This article discusses the concepts of “justice” and “injustice” in Shakespeare’s two plays: Merchant of Venice and Measure for Measure. The application of laws and its effects on the social life are the basic themes of this study. Shakespeare concluded these plays so masterfully and open endedly that it is now reader’s responsibility to decide whether the court and society are “just” enough. This study tries to give some examples from both of the plays admitting that the concept of “justice” is hard to define. The conclusions will shed further light on the discussion about the justness of Shakespearean plays.

The author of the article refers to two judgements of the Court of Justice of the European Union, which relate to the principle of the reversal of the burden of proof in anti-discrimination cases. She focuses on the facts, from which it may be presumed that there has been discrimination. The paper discusses issues of the validity of aesthetic judgements in the concept of George Santayana, the author of The Sense of Beauty and Reason in Art. Although Santayana places aesthetic experience as well as experience as such at the center of his analyses, and explicitly opposes the view that aesthetic judgements are supra-individual, I endeavor to demonstrate that his concept is not necessarily contrary to the achievements of 18th-century aesthetics proclaiming the validity of judgements of taste (Shaftesbury, D. Hume, E. Burke or I. Kant). It is true that Santayana’s multifaceted understanding of beauty reveals the limitations of Kant’s aesthetics, but nevertheless, it does not contradict its achievements. The differentiation he made between the beauty of matter, form, and expression suggests a dual meaning of the validity of aesthetic judgements, on the one hand pointing to their universality while on the other referring to the ideals of reason whose sensual representation is available in works of art.

Drawing on the work of Ricoeur, this paper contributes to theorisation of the organisational field in understanding of how structural power operates through professional langue in shaping a construction of individual judgement in professional service firms. As Ricoeur argued that judicial sense may be envisaged as one of the best examples of hermeneutic application (1991: 493), I explore practitioners’ sense making and their interaction with the surrounding structures and its discourse, learned and assimilated during the formative years in the context of audit practice. The interviews-based story provides an illustration of (1) the processes of socialisation that are geared towards conceptions of what constitutes professional best practice, where the professional learns to use judgement and follow structure in particular ways (a perpetuated myth of best practice), and (2) the effects of such formation on the working process. The paper contributes insights into organisational theory in areas of negotiating a balance between institutional requirements (structural conditioning of professional epistemology) and technical demands of hermeneutic function (purposive expert activities) in decision making process. The paper concludes that practitioners assume the appearance of professionalism by adopting a particular professional langue where judgement becomes normative in its own terms. These re-production processes in accordance with organisational frames of references for action may be in opposition to the decisional autonomy, where there may be a space for simultaneously creating (agency) and sharing (structure) on the job. The study reveals that professional langue itself is a place of prejudice and bias on the job.

In a letter published on March 30, 2021, 24 world leaders have called for global solidarity in the fight against the Covid-19 pandemic. This commitment to act in solidarity with low-income countries however was won under duress, and it was in part at least self-serving. Can this still be called solidarity? On the basis of a functional view on solidarity the paper argues that states can indeed act in solidarity, if they accept costs to assist others with whom they recognize similarity in a relevant respect. States can act in solidarity, or they can fail to act in solidarity, also in situations of duress and if solidary acts also serve their own interests. The paper concludes that if this is true for the Covid-19 pandemic it is also true for the climate crisis, where damage of even much bigger dimensions are to be prevented. Also in regard to anthropogenic global heating, nobody is safe until everyone is safe.

Recently Polish courts have started to attach bank accounts of foreign embassies for the purpose of enforcement of judgements against embassies of foreign States in e.g. employment cases. The courts have applied the same principle to jurisdictional State immunity and immunity from enforcement and recognized that if state activities giving rise to the claims examined by courts were of private-law character, they are not protected either by jurisdictional or enforcement immunity. This standpoint is contrary to the dominant trend in other states’ practice, confirmed by the International Court of Justice in 2012 (Germany v. Italy: Greece Intervening). While in the field of jurisdictional immunity, the nature of an act as iure imperii or iure gestionis is decisive, in a case of immunity from enforcement – the allocation of the property against which enforcement measures are sought. Embassy bank accounts are generally covered by immunity from enforcement. In this situation Polish courts should develop convincing and exhaustive reasons why it is necessary for the protection of an individual to overrule the ne impediatur legatio principle. The judgements are not sufficiently reasoned and there is no good argument to support this stance. They expose Poland to international liability.

This paper explores the relationship between common sense and taste in the history of aesthetic thought. “Common sense” guarantees the communication of tastes through different modalities. It can either facilitate agreement among individuals, fostering mutual understanding and envisaging a universal aesthetic community, or provoke disagreement. In the former scenario, common sense is literally common to everyone, while in the latter case, it implies diversity and dissensus. By associating the concept of taste with judgement and the sensible (Arendt and Rancière), we scrutinize some contemporary political interpretations of Kantian aesthetics. Through this analysis, we illustrate that common sense is intertwined with certain metaphysical assumptions that not only hinder its claims of universality but also introduce structural paradoxes within the system of aesthetic judgment. In the last section of the article, we explore these paradoxes, proposing another communicability beyond the confines of the judgment of taste or subjective limitations.

In this paper free volitions are construed as a subclass of reflective judgements in the Kantian meaning, i.e. judgements not involving any fixed concepts but displaying a concept-like form. Judgements expressing volitions and issuing in action may be termed volitional judgements, therefore free volitions are construed as reflective volitional judgements. Due to an element of conceptual novelty and the fact that in a reflective judgement volition gets conceptually fixed out of an unstable equilibrium between different conceptualizations, free volitions thus construed seem to be apt candidates for causally undetermined events.

W Kościele rzymskokatolickim władza sądownicza stanowi część władzy rządzenia, która zgodnie z kan. 135 KPK dzieli się na władzę ustawodawczą, wykonawczą i sądowniczą. Funkcja sądownicza zawiera się w sądzeniu, czyli w deklarowaniu i aplikowaniu prawa do pojedynczych sytuacji spornych. Władza ta przypisana jest jako własna papieżowi oraz biskupom, natomiast codziennie i praktycznie jest ona wykonywana w Kościele na sposób zastępczy przez osoby i struktury ustanowione na sposób stały do jej sprawowania, czyli przez Trybunały Apostolskie oraz trybunały biskupie. Jednym z takich trybunałów jest Trybunał Roty Nuncjatury Apostolskiej w Hiszpanii zwany Trybunałem Roty w Madrycie lub najczęściej nazywany po prostu Rotą Hiszpańską. Jest to trybunał zasadniczo apelacyjny i został utworzony na mocy przywileju Stolicy Apostolskiej w XVI w. Przedmiotem artykułu jest komentarz do wyroku, w którym kluczowe jest zagadnienie podwójnego rozpatrywania tej samej sprawy.

By bringing people closer together, the phenomenon of globalisation not only accentuates differences but also it reinforces the sense of identity and belonging. This paradoxical and dynamic picture puts us straight before the challenge as to how to accommodate differences in order to live peacefully together. The gulf between “us” and “them” become more and more visible. The perception we can have of “others” remains deeply shaped by the values and precepts we learn in our respective cultural and educational circles. Yet, because men are not mere cultural products, individual responsibility and rational deliberation play an important role in the ways we approach “others.” In this article, we investigate prejudices as a phenomenon that is in the heart of above-mentioned issues. After a brief investigation into the nature of a prejudice, the paper outlines two main philosophical positions that either rehabilitate prejudices (Hans-Georg Gadamer) or calls for their abandonment (Descartes). The author argues that, despite the good arguments to be found in both positions, the nature of prejudices—as “something not yet knowledge”—puts upon us a kind of “moral and epistemological obligation” to overcome them, in order to do justice to ourselves and to our fellowmen, and construct sustainable and peaceful societies.

The main aim of the author is to analyze the term “moral intuitions”, used in discussions pertaining to moral luck. He presents the contemporary psychological estimation of moral intuitions based on the research of Jonathan Haidt (Social Intuitionist Model) and philosophical moral intuitionism. He claims that these two approaches do not have one subject of interest; hence, psychologists and philosophers study two different phenomena, both of which can serve as grounds for discussion concerning moral luck. However, the author concludes that there are valid reasons to question the normative status of moral intuitions in both psychological and philosophical senses, proving the discussion to be very complicated. On the other hand, he names coherentism as a possible cipher to adequately describe or even solve the problem of moral luck.

After identifying a linguistic difference between the English quantifier most and the Japanese quantifier hotondo ‘most’ we set out to find if the semantic difference between the two would constitute a learning problem for Japanese second language (L2) learners of English. The difference we hypothesized between the two is that English most is considered “more than half,” while hotondo is “nearly all.” As this semantic difference is not explicitly taught in a classroom environment, acquisition by learners would need to take place through experiencing most in contexts where they might receive contextual clues. An examination of a corpus indicated that contextual clues towards such a semantic difference would be unavailable or rarely available. Two sets of experiments (Experiments 1 and 2) were conducted using the Truth Value Judgment Task methodology. The results of Experiment 1 showed that L2 speakers treated most as meaning “nearly all” but that the level of learner proficiency has an effect. The upper intermediate L2 learner group (Experiment 1a) behaved more like the L1 English speaker group (Experiment 1b) than the lower proficiency L2 group (Experiment 1c). Experiment 2, testing Japanese L1 speakers on their interpretation of Japanese hotondo ‘most,’ revealed that while a majority of participants treated hotondo as “almost all,” there was, somewhat unexpectedly, a group of speakers who interpreted hotondo to mean “more than half.” Therefore, although the possibility cannot completely be eliminated that the result of Experiment 1a is due to L1 transfer, if some Japanese learners of English can unlearn the incorrect meaning, then some prior, if not innate, knowledge that makes the process possible must be available to them.

Ethically conducted business has a positive impact on consumer trust, satisfaction and loyalty. eTh aim of this paper is to identify the bank activities that customers perceive as ethical and to what extent they aefct consumer perceived ethicality. eTh binomial logit model applied in this study demonstrates that the honesty of ifnancial advice, use of e-banking services and use of artificial intelligence technology to improve the quality of banking services have a significantly positive impact on consumers' perception of banks in Poland as ethical institutions. Significant variables that negatively inuflence consumer perceived ethicality include gender, education, use of ifnancial advisory services, banks' manipulation of information about financial products and use of personal data against the will of customers.
