According to Art. 9 sec. 2 of Regulation (EC) No.861/2007 of the European Parliament and of the Council of 11 July 2007 establishing a European Small Claims Procedure, the court or tribunal may allow written evidence from witnesses, experts or parties to be taken. The Regulation applies to cross-border cases (Regulation of 11 July 2007), i.e., cases in which at least one of the parties is domiciled or habitually resident in a Member State other than the Member State of the court or tribunal examining the case (Article 3). On the other hand, the Act amending the Act - Code of Civil Procedure and some other acts of 5 December 2008 added Art. 505 25. Pursuant to § 1 of this provision: The witness shall testify in writing if the court so decides. In this case, the witness shall make an oath by signing the text of the oath. The witness is obliged to submit the text of the testimony to the court within the time limit set by the court. The provisions of art. 165 § 2, art. 274 § 1 and art. 276 shall apply accordingly. As indicated in the justification for the draft of this legal act: Due to the fact that Polish law does not know the written form of testifying by witnesses and hearing the parties (the exception applies to mute and deaf people, cf. Art. 271 § 2 of the Code of Civil Procedure; this provision applies accordingly to hear the parties pursuant to the third sentence of Article 304), it was necessary to introduce appropriate regulations in this respect applicable to the European Small Claims Procedure.

Opis:
Computer forensics is a key science and competency in meeting the growing risks of cybercrime, as well as for criminal investigation generally. In order to provide irrefutable evidence of a potential crime, a specialist in the incident response team (e.g. an IT forensics specialist) must secure the digital evidence in accordance with the correct procedure. There are no strict guidelines on how to do this. It is known that the authenticity and fidelity of data must be preserved. This article will collect good practices developed by specialists in the field of computer forensics. The process of securing the evidence material from a digital data sources for later analysis will be presented.

This article addresses an issue that is highly debatable both in the theory of civil procedural law and in the practice of jurisprudence, namely the entrepreneur’s right to a court and, consequently, the possibility of respecting the principle of material truth in a separate proceeding in commercial cases in the context of evidentiary limitations introduced by the legislator under the Act of 4 July 2019 amending the Code of Civil Procedure. Due to the fact that eponymous matters are complex and multifaceted, the present article shall describe and signal selected specific issues, which seem to raise the most doubts among representatives of the world of science and practitioners who apply civil law daily.

The main goal of this paper is to discuss the current state of research on horse domestication in prehistory by using selected evidence. This article refers to the steppe origin of horse domestication. Recently, the debate on this problem concerns not only archaeological aspects but also specialist analyses, such as archaeozoology or genetics. The interdisciplinary character of the problems explored in this article creates significant research possibilities, especially with regard to the of origins and dating of horse domestication. All of these issues are still open for debate among archaeologists.

The paper pertains to the comprehensive amendment to the Polish Code of Civil Procedure of 4 July 2019, which covered, among others, the regulations concerning evidence in civil proceedings. The amendment influenced all the aspects of evidence procedure: means of evidence, taking of evidence, as well as its assessment. The author attempted to analyse the amended provisions through the essence of the influence that the evidence procedure has on the entire court examination proceedings, and in particular whether the amendment introduced any provisions improving the dynamics of civil procedure.
Opracowanie odnosi się do obszernej nowelizacji Kodeksu postępowania cywilnego z dnia 4 lipca 2019 r., która objęła m.in. regulacje dotyczące dowodów w procesie cywilnym. Wprowadzone zmiany dotknęły wszystkich płaszczyzn postępowania dowodowego, a więc środków dowodowych, przeprowadzenia dowodów, a także ich oceny. Autorka podjęła próbę analizy znowelizowanych przepisów przez pryzmat istoty wpływu, jakie postępowanie dowodowe ma na całe sądowe postępowanie rozpoznawcze, a zwłaszcza czy wprowadzono do Kodeksu postępowania cywilnego przepisy usprawniające jego dynamikę.

The Article 168a of Code of Criminal Procedure introduces the rule of the permissibility in criminal proceedings evidence obtained under the violation of criminal procedure regulations or as the result of indictable offence defined in Article 1 of Criminal Code. The Article 168a of CCP is highly controversial, especially due to the lack of linguistic precision of its provision and collision with Constitution. The regulation mentioned above is in conflict with the system of evidence-related prohibitions in criminal proceedings. In this context, the freedom expression rule during the interrogation is essential. Its violation results in the prohibition of the use of evidence. Used in the provision of Art. 168a of CCP, word „exclusively” is claimed to be a key for proper resolution of this problem. If interpreted differently, the provision would flagrantly deny the essence and nature of the freedom expression rule during the interrogation

This article analyses the admissibility of evidence gathered by the Polish procedural authorities as a  result of issuing an European Investigation Order, on the basis of provisions implemented due to the adoption on the 3th of April 2014 of the Directive of the European Parliament and of the Council regarding the European Investigation Order in criminal matters. This Directive created a mechanism that allows for transfer of evidence between EU Member States. In this text the question will be answered how to deal with results of investigative measures that have been legally obtained in the executing state but despite acting in accordance with the legality principle by both states, happen to be illegal in the issuing Member State. Another discussed problem is how the rules of admissibility of evidence obtained from the result of issuing an EIO work in Poland – or at least how they should operate. The second discussed issue thus will refer to the current provisions in force in Poland regulating the method of dealing with evidence obtained abroad – that is also with evidence transferred from other Member States. It will be shown that they are unclear and may lead to undesirable results. In addition,  suggested changes in Polish law will be proposed.

New material collected from the Kliphoek Member of the Nama Group (Kuibis Subgroup, Dabis Formation) on Farm Aar, southern Namibia, offers insights concerning the morphology of the Ediacaran organism Pteridinium. Pteridinium fossils previously described as being preserved in situ have been discovered in association with scour−and−fill structures indicative of transport. Additionally, two Pteridinium fossils have been found within sedimentary dish structures in the Kliphoek Member. A form of organic surface with a discrete membrane−like habit has also been recovered from Farm Aar, and specimens exist with both Pteridinium and membrane−like structures superimposed. The association between Pteridinium fossils and membrane−like structures suggests several possibilities. Pteridinium individuals may have been transported before burial along with fragments of microbial mat; alternately they may have been enclosed by an external membranous structure during life.

In addition, the issue of whether the rules on administrative evidence should be changed to cover the use of AI evidence is examined.

This paper presents an approach to assembly planning in the early phase of product development. The product specification, workstation, environment, equipment and tools are not fully known in the early stage of product development. When comparing product variants at this stage there is a lack of data that affects the efficiency of the manufacturing process. It is therefore necessary to apply methods useful in processing incomplete and uncertain data. The main indicator which helps in comparing different product variants is manufacturing time standard. This papier is focused on assembly tool selection which is one of important data influenced assembly time. Based on the proposed algorithm and case study, a tool selection method using a decision tree induced from a training set with reduced uncertainty is presented.

This paper submits that in Shakespeare’s The Merchant of Venice, „this merry bond” (1.3.169) becomes the central artery through which the fates of two friends, Antonio and Bassanio, become intertwined, and Shylock’stragically falls, thereby illustrating how this written evidence functions to disassemble contractual relationships, rather than serve as a prohibition against the commercial corruption, as provided in the Fraudulent Conveyance Act (1571). The essay explores the nature of settlement negotiations and the disparate conditions of bargaining powers by the parties — those which represent the state’s interests and those which represent individual interests. Here, this analysis focuses on the attempts in the play to devalue the trustworthiness of written evidence, particularly contracts, presented at a time where the early modern courts emphasizes the reliability of such evidence, and demonstrates how interpersonal communications intervene as vital legal vehicles within this society.

The thrust of this article is to examine a contemporary international arbitration process in commercial and investment cases, specifically the interplay of common law and civil law elements in the taking of evidence. It begins with a survey of the provisions of the most popular international arbitration instruments, including international arbitration rules and IBA Rules on the Taking of Evidence in International Arbitration. Following the discussion of some relevant examples of international arbitration instruments, the author tries to answer the question whether these instruments, in their current form, support the popular thesis that the international arbitration process has become largely harmonized. In trying to verify this thesis, the article also goes beyond the text of international arbitration instruments and considers the influence of the cultural biases of international arbitration actors.
