The Polish Financial Supervision Authority is the authority competent for cybersecurity for the banking sector and financial market infrastructure. It is the only cybersecurity authority that does not have the status of a minister managing a government administration department as well as being the only authority competent for cybersecurity outside the structure of the government administration and not operating within the legal personality of the State Treasury. Only some entities supervised by the Polish Financial Supervision Authority under the regulations on supervision over the financial market are subject to its supervision as the authority competent for cybersecurity. Regulatory differences lead to the necessity to apply different rules when the Polish Financial Supervision Authority carries out controls under the regulations on financial market supervision and controls under the National Cybersecurity System Act.

Opis:
Financial market supervision is exercised by the Polish Financial Supervision Authority (PFSA). It is a central public administration authority, but not a government administration authority. Since 1 January 2019, it has become a body of a state legal entity – the Office of the Polish Financial Supervision Authority (UKNF). A number of systemic changes concerning the shape of financial market supervision were introduced based on limited objectives without a broader analysis of the systemic consequences of these changes being conducted. This also applies to the recognition of the Office of the Polish Financial Supervision Authority as a state legal entity, and the Polish Financial Supervision Authority and its Chairman as authorities of the Office. Under administrative law, the Office remains the work apparatus of the Authority.

In this paper, precedents are analysed in terms of reasons that they can give to judges in various legal systems, with the purpose of identifying the ways in which precedents can be authoritative in judicial reasoning. The analysis starts with the distinction between two kinds of precedents – precedents of solution and precedents of interpretation. The ways in which both precedents of solution and precedents of interpretation affect the reasoning of future courts are identified and described, in order to focus on instances in which this affection can be considered practically and epistemically authoritative. Finally, conditions for considering under which it can be justified to treat precedents as authoritative are laid down, with a special emphasis on the possibility of justifying the epistemic authority of interpretative precedents.
W artykule omówiono teoretycznoprawne aspekty wpływu precedensów na praktykę stosowania prawa w systemach prawnych należących do kręgu civil law jako modelu przyszłych decyzji prawnych. W tym kontekście analizie poddano samo pojęcie precedensu i wskazano różnice pomiędzy precedensem decyzyjnym i interpretacyjnym. Na gruncie tych ustaleń prowadzone są rozważania dotyczące źródeł „autorytetu” precedensu oraz podstaw i sposobu jego wpływu na późniejsze orzeczenia. W efekcie prowadzi to do wyodrębnienia i dostrzeżenia specyfiki praktycznego i epistemicznego ujęcia oraz uzasadnienia autorytetu precedensu.

This article addresses the issue of authority and explains its significance for a contemporary school, university and workplace. It briefly presents the theoretical aspects of authority together with their determinants. The problem of authority crisis has been addressed, as well as the role played by authority in the past and nowadays has been presented, in the context of the education and workplace of the people surveyed. The survey was conducted on professionally active students and was aimed at presenting the modern perception and position of authority in young employees’ hierarchy of values, drawing attention to the connection between authority and power, and also showing the basis for building the authority of a teacher and an employer in the view of the people surveyed.
W niniejszym artykule poruszono problematykę autorytetu oraz wyjaśniano jego znaczenie we współczesnej szkole, na uczelni i w miejscu pracy. Pokrótce zostały przedstawione teoretyczne aspekty autorytetu wraz z ich determinantami. Poruszony został problem kryzysu autorytetu, a także ukazana została rola, jaką odgrywał on kiedyś i jaką odgrywa obecnie w kontekście edukacji i miejsca pracy osób badanych. Badania ankietowe przeprowadzone wśród aktywnych zawodowo studentów miały na celu ukazanie współczesnego rozumienia i umiejscowienia autorytetu w systemie wartości młodych pracowników, wskazanie związku autorytetu z władzą, a także ukazanie podstaw budowania autorytetu nauczyciela i pracodawcy w opinii badanych osób.

The Polish version of the article was published in Roczniki Humanistyczne 58 (2010), issue 2. The idea of the justice of the authority in the general meaning remains a central topic in Polish political theory. This has resulted in the frequent tackling of this problem, but it has not been reflected in the complexity of the theory. It is even difficult to talk about a theory in the case of the considerations analyzed. They were mostly very superficial mentions of the monarch’s justice, permeated with old-Polish legalism, a legalism reduced to the rule: the king is obliged to observe legal norms and to give priority to the good of those ruled over his own interests. This model determined the deliberations about justice. Most theoreticians could not see the possibility of strengthening the king’s influence on dispensing justice in the country, although there were exceptions to this view and not only among monarchists. Owing to this model in Polish political thought, after the fall of the First Republic of Poland it was easier to accept the idea of justice dispensed by broad bodies representing the community. The model was not even overturned by the instrumental transfer of the idea of natural justice to Poland. It was also not overturned by the doubts expressed by Wybicki about the possibilities of linking justice to the subjects’ happiness and political freedom.

The article aims to illustrate how pedagogical authority has changed against the backdrop of the developments in our concept of the relationship between children and adults. It maps out selected concepts of authority in pedagogy (the platonic, democratic and patriarchal models), follows the transformations of the parent-child relationship in a psychohistorical context, and outlines the distinctions between authority and authoritarianism. Further arguments relate to the necessity of partnership in the model of pedagogical authority and demonstrate the shift from the disciplinary to the personalizing code of education, in conjunction with Bernstein's concept of invisible pedagogy. The text also deals with the contradictions and paradoxes that characterize contemporary childhood and complicate any clear-cut notion of pedagogical authority. The conclusion is that the current ambivalence surrounding pedagogical authority requires a renewal of the debate about educational ideals, especially the humanizing goal of education in post-industrial society.

The situation of conflict between Israelis and Palestinians has lasted for over a century with half of the century of increasing violence, especially after the Six Days War. The long-standing occupation has been leading to mental take over by this issue and dehumanization of opponents in both parties’ minds. Although in last decade one could see some symptoms of peace process, especially after Oslo agreement, violence always erupted despite the official papers. In this paper I will examine the conditions of societies in the Palestinian Autonomy and Israel with special emphasis on NGOs. Although it is obvious that civil society cannot be narrowed to the non-governmental organizations, one can say that the NGOs are the most visible and measurable among the signs of existence of civil society.

The contribution focuses on the issue of teacher authority and classroom climate. Our research aimed to determine a relationship between teacher authority built on the teacher’s interaction style and dimensions constituting the classroom climate. The research involved n = 411 students who assessed the interaction style of their teachers (n = 23). The Questionnaire on Teacher Interaction (QTI) and Classroom Environment Scale (CES) were employed. Analysis of empirical data showed a statistically significant positive relationship between the interaction style-built teacher authority and classroom climate dimensions. The statistically significant positive relationship was between the interaction style dimensions: helpful, understanding, student responsibility and the classroom climate dimensions: involvement, task orientation, organisation and order, and rule clarity. A statistically negative relationship was found between the interaction style dimensions: uncertain, dissatisfied, admonishing and the classroom climate dimensions: teacher support, organisation and order, and rule clarity. According to our findings, authoritative teachers, perceived by students as good organisers, helpful, understanding, and giving responsibility, can create a positive climate in classrooms.

The article is primarily concerned with the relationship between authority and freedom. From the pedagogical point of view, freedom comes from authority because to be free means to be able to express self-control in order to choose only what is good. Educational authority isn’t tyranny because the educator must be coherent and must act as he/she teaches. The main challenge to educating people and to people in education – both of them – is to be able to practice virtue, not only to recognize values. Nowadays, especially the “bad conduct” of youths, people are increasingly concerned about their relationship with permissive educational practices. In fact, the problem revolves around the fact that boys and girls have learned but are unable to lead themselves, they involved in addictions (drugs, alcohol, internet…) and they show their weakness in concrete decisions. It isn’t a matter of knowledge, but of will; it is related to the lack of will towards self-care. Why are boys and girls who attend school, are well informed and without economic problems not determined to reject what is bad not only from the moral point of view, but also from the point of view of their health? Because they are not educated to fix limits to their desires: that problem is related to the lack of authority because authority makes us able to face limitations. For this reason it is necessary to reconsider authority within educational theory and practice.
Artykuł dotyczy przede wszystkim relacji pomiędzy władzą a wolnością. Z pedagogicznego punktu widzenia, wolność pochodzi od autorytetu, ponieważ bycie wolnym oznacza możliwość wyrażania samokontroli w celu wybierania tylko tego, co jest dobre. Instytucja edukacyjna nie jest tyrania, ponieważ wychowawca musi być spójny i musi działać jak uczy. Głównym wyzwaniem dla uczących i edukowanych jest to, aby móc praktykować cnotę a nie tylko do uznawać wartości. W dzisiejszych czasach ludzie są coraz bardziej zaniepokojeni obecnością permisywnych praktyk edukacyjnych. W rzeczywistości problem kręci się wokół faktu, że chłopcy i dziewczęta uczą się, ale nie są w stanie sobą kierować, uzależniają się (narkotyki, alkohol, internet ...) i przejawiają słabość w podejmowaniu konkretnych decyzji. To nie jest kwestia wiedzy, ale woli; jest to związane z brakiem woli to, by się o siebie troszczyć. Dlaczego chłopcy i dziewczęta, którzy uczęszczają do szkoły, są dobrze poinformowani nie potrafią odrzucić tego, co jest złe, nie tylko z moralnego punktu widzenia, ale także z punktu widzenia ich zdrowia? Ponieważ nie są nauczeni stawiania granic dla swoich pragnień: problem ten związany jest z brakiem autorytetu, bo autorytet umożliwia nam stawianie czoła ograniczeniom. Z tego powodu konieczne jest ponowne przyjrzenie się autorytetowi w teorii i praktyce edukacyjnej.

The article considers the organizational and legal framework for ensuring the right of access to public information in Ukraine. The positive tendencies of legal support of realization of this public right of physical persons and shortcomings of the legal practice revealed in this sphere are defined. It was found that the object of influence of the administrative and legal mechanism to ensure the exercise of the right of access to public information is public relations in the field of satisfaction of the right of access to public information, by creating opportunities for free access to statistics, archives, libraries and museums. , other information banks, databases, information resources, information on the powers and activities of the subjects of power. Forms, methods and means of ensuring the right of access to the public are described. It was found that the purpose of the administrative and legal mechanism to ensure the exercise of the right of access to public information is to create conditions under which every individual can freely exercise the right of access to public information. The author’s definition of the key concept of a scientific article is offered.

In relating humanities to science, some scholars have argues that tradition plays a prominent role in the humanities but not in the sciences. This, for them, explains why there is development in science more than humanities because tradition in treated a d dead weight that hinders reason and freedom this paper challenges this view point as grossly inadequate as it represents only a superficial observation of the practice of science and does not recognise the role tradition plays in the progress of science. This paper attempts to show that science which is supposedly a dynamic and progressive enterprise is tradition-dependent and that membership in the scientific community requires working within the scientific tradition. It is argued that the attack of science on all kinds of tradition and authority is unjustifiable. The paper concludes by proposing the need for the critique of tradition so that it does not slip into traditionalism. The methodology this paper adopt is the conceptual analytic method.

The study examines the interaction effect between source epistemic authority (EA) and self epistemic authority (SEA) on the intention to follow the source’s recommendation. The results showed that high SEA subjects were more likely to follow the recommendation if its source had high EA and less likely if the source’s EA was low. RESEARCH OBJECTIVE: The paper aims to determine in what manner official papal titles are an expression of supreme power in the Church. THE RESEARCH PROBLEM AND METHODS: The principal problem refers to the ecclesiological correlation between papal titles and primatial power, as well as the ongoing changes in the understanding of power within the Church, manifested by the departure from iurisdictio in favour of communio. Methods involve source text analysis (of the Holy Scripture and ecclesiastical documents), interpretation, and comparison. THE PROCESS OF ARGUMENTATION: All names of the highest office in the Catholic Church are derived from the so-called primatial texts which describe St Peter the Apostle and his mission. Together with the practice of the first centuries of Christianity, they have provided a basis for establishing the dogmatic truth about the primacy of St Peter and his successors. The primacy involves supreme jurisdictional power in the Universal Church. In this context, the author proceeds to analyse current papal titles which expose the scope and the multifaceted nature of the power exercised by the Bishop of Rome. Furthermore, the author presents modifications in the official papal titles, which are simultaneously a reflection of ecclesiastical changes in the area. RESEARCH RESULTS: It has been established that some titles are an expression of real jurisdictional power (e.g. Bishop of Rome, Sovereign of the Vatican City State), while others carry historical and honorary importance (e.g. Primate of Italy) or manifest contemporary tendencies to highlight the religious character of the office (Servant of the Servants of God). CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: A departure from the secular understanding of power in favour of a religious and ministerial direction encourages further, praxeological research, as the primatial practice of individual pontificates (gestures and symbols) precedes the official primatial doctrine.

Social security is an element of the broadly understood state security system. A centralized approach to managing social needs does not take into account the local and regional differentiation of a population’s preferences, and, as a result, does not allocate resources in an optimal fashion. Decentralisation contributes to improving efficiency by way of more effective adaptation of public services to social needs, which is achieved by gaining a wider and deeper knowledge about the needs of local communities. Greater power of local authority bodies inspires innovative solutions and stimulates activity and competition between territorial units. It contributes to the rational allocation of resources at the disposal of local authorities, which leads to the conclusion that they are dominant with regard to exercising the social function of the state.
