Poland is the leading country in pursuing its own citizens under the European Arrest Warrant (EAW), with the number of EAWs issued between 2005 and 2013 representing one third of the warrants issued by all EU countries (although some serious inconsistencies between Polish and Eurostat statistical data can be observed). The data show that Poland overuses this instrument by issuing EAWs in minor cases, sometimes even for petty crimes. However, even though this phenomenon is so widespread, it has attracted very little academic interest thus far. This paper fills that gap. The authors scrutinise the topic against its legal, theoretical and statistical backdrop. Based on their findings, a theoretical perspective is drawn up to consider what the term ‘justice’ actually means and which activities of the criminal justice system could be called ‘just’ and which go beyond this term. The main question to answer is: Should every crime be pursued (even a petty one) and every person face punishment – even after years have passed and a successful and law-abiding life has been building in another country? Or should some restrictions be introduced to the law to prevent the abuse of justice?

This contribution offers an insight into the legal practice of the Aranyosi test during the EAW proceedings in seven Member States, an outcome of the research conducted during the ImprovEAW Project. Only the executing judicial authorities of some Member States do trigger the test. Member States are roughly differentiated between those having facilities with usually bad or usually good detention conditions, promoting antagonistic relationships instead of equal partnership. The lack of streamlining of the communication when supplementary information is requested, the lack of common standards and approach towards guarantees lead to further misunderstandings and frustration. The findings of this research have revealed the importance of departing from a pure legal understanding of mutual trust and follow a more empirical, experiential or bottom-up concept. Mutual trust is not only a legal concept, but it underpins the legal culture of the cooperation and collegial attitudes of authorities towards one another. This expression of mutual trust remains quite undiscovered: how is miscommunication affecting mutual trust? Do judicial authorities of legal systems express collegiality to one another? How do cultural aspects and preconceived ideas regarding the quality of other legal systems influence mutual trust? Accordingly, some suggestions have been made to improve the cooperation and the establishment of rapport when supplementary information is requested. Finally, I advocate for a more neutral view towards the Aranyosi test. As opposed to considering it as a supervisory mechanism, I have explored the idea of approaching it as a risk management tool: it tackles risks created by mutual trust. Such approach helps both sides to take responsibility to avert ad hoc risks, instead of experiencing Aranyosi as a testing moment. Such approach centres the real problem, i.e. the risks created by mutual trust for individuals and it can stimulate more proactive policy-making in this regard.

As stated in the European Convention on Hu- man Rights Preamble, the aim of the Council of Europe is the achievement of greater unity between its members through the maintenance and realisation of Human Rights and Fundamental Freedoms . Nowadays, the European Union includes the majority of the ECHR signatories (27 of 47) and incorporates the key legal instrument of judicial cooperation in criminal matters, namely the European Arrest Warrant Framework Decision . Nevertheless, the possible effects of the EAWFD on the practice of the European Court of Human Rights remain understudied – despite the crucial need to properly balance the enforcement of the principle of mutual recognition and Human Rights protection in the European Union. Since the first attempts to approach the EAWFD, the Strasbourg Court preferred to find the applications inadmissible (Pianese, Monedero Angora, Stapleton) or to establish a very high threshold for establishing a Convention violation within this context (Pirozzi). It will be argued that the newly developing Strasbourg Court’s case-law on the EAWFD (Castano, Bivolaru/Moldovan, Alosa) could potentially mark a new step in the judicial dialogue be- tween two European Courts. In the Castano and Bivolaru/ Moldovan rulings, the ECtHR – for the first time – found that the EU Member States had breached their obligations under Arts . 2 ( ́right to life ́) and 3 ( ́prohibition of torture ́) ECHR within the European Arrest Warrant context (murder/traffick- ing in human beings charges). At the same time, this interpre- tation opens the floor for discussion on potential applicability of other Convention provisions (Arts . 4, 5, 8, 13) to other offences listed in Art . 2(2) of the EAWFD (such as, for instance, corruption, fraud, computer-related crime etc .). Even though the Strasbourg Court has transposed the CJEU’s benchmarks of the EAW refusals legality assessment – i .e . a risk of inhuman or degrading treatment in the requesting State (Aranyosi/Căldăra ru), the EU Member States ́ courts are now forced – de facto – to consider an additional (ECHR-based) criterion for assessing the legality of refusals to execute the European Arrest Warrants. This can arguably pose further questions upon the entry into force of Protocol No. 15 ECHR which aims at the most effective realisation of the ́subsidiarity ́ principle in the European Convention system.

This article focuses on detention pending surrender, i.e. detention of the requested person in the executing Member State on the basis of the European Arrest Warrant (EAW). It defines the scope of application of Article 5 of the European Convention on Human Rights to such detention and analyses the case-law of the Court of Justice of the European Union on time limits of keeping the requested person in detention in the executing MS as well as on the notion of “the executing judicial authority” entitled to decide on detention pending surrender. Both issues are explored with reference to national law and practice of the Netherlands and Poland. The article provides the answer to the question whether national provisions which limit the duration of detention pending surrender properly reflect the normative content of the framework decision on the EAW. The answer to this question is given with due regard to the standard of protection of the requested person stemming from Article 5 § 1 ECHR and Article 6 of the Charter of Fundamental Rights. Furthermore, the analyses focus on Dutch and Polish provisions concerning the authority entitled to decide on detention pending surrender and their compliance with the CJEU’s jurisprudence on the notion of “the executing judicial authority.” Recognising that detention is the basic measure for ensuring the effectiveness of surrender, we try to define the limits of its use in the EAW procedure, stemming from the requirements of protection of human rights.

The authors advocate operational improvement of the European Arrest Warrant system. When applying the judicial cooperation instruments concerning criminal matters, more attention should be devoted to the requirements of proportionality, effective judicial protection, and coherence. The power to issue an EAW should be more circumscribed whereas executing authorities should be allowed more flexibility in the decision making process as far as the execution of an EAW is concerned. The authors conclude by sketching amendments to the legal and practical framework and the efforts required to implement them as well as by addressing the issue of political feasibility.

The article illustrates problems which were encountered by students of the first and second year of English Philology, who had been given a task of translating from Polish into English a passage from a Supreme Court act, concerning the European Arrest Warrant execution. The author who is an active lawyer – working as a prosecutor of the District Prosecutor’s Office – analyzes almost twenty legal phrases coming from the original text and, comparing them with the official version of translation, examines the students’ versions (108 translations altogether) which are then accompanied by descriptions and comments on the mistakes made. The analyzed examples show the uniqueness of the legal language and its pitfalls as well as lexical and syntactic dilemmas which create linguistic traps for a Polish translator who is preoccupied with translation of legal texts from Polish into English or vice versa. Moreover, the discussed cases indicate the need for a highly professional training of philology students, especially in the area of ESP (English for Special Purposes).
Artykuł ukazuje problemy jakie napotkali studenci I i II roku anglistyki, którym postawiono za zadanie przetłumaczyć z języka polskiego na angielski, fragment uchwały Sądu Najwyższego dotyczącej wykonania Europejskiego Nakazu Aresztowania. Autor – czynny zawodowo prawnik – prokurator Prokuratury Rejonowej – analizuje ok. 20 zwrotów prawniczych pochodzących z tej uchwały i, odnosząc się do oficjalnego tłumaczenia tekstu, dokonuje analizy tłumaczeń zaproponowanych przez studentów (w sumie 108 wersji) przedstawiając i opisując zaistniałe błędy. Przeanalizowane przykłady ukazują specyfikę języka prawnego i prawniczego oraz zawiłości i pułapki leksykalno-syntaktyczne, jakie czyhają na polskiego tłumacza zajmującego się przekładem prawniczych tekstów z języka polskiego na język angielski lub odwrotnie. Omówione przykłady wskazują na potrzebę wysoce profesjonalnego szkolenia studentów neofilologii w zakresie przekładu tekstów specjalistycznych.

This paper focuses on the question whether Polish law offers an adequate legal framework for dual representation, as required by Article 10 of the EU Directive 2013/48 and Article 5 of the EU Directive 2016/1919. It explores both perspectives: dual representation in proceedings concerning execution of EAW conducted by Polish authorities as well as the right to appoint a lawyer in Poland by the requested person in a case where the EAW is issued by the Polish authorities. The scope of the ensuing analysis is confined to EAWs issued for prosecution of the requested person. Although both above mentioned provisions of EU Directives have not been transposed into Polish national law, their direct application may ensure full exercise of the requested person’s right to dual representation. Thanks to the fact that, in Poland, the requested person is treated as a quasi-defendant in criminal proceedings, the Code of Criminal Procedure offers a legal framework allowing for appointment of the defence lawyer in Poland as the issuing state.
W artykule podjęto próbę udzielenia odpowiedzi na pytanie, czy prawo polskie oferuje możliwość tzw. "podwójnej reprezentacji", jak tego wymaga art. 10 dyrektywy unijnej 2013/48 oraz art. 5 dyrektywy unijnej 2016/1919. Analiza obejmuje obie perspektywy, to znaczy zbadano zarówno możliwość realizowania prawa do "podwójnej reprezentacji" w postępowaniu w sprawie wykonania Europejskiego Nakazu Aresztowania prowadzonym w Polsce, jak i prawo do wyznaczenia obrońcy w Polsce jako kraju wydania tego nakazu. Rozważania dotyczą jedynie Europejskich Nakazów Aresztowania wydanych w celu ścigania. Chociaż oba wymienione przepisy dyrektyw nie zostały wdrożone do prawa krajowego, ich bezpośrednie stosowanie może zapewnić pełne korzystanie przez osobę ściganą z prawa do "podwójnej reprezentacji". Dzięki temu, że prawo polskie traktuje osobę ściganą jak oskarżonego w postępowaniu karnym, Kodeks postępowania karnego oferuje podstawy prawne do ustanowienia/wyznaczenia osobie ściganej obrońcy w Polsce jako kraju wydania Europejskiego Nakazu Aresztowania.

The paper analyses the grounds for reopening criminal proceedings stipulated in Article 540b of the Criminal Procedure Code. The author argues that, although the aim of the introduction of this provision to the CPC in 2011 was to facilitate the surrender under the European Arrest Warrant of persons pursued in order to execute a sentence issued in absentia in Poland, that aim has not been achieved due to the flaws in the provision indicated in the paper. The start of the time limit running for lodging a motion for a retrial under Article 540b CPC, as well as the optional nature of such retrial have been critically assessed. It has also been proved that the concerns originally expressed in the doctrine that the discussed grounds for reopening of court proceedings may undermine the stability of valid judgements issued in criminal cases did not come to fruition
Artykuł zawiera analizę podstawy wznowienia postępowania karnego wyrażonej w art. 540b kodeksu postępowania karnego. Jak wykazuje autorka, chociaż wprowadzenie tego przepisu do k.p.k. w 2011 r. miało na celu ułatwienie wykonywania europejskich nakazów aresztowania zmierzających do przekazania osoby ściganej do wykonania kary orzeczonej w Polsce in absentia, to jednak ze względu na wskazane w artykule wady tej regulacji cel ten nie został osiągnięty. Krytycznie oceniono uregulowanie początku biegu terminu do złożenia wniosku o wznowienie postępowania na podstawie art. 540b k.p.k., jak również fakultatywność tego wznowienia. Jednocześnie w artykule wykazano, że nie sprawdziły się formułowane w doktrynie obawy, iż omawiana podstawa wznowienia postępowania sądowego spowoduje zachwianie stabilności prawomocnych wyroków wydawanych w sprawach karnych.

An effective implementation of mutual recognition in the Area of Freedom, Security, and Justice requires mutual trust between the Member State. Mutual trust has been eroded in some Member States due to the rule of law crisis. However, it is not only the rule of law crisis, but also the departure of the Member States from the shared values of respect for fundamental rights, as well as the differences in the prosecutorial systems of individual Member States, that have caused changes in the perception of the principle of mutual recognition. This paper will examine the evolving approach to the principle of mutual recognition based on the recent Court of Justice of the European Union rulings on the European arrest warrant. The analysis concludes that the CJEU attaches more importance to the protection of the principle of mutual recognition, the prosecution of perpetrators of crime, and the unwavering presumption of respect for fundamental rights by the Member states than to the effective protection of fundamental rights.
