CAUSAL EFFECT RELATIONSHIP IN MEDICAL CASES. AN OLD PROBLEM IN A NEW SCENARIO. COMMENTARY TO CJEU JUDGMENT (SECOND CHAMBER) OF 21 JUNE 2017, N.W. & OTHERS V. SANOFI PASTEUR MSD & OTHERS, CASE C-621/15, EU:C:2017:484 APPROBATIVE GLOSS

Opis:
This commentary evaluates the problem in assessing the role of a causal connection between damage and the use of a defective medical product, specifically a vaccine. The judgment of the Court of Justice of the European Union (CJEU) in the Sanofi Pasteur Case, which allowed the possibility of recognizing damage claims, even in cases where the prevailing scientific theory claims that there is no scientific evidence of a causal link between a vaccination and the disease, became a base for consideration. Consequently, procedural solutions (such as the standard of proof required, the admissibility of prima facie evidence reasoning and other solutions in cases of an uncertain causation) remain to be decided by national law. The authors assessed two legal systems: the French and Polish legal systems in the context of how to resolve these dilemmas and to describe the impact of the above-mentioned judgment on the case-law of French and Polish courts as regards the application of Directive 85/374/EEC. As a result, they concluded that the most important interpretative motive has become the individual interest of the vaccination’s victim as a consumer of medical services. It seems to be in accordance with Directive 85/374/EEC, which is motivated by the necessity of approximation of the laws of the Member States concerning the liability of the producer for damage caused by the defectiveness of his products. However, since the existing divergences may distort competition and affect the movement of goods within the common market and entail a differing degree of protection of the consumer against damage caused by a defective product to his health or property, in countries belonging to the European Union, the authors wonder how the commented judgment will affect the further development of consumers protection against defective vaccines.

Opis:
Geochemical studies (WD-XRF, ICP-MS, and GF-AAS) have shown that polymetallic nodules from the eastern Clarion-Clipperton Zone (CCZ) in the Pacific Ocean are enriched in several metals such as Cu (mean 1.16%), Ni (1.15%), Co (0.15%), and Zn (0.14%), as well as remarkable contents of Mo (0.059%), V (0.04%), Ce (0.019%), Nd (0.011%), Li (0.015), and Pt (43 ppb). The average content of REE, together with Y and Sc, is 620 ppm. In nodules from the CCZ metal concentrations are often much higher than those reported in nodules from other ocean basins in the world. The bulk-nodule mean value of the Mn/Fe ratio is 5.3, which is characteristic for a mixed (hydrogenetic and diagenetic) origin of the nodules. Microprobe investigation revealed two different chemical compositions of the layers, and ascertained their general metal content. The nodules analyzed are composed mainly of concentric-collomorphic laminae of Mn and Fe (oxy)hydroxides which crystallized around mineral nuclei (e.g., quartz, clay minerals), bioclasts or rock fragments. They are from 3.3 to 7.6 cm in diameter. The chemical and physical properties of the laminae allowed distinction of two genetic types: hydrogenetic and diagenetic. Those formed as a result of hydrogenesis had increased values of Co, Si, Cl and S, while formed diagenetically showed increased levels of Cu, Ni, Mg, Zn and K. These lamina types are characterized by different growth structures, reflectivity, density and Mn/Fe ratios. The ratio of the diagenetic layers to hydrogenetic layers (192/53) in representative polymetallic nodules shows that the nodules of this study are of mixed hydrogenetic-diagenetic type. A mixed genesis was also shown by discriminant diagrams, with these CCZ samples being located at the transition between typical hydrogenetic and diagenetic fields.

Opis:
The article describes three interlaboratory experiments concerning 222Rn determination in water samples. The first two experiments were carried out with the use of artificial radon waters prepared by the Laboratory of Radiometric Expertise (LER), Institute of Nuclear Physics, Polish Academy of Sciences in Kraków in 2014 and 2018. The third experiment was performed using natural environment waters collected in the vicinity of the former uranium mine in Kowary in 2016. Most of the institutions performing radon in water measurements in Poland were gathered in the Polish Radon Centre Network, and they participated in the experiments. The goal of these exercises was to evaluate different measurement techniques used routinely in Polish laboratories and the laboratories’ proficiency of radon in water measurements. In the experiment performed in 2018, the reference values of 222Rn concentration in water were calculated based on the method developed at LER. The participants’ results appeared to be worse for low radon concentration than for high radon concentrations. The conclusions drawn on that base indicated the weaknesses of the used methods and probably the sampling. The interlaboratory experiments, in term, can help to improve the participants’ skills and reliability of their results.

Opis:
At the beginning of the year 2016, the representatives of the Polish Radon Centre decided to organize proficiency tests (PTs) for measurements of radon gas and radon decay products in the air, involving radon monitors and laboratory passive techniques. The Silesian Centre for Environmental Radioactivity of the Central Mining Institute (GIG), Katowice, became responsible for the organization of the PT exercises. The main reason to choose that location was the radon chamber in GIG with a volume of 17 m3 , the biggest one in Poland. Accordingly, 13 participants from Poland plus one participant from Germany expressed their interest. The participants were invited to inform the organizers about what types of monitors and methods they would like to check during the tests. On this basis, the GIG team prepared the proposal for the schedule of exercises, such as the required level(s) of radon concentrations, the number and periods of tests, proposed potential alpha energy concentration (PAEC) levels and also the overall period of PT. The PT activity was performed between 6th and 17th June 2016. After assessment of the results, the agreement between radon monitors and other measurement methods was confirmed. In the case of PAEC monitors and methods of measurements, the results of PT exercises were consistent and confirmed the accuracy of the calibration procedures used by the participants. The results of the PAEC PTs will be published elsewhere; in this paper, only the results of radon intercomparison are described.
