “Common,” on the other side. The Europeanization of law refers to the communization of the law by EU institutions and to a process that aims at creating a common Europe legal system. In the end, either in medium or long term, the Europeanization is contributing to the so-called non-mandatory or soft harmonization of private law. It is in the best interest of the EU to seek adequate judicial instruments to accommodate the massive numbers of laws deriving from different Civil Law and the Common law systems.

This paper refers to the accurate usage of the word “Eurasian”, which is tightly connected with Russian Eurasianism, an intellectual movement that existed in the Interwar period, in the years 1921–1939. Nowadays, the concept of “Legal Culture” is rendered banal by comparative legal thinkers, who reduce it to legal tradition or even the legal system as a social system. In contrast to these theories, the Eurasianist jural project was mostly culture-oriented. For instance, the Eurasianist idea of Language Union, provided by Nikolai Trubetzkoy and the famous linguist Roman Jakobson, could be useful for developing a new concept of Legal Union instead of the idea of legal family. Piotr Savitzky’s notion of “Mestorazvitie”, Jakobson’s “method of linking”, and Nickolai Alekseev’s idea of “Right-Duty” could be very fruitful concepts for establishing cultural jurisprudence.

The article is a brief analysis of the legal understanding and functioning of the concept of "family office" at the present time. In the work, the author starts from the definition - what is a "family office", gives statistical data on the organizational forms operating in this way, discusses the specifics of the "family office", the identification of the "family office" against the background of the Polish Law on Foundations and the Law on Investment Funds and Management of Alternative Investment Funds, and addresses the issue of conflicts of interest of the "family office" arising from the Law on Investment Funds and Management of Alternative Investment Funds. The work answers the question - whether in Poland it is possible to create "family office" entities by wealthy families similar to such entities in Western countries.

Opis:
Research background: Comparing to larger businesses, SMEs encounter more problems in their operations. Since innovativeness enables SMEs to be more competitive against their rivals, having more innovative activities might make SMEs overcome these issues. Nevertheless, depending on businesses-founders/owners' characteristics, SMEs' innovativeness in organizational, local, and global extents might differ. Purpose of the article: This research explores differences in family-owned SMEs' innovativeness regarding the age of their founders/entrepreneurs, legal form, and succession of these businesses. Methods: The researchers used a questionnaire survey. Data collection process was completed in 2020. The research sample includes 343 family-owned SMEs that operate in Czechia. The normality test result directs the authors to perform an Independent sample T-test to find differences between selected variables. Findings & value added: According to the obtained results, global innovativeness does not differ depending on firms-owners/entrepreneurs' characteristics. However, limited liability firms perform better in local innovativeness than other firms structured in different legal forms. Moreover, the organizational innovativeness of SMEs with successors is greater than firms without successors. While organizational innovativeness does not differ depending on entrepreneurs/founders' age and legal structure of businesses, local innovativeness does not differ depending on entrepreneurs/founders' age and successors' existence in these businesses. The educational level of entrepreneurs/founders, sector, and SMEs' location might be reasons for similarities and differences between SMEs' innovativeness. From the policy perspective, based on the obtained results, the authors suggest creating industrial zones. Furthermore, policymakers' collaborations with other essential players in the market might stimulate innovative attitudes among businesses. This paper's main contribution to the existing literature is to fill the gap regarding organizational, local, and global innovativeness of family-owned SMEs by providing detailed and empirical results about entrepreneurs' and firms' characteristics. Thus, this paper might draw businesses, policymakers, academicians, and international readers' attention concerning family-owned SMEs' innovativeness.

The aim of this paper is to have a look at some institutions of civil law and family law in the light of the requirements of the Convention on the Rights of the Child, on the occasion of the 30th anniversary of this Convention. The child’s incapacity or limited capacity to act, the child marriage and the child’s right to be heard shall be envisaged from a legal historical perspective with a special regard to the age-limits and the modifications of these age-limits on the field of civil law and family law. The subject of the historical overview is the concerned regulations of Hungary, namely the changes in the Hungarian legal rules and the regulations of the effective Hungarian Civil Code which entered into force in 2014. The paper would like to provide a guide for a travel from the end of the nineteenth century to today’s legal rules on the field of age-limits in connection with the above-mentioned institutions which designate the child’s legal position concerning some children’s rights. Some issues of the judiciary concerning the child’s right to be heard in family law proceedings will be mentioned as well to highlight a problem of the everyday legal life. The final aim of this historical travel is to discover whether the discussed legal rules being in force today meet the requirements of the Convention on the Rights of the Child and to compare the legal attitude behind the effective legal rules and the attitude of the child-focused thinking, which shall be also analysed.

Both in the Universal Declaration of Human Rights (Art. 16) and in the European Convention on Human Rights (Art. 12), the right to marriage is perceived and defined as a fundamental human right, as it was in fact enounced both by jus divinum and by jus naturale. Among other things, from the texts of the legal instruments, of prime importance to the nations of the world, one can note that a marriage can be concluded only between a man and a woman, and only if the following indispensable conditions are met, namely: a) the marriageable age laid down in the national law; b) the mutual consent of the future spouses; c) that the race, nationality or religion of the future spouses are not taken into account. Therefore, a valid marriage is concluded only by the persons of different sex (man and woman), and not by the people of any sex, as the Treaty of Nice (2000) stipulated. In the article, we also highlighted the fact that the right of a man and a woman to have a family is ontologically bound with the marriage. This reality proves in fact, once more, that the marriage and the family were and remain “two main institutions of the mankind.”

Zasadniczym założeniem i celem tak sformułowanego tematu, jest próba wykazania szczególnego statusu oraz wyjątkowej pozycji społecznej: tak małżeństwa jak i rodziny; zwłaszcza w Kościele, w Państwie i narodzie. Ich zaś szczególna pozycja społeczna ma swoje źródło w ich naturze oraz w powołaniu, które swoiście wyrażają właściwe im prawa i obowiązki, mające prowadzić do realizacji ich celów. Innym szczególnym spoiwem, jaki je łączy (małżeństwo i rodzinę) między sobą, jest realny postulat budowy rodziny, na legalnie zawartym małżeństwie.
The fundamental premise and purpose of the subject so framed is to demonstrate the special status and unique social position of both marriage and family, especially in the Church, state, and nation. Their distinct social position stems from their nature and vocation, the latter being manifested in their rights and duties intended to help achieve their goals. Another specific bond that binds them (marriage and family) together is the actual desire to establish a family on the foundation of a legally contracted marriage.

The article contains an overview of the rules relating to the scope of application of the EU private international law regulations. It addresses the treatment of the relevant preliminary questions, with special reference to the Succession Regulation. The issues are discussed in three steps. The first is connected with the way of interpreting the notions and concepts, such as marriage, adoption, legal capacity etc., where such matters as personal status, legal capacity or family relationship may come to the foreground as a preliminary question. The second is dealing with the law applicable to the preliminary question. The author compares pros and cons of the “independent reference” (lex fori) and the “dependent reference” (lex causae) solutions, considering the latter as less effective, producing more negative consequences. The third step embraces questions relating to the jurisdiction with respect to preliminary question.

The study presents the current legal regulations and problems with the implementation of procedural rights of a minor victim in the case of crimes committed by members of his family in the Polish legal system. The presented issue concerns the necessity to apply provisions contained in various acts, both public and private law. The author discusses the most important judgements of Polish jurisprudence in the indicated scope, emphasizing, however, that many aspects of the discussed issues, of a procedural nature, have still not been regulated. The conclusions include de lege ferenda postulates concerning, i.a., the transfer to the criminal court of the competence to appoint a guardian ad litem for disadvantaged minors.
W opracowaniu omówiono aktualnie obowiązujące regulacje prawne oraz problemy dotyczące realizacji uprawnień procesowych małoletniego pokrzywdzonego w przypadku przestępstw popełnionych przez członków jego rodziny w polskim porządku prawnym. Przedstawiona problematyka dotyczy konieczności zastosowania rozwiązań zawartych w różnych ustawach, o charakterze zarówno publiczno-, jak i prywatnoprawnym. Autor omawia najważniejsze rozstrzygnięcia polskiego orzecznictwa we wskazanym zakresie, podkreślając jednak, że wiele aspektów poruszanej problematyki, o charakterze procesowym, wciąż nie zostało uregulowanych. W konkluzji zamieszczono postulaty de lege ferenda, dotyczące m.in. przeniesienia na sąd karny kompetencji ustanawiania kuratora procesowego dla małoletnich pokrzywdzonych.
