‘Legitimacy’, ‘reputation’ or ‘institutional trust’ inspired by judicial institutions constitutes an important aspect of the rule of law. Consequently, scholars developed survey-based methods to quantify ‘legitimacy’ as understood in the Weberian sense. Thereby, the survey response quality can meaningfully impact the obtained results. Moreover, one can expect, that sharpening political polarization observed in various countries could amplify such measurement problems. The goal of this paper is to examine the assessments of the Polish Constitutional Tribunal (CT) using two distinct surveys carried out in March 2022 by CBOS (Public Opinion Research Center). Both asked about the overall assessment of the CT performance, as well as electoral preferences (voting intent and preferred political party), frequency of religious practices, self-assessment of economic conditions and included a battery of standard demographic controls. Both overall assessment levels as well as individual-level determinants of the CT assessment (using probit models) had been compared. The findings document that, regardless of the survey data collection mode, controlled for demographic factors, the assessment of CT depends upon variables representing political polarization. This finding can be interpreted as an indication of its political de-legitimization. Moreover, five years after the constitutional crisis, and nearly one and a half years since the abortion verdict, over 40 per cent of respondents of the Allerhand Institute Survey admitted they ‘don’t know precisely’ the task of the CT or even ‘haven’t heard’ about it, indicating a substantial lack of knowledge. The second group of findings documents differences between CAPI and CAWI polls. According to the authors’ knowledge, it is the first attempt to examine respondent-level determinants of CT assessment, and test their sensitivity to the survey data collection mode, thereby contributing to our understanding of the Polish CT legitimacy five years after the constitutional crisis, and methodological aspects of such measurements in general.

Under the provisions of Act I of 2017 on the Code of Administrative Court Procedure, a brand new institution has been introduced in Hungary: as of 1 January 2018, in administrative court proceedings, the judge may, with the agreement of the parties, allow for a court mediation procedure in the cases in which the law does not preclude it. The primary method to approach the topic is the review of the relevant primary legal sources [actual law in the form of the constitution (Fundamental Law of Hungary), acts, governmental decrees, orders of the President of the National Office, court cases, etc.] and secondary legal sources (Hungarian and international scientific literature explaining the primary sources, the legal practice and also the specific circumstances determining the broader social environment) through which we may define relevant scientific problems, create our own definitions and prepare a catalogue of practical problems, specifically for Hungarian issues regarding the topic. Moreover, this article tries to build on the results of the interviews with judges, representatives of different defendants (administrative authorities) and others. Qualitative interviewing, including the interviewing of judges and other participants of such proceedings, is a relatively new method in the field of legal studies, at least in Hungary.

This paper presents information from a nationally representative Polish survey in 2014 on the types of dispute resolution preferred by the respondents. It places the findings in the conceptual background of studies conducted since the mid-1970s in Polish sociology of law on the subject of disputes and the use of the courts. The purpose of the analysis was to identify the more general types of dispute settlement preferred in the popular legal culture in Poland, and the socio-demographic variables that correlate significantly with these preferences. The significance of social position, as measured by a version of the Center-Periphery index, has also been confirmed.

Court packing greatly threatens democracy. This paper examines, compares and draws conclusions from two attempts: The PiS government is near to packing Polish courts; President Roosevelt tried but failed to pack the U.S. Supreme Court in 1937. In most democracies a head of government with a legislative majority and strong party control can pack courts, giving complete control. The United States escaped; Roosevelt lacked complete party control. Poland is unlucky; PiS is strongly controlled. Peaceful domestic protest is necessary, but Poland’s hope is from EU-level institutional pressure, supported by major democracies, to reverse packing and prevent further seizure of power.

This Article investigates how the European Court of Human Rights becomes competent to make decisions in cases concerning (or taking roots in) 'historical situations' preceding the ratification of the European Convention by a given Member State or even the enactment of the Convention. 'Historical situations' refer to events that occurred in the period of Second World War or shortly thereafter. In all such cases, the preliminary question arises whether the Court is competent temporally (ratione temporis) to deal with the application. This group of cases concerned usually allegations touching upon the right to life and the right to property. The Court had to decide if the allegation in question related to a temporally closed event (making the Court not competent) or rather to a continuous violation (where the Court could adjudicate). A specific set of legal questions arose vis-a-vis the right to life, first of all that of the autonomy of the procedural obligation to conduct an efficient investigation. The Strasbourg case law did not provide a clear answer. However, following two crucial judgements rendered by the Grand Chamber, the Court has established an interesting legal framework. Article analyses also two other situations having a historical dimension: bringing to justice those accused of war crimes or other crimes under international law (in light of the alleged conflict with the principle of nullum crimes sine lege) and pursuing authors of pro-Nazi statements or speech denying the reality of Nazi atrocities.

The Israeli radical judicial overhaul program, aiming to seriously weaken the judiciary, has led the country to the brink of chaos and violence, with hundreds of thousands of demonstrators in the streets, society tearing itself apart and numerous sectors of society, such as medical service or reservists of IDF, announcing a suspension of their service to a nation they fear will no longer be a democracy. Despite the strong social protest, Knesset – representing an extremely right-wing coalition – adopted on the July 24, 2023 the amendment to Basic Law: The Judiciary to bar the judiciary from striking down decisions of the government and its ministers on the grounds of such decisions being unreasonable. The measure known as the reasonableness clause (standard) is rooted in English and American case law and it is frequently used in Israel to control administrative activity. It allows the courts to strike down governmental and administrative decisions and their regulations seen as having not taken into account all the relevant considerations of a particular issue, or not given the correct weight to those considerations – even if they do not violate any particular law or administrative rulings. The current right-wing coalition, led by Benjamin Netanyahu, argues that the clause as it stands gives too much power to the judiciary, especially the Supreme Court sitting as a High Court of Justice, to interfere with the actions of the executive, and that the powers of judges, who are not elected by the public, remain out of control in this procedure. Opponents of the government’s amendment argue that this standard is crucial in helping to protect civil rights that are not fully defined in Israeli law. Eliminating the standard of reasonableness will be another step towards giving the government unlimited power. It violates not only the separation of powers principle and the rule of law but it also harms the right to good administration. Irrespective of the Supreme Court’s decision on the constitutionality of the government’s amendment, the struggle to maintain the democratic principles of the Israeli system will continue.

This article examines the U.S. Supreme Court’s lesser-known educative role as an egalitarian institution within a broader deliberative democratic process. Scholars have argued that the Court’s long asserted power of judicial review, especially in the equal protection and civil rights context, has been an over-reach of the judicial branch’s constitutional authority and responsibilities. Normative and empirical critiques have been centered on the aims of judicial review, and the challenges it poses in American political life. A core issue surrounding these critiques is that Justices are appointed not elected, and thus undermine the principle of majority rule in the U.S. constitutional democratic order. Although these critiques are legitimate in terms of claims about unelected Supreme Court Justices’ seemingly discretionary powers over elected legislative bodies, and the uncertain policy implications of judicial pronouncements on the broader society, there is, nevertheless, a positive application of judicial review as a tool Justices use as part of their educative role overcoming the so-called “counter-majoritarian difficulty.” Through a close reading of oral arguments in Brown vs. Board of Education (1954) and San Antonio vs. Rodriguez (1973)-two landmark cases invoking the Equal Protection Clause of the 14th Amendment to the federal Constitution-the article shows how appointed Justices adjudicate individual cases on appeal and attempt to educate (through an argumentative, reason-based and question-centered process) citizenlitigants and their legal representatives about the importance of equality, fairness and ethical responsibility even prior to rendering final decisions on policy controversies that have broader national social, political and economic implications.

The COVID-19 pandemic has introduced colossal changes in the functioning of courts. As it were, certain inevitable changes were accelerated, and the courts were forced to undergo digitization and open to remote operation, which was a more common phenomenon in other industries. The pandemic meant that not only the courts had to use distance communication programs to a greater extent, it happened in almost every industry. The purpose of introducing remote hearings during the pandemic was to enable the functioning of the courts without exposing the public to infection.

Communication and communication systems are topics widely discussed in the literature of the subject. However, the analysis of the specific subjects of this study as courts, is so far a subject that is rarely discussed in empirical research as well as in a debate at the level of communication theory. The paper presents the results of survey research on internal communication in district and regional courts in the context of trust building. The study assumes that there is a relationship between communication on a given project tasks, communication on project management and non‑formal communication, and confidence in the public institution and its management. The results of the research clearly showed the existing relationship between satisfaction coming from the proper communication, and the level of employee trust in the court as a place of work.

The aim of the publication is to present the role and tasks of the police in criminal proceedings in a legal and comparative approach. Over the years, there could have been noticed an evolution in the area of police powers. The rationale for addressing such an important issue is, first of all, to look at the achievements of the authors of reforms in the post-annexation period and to recognise their contribution to the process of shaping high standards of functioning of police authorities. Studies and analysis of legal texts from the period when Poland regained independence is an important element of learning about history and tradition, as well as the possibility of following patterns of lawmaking adequate to the challenges of lawmaking. The original spelling of source texts and sometimes their archaic language layer, quoted in the text of the publication, is a measure to respect the principle of faithfulness to the sources and, at the same time, to illustrate the development of individual legal institutions. The article focuses on the analysis of selected regulations of the Regulation of the President of the Republic of 19 March 1928 — Code of Criminal Procedure (Journal of Laws of 1928, No. 33, item 313) in relation to the current solutions of the procedural act.

As the European Union candidate country (hereinafter the EU), Ukraine is one step away from becoming an EU Member State. From this point on, the country will be subject to the influence of EU institutions, including the Court of Justice of the European Union (hereinafter the CJEU). It is suggested that upon the accession of Ukraine, the CJEU’s impact will be comparable to the influence on legal orders of other EU Members States provided necessary preparatory steps, such as training for judges, are taken. It is established that the main functions of the CJEU are to interpret and ensure the uniform application of EU law in each EU Member State, to ensure compliance with EU law by EU countries and institutions, to ensure respect for the rights and freedoms of individuals, to provide clarifications to national courts, and to promote “positive integration” and “negative integration” of EU Member States. With respect to the above-mentioned functions, it is argued that the CJEU will become an effective tool for Ukraine after it accedes to the EU. It will facilitate the harmonization of national legislation with EU standards through the application of precedents by national courts, influence the activities of legislative bodies, and help prevent future complaints by becoming an additional “quasi-supervisory” body in Ukraine. It will also provide interpretation of the EU law at the request of national courts through the preliminary rulings and procedures, protecting human rights and freedoms by enabling individuals to apply to the CJEU for protection. At the same time, arguably, Ukraine will also impact the functioning of the CJEU by increasing the caseload and appointing judges from Ukraine as well as potentially Advocate-General. Given these potential implications, certain preparatory actions, like preparing a cadre reserve, may be considered at the present moment. Finally, the authors argue that even before Ukraine’s accession, the CJEU has an indirect impact on the Ukrainian legal order. It is suggested that constitutional amendments, as well as certain institutional changes like the establishment of an impartial judicial system and empowering a Ukrainian state body with powers to execute CJEU decisions, will need to take place prior to the accession, which is a demonstration of the CJEU’s indirect influence.

This article presents the history of the construction of the room above the porte cochère in the northern wing of the Kwidzyn castle in the times of the Pomesanian chapter. The findings presented here were derived from the architectural and stratigraphic research and analysis of archival materials conducted in 2017. According to these findings, the room was built in the first stage of erecting the castle. In the following centuries, it underwent architectural changes corresponding to the new needs of the castle’s inhabitants. The preserved traces testify that it had several successive functions from the $14^{th}$ to the $16^{th}$ century, so far not fully recognised and explained: a watchtower, court office or chamber, or even a chapel. Much of the knowledge about it is contained in the stratification of the walls and the reconstructions of historical transformations from the medieval period. In later times, the room was spared significant damage and still constitutes a valuable source of knowledge about the castle’s history.
W artykule przedstawiono historię budowlaną pomieszczenia nad przejazdem bramnym w skrzydle północnym zamku w Kwidzynie w czasach kapituły pomezańskiej. Prezentowane ustalenia uzyskano na podstawie wyników badań architektonicznych, stratygraficznych oraz analizy materiałów archiwalnych, które przeprowadzono w 2017 roku. Według nich pomieszczenie powstało w pierwszym etapie wznoszenia zamku. W kolejnych wiekach podlegało architektonicznym zmianom odpowiadającym nowym potrzebom mieszkańców zamku. Zachowane ślady świadczą, że od XIV do XVI wieku pełniło ono kilka następujących po sobie funkcji, dotąd nie w pełni rozpoznanych i umotywowanych: strażnicy, kancelarii bądź izby sądowej, a nawet kaplicy. Znaczną część wiedzy o nich zawarto w rozwarstwieniu ścian i rekonstrukcjach historycznych przekształceń z okresu średniowiecza. W późniejszych czasach wnętrze uniknęło znacznych zniszczeń i do dziś stanowi cenne źródło wiedzy o historii zamku.

In this paper, I’d like to provide an overview of the presidents of the Hungarian Royal Administrative Court (Magyar Királyi Közigazgatási Bíróság) which operated in Budapest between 1897 and 1949. In the opening, however, I will outline the organisation, the scope of authority and the operation of the Administrative Court.
Niniejsze opracowanie prezentuje sylwetki przewodniczących Węgierskiego Królewskiego Sądu Administracyjnego (Magyar Királyi Közigazgatási Bíróság), który mieścił się w Budapeszcie w latach 1897–1949. Została w nim także dokonana analiza stanu prawnego oraz tła politycznego i ówczesnych stosunków społecznych, a także uwzględnione aspekty naukowe związane z przewodniczącymi tego sądu. W ramach zagadnień wstępnych w artykule zostały w zarysie przedstawione organizacja, kompetencje i zasady funkcjonowania Sądu Administracyjnego.

The paper indicates the most important arguments raised by the participants in the dispute concerning the possibility of control by the administrative courts of decisions of the President of the Republic of Poland on the refusal to appoint a judge and an attempt to make a substantive evaluation of them. In my opinion, the refusal to appoint a judge, as well as refusal to accept the judge’s position under the amended Act on the Supreme Court (SC) should be strictly exceptional and in principle be justified at the constitutional level, which should be seen as the duty of the President to ensure compliance with the Constitution. Both of these resolutions should contain the motives of the President, which would make this act, with all its arbitrariness, more transparent. This is important not only from the point of view of the person concerned, but this also has an important social dimension. The public has the right to know, not only which candidates, who met the requirements for the appointment as a judge and were recommended by the National Council of the Judiciary of Poland (NCJ), were not appointed by the President, but also what reasons were at the heart of such a decision of the Head of State.
