Before 2013, the term ‘gender’ as used to define male and female social roles had appeared relatively rarely in the public sphere. However, it had not been completely unknown. Whenever this term did occur in utterances of public figures, it was mostly in reference to equality policies (gender policy) and the idea of gender mainstreaming in EU projects. It was commonly associated with feminism and has in this form entered the social consciousness, including the minds of major public figures, especially those with highest state positions. The situation changed radically in 2013. The term ‘gender’ started to be connected with ‘gender ideology’, a term coined by people associated with the Catholic Church. This article presents the ways in which the issues related to the broadly meant gender are presented on the right and left sides of the political scene. This analysis is based on selected interviews and other utterances of famous politicians as well as the articles in popular weekly magazines published in 2011–2015. This paper covers both kinds of utterances – those in line with the rules of political correctness and the examples of hate speech. All examples are provided to highlight the mechanisms of discrimination hidden in the language of politics.

Obsługa kredytów konsumpcyjnych jest jednym z rodzajów działalności banków. Zdolność kredytowa klienta jest oceniana na podstawie złożonego przez niego wniosku. W pracy rozważany jest problem przewidywania, do której z dwóch grup klientów, posiadających zdolność kredytową lub nie (w ocenie banku), zostanie zaliczona osoba ubiegająca się o kredyt. Analizowane są tu możliwości zastosowania modeli probitowych oraz metod analizy dyskryminacyjnej wykorzystujących kwadratową funkcję dyskryminacyjną i zmienną dyskryminacyjną z próby. Przeprowadzona jest także ocena poprawności klasyfikacji danych z pewnego banku.
Retail banking deals with servicing consumer credits and it constitutes one of the major banking activities. A customer applying for the credit fills in the application which is basis to evaluated of his creditworthiness. The paper considers the problem of evaluation to which of the two groups the person applying for a credit should be assigned to: a) those who possess the creditworthiness; b) those who do not possess the creditworthiness. It analyses the possibility of applying the probit models and the discrimination analysis methods using the quadratic and linear discrimination function. An evaluation of the correctness of the classification based on the real data from a commercial bank is conducted.

Some people behind terrorist attacks committed in the 21st century in Europe include immigrants or descendants of immigrants, which is abominable to the native population. In this paper, I analyse factors that account not only for cultural or political motivation of the terrorists, but also factors conditioned by interaction between immigrants or their descendants with indigenous people of the host country. One of the fundamental questions to be asked is whether immigrants in European countries are really accepted by residents of the host country. If they are indeed not accepted, they might have developed a sense of exclusion, even despite achieving apparent integration at certain levels of the social structure. The sense of being rejected is a major factor causing aggression, and such aggression can be used by terrorist organisations to recruit such people.

Although the instances of application of Article 102(c) TFEU can hardly be described as rare, to date it has been applied to essentially two sets of diverging situations, namely to discrimination on grounds of nationality on the one hand, and other forms of discrimination on the other. While there is a relatively high number of instances of the former category of applications, and the criteria of the application of Article 102(c) TFEU to such situations seem straightforward, fewer cases exist in which Article 102(c) TFEU was applied to non-exclusionary secondary line discrimination on grounds other than nationality, and the criteria of application are arguably less clear. The judgment in case C-525/16 MEO represents a significant, yet not a revolutionary step in its interpretation. While in some respects, it may be seen as bringing some novelty (for example, the delineation of the respective scopes of application of Article 102(b) and Article 102(c) TFEU), in others (that is, the notion of competitive disadvantage), it rather confirms the principles which have been previously established. Arguably, the Court’s teaching on the elements which the competition authorities and courts across the EU may have at their disposal to establish the existence of competitive disadvantage, within the meaning of Article 102(c) TFEU, is open to various interpretations. Yet it does to a certain extent shape the toolkit that these authorities and courts may have at their disposal and leaves some room for reasonable welfare related arguments.
Bien que les cas d’application de l’article 102, point c), du TFUE puissant difficilement être considérés comme rares, ils ont été appliqués jusqu’à present à deux ensembles de situations essentiellement différentes: la discrimination fondée sur la nationalité, d’une part, et les autres formes de discrimination, d’autre part. Si le nombre de cas de la première catégorie de demandes est relativement élevé et si les critères d’application de l’article 102, point c), du TFUE à de tells situations semblent simples, il existe moins de cas où l’article 102, point c), du TFUE a été appliqué à une discrimination secondaire non exclusive fondée sur des motifs autres que la nationalité, et les critères d’application sont sans doute moins clairs. La décision rendue dans l’affaire C-525/16 MEO représente une étape importante, mais non révolutionnaire. Elle peut être considérée, à certains égards, comme apportant une certaine nouveauté (par exemple, la delimitation des champs d’application respectifs de l’article 102, point b), et de l’article 102, point c), du TFUE), mais elle confirme plutôt les principes qui ont été établis antérieurement (i.e., la notion de désavantage concurrentiel). L’enseignement de la Cour sur les éléments dont les autorités de concurrence et les juridictions de l’UE peuvent disposer pour établir l’existence d’un désavantage concurrentiel, au sens de l’article 102, point c), du TFUE, peut sans doute être interprété de diverses manières. Pourtant, elle détermine dans une certaine mesure les instruments don’t les autorités et les tribunaux peuvent disposer et laisse une certaine place à des arguments raisonnables liés au bien-être.

Disability is one of the most crucial social problems of the 21st century because of the fact that one in six inhabitants of the European Union, namely, about 80 million in total, has a moderate or severe level of disability, whereas one-third of people at the age of above 75 is disabled. Constant progress in the process of diagnosing diseases, innovative methods of their prevention and treatment – thanks to the newest achievements in medical technology that are reflected in modern medical equipment – enable physicians to prolong life. So, gradual ageing of the population will lead to an increase of the number of disabled people and consequently, to the necessity of adapting the surrounding in such a way that we create for these people possibilities of participating in everyday life. In this publication we discuss several guidelines from the strategy of the European Union on disability and attempt to assess their implementation, conducted on the example of adjustedness of very special public institutions – banks – to the service on disabled persons. A major focus is on the analysis of the level of preparation of open-access rooms, taking into consideration architectural solutions, furnishing with modern equipment that supports the service on a disabled customer and also an appropriate training of thebank employees in order to raise the quality of service. Purpose – The purpose of the study was to estimate the prevalence of unequal treatment of men employed in Polish enterprises and the level of knowledge possessed by the employees in terms of the rights of discriminated persons.Methodology – A survey was carried out using a survey questionnaire which included a total of 304 male employees in 12 surveyed enterprises, holding managerial and specialist positions, located in various functional areas of the organization.Findings – The research confirmed the phenomenon of discrimination against men in the workplace and low level of respondents’ knowledge on the rights of discriminated persons. The answers provided by male respondents show that the most frequently encountered type of discrimination in order of indication was discrimination on grounds of education, age, sex, while the least indicated kind of discrimination concerned disability.Research implications – The findings of this study may serve as a starting point to discover the causes of the phenomenon of discrimination in the workplace.Practical implications – The findings of this study may be used by employers to develop programs against discrimination and to educate employees in identifying and responding to cases of unequal treatment in the workplace.Social implications – The findings of this study may increase the general knowledge on the phenomenon of discrimination in the workplace.Originality/Value – The article complements the knowledge on the selected manifestations of discrimination, the prevalence of unequal treatment of men in their working life and the level of knowledge possessed by the respondents in terms of the rights of discriminated persons.Type of article – A research article.

This study is focused on stereotypes of women as managers. The literature review summariz-es the most common areas of gender stereotypes. In the empirical part we conducted research on a sample of 111 respondents (students). Research data was obtained by administration of translat-ed and adapted questionnaire Women as Managers Scale (L. Peters et al.). Psychometric analysis of the questionnaire was conducted and its factor structure verifi ed. The goal of this study was to create and pilot Czech adaptation of the questionnaire as an instrument for diagnostics of gender stereotypes in different types of organizations (schools, corporate and public sector).

The aim of this article is to present the situation of atheists around the world in the face of political and cultural changes in the world due to the increase in religious radicalism, particularly Islamic one, migration and terrorism. The article is of an illustrative character and presents the review of English literature in the scope of the discussed subject matter. Furthermore, the results of the latest global reports on prevalence of atheism in the world and the phenomenon of discrimination against persons not identifying with any faith: atheists, humanists or freethinkers were presented. The results of the selected, recent studies on the social perception of atheists and the phenomena of discrimination against them were shown. Another raised issue was the new social movement called New Atheism widespread mainly in the countries of the Western culture that in the future can constitute a new social and political challenge. Conclusions: Between 2005 and 2012 the number of atheists increased by 3% and currently they constitute 13% of the population of the world, while the percentage of religious people decreased by 9%. Atheists like other minority groups are discriminated against and their situation is dependent on the country in which they live. However, the vast majority of countries in the world violates the rights of persons identifying themselves as atheists. Still, in some countries, the declaration of atheism is forbidden, and in 13 countries the death penalty can be imposed.

The paper deals with the problem of women's discrimination in the labour market. Significant differences, among women and men in the labour market, are especially in unemployment rate in reward system, and high horizontal and vertical segregation of women. Artykuł dotyczy problemu dyskryminacji kobiet na rynku pracy. Na rynku pracy występują istotne różnice pomiędzy kobietami i mężczyznami, dotyczy to w szczególności systemu wynagrodzenia, poziomej i pionowej segregacji kobiet. Pomimo istniejącego prawodawstwa zakazującego dyskryminacji płci, nadal występuje to zjawisko. Analiza argumentów, konsekwencji i modeli dyskryminacji kobiet na rynku pracy, może znacząco przyczynić się do poprawy tego niekorzystnego zjawiska, występujące w naszej gospodarce i społeczeństwie.

Sequential classification methods are suggested for the case of two or more populations. First, a method for two populations with known probability densities is presented. The method is based on the likelihood ratio and Wald's method of sequential testing of simple null hypothesis against an alternative hypothesis. Two approximate methods for obtaining boundaries, in the form of inequalities for the likelihood ratios, are suggested. The classification for more populations is based similarly on simple inequalities for sequential likelihood ratios based on increasing numbers of measurements. The method is completed by the Bayes decision rule used in the case in which the entire a priori established maximal dimension of measurements is reached. Again two ways of obtaining approximate boundaries are presented. As an example for the case of two populations, the sequential classification rules for normal distributions with known mean vectors and known and unequal covariance matrices are constructed. These rules are in fact quadratic discriminant functions for the sequence of dimensions. The rest of the paper is devoted to a comparison of the methods suggested from the point of view of their conservativeness and power.

The subject of this article is to analyze the meaning of the prohibition of discrimination on grounds of nationality in the light of the provisions of primary and secondary European Union law and the case law of the Court of Justice of the European Union, which is inherent to the functioning of the internal market and EU citizenship. The prohibition of discrimination on grounds of nationality is undoubtedly one of the main goals of the European Union[1] in the social and economic context, which was reflected in the localization of the matter in question in the primary law of the European Union[2], in secondary law and in the jurisprudence of the Court of Justice of the European Union (CJEU). The Treaty on European Union (TEU)[3] and the Treaty on the Functioning of the European Union (TFEU)[4] indicate equality as one of the EU values (Article 2 TEU), require it to be promoted and combat all discrimination (Articles 8 and 10 TFEU) and prohibit discrimination due to the criteria indicated therein (Articles 18 and 19 TFEU). In secondary law, this principle was expressed primarily in the Regulation of the European Parliament and of the Council No. 492/2011 on the free movement of workers within the Union and in art. 24 of Directive 2004/38/EC 2004 on the right of citizens of the Union and their relatives to move freely[5]. A special role in this area is played by the case law of the Court of Justice of the European Union (CJEU), which stated that all authorities of the Member States are obliged to refuse to apply a provision of national law that is contrary to the prohibition of discrimination on the grounds of citizenship (Article 18 TFEU)[6]. Moreover, national measures may be examined in the light of art. 18 TFEU, but only to the extent that they apply to situations not covered by specific non-discrimination provisions included in the Treaty[7]. The author puts forward the thesis that the analysis of CJEU jurisprudence reveals a visible dissonance between the application of national regulations of the Member States and the provisions of EU law in this matter, which significantly hinders the implementation of the principle of non-discrimination in practice. Discrepancies mainly occur in domestic legal acts due to the improper drafting of national legal provisions and / or their misinterpretation by national judicial or administrative authorities. It should be emphasized that the Member States are obliged to comply with EU law, which is not tantamount only to the obligation of state authorities to respect directly applicable acts, or to implement required regulations into internal law, but also the obligation to interpret and apply internal law in a manner that does not violate the requirement resulting from EU law[8]. Judicial and administrative authorities of the Member States should therefore interpret national law as far as possible, in line with EU law, because the limits of the pro-EU interpretation will be determined by the powers conferred by domestic law[9]. The study uses the legal-comparative method, consisting in a comparative analysis of the legal systems of the Member States and the European Union in the field of non-discrimination on the basis of nationality, rights and restrictions on the freedom of movement of authorized entities. Comparative verification of EU acts with the internal standards of individual EU Member States allows to reveal the degree of advancement of the implementation process of EU law provisions under the free movement of EU citizens and their family members in the discussed area in the legal systems of European Union Member States. The purpose of this analysis is to, inter alia, diagnose areas in which these countries have not implemented or improperly implemented EU regulations, or have misinterpreted them. The second method used is the method of analyzing the jurisprudence of the Court of Justice of the European Union - the rulings of the CJEU constitute a significant part of the study. The case law in question covers the period from the establishment of the Treaties of Rome to the present day. The use of the latter obligated the author to apply the comparative method of judgments based on same or similar legal bases in similar circumstances from different stages of the evolution of the free movement of citizens of the European Union and their family members under the prohibition of discrimination on the basis of nationality. Opis:
The article analyzes the transformational potential of the #MeToo movement in terms of personal experience, institutional and social transformations, looking first of all at the dynamics the movement has created in theatre in Poland and around the world. The author unveils the systemic dimension of violence encoded in invisible and standardized relations of domination and subordination, inscribed in the two models which are still very common in Polish theatre: the “master and apprentice” model defining the position of a director and the “feudal” model visible in institutional relations. Looking at the Gardzienice case and the reactions of the public to the testimonies exposing violence, the author also mentions examples of institutional and systemic reactions to similar situations in British and Belgian theatre. In this way, she outlines possible directions for action in Polish theatre. She asks questions about the transformative and emancipatory potential of the #MeToo movement, emphasizing the necessity to consider an intersectional perspective, to build alliances and to practice promiscuous care.
