Remigiusz Sobański (†2010) was highly appreciated in the world of post-Council canon law studies. His research was published in many languages. Most of his scientific achievements were presented in the Polish language. For this reason, I reach for studies unknown to a wider community of canonists in order to present Professor Sobański’s views on theology of canon law, whose subject matter was a predominant topic of his scientific interests. I present the thematic scope of theology of canon law, its role in reference to fundamental issues of canon law, but also its inadequacy. Sobański thought that in order to fully illustrate the basic issues of canon law, theological approach should coexist with the legal one within one theory of canon law.
Remigiusz Sobański (†2010) cieszył się uznaniem w świecie posoborowej kanonistyki. Jego badania naukowe zostały opublikowane w wielu językach. Większość jednak dorobku naukowego została przedstawiona w języku polskim. Z tego względu Autor opracowania sięga do nieznanych dla szerszej społeczności kanonistów opracowań, by przedstawić poglądy R. Sobańskiego na temat teologii prawa kanonicznego, której tematyka była wiodącym przedmiotem jego naukowych zainteresowań. Prezentuje zakres tematyczny teologii prawa kanonicznego, jej rolę w odniesieniu do podstawowych zagadnień prawa kanonicznego, ale również jej niewystarczalność. R. Sobański sądził, że dla pełnego zobrazowania podstawowych zagadnień prawa kanonicznego podejście teologiczne powinno współistnieć z prawnym w ramach jednej teorii prawa kanonicznego.
Remigiusz Sobanski (†2010) a bénéficié d’une reconnaissance dans le monde de la canonistique postconciliaire. Ses recherches scientifiques ont été publiées dans de nombreuses langues. Cependant, la plupart de ses travaux scientifiques ont été présentés en polonais. Voilà pourquoi l’Auteur du présent article s’intéresse à des études inconnues de la communauté des canonistes pour présenter les points de vue de Sobański sur la théologie du droit canonique, dont le sujet était l’objet principal de son intérêt scientifique. Il présente le champ thématique de la théologie du droit canonique, son rôle par rapport aux questions fondamentales du droit canonique, mais aussi son insuffisance. Sobański pensait que pour illustrer pleinement les questions fondamentales du droit canonique, l’approche théologique devait coexister avec l’approche juridique au sein d’une seule et même théorie du droit canonique.

In Austria, the Ecumenical Council of Churches in Austria (ÖRKÖ), which, unlike in Germany, includes the Catholic Church, have complied with this request and wish of the pope by issuing numerous joint statements on various topics. These joint statements are to be widely disseminated until the beginning of the year 2022.

Thus an opportunity is created to offer to the reader (canonist or theologian) some eloquent testimonies of the liturgical-canonical Tradition of this Church, which is part of the common liturgical-canonical heritage of the ecumenical Church of the first millennium.

Refugees and migrants have always been of particular concern to the Roman Catholic Church and its pastoral care. Even if the large influx of refugees happening in 2015 and 2016 is no longer the case, flight and migration are still relevant topics in Austria. The contribution deals with the historical development of canonical regulations, the situation of refugees and migrants in Austria, the legal basis, the implementation of asylum procedures and numbers, the statements of the Austrian Bishop’s Conference, the access to a Church or religious community and converting from one to another, the question of the Catholic Church’s necessity of salvation, regulations concerning catechumenate and the question of church asylum. It provides figures, data and facts, presents the canonical and state legal situation and analyses it. It tries to make weak points obvious and would like to provide help for future considerations.

The emphasis on the human person and his dignity was significantly applied in the new regulation of the law of consecrated life, which is dealt with in the new Code of Canon Law of 1983 in integrum compared to the previous Code of Canon Law of 1917. This paper describes only some of the changes in the law of religious institutes in the Latin Church.The first section regards mainly the person who has taken religious vows and focuses on the question of religious vows as the basis of religious life. It also discusses confessors viewed as a necessary tool for the renewal of religious life as well as modifications in the concept of poverty as a very important element of religious life. The second section focuses on the government of religious institutes, discussing the strengthened position of internal superiors over external superiors in religious congregations, the strengthened position of the superior of monasteries of nuns, and the extended powers of superiors on release from a religious institute due to illegitimate absence from a religious house.As this is in some cases a very recent legal regulation, the author does not hesitate to express his critical observations.

The sexual abuse of a child is a crime which demands a response on various levels. On the one hand, it requires psychological support for the victims, while on the other, it requires concrete legal and penal measures against the perpetrators, as well as broad social education and preventive measures in order to prevent similar tragedies from recurring in the future. The document entitled “Protection of Minors in the Pastoral Work of the Diocese of Tarnów – Norms and Rules” refers to the actions of the universal Church. The document on the protection of minors is a guideline for the Diocese of Tarnów to be used in all parishes, communities and works of the diocese, both by clergymen, consecrated persons and laity who undertake ministry among children and young people.

The article discusses the concept of penalties in the Church and the remission of such penalties internally as provided for in Title IV of Book VI of the 1983 Code of Canon Law. W artykule zostało przedstawione pojęcie kary kościelnej, a następnie zagadnienia dotyczące zwalniania z kar kościelnych w zakresie wewnętrznym sakramentalnym uregulowane w Tytule IV Księgi VI Kodeksu Prawa Kanonicznego z 1983 r. Autor w pierwszej kolejności scharakteryzował pojęcie kary kościelnej. Następnie przeanalizował władzę kompetentną w zakresie zwalniania z kar w sytuacjach zwyczajnych, jak też zagadnienie uwalniania z kar w sytuacjach naglących.

One of the fascinating intersections of the Canon law and the modern society can be found in the catholic-founded dynastic orders of knighthood. The author conducted a comprehensive review of legal debates, both in the Canon law and in the international law, to provide readers with an up-to-date understanding on this developing topic. Six major views on the appointment of knights are extracted from the review. Then, a new interpretation is proposed, wherein the legitimacy to confer honours and the legitimacy of the orders of knighthood themselves have to be considered separately. Under this method of interpretation, the criterion to judge the legitimacy of an appointment of knight is both the jus honorum of the head of the family and the order of knighthood itself being legitimate. This article provides a unique perspective on how the Canon law affects an unexpected area of the modern society.

For centuries, funeral law was not too favourable to suicides. Admittedly, at the dawn of Christianity this group of the deceased was not refused religious funeral celebrations or a burial, yet, the situation changed along with the Catholic religion gaining significance. At the beginning of the Middle Ages, suicides were deprived of the right to a religious funeral. Furthermore, in the 11th century the ecclesiastical legislator forbade burial for suicides in “holy places.” Until modern times, therefore, suicides were buried at a distance from grave- yards. This in practice often indicated a burial insulting human dignity. The monopoly on religious funeral regulations only ended in Europe at the end of the 18th century, when state authorities took an interest in funeral law. On Polish soil, the more enlightened regulations of the Partitioners were enforced in the 19th century. In addition, the Act on burying the de¬ceased passed in 1932 led to the necessary standardization of provisions of national funeral law, while the binding provisions of the Act on cemeteries of 1959 provided equality of rights for the deceased in the access to a place of burial at a cemetery. Finally, in the second half of the 20th century, the ecclesiastical legislator introduced amendments to the Canon Law al- lowing (in certain instances) a Catholic funeral for a suicide. The Roman Church was a leading public institution of the Middle Ages and its law, canon law, belonged to most powerful factors of European legal history. Today’s lawyers have hardly any awareness of the canonist origins of several current legal institutions. Together with Roman law, canon law constituted the system of “both laws” (utrumque ius) which were the only laws acknowledged as “learned” and, consequently, taught at medieval universities. The dualism of secular (imperium) and spiritual power (sacerdotium), symbolized by so-called two swords doctrine, conferred to the Western legal tradition its balance and stability. We analyze the most important institutional achievements of the medieval canon lawyers: acquisitive prescription, the Roman-canonical procedure, the theory of just war, marriage and family law, freedom of contract, the inheritance under will, juristic personality, some institutions of constitutional law, in particular those based on the concept of representation, and finally commercial law. Last not least, the applicability of canon law defined the territorial extension of medieval and early modern Christian civilization which exceeded by far the borders of the Holy Roman Empire, where Roman law was effective as the law of the ruler. Hence, the first scholar to associate Roman law with (continental) Europe as a relatively homogeneous legal area, Paul Koschaker, committed in his monograph Europa und das römische Recht, published in 1947, the error of taking a part for the whole. In fact, Western legal tradition was based, in its entirety, not on Roman, but rather on canon law; embracing the common law of England, it represented – to cite Harold Joseph Berman – the first great “transnational legal culture”. At the end, some structural features of canon law are discussed, such as the frequent use of soft-law instruments and the respect for tradition, clearly visible in the approach to the problem of codification.

Ces analyses savantes lui ont permis de formuler de nombreuses remarques et commentaires, ainsi que des postulats concernant cette loi. Dans le présent article, l’attention est portée sur les aspects formels du droit légiféré abordés par le grand canoniste.

In the last few months, especially since last Synod (October 2014), the question regarding the necessity of the confirmation of the sentence when declaring the invalidity marriage has become an area of debate. This article brings together the arguments surrounding this debate during the compilation of the Codex of 1983 – a debate which extended until right up to the final moments of the codification. The opinions of the contributors to the Code were varied and the debate was long and profound. Thirty years later it appears that the problems that were debated then continue to exist today.

During the Early Modern Age the study of Roman and canon law was undoubtedly an important fact in the Spanish universities. However, the instruction in the Castilian laws – like the Siete Partidas or the Nueva Recopilación – was a gap in the academic curriculum in law faculties. Several scholars learned the legal procedure and the “na- tional” laws on their own – reading legal handbooks, practice treatises or dictionaries. In the eighteenth century the establishment of Chairs in royal laws was taught in some important centers for legal studies like Valladolid, Salamanca and Alcalá. In 1771 Ignacio Jordán de Asso and Miguel de Manuel Rodr´ıguez published the first edition of their work Instituciones del Derecho civil de Castilla, a well-known handbook that also contain- ed the Aragonese civil law. The reforms in the curriculum had a royalist purpose at the expense of Roman law and the papal power. At the same time, the renewal was necessary because the contents of the courses in universities were not suitable for the practice of justice before the various courts. Although some regulatory provisions tried to effect the transformation of legal studies since 1713, the establishment of native law teaching occurred under the reign of Charles III, a considerable delay. The purpose of this paper is the analysis of the transformations of legal education in Spain during the second half of that century.

W prawie kanonicznym wątpliwość prawna jest jednym z warunków, w jakich prawo kościelne nie obowiązuje. Pojęcia zawarte w tekście ustawy zarówno w kanonie 14 KPK, jak i kanonie 1496 KKKW stanowią jedną rzeczywistość wątpliwości z dwóch aspektów prawnych lub faktycznych. Wątpliwości prawnej kodeksu nie obowiązują, nawet unieważniające i uniezdalniające. Jeśli wątpliwości są natury faktycznej, prawo obowiązuje, ale właściwe władze mogą od niego dyspensować. Autor w swoim artykule koncentruje się na historycznym kontekście powyższej reguły.
In canon law, doubt is one of the conditions under which an ecclesiastical law may lack an obligation. The concepts contained in the text of the law in both canon 14 and CCEO canon 1496 pose a single reality of doubt with two facets of law or of fact. In doubt of law, laws even if they are disqualifying or invalidating, do not oblige. If the doubt is about a fact, the law obliges but the competent authority can dispense it. The research focuses majorly on the historical origin of the rule about doubt of law and lack of obligation. The origin of this rule may help to understand whether it is a juridical law capable of producing a juridical obligation with respective juridical effects, or if its positivistic application may have some juridical and moral consequences in relation to individual’s rights or the rights of the third parties.
