In Western Europe the Church as an institution was integrated into the military system and was obliged to serve the monarchy. Apart from performing vassal duties, the Latin clergy frequently participated in military actions. Although the Church laws forbade clergymen to shed blood, there were many examples of the violation of this rule. The attitude of the Orthodox Church in the Byzantine Empire concerning the possible participation of the clergy in war differed significantly from that of Latin Europe. The Byzantine priesthood did not become involved in military actions. The Greek Church possessed neither military units nor vassal commitment to the Empire. Despite a very close relationship with the Byzantine Church the attitude of the Georgian Church to the issue differs from that of Byzantium and is closer to the Western practice. The feudal organization of Georgia conditioned the social structure of the Georgian Church and its obligations before the monarchy. Despite the fact that the Georgian Church enjoyed many advantages, it had to take part in military campaigns. The upper circles of Georgian Church dignitaries were accustomed to both conducting military campaigns or taking part in the combat. In regard to military activities of clergy, Georgian law was much more lenient than Byzantine, and in the case of necessity, it even modified Greek legal norms. The conflict with the Christian canons was decided in favor of military necessity, and it was reflected in the legislation.

The concept of the synod plays a special role in the Evangelical ecclesiology. In the 20th century, the synod was radically defined as “the personification of the Church.” In the Evangelical tradition, however, there are equal Church management systems: episcopal, synodal-consistory, presbyterian (mainly in the Evangelical-Reformed denomination), and to a lesser extent congregational (especially observed in the so-called free Churches). Reformation theology understands the Church as a community of all saints, where the Gospel is preached purely and the sacraments are properly administered (Augsburg Confession — CA VII). The system of the Church does not belong to the so-called notae ecclesiae. An important theological doctrine of the Reformation is the teaching about the universal priesthood of all believers, which is the theological foundation of the idea of the synodal responsibility of the Church. In the 19th century synods concerned mainly clergy. In the 20th century, in the course of democratisation processes, most Evangelical Churches raised the importance of the synod in the overall management of the Church, and the Polish Lutheran Church introduced a provision into her law which stipulates that the synod is “the embodiment of the Church” and its supreme authority.
Il concetto di sinodo svolge un ruolo speciale nell’ecclesiologia evangelica. Nel XX secolo, il sinodo è stato definito in modo radicale come “personificazione della Chiesa”. Nella tradizione evangelica, tuttavia, ci sono sistemi equiparati di gestione della Chiesa: episcopale, sinodale-concistoro, presbiteriano (principalmente nella Chiesa evangelica riformata) e, in misura minore, congregazionalista (praticato soprattutto nelle strutture della chiesa libera). La teologia della Riforma intende la Chiesa come una comunità di santi in cui il Vangelo è chiaramente predicato e i sacramenti sono amministrati correttamente (Confessione di Augsburgo — CA VII). Il sistema della Chiesa non appartiene alle cosiddette notae ecclesiae. Un’importante dottrina teologica della Riforma è la dottrina del sacerdozio universale di tutti i credenti, che è il fondamento teologico dell’idea di responsabilità sinodale per la Chiesa. Nel XIX secolo, i sinodi riguardavano principalmente il clero. Nel corso dei processi democratici nel XX secolo, la maggior parte delle chiese evangeliche ha sollevato l’importanza del sinodo nella gestione generale della Chiesa, e la Chiesa luterana polacca ha introdotto una disposizione nella sua legge secondo cui il sinodo è l’incarnazione della Chiesa e la sua autorità suprema.

Orthodox church law is comprised of elements that regulate the life of the Church at various levels. The theological decisions, oroses, canons and canonical letters, which concern the Church globally, obviously focus on doctrine. Still, they also characterize the theological aspects of ecclesiology, primarily expressed in the Orthodox Church’s fundamental confession of faith – the Nicene-Constantinopolitan Creed. Although a number of the canons of the ecumenical councils and of the Holy Fathers, historical and contemporary resolutions passed by various local Orthodox Churches and other ecclesiastical authorities and institutions pertain to the universal sphere in many aspects, the vast majority of them set specific organizational standards of church life in the local perspective: the local Church, basic administrative units (dioceses, metropolises or exarchates), but above all in basic organizational structures, which include parishes and monasteries.
Prawo cerkiewne składa się z elementów, które regulują życie Kościoła na różnych poziomach. Decyzje teologiczne, orosy, kanony i listy kanoniczne, które dotyczą Kościoła w skali globalnej, koncentrują się oczywiście na doktrynie. Charakteryzują one jednak również teologiczne aspekty eklezjologii, wyrażone przede wszystkim w fundamentalnym wyznaniu wiary Kościoła prawosławnego - Credo Nicejsko-Konstantynopolitańskim. Chociaż szereg kanonów soborów ekumenicznych i Ojców Kościoła, historycznych i współczesnych uchwał różnych lokalnych Kościołów prawosławnych oraz innych władz i instytucji kościelnych odnosi się w wielu aspektach do sfery powszechnej, to jednak zdecydowana większość z nich wyznacza konkretne normy organizacyjne życia kościelnego w perspektywie lokalnej: Kościoła lokalnego, podstawowych jednostek administracyjnych (diecezji, metropolii czy egzarchatów), a przede wszystkim w podstawowych strukturach organizacyjnych, do których należą parafie i monastery.

“Synodality is a style, it is walking together, and it is what the Lord expects of the Church in the third millennium” (Francis). The specific motto and wording of this study in the quoted “programme” thought of Pope Francis, articulated in the Address to Members of the International Theological Commission (2019). The Pope expresses appreciation for the extensive work of the Commission crowned with the “theological clarification” of the mentioned idea, and above all by demonstrating the importance in the perception of the mission of the Church today. If, in the opinion of the Holy Father, factual and competent expert argumentation, step by step, reveals the truth that “a synodal Church is a Church of participation and co-responsibility,” such a determination cannot remain without impact on the praxis of undertaking the most serious pastoral challenges of the present time — on various levels of realization: local, regional, and universal, including ecumenical commitment. This applies in its entirety to the creation of strategies and specific actions of the Church towards the growing phenomenon of human mobility, especially in its forms that manifest themselves as dramatic and devastating to families and individuals. What we mean here is the Church’s multi-track postulate — or more precisely: communion, synodal — efficiency (with its determinants: dynamics, efficiency, effectiveness), for which in 2016 Francis coined the term: “accompanying migrants”. Consequently, in recent years there have been a number of normative and operational activities of the present successor of St. Peter, which in our time — rightly called: “the era of migration” (Francis) — set a new trend of clothing/embellishing the aforementioned critical area of salus animarum with synodal accents. As it is showed in the study, a canonist, with the horizon of the principle of ius sequitur vitam before his eyes, cannot remain passive towards the pressing challenges delineated here. Indeed, within the orbit of the study of canon law a weighty question appears — what conclusions of a canonical nature stem from the “millennium” project of the realization of the Synodal Church Idea.

In the communio Ecclesiae reality, of a unitarian, charismatic, and institutiona structure, the crucial concepts of participation and co-responsibility are firmly anchored in the juridical and canonical discourse. This is the way in which the horizon of the subject matter reveals itself, the study of which — from the point of view of the title triad: synodality — participation — co-responsibility — will never lose its relevance. What is, at the same time, important is the idea of “synodality,” which is adequately recognized as the sacra potestas of a sacramental origin (ontological aspect), which gains the dynamism of libertas sacra (existential and dynamic aspect) through the charisms of the Holy Spirit, thus leading to the inseparability of its personal and synodal aspects. Therefore, in the attempt to illuminate the determinant of the aggiornamento of the Church law in this study, it was appropriate, on the one hand, to consistently refer to the essence of the idea of the communio hierarchica, according to which Christ makes selected servants participate in his authority by means of an office, the exercise of which always remains a diaconia in the community of faith. On the other hand, in reference to the contemporary understanding of communio fidelium, the axis of scientific reflection was to be the communion-creative phenomenon of charisms — gifts of the Holy Spirit that awaken in the People of God synodal co-responsibility for the good of the entire Church community. In both cases — without losing sight of the obvious truth that, in the sacramental structure of the Church (communio), both hierarchical and charismatic gifts converge in the service of the bishop, who updates — according to the logic of the Vaticanum II aggiormamento and the ecclesiological principles of the Council: collegiality, the title synodality and subsidiarity — the fullness of Christ’s service: as Prophet, Priest, and King.
Nella realtà della communio Ecclesiae, che si caratterizza per una struttura carismatica e istituzionale unitaria, i concetti di partecipazione e di responsabilità condivisa — essenziali nel discorso giuridico e canonico, sono fortemente ancorati. Si svela così l’orizzonte della questione, il cui studio — nei termini della triade apparsa nel titolo: sinodalità — partecipazione — responsabilità condivisa — non perderà mai la sua rilevanza. È importante sottolineare che l’idea di “sinodalità” — adeguatamente riconosciuta come sacra potestas di origine sacramentale (aspetto ontologico), guadagnando il dinamismo di libertas sacra grazie ai carismi dello Spirito Santo (aspetto esistenziale e dinamico) —conduce all’inseparabilità dei suoi aspetti: personale e sinodale. Pertanto, nel tentativo compiuto in questo studio di illuminare le determinanti dell’ “aggiornamento” del diritto ecclesiastico, è stato opportuno, da un lato, riferirsi sistematicamente all’essenza dell’idea di communio hierarchica, secondo la quale Cristo rende i servi eletti partecipi del suo potere mediante un ufficio il cui adempimento resta sempre una diaconia nella comunità di fede; d’altra parte, in riferimento alla concezione contemporanea di communio fidelium — asse della riflessione scientifica dovrebbe essere il fenomeno dei carismi collegato con la comunione e la creazione — questi doni dello Spirito Santo, suscitando la responsabilità condivisa e sinodale per il bene dell’intera comunità ecclesiale nel popolo sacerdotale. In entrambi i casi — senza perdere di vista l’ovvia verità che nella struttura sacramentale della Chiesa (communio) sia i doni gerarchici che quelli carismatici coincidono nel ministero del vescovo che attua — secondo la logica dell’aggiormamento esposta dal Vaticano II e dei principi ecclesiologici conciliari: la collegialità, la sinodalità e la sussidiarietà — la pienezza del ministero di Cristo: Profeta, Sacerdote e Re.

Ustanowienie przez Henryka VIII Kościoła anglikańskiego i jego protestantyzacja dokonana za rządów jego dzieci, Edwarda VI oraz Elżbiety I nie doprowadziły do zupełnego zanegowania katolickich zwyczajów i tradycji w Anglii. Wbrew innym wspólnotom protestanckim Kościół anglikański zachował rozbudowany porządek prawny, który stanowił dziedzictwo średniowiecznego prawa kanonicznego. Ostateczne zwycięstwo anglikanizmu nad katolickimi sympatiami dokonało się w osiemnastym stuleciu. W artykule stawiane jest jednak pytanie, czy ten sam mechanizm zadziałał także w obrębie nauczania prawa kanonicznego w Anglii we wspomnianej epoce. Warto pamiętać, iż wprost prawo kanoniczne nie mogło być nauczane, stąd ubierane było ono często w formę wykładu historii i recepcji prawa rzymskiego. Artykuł zawiera wnioski z analizy popularnych osiemnastowiecznych podręczników prawa rzymskiego oraz anglikańskiego prawa kościelnego. Poszukiwano w nich zarówno odwołań do prawa rzymskokatolickiego, jak również oceniono sposób formułowania wypowiedzi o Kościele katolickim i jego porządku prawnym.
The establishment of the Anglican Church by Henry VIII and its Protestantisation achieved by his children Edward VI and Elizabeth I did not cause the absolute rejection of Catholic customs and traditions in England. Unlike other Protestant communities, the Anglican Church maintained a developed legal order, which was a continuation of a heritage of medieval canon law. The final victory of Anglicanism over Catholic sentiments was achieved in the eighteenth century. The article asks whether that same mechanism worked in the sphere of the teaching of canon law in England in the eighteenth century. It is worth remembering that canon law could not be taught openly, and for this reason, it was often disguised in the form of history lectures and the reception of Roman law. The article contains the conclusions drawn from the analysis of popular eighteenth-century textbooks of Roman law and Anglican ecclesiastical law. References to Roman canon law were sought in them, and modes of expressing statements regarding the Catholic Church and its law were evaluated.

Current demographic conditions and foreseeable future developments are forcing Germany’s two major Christian churches to develop innovative strategies to recruit members or retain them over the long term. Already today, less than 50 percent of 6- to 18-year-olds are Protestant or Catholic. According to forecasts, this figure will halve by 2060. The aim of this paper is to show that the German system of church tax is being applied properly from a fiscal point of view, but should be re-evaluated in light of demographic and societal challenges.

The emphasis on the human person and his dignity was significantly applied in the new regulation of the law of consecrated life, which is dealt with in the new Code of Canon Law of 1983 in integrum compared to the previous Code of Canon Law of 1917. This paper describes only some of the changes in the law of religious institutes in the Latin Church.The first section regards mainly the person who has taken religious vows and focuses on the question of religious vows as the basis of religious life. It also discusses confessors viewed as a necessary tool for the renewal of religious life as well as modifications in the concept of poverty as a very important element of religious life. The second section focuses on the government of religious institutes, discussing the strengthened position of internal superiors over external superiors in religious congregations, the strengthened position of the superior of monasteries of nuns, and the extended powers of superiors on release from a religious institute due to illegitimate absence from a religious house.As this is in some cases a very recent legal regulation, the author does not hesitate to express his critical observations.

The purpose of this paper was to show how the ecclesiastical and secular societies protect human life against a specific danger posed by one’s own hand. The authors, basing on the formal-dogmatic approach, researching literature and analysing appropriate norms of canon and Polish law, demonstrate that both canon and Polish criminal law provisions on suicide protect human life only circumstantially. In the first part, we present the issue of suicide from the point of view of moral teachings of the Catholic Church, which are a fundamen- tal law-making factor for the ecclesiastical community. Reception of the ethical doctrine by canon law was reflected in two Codes of Canon Law, those of 1917 and 1983. In these codi- fications, we traced gradual reduction of prohibitions or sanctions for suicides (especially regarding right to Christian burial), which however does not refer to all self-killers, because of the need for protecting other spiritual goods (suicide attempt as irregularity in the case of receiving or exercising holy orders). In the second part, we presented the problem of suicide in the context of Polish law, with special emphasis on the significance of human life as a le- gal interest subject to strong protection and as a conflict between life and dignity. We also analysed the question of the unlawfulness of suicide attempts. In the end, we point to legal measures intended to prevent this phenomenon, which is unfavourable to the society.

The Code of Canon Law of 1983 came up with a list of obligations and duties of the Catholic faithful. This list is analogical to those of the charters of fundamental rights and freedoms found in the documents of international law and in the constitutions of democratic countries. the inspiration of church law by civilian law was a reality from the very beginnings of the development of Canon Law: first by Roman Law, in the modern world by complex codifications of civil law, and after Vatican II also the idea of universal human rights. The specifics of the Catholic Church in relation to a democratic state is the incorporation of the subject of law into the Church through baptism which brings, above all, duties and obligations. Thus the catalogue which may now be seen in the Code contains first and foremost a list of duties, not rights, which are not stressed in the modern state. In fact, the modern state has very few demands; often just the payment of taxes and compulsory school attendance. The article deals with the individual obligations and rights found in the Code of Canon Law and compares them with their analogies in constitutions. The concept of civil and canonical norms tends to get closer primarily in the case of inspiration by natural law, whereas the obligations of the faithful represent a specifically ecclesiastical goals, for which no analogy in civil law can be found. After all, the supreme law of the Church is the salvation of souls, indeed, the state does not have such a supernatural goal.
Il Codice di Diritto Canonico del 1983 ha introdotto un elenco di doveri e diritti dei fedeli laici. È analogo agli elenchi caratteristici dei diritti e delle libertà fondamentali contenuti nei documenti di diritto internazionale e nelle costituzioni dei paesi democratici. L’ispirazione della Chiesa al diritto civile è stata una realtà sin dall’inizio del diritto canonico: prima attraverso il diritto romano, poi, nel mondo moderno, attraverso complesse codificazioni del diritto civile, e dopo il Concilio Vaticano II, attraverso le idee dei diritti umani universali. Una caratteristica specifica della Chiesa cattolica rispetto a uno Stato democratico è l’incorporazione del soggetto di diritto nella Chiesa attraverso il battesimo, ciò che porta con sé tutti i diritti e gli obblighi. In questo modo, il catalogo dei diritti e degli obblighi, che ora esiste nel codice, include principalmente un elenco di questi ultimi. I diritti sono invece messi in evidenza dallo Stato moderno. In effetti, lo Stato moderno impone pochi obblighi ai suoi cittadini; spesso si tratta solo di pagare le tasse e di obbedire alla costrizione dell’istruzione obbligatoria. Il presente articolo tratta dei singoli obblighi e diritti contenuti nel Codice di Diritto Canonico e li confronta con i corrispondenti obblighi e diritti contenuti nelle costituzioni. Il concetto di norme civili e canoniche è simile, soprattutto se ispirato alla legge naturale. I doveri dei fedeli, invece, rappresentano fini ecclesiastici specifici, e in questo caso è difficile stabilire un’analogia con il diritto civile. Soprattutto, la legge suprema della Chiesa è la salvezza delle anime, e lo Stato non ha un obiettivo così soprannaturale.
Le Code de droit canonique de 1983 a dressé une liste de devoirs et de droits propres aux fidèles laïcs. Elle est analogue aux listes de droits et libertés fondamentaux contenus dans les documents de droit international et dans les constitutions des pays démocratiques. Le fait que l’Église se soit inspirée du droit civil est une réalité qui remonte aux origines du droit canonique : tout d’abord à travers le droit romain, puis, dans le monde moderne, à travers des codifications complexes du droit civil, et après le Concile Vatican II, à travers les idées de droits humains universels. Une caractéristique spécifique de l’Église catholique par rapport à l’État démocratique est l’incorporation du sujet de droit dans l’Église par le baptême, qui entraîne tous un ensemble de droits et obligations. De cette manière, ce catalogue des droits et obligations qui existe désormais dans le code comprend principalement la liste de ces dernières. Ce sont au contraire les droits qui sont mis en évidence par l’État moderne. En fait, l’État moderne impose peu d’obligations à ses citoyens; souvent, il ne s’agit que de payer ses impôts et de suivre l’enseignement obligatoire. L’article traite des obligations et droits individuels contenus dans le Code du droit canon et les compare aux obligations et droits correspondants contenus dans les constitutions. Les concepts de normes civiles et de normes canoniques sont comparables, notamment parce que toutes deux s’inspirent du droit naturel. Les devoirs des fidèles, en revanche, représentent un objectif spécifique de l’Église et, dans ce cas, il est difficile d’établir une analogie avec le droit civil. Par-dessus tout, la loi majeure de l’Église reste le salut des âmes, alors que l’État ne poursuit pas un but surnaturel de ce type.

W recenzji przedstawiono monografię Kanoniczne prawo małżeńskie autorstwa Stanisława Pribyła, która jest przeznaczona jako tekst dla studentów wydziałów prawa. Poza przedmową i zakończeniem monografia podzielona jest na 16 rozdziałów, przy czym najwięcej miejsca poświęcono problematyce zgody małżonków, zgodnie z jej doktrynalnym i prawnym znaczeniem, nawet poprzez częste podawanie przykładów z praktyki sądowej, zwłaszcza w zakresie braków zgody małżonków - jest to niezwykle cenny walor tej pracy. Uwzględnia również świeckie prawo rodzinne, zwłaszcza czeskie, a także prawo innych kościołów chrześcijańskich. Niniejsza monografia ma zatem również wymiar ekumeniczny.
The review presents the monograph Canonical Marriage Law by Stanislav Pribyl, which is intended as a text for students of faculties of law. Apart from the preface and conclusion, the monograph is divided into 16 chapters, with the most space devoted to the issues of marital consent, in accordance with its doctrinal and legal significance, by frequently giving examples from court practice, especially in the area of deficiencies of marital consent - this is an extremely valuable asset of this work. It also considers secular family law, especially Czech law, as well as the law of other Christian churches. This monograph therefore also has an ecumenical dimension.
