Each country which allows for organ transplantation developed legal regula-tions concerning the related procedure the objective of which is to both ensure the safety of the procedure and to prevent trafficking in human organs . There are however substantial differences between the solutions adopted by particular legislators .The most commonly used models include the legal construct of explicit consent (represented by Norwegian legislator) and presumed consent (adopted in Poland) . A half-way model described as a bridge between those two constructs is the gift law construct adopted in the USA .The analysis of particular legal regulations related to transplantology may have an impact on amendments to Polish legislation aiming at an increase in the number of organ transplants .

This article analyzes the role a family play in the context of business and society. Although it may seem obvious enough that this primary group is fundamental for social organization, certain aspects of this impact, which in the end influences ethical development of social actors are described. The article concentrates on such issues as gift, trust and responsibility as the elements that are naturally present in family life. The problem is presented in an interdisciplinary way because the nature of the issue demands and requires it. Engaging the category of family is import ant mainly because it has been underemphasized, and this lack of focus has inadvertently supported the domination of the individualistic perspective in economics and business. Such a paradigm is not only the symptom of short-term thinking but also the proof of narrow and reduced anthropology of the economic actor. Families are where people learn the logic of “gift,” which is as necessary in business as in other social spheres. George Gilder wrote that “capitalism begins with giving. Not from greed, avarice, or even self-love can one expect the rewards of commerce, but from a spirit closely akin to altruism, a regard for the needs of others, a benevolent, outgoing, and courageous temper of mind” (Gilder 1993, p. 21). As such, we should thoroughly examine the role that gift giving plays in the functioning of economy. Secondly, the unique role that a family plays in trust development is presented. According to analysis of Jennifer Roback Morse, familie are where people learn to trust. Thirdly, the ability to trust is analyzed as the background for the development of responsibility, a key to developing an ethical attitude. The findings of the paper should help to diagnose the causes of the responsibility crisis and enrich reflection on business ethics by presenting family life as fundamental element in understanding the nature of economic actor and offering family as a useful perspective to understand the process of ethical evaluation of business activity.

The paper discusses Shakespeare’s preoccupation with the Christian notions of divine love, forgiveness and justice in The Tragedy of King Lear. In my reading I employ Jean-Luc Marion’s phenomenological reflection on the givenness of love and Hans-Urs von Balthasar’s theology of Paschal mystery. I take issue with the Marxist and existentialist interpretations of Shakespeare’s tragedy which prevailed in the second half of the $20^{th}$ century. My aim is not a simple recuperation of the “redemptionism” of the play, but an in-depth consideration of Christian allusions in the play which may tie love and forgiveness to justice and throw light on the ending of King Lear.

Since there are different doctrines of gift, it first provides an overview of anthro-pological, sociological, philosophical, ethical, and religious approaches to the nature of gift. Then, it delineates the essential notes of the gift and its structure, and relates the gift to duties of justice. Finally, it shows that the gift constitutes an anthropological transcendental that helps us to better understand man and his supernatural dimension.

In putting forth a view of economic agents as autonomous individuals driven by self-interest, mainstream economics precludes the possibility of gift. Gift could be found in non-market, “collectivist”, societies, where “informal” norms would include gift-giving. In this context, the paper argues that mainstream views regarding the impossibility of the concept of gift are inaccurate, via an analysis of conceptual and empirical contributions of other social sciences, notably sciences of mankind “par excellence” such as anthropology and philosophy. In particular, the paper shows that critiques of mainstream views that are based on simple contrasts and qualifications do not provide conceptual instruments for a rigorous critique (such as “collectivism”, “informality”, “altruism”). This is also the case with the more “heterodox” views that underscore the unrealistic character of mainstream models of social interactions and norms. The mainstream arguments of self-interest and exchanges, based on expectations of future returns as universal traits of human beings, are indeed not easy to refute, including with the conceptual tools of other social sciences. This paper instead argues that a deeper analysis of concepts such as selfishness, interest, exchange, or the individual yields a more relevant critique of mainstream conceptions of gift—“the interest of whom?” and “exchange shaped by what?” being the pertinent questions. Other social sciences show that these concepts actually always presuppose the pre-existence of societies before that of individuals, and this is expressed by the many facets of the conceptualisations of the act of giving, whether societies are market or non-market ones.

A vital factor governing early modern diplomatic relations was the practice of hospitality. To assure that the embassy began amicably, ambassadors had to be received with generosity. The nature and extent of diplomatic hospitality differed according to the host state, but it often included the offer of housing and victuals. This critical edition of a primary source aims to shed new light on the characteristics of diplomatic hospitality by carefully examining a list of expenses drafted by the Venetian office of the Rason Vecchie. This archival document provides a detailed account of all the food that was supplied to host a Muscovite delegation that visited Venice in 1582. In the first place, the article unravels the qualities and dynamics of Venetian food gifts by contextualising and comparing the source with additional Venetian records. Furthermore, it argues that the type of foodstuffs offered, the amount of money spent on them, and the splendour of festive banquets all communicated strong symbolic and political messages. By focusing the analysis on lists of expenses, the relevance of these documents for the study of diplomatic practices is illustrated. Overviews of financial transactions might seem static and dry accounts at first sight, however, when analysed closely, they reveal a great deal about the day-to-day operation of early modern diplomacy.

At the beginning of the 1980s, Pierpaolo Donati initiated in Italy the relational turn in sociology, while in France Alain Caillé stipulated the anti-utilitarian movement in social sciences. The acronym MAUSS (from Mouvement Anti-Utilitariste en Sciences Sociales) simultaneously refers to the surname of Marcel Mauss, author of the pioneering work on the gift-Essai sur le don. This movement forms and spreads a new gift paradigm. The notion of the gift has shifted from a specific phenomenon researched in archaic societies towards a basic category for theorizing social order and taking a central position in research on modern transformations. The relational paradigm also focuses on the gift as a crucial aspect of social relations, and on its importance for the civil society. The article traces and discusses various interpretations of the concept of gift, along with the influence of the anti-utilitarian movement and the gift paradigm on relational sociology.

Starting from the modern understanding of giftedness as a domain-specific personality quality, research was conducted to determine the moral competencies of gifted students in different domains and to examine the psychometric characteristics of the adapted version of Moral Competency Inventory - MCI on a sample of 473 respondents. The results indicate that the original four-factor structure has been confirmed and that the MCI is a reliable and valid instrument suitable for application in other educational contexts as well. It was found that students gifted in different domains differ from each other when it comes to integrity and that this property is most developed in students gifted in the field of sports, then music, mathematics, and finally, visual arts. Such results indicate the importance and need for continuous professional guidance and intentional moral education of gifted students.

This article intends to think the concrete reality of the family from the perspective of a philosophical anthropology, based on the biblical-Christian hermeneutic model. At the same time, starting from this particular anthropology, it suggests a general anthropology according to a family matrix. This anthropology is understood as relation of different persons, based on the model of donation. The concrete mode of its accomplishment occurs in family relations, like filiation, fraternity, conjugality and parenthood.
Artykuł stawia sobie za zadanie przemyślenie konkretnej rzeczywistości rodziny z perspektywy antropologii filozoficznej, opartej na biblijno-chrześcijańskim modelu hermeneutyki. Jednocześnie, rozpoczynając od tej szczególnej antropologii, proponuje się antropologię ogólną, zgodną z modelem rodziny. Antropologia ta jest rozumiana jako relacja różnych osób, oparta na modelu darowania. Konkretny sposób jej realizacji pojawia się w relacjach rodzinnych jak synostwo, braterstwo, partnerstwo i rodzicielstwo.

The baptism of Jesus and John, presented in the synoptic Gospels, shows it as an event full of the dynamics of the Spirit. It takes place according to the assumptions of each Gospel and the Acts of the Apostles. In the Gospel of Mark Jesus shares with humanity the same nature that has been subjected to sin. Baptism becomes the beginning of a new saving economy in which it is necessary to bear witness. The essential element of this testimony is the cross which all His disciples have to share with the Lord. The community on the one hand then needs baptism as a way to go out, and on the other, it is strengthened by the gift of the Spirit that leads to the testimony.

This article examines two Dutch diplomatic missions, in 1627–28 and 1635, by which the United Provinces intervened in a Polish-Swedish armed conflict in Prussia. The focus is on ‘diplomatic poetics’: the ways in which literature functioned within diplomatic practice, and how that practice (or the ‘diplomatic moment’) was in turn envisioned in literature. The Polish-Swedish conflict was of great interest to the United Provinces, and was elaborately discussed in various Dutch media, as well as in the correspondences of merchants and politicians. The Dutch embassies to Polish territories themselves, meanwhile, inspired a number of literary works, published mostly in the Republic, but also in for example Danzig and Königsberg. These sources demonstrate how early modern literary and diplomatic practices in Europe overlapped and influenced each other. Firstly, German, French and Dutch poems by Johannes Plavius, Simon van Beaumont and Joost van den Vondel illustrate the blurring of the lines between the realms of diplomacy and literature. Poems could function as diplomatic gifts, enabling both personal, intellectual communication and the widespread transmission of political messages. Moreover, Latin and German plays by Johannes Narssius and Simon Dach, and more importantly Latin poems by Simon van Beaumont and Caspar Barlaeus, as well as an illustrated Dutch account of the first mission by Abraham Booth, reveal that the Dutch envoys featured in literary narratives as both wise peace bringers and travelling poets, and their missions to Poland as both arduous ordeals and epic adventures. Much like poetic gifts, these literary reflections on ‘the diplomatic moment’ had public diplomatic agency, simultaneously voicing political opinions and crafting artistic images of the diplomats themselves.

This article is concerned with a phenomenological exploration of Western mysticism, more concretely the mysticism of Saint John of the Cross. The research lies within the context of broader phenomenological inquiries of the phenomenology of the person as well as the phenomenology of the religious experience. The first part briefly outlines the author’s methodological and thematic standpoint. The article then clarifies the basic concepts of ‘distance’, ‘nearness’ and ‘desire’. In so doing, it will be able to present the philosophical conclusions arising from the elaborated perspective: the crucial role of passivity, the question of appropriating identity and the essential character of mysticism. It concludes with an interpretation of mysticism as the most radical experience of interpersonality.
Artykuł jest fenomenologicznym studium mistyki zachodniej, a zwłaszcza mistyki św. Jana od Krzyża. Badania są prowadzone w szerszym kontekście fenomenologii osoby i fenomenologii doświadczenia religijnego. Część pierwsza określa metodologiczny i merytoryczny punkt wyjścia badań. Następnie wyjaśnia się pojęcia „oddalenia”, „bliskości” i „pragnienia”, co prowadzi do sformułowania filozoficznych wniosków pojawiających się w przyjętej perspektywie badawczej: fundamentalne znaczenie „bierności”, kwestię ‘utraty’ tożsamości i istotny charakter mistyki. W konkluzji interpretuje się mistykę jako najbardziej radykalne doświadczenie relacji międzyosobowej.

The article deals with the problem of legal nature of the donation contract with the duty of the donee in favor of a third party in the civil legislation of Ukraine. On the basis of civil law and legal literature the specifics of such contract is revealed, as well as its correlation with other related contracts. Special attention is devoted to the right for claim that the third party gets entitled to due to such contracts.
Artykuł dotyczy charakteru prawnego umowy darowizny w prawie cywilnym Ukrainy, ze szczególnym uwzględnieniem obowiązków obdarowanego na rzecz osoby trzeciej. W świetle norm prawa cywilnego i dorobku doktryny jawny jest charakter omawianych zobowiązań, jak również ich powiązania z innymi umowami. Szczególną uwagę poświęcono uprawnieniu osoby trzeciej do żądania wykonania wobec niej obowiązku nałożonego przez darczyńcę na obdarowanego.
